Texto de origen - inglés SOCIAL ACTION TO STOP THE PRIVATIZATION OF CANAL ISABEL II (Spanish public company responsible for managing the cycle of water in the Community of Madrid): A JOINT ACTION BETWEEN SOCIAL, POLITICAL AND TRADE ORGANIZATIONS ALONG WITH THE 15th OF MAY MOVEMENT
In December 2008, the Madrid Assembly approved the privatization of Canal Isabel II (CYII) with the vote from Partido Popular as the only political party voting for the privatization. This decision does not have any economic neither technical nor social justifications. Furthermore, it will possibly lead to a worsening of the supply and sanitation services, increased costs and even a deterioration of the working and professional conditions, just like it happened in other similar privatization processes in the past. From the very beginning, the privatization process has suffered from a democratic deficit and a total lack of transparency as citizens have not been given the opportunity to participate in any way in a decision so important to their interests. The whole process has elapsed with great opacity and secrecy and relevant information has been concealed from the public and even the local Parliament itself on the conditions of the company market release, the type of the company constitution, its capital and sale values, its mission, the actual private shareholding percentage and its relationships with local councils.
The Platform against the Privatization of Canal de Isabel II has been created with the participation of social organizations, unions, political parties and private individuals in order to object to this privatization initiative. The aim is to coordinate and launch as many joint actions as possible to prevent the privatization of the company as well as to mobilize and inform the public on the consequences of this initiative. To achieve these goals, the platform will carry out four main activities: the dissemination of information to combat opacity and lack of transparency; to raise institutional, political and social awareness and seeking advocacy from councils, political parties and unions; to exploit any legal remedies which can be useful to undermine the privatization process and to prevent frauds, especially during the development of the privatization process as well as when definite steps for the constitution of the company will be taken. Finally, public mobilization is the fourth line of action. This is materialized in calls for assemblies, large meetings, and, particularly due to its impact on society and media, demonstrations.
The emergence of the 15th of May movement has significantly strengthened the capacity for influence and impact of the activities carried out by the Platform. This power is, with any doubt, motivated as a very significant number of town and neighborhood assemblies have taken the claims of the Platform as their own claims, which has made possible a mutual and coordinated permanent collaboration.
Traducción - español LA MOVILIZACIÓN SOCIAL PARA FRENAR LA PRIVATIZACIÓN DEL CANAL DE ISABEL II: UNA ESTRATEGIA CONJUNTA ENTRE ORGANIZACIONES SOCIALES, POLÍTICAS Y SINDICALES Y EL 15M
En diciembre de 2008, la Asamblea de Madrid aprobó la privatización del Canal de Isabel II (CYII), con los únicos votos a favor del Partido Popular; esta decisión no tiene justificación ni económica, ni técnica ni social y, sin embargo, puede conducir a la prestación de peores servicios del abastecimiento y el saneamiento, a mayores costes y a un empeoramiento de las condiciones laborales y profesionales de sus trabajadores, tal como se ha constatado en otras privatizaciones similares. El proceso de privatización ha adolecido desde su comienzo de un déficit democrático y de absoluta falta de transparencia, ya que los ciudadanos no han podido participar de forma alguna en una decisión tan trascendental para sus intereses. Todo el proceso ha transcurrido con gran opacidad y secretismo, ocultando a la ciudadanía y al propio Parlamento Regional información relevante sobre las condiciones de salida al mercado de la nueva empresa, del modelo de sociedad que se va a constituir, su valor patrimonial y su valor de venta, sus competencias, el porcentaje real del accionariado privado y el sistema de relación con los ayuntamientos.
