Effective Communication
By the end of this unit, you will be able to:

Lesson 1: Working Successfully with Others
In Unit 2 we looked at the individual skills you need to come well-prepared to a medical office workplace — from the six workplace essentials to the personal qualities
we call effective self-management.
In this unit we expand your skills to include the interpersonal: the way we communicate and interact with others. Effective interpersonal communication is much more than simply talking effectively.
Good communication requires that messages be heard, processed and acted upon.
.
This lesson will begin building the basics of effective communication: with other individuals, with workplace teams, in person and over the telephone. Then we’ll expand the discussion to include therapeutic communication, the use of professional communication skills to create a feeling of comfort with patients — even under difficult or unpleasant circumstances.
1. 1 Interpersonal Communication
Interpersonal communication will test your inner attitude, confidence and self-management. You may have a great knowledge of your job, and a wealth of confidence in your skills, but if you cannot communicate positively with co-workers, you will encounter problems.
There are also barriers to effective communication. They include:
:
• timidez
• poor language skills
• fear of failure
• not wanting to appear ignorant
• cultural differences
• inexperience
Overcoming Barriers
It’s not unusual to feel anxiety as you think about your new job or career. Anxiety is an unease of mind, a feeling of worry — a fear of a situation or the unknown.
The key word here is unknown. Remember that in your new workplace you will be given a thorough orientation to your job. You will have a supervisor with an active interest in your success and in building your confidence. And you will have fellow team members who have gone through the same experience themselves. Everyone remembers what it’s like to start a new job, to be in a new role and meet new people.

Most of your co-workers have experienced the same feelings of anxiety that you have. The following are a couple of ways to overcome these barriers.
Shyness. Make an effort to get out of your “shell” by greeting your co-workers
regularly. Take the first step by saying hello every morning; initiate the conversation,
and ask them about their lives. Get them talking!
Poor language skills. Let fellow team members know you’re actively working to improve your English skills. Encourage them to coach and correct you if you need help; ask for clarification of meaning if you don’t understand. Do not be excessively apologetic — you have nothing to be ashamed of as you learn and improve.
Fear of failure. This is a common reason why people “clam up” and fail to communicate. No one expects a new employee to know it all or make no mistakes. Attitude is everything: people should see that you are positive, open to feedback and willing to learn.
Cultural differences. Different cultures use different communication styles. Some are more direct, use different body language and avoid eye contact. Learn how to integrate your own cultural differences into your workplace culture. Honor and respect should be given to your native culture, but it is necessary for you to adapt to the workplace itself.
Inexperience. Everyone has had to start somewhere. Use the first days and weeks on the job to ask questions and learn, and always have a good sense of humor. The first judgments that will be made of your work performance will likely involve your attitude, energy and openness to learning.
Effective Communication: Five Habits
In Unit 2 you learned about the two types of “customers” you must communicate with in the workplace.
external customers: patients, vendors, family members
internal customers: co-workers, supervisors, colleagues
Effective communicators use the same techniques in their interpersonal communication with both groups. Here are five basic communication habits that will make you a more effective communicator.
1. Meet and greet people with positive energy. Put a smile on your face and into
your voice. Remember how important a first impression can be.
• Say hello to people you encounter.
• Acknowledge others with a smile and welcoming expression.
• Introduce yourself to anyone you don’t know.
2. Show interest with engaging body language. Maintain steady eye contact and
orient your body directly toward the individual with whom you’re communicating.
• Maintain an upright posture.
• Don’t slouch or turn away from a conversation.
• Avoid crossing your arms over your chest.
3. Use active listening to get the real message. Active listening requires that you pay conscious attention to the individual you’re speaking with.
• Concentrate on what’s being said.
• Ask questions to get more information.
• Repeat all or part of what you’ve heard for clarification.
4. Be willing to give and receive feedback. Probe for more meaning if you’re unsure about what’s being said or what the purpose of the communication really is. Give assurances or acknowledgements that you understand something, and ask questions if you’re unsure. Feedback is a set of responses that provide clarification or direction.
• Acknowledge that you’ve heard what’s been said.
• Re-phrase or repeat key points if necessary.
• Reiterate for your own understanding: “So you’d like me to…”
5. Put the “human touch” first. Conversations in the medical environment often involve a piece of technology or a form to be filled out. It’s important that you not let that task or tool interfere with the communications basics: eye contact, empathy, tact and active listening.
• If you’re using a keyboard, type during conversational pauses.
• If taking notes, make them brief, and complete them later.
• Confirm understanding before looking away to make a note.
Computers, forms and other business tools are there to help us better do our jobs. Never let the technology or tool being used come before your interpersonal communication.
The Power of Listening
There are four basic modes of communication that we use in the workplace:
1. speaking
2. listening
3. gestures and body language
4. writing
Which of these do you think is used most often? It’s listening.
Experts say that, with the exception of breathing, we listen more than we perform any other single activity.
The following is a list of listening-related work activities that will apply to you as a medical office assistant.
• personal coaching and counseling (one on one)
• giving and receiving instructions
• interviewing others
• making decisions based on oral information
• assisting patients and colleagues
• providing services to other work groups or departments
• using the telephone
Tips for Active Listening
Going beyond simply “hearing” to really understanding what’s being said is sometimes called active listening: paying conscious attention to the speaker, asking questions to get more information, and giving feedback.
Here are seven ideas for becoming a better listener.
1. Take notes whenever possible. Doing this aids retention. If you need to make
notes later to avoid interrupting the flow of the conversation, do so.
2. Listen now, report later. Plan on telling someone what you heard; it will help
you remember.
3. Want to listen. You must have the desire, interest, self-discipline and
concentration to be a good listener.
4. Be in the present. Beware of tendencies to daydream or lose focus.
5. Become a “whole body” listener. Listen with your ears, your eyes, your heart,
your intuition and your mind.
6. Control your own emotional “hot buttons.” If you are biased against the
speaker or are in potential disagreement with the message, it can interfere
with hearing what’s really being said.
7. Control distractions. Don’t let internal or external distractions interfere with
your concentration.
