ACUERDO ALTERNATIVO INICIAL Y PACTO DE CONFIDENCIALIDAD
Guadalajara, Jalisco a 15 de marzo de 2024.
En las instalaciones ubicadas en Avenida Montevideo número 3286 interior 2 en la colonia Providencia 4ta seccion, Guadalajara Jalisco, y toda vez que la parte solicitante la C. JUAN PEREZ PEREZ, como parte complementaria la C. JOSEFINA URSISICHI LEYVA, así como PEDRO ARTURO VALADEZ ROVELO como tercer interesado, comparecieron a la entrevista inicial misma que tuvo verificativo previamente ante la presencia del suscrito prestador de servicios ABOGADO VICTOR ALBERTO LOPEZ SANCHEZ quien fue designado para la prestación del servicio de método alterno en esta etapa del procedimiento.
Una vez que se le brindó ampliamente la información relativa a los métodos alternos; los beneficios de solucionar su conflicto a través de los mismos; el carácter voluntario, profesional, neutral, confidencial, imparcial, ágil y equitativo de éstos; la trascendencia de los acuerdos a los que podrán llegar, los cuales deberán constar en un convenio final, que podrá ser elevado a la categoría de sentencia ejecutoriada.
Ambas partes en forma voluntaria manifiestan su voluntad de participar en el procedimiento, con objeto de obtener una alternativa pacífica a la solución de su conflicto. Siendo su elección el optar por la MEDIACIÓN, como el método alternativo más adecuado para la solución de éste.
En consecuencia, se les hizo saber a los comparecientes que el término de este trámite será de hasta dos meses pudiendo prolongarse por uno más si a juicio de las partes y de este Centro Privado se considera conveniente.
De igual forma se les hace saber a las partes el principio de confidencialidad contemplado en el artículo 4 fracción II de la Ley de Justicia Alternativa del Estado, mismo que señala: “La información derivada de los procedimientos de los métodos alternativos no podrá ser divulgada, por lo que será intransferible e indelegable. Sólo a petición de la autoridad ministerial y Judicial se podrá entregar las actuaciones derivadas de los procedimientos de los métodos alternativos, los cuales se considerarán reservados para efectos de la Ley de Información Pública del Estado de Jalisco y sus municipios”, el cual se relaciona con la obligación de las partes de mantener la confidencialidad del asunto durante su trámite y después de éste, según lo refiere el artículo 7 fracción I de la misma Ley, así como la confidencialidad que debe prevalecer en el desarrollo del método alternativo, tal cual lo refiere el artículo 45 de la Ley en mención: “El procedimiento se desarrollará mediante sesiones orales, comunes o individuales y por su confidencialidad no se levantará constancia de su contenido. Las declaraciones y manifestaciones que se realicen con motivo del procedimiento alternativo carecerán de valor probatorio, y no podrán emplearse en procedimiento judicial”.
Por lo que ambas partes, se comprometen en forma libre y voluntaria a no divulgar o utilizar la información derivada del procedimiento del método alterno elegido, para lo cual firman de conformidad su aceptación en este acto, conforme lo dispone el artículo 57 de la Ley de Justicia Alternativa del Estado.
No habiendo más datos que aportar se da por concluido el presente Acuerdo que contiene el Pacto de Confidencialidad, firmando los comparecientes en unión del suscrito servidor público.

INITIAL ALTERNATIVE AGREEMENT AND CONFIDENTIALITY PACT
Guadalajara, Jalisco, March 15, 2024.
At the premises located at Avenida Montevideo number 3286 interior 2 in the Providencia 4th section neighborhood, Guadalajara, Jalisco, and considering that the requesting party, Mr. JUAN PEREZ PEREZ, as the complementary party, Ms. JOSEFINA URSISICHI LEYVA, as well as PEDRO ARTURO VALADEZ ROVELO as the third interested party, appeared for the initial interview, which was previously conducted in the presence of the undersigned service provider, LAWYER VICTOR ALBERTO LOPEZ SANCHEZ, who was appointed to provide alternative method services at this stage of the procedure.
Once they were extensively provided with information regarding alternative methods, the benefits of resolving their conflict through them, the voluntary, professional, neutral, confidential, impartial, agile, and equitable nature of these methods, and the significance of the agreements they may reach, which must be documented in a final agreement, that may be elevated to the status of an enforceable judgment.
Both parties voluntarily express their willingness to participate in the procedure, in order to obtain a peaceful alternative to the resolution of their conflict. Their choice is to opt for MEDIATION, as the most suitable alternative method for its resolution.
Consequently, it was made known to the attendees that the term of this procedure will be up to two months, which may be extended by one more month if deemed appropriate by the parties and this Private Center.
Likewise, the parties are informed of the principle of confidentiality provided for in Article 4, Section II of the State Alternative Justice Law, which states: "Information derived from alternative method procedures may not be disclosed, making it non-transferable and non-delegable. Only at the request of the ministerial and judicial authority may the proceedings derived from alternative method procedures be provided, which will be considered confidential for the purposes of the State of Jalisco and its municipalities' Public Information Law." This relates to the parties' obligation to maintain the confidentiality of the matter during and after its processing, as referred to in Article 7, Section I of the same Law, as well as the confidentiality that must prevail in the development of the alternative method, as stated in Article 45 of the aforementioned Law: "The procedure will be carried out through oral, common, or individual sessions, and due to its confidentiality, no record of its content will be kept. Declarations and statements made in connection with the alternative procedure will be without probative value and may not be used in judicial proceedings."
Therefore, both parties commit freely and voluntarily not to disclose or use the information derived from the chosen alternative method procedure, for which they sign their acceptance at this act, in accordance with Article 57 of the State Alternative Justice Law.
With no further data to provide, this Agreement containing the Confidentiality Pact is concluded, and the attendees sign together with the undersigned public servant.