Para oponerse a esta iniciativa privatizadora se constituyó la Plataforma contra la privatización del Canal de Isabel II, en la que participan organizaciones sociales, sindicatos, partidos políticos y personas a título individual con el objetivo de coordinar e impulsar cuantas actuaciones unitarias sean posibles para evitar la privatización del Canal y movilizar e informar a los ciudadanos de las consecuencias de esta iniciativa. Para conseguir estos fines, las actividades que desarrolla se incardinan en cuatro ejes fundamentales, cuales son la difusión de la información -para luchar contra la opacidad y la falta de transparencia-, la incidencia institucional, política y social con los ayuntamientos, partidos políticos y sindicatos, las vías jurídicas y legales que puedan aprovecharse para minar el proceso de privatización y evitar los fraudes de ley tanto durante el desarrollo del proceso de privatización, como en el momento en que se den los pasos definitivos para constituir la nueva sociedad anónima. Por último, la movilización ciudadana es el cuarto eje de trabajo que se concreta en la convocatoria de asambleas, reuniones amplias y, especialmente por su impacto social y mediático, manifestaciones.
La eclosión del movimiento 15M ha fortalecido notablemente la capacidad de influencia e impacto de las actividades de la Plataforma, motivado, sin duda, porque un número significativo de asambleas de barrios y pueblos han asumido como propias las reivindicaciones de la Plataforma y se han establecido niveles de coordinación mutua permanentes.

ANNUAL GENERAL MEETING HELD ON 06/ 29 / 2009
The Annual General Meeting of the Owners´ Community of MRC-12 was held on June 29th 2009 at 8:30 pm at second call in the meeting room of Fundación de Arte y Cultura in Nueva Andalucía.
All the owners have been duly called to the Meeting according to the Law on Horizontal Property, to deal with the following:
AGENDA:
1.- Approval of the accounts of the financial year 2008.
2.- Approval of the settlement of debtors.
3.- Granting of powers to the Chairman, and in case of absence or non-attendance; to the Vice-chairman, to start legal action.
4º.- Ratification and, if applicable, implementation of the new coefficients for each huousing unit of the premises, according to what has been agreed upon on item 6 of the Agenda of the AGM of May 29th 2008.
5º.- Approval, of the Expenses Budget for the financial year 2009:
a) ordinary, b) extraordinary –painting of the building–.
6º.- Election of the Board: Chairman, Vice-chairman, Board Members and Administrators-Secretaries.
7º.- Any other business.

Mr Juan José Sánchez Toro presided the meeting with the assistance of Joint Administrator - Secretary Mr Juan Antonio Manzanares Cuesta.
The main agreements with regard to the different items on the Agenda were finally adopted as follows:
1.- Approval of the accounts of the financial year 2008
The Administrator gave a detailed explanation of the accounts of the 2008 financial year, which had been sent together with the call to the meeting, as well as having been handed over to all the owners at the beginning of the meeting. The total surplus amounted to 5,260.81 €uros.
However, he clarified that the debtors in default generated some moments of lack of liquidity and that he shall proceed to explain this under the corresponding item on the Agenda.
After being put to vote, the accounts of the financial year 2008 were approved unanimously.
Documents 1 till 3 inclusive are attached to the present Minutes, representing the following: Income and Expenses 2008, Balance Sheet 31/12/2008, Evolution of the Community Funds.
2.- Statement of debt settlement, if applicable.
The Administrator remarked that the owner of appartment 4º-3 appeared in the list of debtors that was sent together with the call to the meeting because of a banking error, as he did pay the outstanding fee that the bank erroneously had returned. The owner of appartment 4º-9 had paid his debt prior to the date of the meeting.
The settlement of the following debtors was approved unanimously with regard to fees accrued until June 30th 2009
In order to conclude this item, the Administrator declared that on July 12th 2007 a deposit of 43.84 Euros had been made into the account of the Community, however there was no record as to which owner had made such deposit.
3.- Granting of powers to the Chairman, and in case of absence or non-attendance; to the Vice-chairman, to start legal action.
The owners unanimously granted express powers to the Chairman, and in his absence or non-attendance, to the Vice-chairman who will be elected under item 6 on the Agenda; granting likewise the appropriate powers to Lawyers and Court Representatives even if intervention were not obligatory.
Likewise, the owners expressly authorized the Chairman, and in his absence or non-attendance, the Vice-chairman to take any legal action necessary in order to defend the interests of the community by actions derived from co-owners or people from outside the Community.
4.- Ratification and, if applicable, implementation of the new coefficients for each huousing unit of the premises, according to what has been agreed upon on item 6 of the Agenda of the AGM of May 29th 2008..