All of us have known good listeners and bad listeners. Active listening is a gift of respect we give to those who choose to communicate something to us. Being aware of, and improving, your listening skills is one of the most important things you can do for your own personal and career development.

1.2 Communicating with Your Team
Before you can use your communication skills with your patients, you must be able to apply them with your fellow team members. There are a variety of ways you will be interacting with your team every day.
• one-on-one exchanges of information
• team meetings, formal and informal
• assisting each other in a process or procedure
• using the telephone or e-mail
• communicating with your supervisor
In the previous section, and in the video, we demonstrated five powerful positive habits for more effective interpersonal communication:
1. Meet and greet people with positive energy.
2. Show interest with engaging body language.
3. Use active listening to get the real message.
4. Be willing to give and receive feedback.
5. Put the “human touch” first.
Now, let’s look at a specific interpersonal relationship that will help determine your level of success.
Key Relationship: Your Supervisor
Your relationship with your supervisor may be the most important relationship you establish in the workplace. Because the supervisor is evaluating your performance, he or she is vitally concerned that the two of you communicate effectively and on a regular basis.
If you feel that you’re not getting adequate time with your supervisor, or do not understand what is expected of you, it’s your responsibility to set up a
meeting to get clarification and assertively ask for guidance, feedback and support.
In communicating with your supervisor, try to determine his or her preferred communication style. Is your supervisor:
• a person who prefers regularly scheduled sessions over coffee?
• a person who likes casual, informal “on the run” dialogs?
• a person who prefers to write things down and go over them later?
• a person who encourages you to ask questions and bring up issues?
Many supervisors will let you know how they prefer to communicate. They will not be offended if you ask how you should best approach them and solicit their feedback.
Multiple Supervisors?
You may have a number of people who act as your supervisor or help you get oriented to your new job. For instance, if you are assisting in a number of different departments in a clinic or hospital, you may be “reporting to” or supervised by the individual who heads that particular department. Again, do not hesitate to get clarification on the following keys to good performance.
• Who am I reporting to?
• Who will be giving me my directions and evaluating my performance?
• Am I clear on what is expected of me?
• How will I receive feedback?
• What do I do when I have questions or concerns?
In many modern workplaces, supervisors behave more like co-workers or colleagues than “bosses.” Experience in the workplace has shown that teams are usually the most efficient work groups, and that the old-fashioned boss / worker relationship that kept the two very separate and at different status levels in the organization often did not contribute to productivity.
Your supervisor --- even if he or she behaves more like a fellow team member than a “boss” --- will still evaluate your performance.
What Should I Expect from My Supervisor?
Whether you have a single supervisor — or several — you should expect certain things from this relationship; it will influence your performance and level of success.
1. Orientation and Training
Your supervisor will either orient you directly or will set up an orientation for you. As we’ve learned in previous lessons, an orientation is an introductory program intended to guide a person in adjusting to new surroundings, employment or tasks. Orientation can be accomplished in numerous ways.
• Assign a “partner” or “buddy.” You may accompany a fellow worker through
his or her tasks for a few days — or even a week — to learn the job and process.
• Give a tour or overview. You may be walked through the clinic or facility and
given an overview of the functions performed there.
• Meet the team. Often, a special team meeting will be called to introduce a new
staff member and to go over some of the basic procedures and processes.
• Read a manual or watch a video. Some organizations will give you written or video-based materials prepared specifically to orient new employees.
In many jobs you may receive a procedures or policy manual, and be required to acknowledge in writing your receipt and understanding of those procedures.
Your training will be ongoing. In the healthcare field there is constantly new information to absorb, new procedures to learn, and continuous improvement of processes to make the team more productive. Although your supervisor may not be the trainer in all cases, it is his or her responsibility to coordinate your training. If you have any questions or concerns about your training, or wish to volunteer, you begin by asking your supervisor.
In many larger facilities, training and orientation are coordinated and conducted by the Human Resources or “HR” Department. Human Resources is usually the department in an organization that handles personnel issues such as employee benefits, conditions of employment, and employee concerns or problems.
2. Coaching and Feedback
A very important part of the supervisor / employee relationship is ongoing coaching for performance improvement. Unlike formal training, coaching is typically a more informal process involving ongoing feedback, dialog, and demonstration.
And, as opposed to more formal schooling or training, coaching is often a “hands-on” activity that occurs in the midst of the work itself. For instance, a supervisor might observe you taking patient data and coach you on your performance while you complete the interview with the patient.
Coaching is one of the most valuable ways teams improve their performance, and supervisors directly impact the performance of individual team members.
Do not hesitate to ask your supervisor for coaching and ongoing feedback!
As we’ve seen previously, giving and receiving feedback is the basis for workplace coaching and process improvement. Good supervisors will give both positive feedback and constructive criticism if a process is being performed incorrectly, or if there is room for improvement.
It’s not expected that you will do everything perfectly, so be prepared for some constructive criticism. Your receptiveness to criticism, with a positive attitude, will be
an important part of your performance evaluation. Make sure you completely understand any criticism. Ask for clarification if you need it. For instance:
“So I need to slow down my questions, and wait more patiently for responses?”
3. Regular Contact / Meetings
Supervisors have different styles of communication. Some may wish to give you ongoing feedback in a more informal way, through ongoing conversations while you’re working. Others may wish to set up formal, regular meetings to focus entirely on reviewing your performance.
Whichever style your supervisor prefers, it’s important that you have regular contact
to help you evaluate your progress and to gauge how you’re doing.
As you become familiar with the communication style preferred by your supervisor, work with him or her to set up a regular process by which you get feedback, coaching and ongoing training. You may end up meeting once a week in a break room, going out for dessert after work, or setting up a monthly hour in an office.
As you get to know your supervisor better, identify the best way to communicate with him or her. Some supervisors will encourage you to ask questions at any time, and enjoy giving feedback “on the fly” while at work. Others will find this approach distracting and ineffective. Again, if you are uncertain, ask the supervisor what approach he or she prefers you to take.
Team Meetings and Protocols
Besides your relationship with your supervisor, the other key relationship you’ll be developing is with your work team as a whole. You may be assigned to a specific team (say, the Medical Records Department) or simply be a part of the entire team at a local clinic, for instance.
