Texto de origen - ruso Европейский Суд присудил полтора миллиона евро жителям чеченского села, подвергнутого бомбардировке в 1999 г.
29 марта 2011 г. Европейский Суд по правам человека вынес решение по делу Эсмухамбетов и другие против России (жалоба № 23445/03). Это дело касалось гибели 12 сентября 1999 года жителей с. Коги на юго-востоке Чеченской Республики, недалеко от административной границы с Дагестаном при бомбардировке и обстреле с воздуха в ходе «контртеррористической операции».
Суд признал нарушение властями права на жизнь, права на уважение личной и семейной жизни, права на уважение собственности, а также права на эффективные средства правовой защиты, закрепленные в ст. 2, 3, 8 и 13 Европейской Конвенции и в ст. 1 Протокола 1 к Конвенции.

Несмотря на многочисленные жалобы в разные государственные инстанции по факту смерти пятерых родственников заявителей и уничтожения собственности, уголовное дело по факту умышленного разрушения домовладения было возбуждено только 21 января 2002 г., т.е. спустя два с лишним года после событий. Уголовное дело по факту причинения смерти пятерым родственникам заявителей было инициировано после возбуждения дела по уничтожению собственности, однако было прекращено 23 сентября 2005 г. по причине отсутствия состава преступления в действиях военных, которые были признаны правомерными и нацеленными на предотвращение совершения широкомасштабных терактов.
После направления жалобы заявителей в Европейский Суд по правам человека в июле 2003 г., Суд принял решение рассмотреть дело в приоритетном порядке. Суд отклонил оговорки правительства о неприемлемости жалобы ввиду неисчерпания заявителями национальных средств защиты, поскольку российское законодательство и судебная практика предусматривают возможность получения компенсации за разрушенное имущество только в случае неправомерных действий должностных лиц.
Правительство утверждало, что проведенная 12 сентября 1999 г. атака на село Коги была оправдана и абсолютно необходима, поскольку власти якобы знали о приближении членов НВФ к селу и об их подготовке к проведению широкомасштабной террористической атаки. Власти РФ, однако, не предоставили никаких доказательств в подтверждение этого. Суд посчитал эти доводы неубедительными и неадекватными: неизбирательное применение силы в местах проживания гражданского населения ни в коем случае не может считаться обоснованным. Важно отметить, что в обоснование своей позиции Суд ссылается на нормы международного гуманитарного права.
Суд постановил, что власти РФ в нарушение процессуального аспекта ст. 2 Конвенции не провели тщательное расследование инцидента, повлекшего смерть пятерых родственников заявителей.
Что касается разрушения домовладений заявителей, Суд признал, что вмешательство властей в право заявителей на уважение частной и семейной жизни, а также собственности не основано на законе. Суд уже отмечал, что «Закон о борьбе с терроризмом» не соответствует Европейской Конвенции, поскольку в 21 главе закона не прописаны с достаточной точностью рамки полномочий представителей государства во время проведения таких операций.
Наконец, Суд признал, что у заявителей не было возможности на национальном уровне восстановить свои права.
Суд постановил выплатить заявителям в совокупности 1 491 000 Евро в качестве компенсации за причиненные моральные страдания и понесенный материальный ущерб, а представителям заявителей – 9 350 Евро за понесенные расходы на ведение дела.
Это постановление было вынесено Европейским Судом единогласно. Обстоятельства неоправданного применения представителями государства военной силы, повл екшего гибель пятерых родственников заявителей не вызвали у Суда сомнений даже в отсутствие документов, которые Суд безуспешно запрашивал у правительства.
Таким образом, Россия была вновь признана ответственной за гибель граждан во время проведения военной операции в Чечне в 1999 г.
Traducción - inglés European Court awards 1.5 million euros to inhabitants of Chechen village bombed in 1999
On 29 March 2011, the European Court of Human Rights ruled in the case of Esmukhambetov & Others v Russia (application no. 23445/03). This case was about the death, on 12 September 1999, of inhabitants of the village of Kogi in the south-east of the Chechen Republic near the administrative border with Dagestan during an aerial bombardment and gunfire attack, which was part of a ‘counter-terrorist operation’.
The Court found that the authorities had violated the right to life, right to respect for private and family life, right to respect for property and also the right to an effective remedy enshrined in Articles 2, 3, 8 and 13 of the European Convention and in Article 1 of Protocol 1 to the Convention.

Despite numerous applications to various State bodies concerning the deaths of five of the applicants’ relatives and the destruction of property, a criminal case into the wilful destruction of property was not opened until 21 January 2002 – more than two years after the events. The criminal case into the deaths of five of the applicants’ relatives was initiated after the opening of the case into the destruction of property. However, this was closed on 23 September 2005, due to an absence of constituent elements of a crime in the servicemen’s actions, which were deemed to be legitimate and aimed at preventing a large-scale terrorist attack.
Following the applicants’ submission of an application to the European Court of Human Rights in July 2003, the Court decided to consider the application in priority order. The Court rejected the Government’s arguments concerning the inadmissibility of the application on the grounds of the non-exhaustion of domestic remedies by the applicants, as Russian legislation and legal practice only foresee the possibility of obtaining compensation for destroyed property in the event of illegal actions by officials.
The Government maintained that the attack on the village of Kogi carried out on 12 September 1999, was justified and absolutely necessary, as the authorities allegedly had information about members of illegal armed groups arriving in the vicinity of the village and of their preparing to conduct a large-scale terrorist act. The Russian authorities however did not submit any evidence to support this. The Court deemed these arguments to be unconvincing and inadequate: the arbitrary use of force in places inhabited by civilians can under no circumstances be considered to be justified. It is important to note that in justifying its position the Court referred to the norms of international humanitarian law.
The Court found that the Russian authorities had failed to duly investigate the incident that caused the death of five of the applicants’ relatives in violation of the procedural aspect of Article 2 of the Convention.
As regards the destruction of the applicants’ property, the Court ruled that the authorities’ interference in the applicants’ right to respect for private and family life, and also their right to property were unfounded under the law. The Court has already noted that the Suppression of Terrorism Act does not satisfy the European Convention, as section 21 of the Act does not define with sufficient clarity the scope of officials’ powers during the conduct of such operations.
Finally, the Court ruled that the applicants did not have the possibility of restoring their rights at the national level.
The Court ordered the applicants to be paid a total of 1,491,000 euros in compensation for moral suffering and material damages and the applicants’ representatives 9,350 euros for costs and expenses.
This ruling was issued unanimously by the European Court. The circumstances of the unjustified use of military force by State officials leading to the death of five of the applicants’ relatives did not leave the Court in any doubt even in the absence of documents that the Court unsuccessfully requested from the Government.
Thus, Russia was again found responsible for civilian deaths during the conduct of military operations in Chechnya in 1999.