The Administrator explained that; according to the agreement concerning item 6 on the agenda of the last AGM held on May 29th 2008 the 7,30 square meters of the common corridor was released from attachment and incorporated into the housing unit on the ground floor -1. this being the property of Mr Jose Sanchez Gomez by virtue of purchase agreement dated August 18th 2008. The participation co-efficient for each and all of the housing units shall be as such stated in document No. 4 attached to the present minutes.
Likewise, document No. 5 is attached to the present minutes representing the aforementioned purchase agreement
He went on to explain that there was no record of any agreements adopted in the AGM of 29/05/2008 that had been challenged. Therefore, Mr Sánchez Gómez should pay the amount of 1,000.00 Euros retained by him.
In order to conclude this item, the owners approved unanimously the new participation coefficients as well as the requirement to Mr Sánchez Gómez to pay aforementioned amount.
5.- Approval of the expenditure budget for the current financial year (2009):
a) ordinary, b) extraordinary –painting of the building–.
a) Ordinary.
The Administrator itemized the different entries of the Ordinary Expenses Budget for the 2009 financial year.
After being put to vote, the above-mentioned Budget of 16,777.78 Euros was unanimously approved and shall be distributed among all properties according to the specifically established participation coefficient.
The Administrator clarified that the fees of the 1st and 2nd quarter of 2009 had been issued based on the Ordinary Expenses Budget of the financial year 2008, and therefore the fees of the 3rd and 4th quarter 2009 included the Budget increase of the current financial year as well as the difference between the first and second fees.
The fees to be paid from the 1st quarter of 2010 onwards until the next AGM are stated in the right margin of document No. 7 attached to these minutes.
Documents No. 6 and 7 are attached to the present minutes, representing the following: Ordinary Expenses Budget and fees to be paid by each property.
In order to conclude this item, it was recorded that, in accordance with agreements adopted at the last General Meetings, a 10% discount shall be applied (both on ordinary and extraordinary fees) for all those owners who pay the fees within the settlement period – the ordinary fees within the established quarter and the extraordinary ones within ninety days from the date of issue.-
b) Extraordinary –paint of the building–.

Likewise, it was recorded that a Building Permit will be needed as well as a Basic survey on Security and Health.
After discussing the matter extensively, the owners unanimously agreed the following:
a) to paint the interior corridors, staircases and bannisters.
b) not to apply for Building Permit or Basic Survey on Security and Health.
c) to allocate a maximum sum of 7000 Euros of the Community Funds for the painting works.
d) expressly authorize the Board of Directors to choose the most suitable estimate.
e) to submit in the next AGM new estimates to paint the exterior façades of the building.
6.- Election of the Board: Chairman, Vice-chairman, Board Members and Administrators-Secretaries.

En el Local de la Fundación de Arte y Cultura de Nueva Andalucía, siendo las 20:30 horas del día 29 de junio de 2009, se reunió en segunda convocatoria y con carácter ordinario la Junta General de la Comunidad de Propietarios del Edificio MRC-12.
Todos los propietarios fueron debidamente convocados, conforme a lo establecido en la Ley de Propiedad Horizontal, para tratar el siguiente
ORDEN DEL DÍA:
1º.- Aprobación, si procede, de las cuentas del ejercicio 2008.
2º.- Aprobación, si procede, de la liquidación de deudores.
3º.- Concesión de poderes al Presidente y; en ausencia, vacante o imposibilidad de este; al Vicepresidente para, si procede, iniciar las acciones legales pertinentes.
4º.- Ratificación y, en su caso, aplicación de los nuevos coeficientes, para cada una de las fincas que integran el edificio, conforme a lo acordado en el punto 6º del Orden del Día de la Junta General Ordinaria de fecha 29 de mayo de 2008.

La reunión fue presidida por D. Juan José Sánchez Toro, con la asistencia del Administrador – Secretario solidario D. Juan Antonio Manzanares Cuesta.
Los acuerdos adoptados con relación a los distintos puntos del Orden del Día (O.D.) fueron los siguientes:
1º.- Aprobación, si procede, de las cuentas del ejercicio 2008.