Either way, you will need to communicate effectively with fellow team members. These communications may be both informal (part of everyday work routines), and formal (regularly scheduled meetings with specific agendas).
Meetings may last from ten minutes to two hours. Many work groups will gather first thing in the morning for a ten-minute outline of the day ahead, for instance. They may hold a weekly meeting of an hour to go over broader issues in more depth. And, occasionally, teams will schedule major meetings of longer duration for training, team building, or to address problems.
Whatever kind of meeting you’re involved in, use these meeting skills.
• Active listening: be focused and at your most alert.
• Note taking: jot down key points for later reference.
• Appropriate questions: be prepared to ask questions for a better understanding.
“Appropriate” questions are questions whose answers may be useful to the rest of the team. For instance:
“Will you want us to be here fifteen minutes early tomorrow?”
On the other hand, if you have a question that concerns only your own job, performance, or understanding, these are often best saved for one-on-one sessions with your supervisor or a co-worker. For example:
“Did you get the report I ordered from Medical Records yesterday morning?”
Protocols: The Unwritten Rules
We’ve talked about workplace culture and the way workplaces develop their own particular identities that might not be found in a formal policies and procedures manual. Another word often used in the workplace is protocols.
Protocols are the courtesies, manners and procedures considered proper in dealing with people within an organization. These are often “unwritten rules.”
In most cases it will take you a while on the job to get used to the culture and the protocols that may be in effect in your workplace. Such matters, like length of coffee breaks, number of sick days allowed, etc., are covered in employee manuals, and can be learned quickly. But much of protocol is not listed or explained in writing. Below are three examples.
1. Supervisor’s Authority. In most organizations it is a mistake to go over the head of your supervisor to discuss problems that are important to your department. This can be seen as undermining a supervisor’s authority, and consequently, a violation of protocol. Take problems to your direct supervisor first.
2. Personal Issues and Problems. Most workplaces discourage team members from bringing their personal issues and problems into the workplace. Managers and supervisors encourage individuals to keep their personal lives private and to stay focused on work.
You will undoubtedly develop personal relationships with your co-workers, and it’s entirely appropriate to strengthen these more personal relationships during breaks or at lunch. It is generally regarded as unprofessional to dwell on personal issues, especially problems or complaints, while your team is trying to maintain a positive,
professional work environment.
3. Personal Privacy. Good team members respect the personal privacy of their co-workers. this means avoiding eavesdropping or snooping. Team members should refrain from telling jokes or offensive stories that may offend a co-worker. Above all, good team members should practice loyalty to their team and avoid negative comments, gossip or complaints.
A negative attitude undermines team morale and effectiveness, and can cause a backlash against the individual who spreads negative comments and attitudes.
Here are some other situations in which sensitivity to protocol may be required.
• discussing patient details in a crowded elevator
• using first names as opposed to last names and titles
• speaking or laughing in a loud voice that disturbs others
• dressing in a manner that consistently distracts others and affects their productivity
Can you think of other situations that might fall under the “protocol” issue, and situations that require you to be especially sensitive?
Delegating, Sharing and Helping
High functioning teams can be modern miracles of productivity because, as the old saying goes, with a team “the whole is often much greater than the sum of its parts.”
What this means is that the very diversity of the team members — their different talents, energy levels, interests, cultural backgrounds and skills — gives the team a great many more options for working successfully than any one individual would have. The way the team allocates its resources may be decided by the supervisor, or may also be a function built into the team itself. Many teams are self-managed teams, work groups that set up their own arrangements for delegating, sharing and
performing their tasks.
Delegating is the process of assigning or entrusting a duty or responsibility to someone else. In the workplace this typically involves the individual with a greater share of tasks or responsibilities --- usually the supervisor --- assigning or entrusting tasks to other team members. He or she “delegates” the work according to who can do it best, and who has the available time and appropriate training.
It’s entirely appropriate to ask if you can help — especially with a supervisor or team member who is overloaded with work.
Teams will often work out ways to share tasks and responsibilities. This is why team communication is so important. Team members need to be able to divide up a task or set of tasks, communicate clearly to each other what each individual will be doing, and set up a work plan or procedure to get the task done. This can be as simple as agreeing on sharing a task during a quick hallway conversation, or sitting down in a break room and writing down action items and deadlines for getting a more complicated or labor-intensive task done on time and according to expectations.
Your team leader may determine that a task is too big for one individual, and will ask you to form a “mini-team” to complete that task. In your position as medical office assistant, it’s likely that a lot of your work will be generated this way. For instance, a supervisor might say to you:
“I’ve asked Frederick and Carolina to re-order all last year’s Medicare billings by the date of billing, not by the patient name. I’d like you to help them however you can.”
In this case it would become your responsibility to work with your two team members and to take some direction from them.
Medical offices are busy environments that often involve multi-tasking — situations in which a number of duties, tasks and action items must be handled simultaneously.
A good team member knows how and when it’s appropriate to ask for help in getting the job done. This requires:
• knowing when you are “double booked” or assigned so much work that you will need to ask someone for assistance.
• identifying the proper individual or individuals to ask for help (this might mean going through your supervisor).
• asking for help and expressing appreciation for the help.
“I’m going to need some help between two and three today. If you could give
me some assistance for that hour it would be a real life saver.”
If you ask someone for help and they cannot provide it, ask him or her to direct you to another worker who might be able to.
If you follow these guidelines, you won’t risk breaching protocol when asking for help. In your continuing dialog with your supervisor, make a point of educating yourself on when it might be appropriate or inappropriate to ask for help, and the best way of asking for it.

Lección 1: Trabajar Exitosamente Junto a Otros
En la Unidad 2, vimos cuáles eran las aptitudes individuales necesarias para estar bien preparado para trabajar en un consultorio médico – comenzando por los seis elementos esenciales para el lugar de trabajo, pasando luego al conjunto de las cualidades personales que hemos llamado manejo personal eficaz.
En esta unidad ampliaremos sus conocimientos al incluir el aspecto interpersonal, es decir, la forma como nos comunicamos e interactuamos con los demás. La comunicación interpersonal eficaz va mucho más allá que simplemente saber hablar en forma eficaz.
