español term

con carácter subsidiario

español al inglés Jurídico/Patentes Derecho: contrato(s)
This is from an appeal against an administrative decision in Spain. The full sentence is

"Con carácter previo, mediante el presente recurso *LA EMPRESA* pretende que se declare la nulidad de pleno derecho o, ****con carácter subsidiario****, se anule el acto administrativo impugnado".

There is an excellent discussion of "la nulidad de pleno derecho" here:

http://www.proz.com/kudoz/spanish_to_english/law:_contracts/...

Further to that discussion, I'm wondering whether this would be "void ex nunc", but perhaps it means something else - I'm not sure.

British English but all contributions welcome.

Greg Hunt (asker) Jan 16, 2013:
In fact, re-reading this sentence it probably doesn't mean that - it's just "alternatively". I should probably close this.

Standard wording. If the first is not allowed the second is requested. It is NOT alternative.

"On a prelimary basis, by means of this appeal the (Company) seeks a declaration of nullity at law or, on a subsidiary basis, annulment of the challenged administrative act."