El Administrador explicó detalladamente las cuentas del ejercicio, las cuales se enviaron con la convocatoria, así como fueron entregadas a todos los asistentes al inicio de la Junta, resaltando el superávit de 5.260,81 €uros.
No obstante, aclaró que en algunos momentos se había sufrido falta de liquidez, por mor de los deudores, como luego se vería en el punto correspondiente del O.D.
Sometidas a votación se aprobaron, por unanimidad, las cuentas del ejercicio 2008.
Se acompañan con la presente Acta, como anexos números 1 al 3 ambos inclusive, los siguientes documentos: Ingresos y Gastos año 2008, Balance de Situación 31/12/2008 y Evolución de los Fondos Comunitarios.
2º.- Aprobación, si procede, de la liquidación de deudores.
El Administrador comentó que el propietario 4º-3 aparecía en la relación de deudores enviada con la convocatoria por un error bancario, aunque se había remesado nuevamente la cuota pendiente que había sido devuelta, y el propietario 4º-9 había abonado su deuda con anterioridad a la celebración de la Junta.
Se aprobó, por unanimidad, la liquidación de deudores por cuotas devengadas y exigibles hasta el 30 de junio de 2009, según detalle:
Para finalizar este punto, el Administrador manifestó que se había detectado un ingreso en la cuenta corriente de la Comunidad, con fecha 12 de julio de 2007, por importe de 43,84 €uros y no se tenía constancia del propietario que lo había realizado.
3º.- Concesión de poderes al Presidente y; en ausencia, vacante o imposibilidad de este; al Vicepresidente para, si procede, iniciar las acciones legales pertinentes.
Por unanimidad se le concedieron poderes expresos al Presidente y; en ausencia, vacante o imposibilidad de este; al Vicepresidente, que resultasen elegidos en el 6º punto del O.D., otorgando, a su vez, los poderes oportunos a favor de Letrados y Procuradores, aunque no fuese preceptiva la intervención de los mismos.
Asimismo, se facultó expresamente al Presidente y; en ausencia, vacante o imposibilidad de este; al Vicepresidente para iniciar cualquier tipo de acción judicial encaminada a defender los intereses comunitarios, por acciones derivadas de comuneros o de personas ajenas a la Comunidad.
4º.- Ratificación y, en su caso, aplicación de los nuevos coeficientes, para cada una de las fincas que integran el edificio, conforme a lo acordado en el punto 6º del Orden del Día de la Junta General Ordinaria de fecha 29 de mayo de 2008.
El Administrador explicó que; según se acordó en la pasada Junta General Ordinaria celebrada el 29 de mayo de 2008, punto 6º del O.D., al desafectar los 7,30 mtrs.2 de pasillo de zona común incorporándolos a la vivienda Bajo-1, propiedad de D. José Sánchez Gómez, según contrato de compra-venta de fecha 18 de agosto de 2008; los coeficientes de participación para todas y cada una de las viviendas serán los que se expresan en el anexo nº 4, que con la presente Acta se acompaña.
Asimismo, se incorpora al Acta, como anexo nº 5, el referido contrato de compra-venta.
Continuó exponiendo que no se tenía conocimiento de que se hubiese impugnado ningún acuerdo de los adoptados en la J.G.O. de fecha 29/05/08, por lo que el señor Sánchez Gómez debía abonar la cantidad de 1.000,00 €uros que tenía retenida.
Para concluir este punto, se aprobó, por unanimidad, los nuevos coeficientes de participación, así como exigir al señor Sánchez Gómez que abone la cantidad antes referida.
5º.- Aprobación, si procede, del Presupuesto de Gastos para el ejercicio 2009: a) ordinario, b) extraordinario –pintura del edificio–.
a) Ordinario.
El Administrador detalló las partidas que componían en Presupuesto Ordinario de Gastos para el ejercicio 2009.
Tras someterlo a votación, se aprobó, por unanimidad, el referido Presupuesto por importe de 16.777,78 €uros, el cual se distribuirá entre todas las fincas conforme al coeficiente de participación especialmente establecido.