Para que exista una buena comunicación, los mensajes deben ser escuchados, procesados y ejecutados.

Iniciaremos esta lección estableciendo las bases para una comunicación eficaz: con otras personas, con equipos de trabajo, en persona y por teléfono. Luego ampliaremos la temática para incluir la comunicación terapéutica, es decir la aplicación de técnicas profesionales de comunicación que nos permitan sentirnos a gusto con nuestros pacientes, aún en circunstancias difíciles o desagradables.
1.1 Comunicación Interpersonal
La comunicación interpersonal reflejará su actitud interna, su confianza en sí mismo y su capacidad de manejo personal. Tal vez usted conozca muy bien su trabajo y confíe plenamente en sus aptitudes, sin embargo, si no puede comunicarse en forma positiva con sus compañeros de trabajo, se verá en problemas.
También existen obstáculos que limitan la comunicación eficaz. Ellos son los siguientes:
• timidez
• poco conocimiento del idioma
• temor al fracaso
• temor a parecer ignorante
• diferencias culturales
• falta de experiencia
Cómo Superar Obstáculos
Es natural sentir ansiedad ante un nuevo trabajo o una nueva profesión. La ansiedad es un obstáculo para la mente, es un sentimiento de preocupación, de temor ante una situación o ante lo desconocido.
Aquí la palabra clave es “desconocido”. Recuerde que en su nuevo lugar de trabajo le orientarán acerca de las nuevas tareas. Habrá un supervisor que se interesará activamente en que usted salga adelante y se sienta seguro. También habrá otros miembros de su equipo de trabajo que ya pasaron por su misma situación. Todos recordamos cómo nos sentimos cuando iniciamos un nuevo trabajo, una nueva función y conocemos gente nueva.
La mayoría de sus compañeros de trabajo ha experimentado sus mismos sentimientos de ansiedad. A continuación le sugerimos dos formas de superar dichos obstáculos:
Timidez. Haga un esfuerzo por salir de su “concha”, interactuando con sus colegas diariamente. Tome la iniciativa y salúdelos cada mañana; inicie la conversación y pregúnteles acerca de sus vidas. ¡Hágalos hablar!
Poco conocimiento del idioma. Hágales saber a sus compañeros de trabajo que está esforzándose por mejorar sus conocimientos de inglés. Incítelos a enseñarle y corregirle cuando necesita ayuda. Si no entiende el significado de algo, pida que se lo aclaren. No se disculpe excesivamente -- no tiene nada de qué avergonzarse mientras aprende y mejora sus conocimientos.
Temor al fracaso. Esta es una de las razones más comunes por la que las personas “se encierran en sí mismas” y no logran comunicarse. Nadie espera que un nuevo empleado lo sepa todo o no cometa ningún error. La actitud es fundamental: los demás deben notar que usted tiene una actitud positiva, que está abierto a otras opiniones y deseoso de aprender.
Diferencias culturales. Las diferentes culturas utilizan distintos estilos de comunicación. Algunas son más directas, utilizan un lenguaje corporal diferente y evitan el contacto visual. Aprenda a integrar sus propias características culturales a la cultura de su lugar de trabajo. Sin dejar de honrar y respetar su cultura de origen, será necesario adaptarse a su lugar de trabajo.
Falta de experiencia. Todos tuvimos que comenzar en alguna parte. Aproveche los primeros días y semanas en su nuevo cargo para preguntar y aprender, y mantenga siempre un buen sentido del humor. Su actitud, energía y voluntad de aprender seguramente condicionarán los primeros juicios que los demás emitan sobre usted.
Comunicación Eficaz: Cinco hábitos
En la Unidad 2 usted conoció dos tipos de “clientes” con los cuales debe comunicarse en su lugar de trabajo.
clientes externos: pacientes, proveedores, miembros de la familia
clientes internos: compañeros, supervisores, colegas
Los comunicadores eficaces utilizan las mismas técnicas de comunicación interpersonal con ambos grupos. A continuación describiremos los cinco hábitos básicos que le permitirán ser un comunicador más eficaz:
1. Reciba y salude a la gente con energía positiva. Sonría con su cara y con su voz. Recuerde lo importante que puede ser la primera impresión.
• Salude a las personas con las que se encuentre.
• Reciba a los demás con una sonrisa y una expresión de amabilidad.
• Preséntese a todas aquellas personas que no conozca.
2. Demuestre interés utilizando un lenguaje corporal atractivo. Mantenga un contacto visual sostenido y oriente su cuerpo directamente hacia la persona con quien se está comunicando.
• Mantenga una postura erguida.
• No adopte una postura que exprese desinterés, ni se retire en medio de una conversación.
• Evite cruzarse de brazos.
3. Escuche activamente para poder captar el mensaje verdadero. El saber escuchar en forma activa implica atender conscientemente a la persona con la cual estamos dialogando.
• Concéntrese en lo que se está diciendo.
• Haga preguntas para obtener mayor información
• Para aclarar sus dudas repita todo o parte de lo que haya escuchado.
4. Esté dispuesto a dar y recibir opiniones. si no está seguro sobre lo que se está diciendo o sobre el objetivo verdadero del mensaje, solicite más información. Cuando haya comprendido el significado de algo, demuéstrelo con claridad y reconocimiento
y haga preguntas si aún no está seguro. Las recomendaciones o feedback son un conjunto de respuestas que tienen como función aclarar dudas u orientar a la persona.
• Demuestre que ha escuchado lo que se ha dicho.
• Si es necesario, repita los puntos clave ya sea de otra manera o de la misma forma en que fueron dichos.
• Reitere la información para comprenderla mejor: “Entonces usted quiere que yo…”
5. Priorice el “aspecto humano”: muchas veces los diálogos que se desarrollan en el ambiente médico incluyen algún factor tecnológico o un formulario que debe completarse. Es importante evitar que dicha tarea o herramienta de trabajo interfiera con los factores esenciales de la comunicación: el contacto visual, la empatía, el tacto y la capacidad de escuchar activamente.
• Si usted está utilizando un teclado, escriba cuando haya pausas en la conversación.
