bajo acuerdo

I would like to know if this phrase necessarily means that it is a written agreement or if two parties can just be in agreement. In these Coast Guard regulations, some places use "se establecerá acuerdo", but two examples of "bajo acuerdo" are:
1. Bajo acuerdo de ambas partes, las conexiones se mantendrán bloqueadas.
2. Los sistemas de agua contra incendio se presurizarán previamente, o se asegurará bajo acuerdo que podrán ser presurizados de inmediato.

though to me it does not stipulate whether a written or other sort of agreement is involved

Upon agreement

I don't think it necessarily means that the written agreement must exist, but the intention of its existence seems to be implied to me, in other words, if it doesn't exist yet, it is likely in the works.

I think "upon agreement" conveys the message clearly.

would be the more likely usage in US English. Can be written or verbal (a "handshake" agreement)