El Administrador aclaró que las cuotas del 1º y 2º trimestre del 2009 se habían emitido en base al Presupuesto Ordinario de Gastos del ejercicio 2008, por lo que las cuotas del 3º y 4º trimestre del 2009 recogían tanto la subida del Presupuesto del ejercicio corriente como la diferencia entre las primeras y segundas cuotas.
Por todo ello, las cuotas a pagar a partir del 1º trimestre de 2010, y hasta la celebración de la próxima J.G.O., serán las que se expresan en el margen derecho del anexo nº 7.
Se acompaña con la presente Acta, como documentos anexos números 6 y 7, el Presupuesto Ordinario de Gastos y las cuotas a pagar por todas y cada una de las fincas.
Para finalizar este apartado, se hizo constar que, de conformidad con lo aprobado en pasadas Juntas Generales, se aplicará una bonificación única del 10% sobre las cuotas (tanto ordinarias como extraordinarias) a todos aquellos propietarios que abonen estas dentro del periodo de exigibilidad –las ordinarias dentro del trimestre y las extraordinarias antes de los noventa días a contar desde la fecha de su emisión–.
b) Extraordinario –pintura del edificio–.
El Administrador mostró los siguientes presupuestos:

Asimismo, hizo constar que era necesario solicitar la Licencia Municipal de obras y un estudio Básico de Seguridad y Salud.
Tras un amplio debate se acordó, por unanimidad, lo siguiente:
a) Pintar únicamente los pasillos interiores, escaleras y barandillas.
b) No solicitar Licencia de Obras ni estudio Básico de Seguridad y Salud.
c) Destinar una partida máxima de 7.000,00 €uros, de los Fondos Comunitarios, para la pintura.
d) Facultar expresamente a la Junta Directiva para que eligiese el presupuesto más idóneo.
e) Presentar nuevos presupuestos en la próxima J.G.O., para pintar las fachadas exteriores del edificio.
6º.- Elección de cargos de la Comunidad: Presidente, Vicepresidente, Vocales y Administradores-Secretarios.

Powers
1. To PURCHASE or, where appropriate, conclude any real estate purchase operation in Spain under such terms and for such amounts as may be determined by the aforementioned representative.
To SETTLE the respective amounts either in cash, by cheque, by installments or any other negotiable deed.
2. To mortgage or place a lien upon any property in order to guarantee the obligations and any kind of loans in favor of any bank or savings bank or individual, especially to contract obligations and receive loans for such amounts, interests and terms as may be stipulated, becoming subrogated to the rights and liabilities of any existing mortgages and formalize any modifications thereto.
To apply for outstanding debts certificate, cancel and discharge any debt, whether personal or in rem.
3. To provide a bank guarantee for operations made by third parties, whether for the subscription of a personal loan or a mortgage loan and even in the case of a self-dealing event or one of double representation.
4. To SELL or, where appropriate, conclude any real estate sale operation in Spain under such terms and for such amounts as may be determined by the representative. To collect the respective amounts in cash, by cheque, by installments or any other negotiable deed and to redeem any sort of existing encumbrance which may be essential in order to close the sale operation. The representative is empowered to settle or cancel, totally or partially, any private purchase contract on real estate, under the terms and stipulations freely determined by the representative. To collect the amounts that may derive from said agreements and, if applicable, enforce bank guarantees, security bonds or guarantees of any kind on account of the selling price and collect such amounts.
To extinguish any existing joint ownership on the properties of the appearing parties, adjudicate them and collect or pay the corresponding compensations.
5. To follow up, open, make use and close current or saving accounts in banks with offices in Spain as well as to draw, accept, endorse, charge, manage, negotiate or note bills of exchange or bank drafts of any sort.
This special power shall be valid even if the representative emphasized in the use of figures such as self-dealing or multiple representation.
6. To CONTRACT water, telephone, electricity and gas companies to supply said properties, as well as to take out any kind of insurance policy in the parties´ name, to sign the corresponding contracts and to have the corresponding bills paid directly into any of the parties´ bank accounts in Spain.