• Si toma apuntes, trate de que sean breves y en lo posible trate de completarlos más tarde.
• Antes de retirar su mirada para tomar nota, confirme que ha entendido el mensaje.
Las computadoras, los formularios y otras herramientas administrativas sirven para ayudarnos a desempeñar mejor nuestra tarea. Nunca anteponga la tecnología o la herramienta de trabajo a la comunicación interpersonal.
La Capacidad de Escuchar
Hay cuatro modalidades básicas de comunicación que se utilizan en el lugar de trabajo:
¿Cuál de estas piensa usted que se utiliza con mayor frecuencia?
La respuesta es “escuchar.”
Los expertos sostienen que, a excepción de la respiración, el escuchar es la actividad que desempeñamos con mayor frecuencia.
A continuación presentamos una lista de actividades de trabajo relacionadas con la capacidad de escuchar y que le servirán en su cargo de auxiliar de un consultorio médico.
• capacitación y asesoramiento personal (individual)
• impartir y recibir instrucciones
• entrevistar a otros
• toma de decisiones basadas en información oral
• apoyo a pacientes y colegas
• prestar servicios a otros grupos de trabajo u otras oficinas
• uso del teléfono
Pautas para Escuchar Activamente
Se denomina escuchar activamente a la diferencia que existe entre simplemente “oír” algo, y la capacidad de comprender realmente el mensaje escuchado: es decir prestar atención al orador en forma consciente, hacer preguntas para obtener más información, y poder expresar una opinión al respecto.
Le sugerimos siete ideas que le ayudarán a mejorar su capacidad de escuchar:
1. Tome apuntes siempre que sea posible. Esto ayuda a memorizar. Si necesita tomar nota posteriormente para no interrumpir el flujo de la conversación, hágalo.
2. Escuche ahora, informe después. Como forma de ayudar a su memoria, planifique contarle a alguien lo que está escuchando.
3. Deseo de escuchar. Para saber escuchar, usted deberá tener el deseo, el interés, la autodisciplina y la concentración necesarios.
4. Manténgase en el presente. Cuidado con la tendencia a soñar despierto o a distraerse.
5. Escuche con todo su cuerpo. Escuche con los oídos, los ojos, el corazón, la intuición y la mente.
6. Controle sus “disparadores” emocionales Si usted tiene prejuicios en contra del orador o está previamente en desacuerdo con aquello que se va a decir, esto puede afectar su capacidad para entender el verdadero mensaje.
7. Controle las distracciones. No permita que factores internos o externos distraigan su concentración.
Todos hemos conocido buenos y malos escuchas. El saber escuchar activamente es una señal de respeto hacia aquellos que nos quieren comunicar algo. Al hacernos conscientes acerca de nuestra capacidad de escuchar, y mejorar nuestras técnicas para aprender a escuchar mejor, estaremos reforzando uno de los aspectos más importantes para nuestro desarrollo personal y profesional.

1.2 Cómo Comunicarse con su Equipo de Trabajo
Antes de poder aplicar las técnicas de comunicación al diálogo con sus pacientes, debe aplicarlas con los miembros de su equipo de trabajo. Usted interactuará diariamente con los miembros de su equipo de diversas formas.
• intercambio de información entre dos personas.
• reuniones grupales, formales e informales
• apoyo mutuo vinculado a un proceso o procedimiento
• uso del teléfono o del correo electrónico

En la sección anterior y en el video, señalamos cinco hábitos poderosos y positivos que permiten lograr una comunicación interpersonal más eficaz.

Relación Clave: Su Supervisor
La relación con su supervisor podría constituir el lazo más importante que usted pueda establecer en su lugar de trabajo. Dado que el supervisor es quien evalúa su desempeño en el trabajo, él se preocupará esencialmente de lograr una comunicación eficaz y constante entre ambos.
Si considera que no está pudiendo dedicarle el tiempo deseado a relacionarse con su supervisor, o si tiene dudas acerca de lo que se espera de usted, es su responsabilidad promover una reunión para aclarar dudas y, en forma asertiva, solicitar ayuda, recomendaciones y apoyo.
En la comunicación con su supervisor, trate de determinar cuál es el estilo de comunicación que él o ella prefieren. Su supervisor es…
• ¿una persona que prefiere las reuniones con horarios establecidos de antemano y acompañadas de un café?
• ¿una persona que disfruta de los diálogos casuales, informales “sobre la marcha”?
• ¿una persona que prefiere anotar los temas y luego analizarlos?
• ¿una persona que lo estimula a hacer preguntas y a plantear inquietudes?
Muchos supervisores le harán saber cómo prefieren comunicarse. No se ofenderán si usted les consulta acerca de cuál es la mejor manera de dirigirse a ellos y pedirles sus opiniones.
¿Múltiples Supervisores?
Tal vez usted cuente con varias personas que cumplen la función de supervisor o le orientan en su nueva tarea. A título de ejemplo: si usted trabaja como auxiliar en varias oficinas de una misma clínica médica u hospital, podrá reportarse o estar bajo la supervisión de la o las personas que dirigen cada una de las oficinas. Le recomendamos que aclare sus dudas respecto a los siguientes puntos clave para asegurarse un buen desempeño:
• ¿A quién reporto?
• ¿Quién me dará órdenes y evaluará mi desempeño?
• ¿Tengo claro qué se espera de mi?
• ¿De qué forma recibiré recomendaciones u opiniones?
• ¿Qué debo hacer cuando tengo preguntas o inquietudes?
En muchas instituciones modernas, los supervisores se comportan más como compañeros de trabajo o colegas que como “jefes”. La experiencia ha demostrado que los grupos de trabajo más eficaces son los equipos y que la antigua relación jefe / empleado que separaba ambas funciones colocándolas en diferentes niveles jerárquicos dentro de la organización, no favorecía la productividad.
A pesar de que se comporte más como compañero de equipo que como “jefe”, el supervisor evaluará igualmente su desempeño.
¿Qué Debo Esperar de Mi Supervisor?
Aunque usted tenga un único supervisor -–o más de uno—deberá atenerse a ciertos factores inherentes a esta relación; ello determinará su desempeño y su nivel de éxito.
