I prefer "penalty" to "surcharge" in this case, the reason being that a surcharge may be used in contexts unrelated to late payment (e.g., credit card payment surcharges). Using the IRS website terminology (see reference below), I would translate the phrase as "Late filing penalty (late payment penalty)." Good luck!

Late payment surcharges

Slight preference for this over ' payment default charges', as the latter applies to payment agreements arranged to be paid regularly, i.e, monthly. The Inland Revenue in the UK applies late payment fines and surcharges.

Yes, you're right, since 2005 it's the HMRC, though oldtimers like me still use the old term we grew up with.
