I think "le" in the phrase in question can only refer to Mr. X, and "se ... pretende" is an impersonal reflexive verb. The context would be: "... and hence, for the safety of the parties' rights which it is claimed that he (Mr. X) opposes, it is the responsibility of the court now sitting to order ..."