1. Orientación y Capacitación
Su supervisor le orientará él mismo o bien se ocupará de que otros lo orienten. Cómo hemos visto en lecciones anteriores, la orientación es un programa introductorio cuyo propósito es guiar a la persona para que pueda adaptarse a su nuevo entorno, empleo o a sus nuevas tareas. La orientación puede llevarse a cabo de diversas formas.
• Designar un “socio” o “compañero”. Usted podrá acompañar a algún compañero de trabajo durante algunos días, o incluso durante una semana, mientras este realiza sus tareas habituales, con el objetivo de aprender las tareas y los procesos.
• Visita guiada o presentación general. Alguien podrá recorrer junto a usted la clínica o las instalaciones, explicándole en términos generales las diferentes funciones que se cumplen en cada lugar.
• Conozca a su equipo. Con frecuencia se convoca una reunión extraordinaria del equipo de trabajo con el fin de presentar a un nuevo miembro del personal y repasar algunos procedimientos y procesos básicos.
• Leer un manual o mirar un video. Algunas instituciones le proporcionarán material escrito o videos preparados especialmente para orientar a nuevos empleados.
En muchas empresas recibirá un manual de normas o procedimientos, y se le pedirá que confirme por escrito el haber recibido y comprendido dichas normativas.
Su capacitación será permanente. En el área de la salud hay un flujo permanente de información nueva que se debe asimilar, nuevos procedimientos que deben aprenderse y una mejora continua de los procesos para incrementar la productividad del equipo. Aunque su supervisor no sea siempre su instructor, igualmente tiene la responsabilidad de capacitarle. Si usted tiene dudas o inquietudes acerca de su capacitación, o desea colaborar en calidad de voluntario, deberá dirigirse primeramente a su supervisor.
En muchas empresas de mayor tamaño, la coordinación de la capacitación y la orientación estarán a cargo del Departamento de Recursos Humanos o RRHH. En cualquier organización, generalmente la oficina de Recursos Humanos maneja todos los asuntos vinculados con el personal de la empresa, tales como los beneficios de los empleados, las condiciones de empleo, y las inquietudes o problemas que afectan a los empleados.
2. Capacitación y Retroalimentación
Una parte muy importante de la relación entre el supervisor y el empleado es la capacitación permanente para mejorar el desempeño. A diferencia del entrenamiento formal, la capacitación o “coaching” es típicamente un proceso más informal que implica la retroalimentación continua, el diálogo y la demostración.
En contraposición a la enseñanza o al entrenamiento más formal, la capacitación o “coaching” es generalmente una actividad práctica que se desarrolla en medio de la propia tarea. A modo de ejemplo, un supervisor podrá observarlo mientras usted toma los datos de un paciente y aconsejarle acerca de su desempeño en esta tarea, al tiempo que usted realiza la entrevista con el paciente.
La capacitación o “coaching” es una de las mejores técnicas para mejorar el desempeño de un equipo de trabajo, permitiendo asimismo que los supervisores tengan una influencia directa sobre el desempeño de cada miembro del equipo.

Como hemos visto anteriormente, el dar y recibir opiniones constituye la base del “coaching” o capacitación en el lugar de trabajo, y posibilita la mejora de los procesos. Los buenos supervisores comunicarán tanto sus opiniones positivas como sus críticas constructivas si un proceso se realiza en forma incorrecta, o si se puede mejorar.
No se espera que usted haga todo perfectamente bien, por lo tanto deberá estar preparado para recibir algunas críticas constructivas. Su capacidad de recepcionar una crítica con actitud positiva, constituirá parte importante de la evaluación sobre su desempeño. Asegúrese que haya comprendido bien cualquier crítica que le haya sido planteada. Si es necesario, pida aclaraciones. Por ejemplo:
“¿Debo entonces plantear mis preguntas más lentamente, y ser más paciente al esperar las respuestas?”
3. Contactos habituales / Reuniones
Los supervisores tienen diferentes estilos de comunicación. Algunos querrán expresar su opinión de manera más informal, en una conversación mientras usted trabaja. Otros prefieren organizar reuniones formales, preestablecidas, cuyo objetivo central sea la evaluación de su desempeño.
Cualquiera sea el estilo preferido por su supervisor, es importante mantenerse en contacto permanente para que usted pueda evaluar su propio progreso y calibrar su desempeño.
A medida que se familiarice con el estilo de comunicación preferido por su supervisor, elaboren juntos un proceso mediante el cual usted reciba opiniones,
capacitación y formación de manera continúa. Tal vez decidan reunirse una vez por semana durante un momento de descanso, o salir a comer el postre después del horario de trabajo o fijen una cita mensual para reunirse en la oficina.
A medida que conozca más y mejor a su supervisor, descubra cuál es la mejor manera de comunicarse con él. A algunos supervisores les gusta que les hagan preguntas en cualquier momento y dan su opinión “sobre la marcha” mientras trabajan. Otros consideran que este procedimiento provoca distracción y es ineficaz. Le reiteramos: si tiene dudas, pregúntele a su supervisor qué procedimiento prefiere utilizar.
Reuniones de Equipo y Protocolo
Además de la relación con su supervisor, también es de fundamental importancia la relación que usted desarrolle con su equipo de trabajo como grupo. Podrán asignarle a un equipo específico (digamos, por ejemplo, el Departamento de Antecedentes Médicos) o tal vez integre simplemente el equipo formado por todo el personal de una clínica, por ejemplo.
De cualquier manera, deberá poder comunicarse en forma eficaz con sus compañeros de equipo. Dichas comunicaciones pueden ser informales (como parte de la rutina diaria de trabajo) y formales (reuniones establecidas regularmente con un programa de trabajo específico).
Los encuentros podrán durar entre diez minutos y dos horas. Muchos grupos de trabajo se reúnen, por ejemplo, a primera hora de la mañana para dedicar diez minutos a planificar las actividades del día. A veces organizan una reunión semanal de una hora para tratar en profundidad asuntos más generales. Y, ocasionalmente, los equipos organizan reuniones más importantes, de mayor duración, para capacitarse, fortalecer el espíritu de equipo, o tratar problemas específicos.