7. To MAKE new construction statements on a temporary or definite basis, to make consolidations and partitions and to legally split the construction materially or horizontally. To create, modify and extinguish easements and other real rights.
8. To APPEAR AND REPRESENT the party before any public office and particularly before the Home Office in order to obtain the Non-Resident Certificate and ID card.
9. To REPRESENT the party before the Tax Authorities. The representative shall under no circumstance be considered as the sole administrator of the parties´ properties in Spain. However, he is specially empowered to request the refund of any non-resident income tax deduction.
10. For the aforementioned purposes, the representative is authorized to SIGN and EXECUTE any

Les deux plus grosses compagnies aériennes allemandes Lufthansa et Air Berlin s’élèvent contre la fermeture pour cause de nuage de cendres volcaniques de l’espace aérien allemand, qui a été prolongé jusqu’à dimanche soir au mieux et qui leur coute des centaines de millions d’euros.
La compagnie nationale Lufthansa, qui fait partie de Star Alliance, a en effet effectué samedi des vols entre Francfort et Munich et constaté l’absence de tout dégât sur les appareils. »Nous avons fait voler dix Boeing 747 et Airbus A340, à une altitude de 8000 mètres, et nos techniciens n’ont pas trouvé la moindre éraflure sur les fuselages, hublots du cockpit ou dans les moteurs », a déclaré le porte-parole de la compagnie. Pour lui la fermeture de l’espace aérien est basée « sur des calculs informatiques et non des prélèvements ou des mesures », ce qui cause des pertes de milliards d’euros à l’économie. Les vols en questions ont été effectués pour repositionner les avions là où ils seront nécessaires une fois l’interdiction levée.
Pour la seconde compagnie allemande, la low cost Air Berlin, la fermeture est fondée sur des données recueillies par le Volcanic Ash Advisory Center de Londres, données utilisée par les météorologues allemands puis par le contrôle aérien, « sans que le moindre ballon météo ait été envoyé dans le ciel allemand pour mesurer si la cendre était effectivement présente ».
La compagnie néerlandaise KLM a également effectué un vol d’essai samedi entre Amsterdam et Düsseldorf et n’a pas non plus rapporté de problème.
Le ministre des transports allemand a répondu en annonçant qu’un avion équipé d’instruments de mesure adéquats décollerait lundi matin.

Las dos principales compañías aéreas alemanas, Lufthansa y Air Berlín, protestan contra el cierre del espacio aéreo alemán que se prolongó hasta el domingo, en el mejor de los casos, por causa de las cenizas volcánicas. Esto les supondrá pérdidas de cientos de millones de euros.
Lufthansa, que es miembro de Star Alliance, efectuó este sábado vuelos de prueba entre Francfort y Munich y asegura que no se ha producido ningún tipo de avería en sus aparatos. "Hemos realizado vuelos de prueba con diez aviones Boeing 747 y Airbus A340 a una altitud de 8 000 metros. Todos los aparatos han sido inspeccionados y no hemos encontrado daños sobre las lunas o el fuselaje ni tampoco hemos observado ningún efecto en los motores", ha precisado un portavoz de la compañía. Según él, el cierre del espacio aéreo se fundamenta "en cálculos informáticos y no sobre muestras y medidas reales", lo que está provocando pérdidas millonarias a la economía. Los trayectos de los vuelos de prueba se efectuaron para recolocar los aviones donde fueran necesarios una vez levantadas las restricciones.
Según la segunda compañía alemana, Air Berlin, el cierre del espacio aéreo se ha producido exclusivamente siguiendo los resultados de una simulación informática recogidos por el VAAC (Centro de Aviso de Cenizas Volcánicas) de Londres. Estos datos han sido utilizados por los meteorólogos alemanes y después para el control aéreo, "sin que se enviara al cielo alemán siquiera un globo meteorológico para medir si hay ceniza volcánica en el aire y en qué proporciones"
La compañia holandesa KLM realizó asimismo un vuelo de prueba el sábado entre Amsterdam y Düsseldorf sin que se registrasen daños.
El ministro alemán de transportes anunció que un avión equipado con instrumentos de medición adecuados despegará el próximo lunes por la mañana.