Cualquiera sea el tipo de reunión de la cual usted participe, aplique las siguientes técnicas:
• Escuche activamente: manténgase concentrado y bien atento
• Tome apuntes: anote los puntos clave para analizarlos posteriormente.
• Formule preguntas apropiadas: esté preparado para formular preguntas que mejoren su comprensión.
Cuando se habla de preguntas “apropiadas”, nos referimos a aquellas preguntas cuyas respuestas pueden ser útiles para el resto del equipo. Por ejemplo:
“¿Usted quiere que mañana lleguemos quince minutos antes?”
Por otro lado, si usted tiene preguntas referidas únicamente a su propia tarea, a su desempeño, o interés personal, seguramente sea mejor formularlas en sesiones individuales directamente con su supervisor o con su compañero de trabajo. Por ejemplo:
“¿Recibió usted el informe que solicité a la oficina de Antecedentes Médicos ayer por la mañana?”
Protocolo: Las Normas Tácitas
Nos hemos referido anteriormente a la cultura del lugar de trabajo y a la forma en que los propios lugares de trabajo desarrollan sus propias identidades particulares, que pueden no estar incluidas en los manual formales de normativas y procedimientos de la empresa. Otra palabra utilizada frecuentemente en el lugar de trabajo es “el protocolo”.
El protocolo se refiere a cumplidos, modales y procedimientos considerados apropiados para el trato con personas dentro de una organización. Muchas veces se trata de “normas tácitas”.
En la mayoría de los casos, al integrarse a un nuevo puesto, le llevará un tiempo acostumbrarse a la cultura y al protocolo que se estila en su lugar de trabajo. Asuntos tales como la duración de los recesos, la cantidad de días de licencia por enfermedad permitidos, etc. se mencionan en el manual para empleados y se aprenden rápidamente. Pero gran parte del protocolo no se menciona ni se explica en ningún documento escrito. A continuación veremos tres ejemplos.
1. La Autoridad del Supervisor. En la mayoría de las organizaciones se considera un error pasar por encima de su supervisor para tratar problemas de importancia para su departamento. Esta actitud puede interpretarse como una subestimación de la autoridad del supervisor y, por tanto, una violación de las reglas de protocolo. Plantéele los problemas primeramente a su supervisor directo.
2. Asuntos y problemas personales. En la mayoría de los lugares de trabajo se trata de evitar que los miembros del equipo planteen sus asuntos o problemas personales en su lugar de trabajo. Los gerentes y
supervisores alientan a las personas a mantener en privado sus asuntos personales y concentrarse en el trabajo.
Indudablemente usted desarrollará relaciones personales con sus compañeros de trabajo, y se considera perfectamente válido y adecuado el fortalecer estos lazos personales durante las horas de descanso o durante el almuerzo. Generalmente se considera poco profesional hacer hincapié en asuntos personales, especialmente cuando se trata de problemas o reclamos, mientras su equipo intenta conservar un ambiente de trabajo profesional y saludable.
3. Privacidad individual Un buen compañero de equipo sabe respetar la privacidad individual de sus colegas. Esto significa que debe evitar escuchar indiscretamente o entrometerse en los asuntos de otros. Los miembros de un equipo deben sustraerse de hacer bromas o comentarios ofensivos que puedan causar molestias a un compañero. Por sobre todo, ser un buen compañero de equipo significa ser fiel al equipo y evitar comentarios negativos, chismorreos o quejas.
Una actitud negativa socava el espíritu de grupo y su rendimiento, y puede conllevar repercusiones negativas sobre la persona que difunde comentarios y actitudes negativas.
En las siguientes situaciones podría ser necesario tener en cuenta las “normas tácitas” de protocolo:
• discutir detalles acerca de un paciente en un elevador lleno de gente
• usar nombres de pila en lugar de apellidos y títulos.
• hablar o reírse en un tono de voz que perturbe a los demás
• vestirse de manera tal que distraiga permanentemente a los otros y afecte su productividad
¿Qué otras situaciones considera usted que pueden catalogarse como protocolares o ante las cuales deberíamos tener especial cuidado?
Delegar, Compartir y Ayudar
Los equipos dinámicos pueden constituir milagros de productividad, dado que, como lo dice un viejo refrán, en un equipo “el todo es más que la suma de las partes”.
Esto significa que la gran diversidad de los miembros del equipo –es decir sus diversos talentos, niveles de energía, intereses, orígenes culturales y habilidades—hace que el grupo tenga muchas más posibilidades de lograr el éxito que un individuo que trabaje en forma aislada. El supervisor podrá decidir de qué forma el equipo asignará sus recursos, aunque también esta podrá ser una función que realice el propio equipo. Muchos de ellos son equipos autogerenciados, es decir que establecen sus propios acuerdos para delegar, compartir y desempeñar las tareas.
Delegar es el proceso que consiste en asignar y confiar una tarea o responsabilidad a otra persona. En el lugar de trabajo generalmente implica que la persona que tiene a su cargo más tareas o responsabilidades --- normalmente se trata del supervisor --- sea quien asigna o confía tareas a otros miembros del equipo. Dichas persona “delega” el trabajo a quien considere que pueda realizarlo mejor, y a quien tenga la disponibilidad y capacitación adecuadas.
Es perfectamente aceptado ofrecer ayuda, especialmente si el supervisor o integrante del equipo está sobrecargado de trabajo.
Generalmente los equipos buscarán formas de compartir tareas y responsabilidades. Esta es la razón por la cual la comunicación dentro del equipo es tan importante. Los miembros de un equipo deben ser capaces de dividirse las tareas o los conjuntos de tareas, comunicarse entre ellos con claridad acerca de la función que cumplirá cada uno de ellos, y elaborar un plan de trabajo o procedimiento que permita cumplir con la tarea. Esto puede traducirse en una tarea tan simple como ponerse de acuerdo en compartir la tarea durante una breve conversación de pasillo, o sentarse en un salón durante un período de descanso y definir por escrito acciones y plazos que nos permitan cumplir con tareas complejas en tiempo y forma y de acuerdo a las expectativas.
El jefe del equipo podrá determinar que una tarea es demasiado extensa para que la realice una sola persona, y solicitará la conformación de un “mini-equipo” para poder completar dicha tarea. En su función como auxiliar en un consultorio médico, seguramente gran parte de su trabajo surgirá de esta forma. Por ejemplo, un supervisor podría decirle lo siguiente:
“Le he pedido a Federico y Carolina que vuelvan a ordenar toda la facturación de Medicare correspondiente al año pasado, por fecha de facturación, y no por nombre del paciente. Quisiera que usted los ayude como pueda.”
En este caso será su responsabilidad trabajar con los dos miembros de su equipo y recibir instrucciones de parte de ellos.
Los consultorios médicos son lugares muy activos que con frecuencia involucran la ejecución de tareas múltiples, es decir situaciones en las que se deben manejar simultáneamente diversas obligaciones, tareas y acciones.

Un buen miembro de su equipo sabe cómo y cuándo corresponde pedir ayuda para realizar un trabajo. Para ello es necesario:
• saber cuándo usted está “sobrecargado” o se le ha asignado demasiado trabajo y necesita pedir ayuda
• identificar a la persona o las personas adecuadas para solicitar ayuda (puede ser necesario recurrir a su supervisor)
• Pedir ayuda y expresar agradecimiento por la ayuda brindada
“Hoy voy a necesitar algo de ayuda entre las dos y las tres. Si usted pudiese ayudarme durante esa hora, realmente me salvaría la vida.”
Si usted le pide ayuda a una persona y esta no está disponible, pídale que le sugiera otro empleado que pueda hacerlo.
Si usted sigue estos lineamientos, no correrá el riesgo de violar las normas de protocolo cuando solicite ayuda. En su diálogo permanente con su supervisor, esfuércese especialmente por aprender cuándo corresponde o no pedir ayuda, y cuál es la mejor forma de hacerlo.

SCOPE
The main purpose of the BTW 1 Program is to have people become aware of the need to develop a permanent preventive attitude in the streets and roads, as a way to avoid the occurrence of incidents and accidents.
The content of the theoretical activity is directed towards having drivers acquire conscience of the importance to practice a preventive routine, with special emphasis on possibilities and limitations, not only of the drivers, but also of the vehicles, also considering the surrounding area and the different variables that are cause of incidents and accidents. The main objective is to minimize or neutralize the participation of drivers in critical events.
The commitment of the practical phase is to evaluate the driving skills of the employees, offering them the necessary training exercise routine, combining conventional and highly complex situations that are more frequent in traffic.
Therefore, this phase permits us to detect and eliminate incorrect habits and reactions, thus improving the technical and maneuvering capacity of the drivers, as well as generating the due reasoning of existing limitations beyond the experience or ability each driver may have, including vehicle technical knowledge.

OBJETIVO
La finalidad primordial del Programa BTW 1 es sensibilizar a las personas hacia el desarrollo de una actitud preventiva permanente en la vía pública, como forma de evitar la ocurrencia de incidentes y accidentes.
El contenido temático de la actividad teórica esta dirigido a concientizar a los conductores sobre la importancia de practicar una rutina preventiva, subrayándose las posibilidades y limitaciones no solo de los conductores, sino también de los vehículos, considerando incluso al entorno y las diferentes variables que son causa de incidentes y accidentes. El objetivo principal es minimizar o neutralizar la participación de los conductores en eventos críticos.
La fase práctica tiene por cometido valorar la capacidad conductiva los funcionarios entrenándolos en una rutina de ejercicios que combina situaciones convencionales y de alta complejidad, que se presentan en el tránsito con mayor frecuencia.
En consecuencia, esta fase permite detectar y eliminar hábitos y reacciones incorrectas, mejorando la calidad técnica y capacidad de maniobra de los conductores, generando a su vez, la debida reflexión acerca de las limitaciones existentes a pesar de la experiencia y habilidad que pueda tener el conductor y de la tecnología del vehículo.

Why would a baby refuse to take the breast?
There are many reasons a baby might refuse to latch on. Often there is a combination of reasons. For example, a baby might latch on even with a tight frenulum if no other factors come into play, but if, for example, he is also given bottles early on, this may very well change the situation from “good enough”, to “not working at all”.
1. If the mother’s nipples are particularly large, or inverted, or flat, these nipple variations make latching on more difficult, not usually impossible.
2. Some babies are unwilling to nurse, or suck poorly as a result of medication they received during the labour. Narcotics are responsible for many such situations, and meperidine (Demerol) is particularly bad as it stays in the baby’s blood for a long time and affects the way he sucks for several days. Even morphine given in an epidural may cause the baby to be unwilling to nurse or latch on, since medication from an epidural definitely does get into the mother’s blood, and thus into the baby before he is born.
3. Vigorous suctioning at birth may result in babies not sucking properly and not wanting to latch on. There is no need to suction a healthy, full term baby at birth.
4. Abnormalities of the baby’s mouth may result in the baby’s not latching on. Cleft palate, but not cleft lip, causes severe difficulties in latching on. Sometimes the cleft palate is not obvious, affecting only the part inside the baby’s mouth.
5. A tight frenulum (the whitish tissue under the tongue) may result in a baby having difficulty latching on. This is not, strictly speaking, considered an abnormality, and thus, many physicians do not believe that it can interfere with breastfeeding, but they are misinformed.
6. A baby learns to breastfeed by breastfeeding. Artificial nipples interfere with how the baby takes the breast. Babies are not stupid. If they get slow flow from the breast (as is expected in the first few days of life) and rapid flow from the bottle, they will not be confused—many will figure it out quite quickly.
However, one of the most common causes of babies’ refusing to latch on arises from the misguided belief that babies in the first few days must breastfeed every 3 hours, or on some other insane sort of schedule. This results in anxiety on the part of the staff when a baby has not fed, for example, for three hours after birth, which results, frequently, in babies being forced to the breast when they are not ready yet to feed. When the baby is forced into the breast, and kept there by force, when the baby is not interested or ready, we should not be surprised that some babies develop an aversion to the breast. If this misguided approach then results in panic, and “the baby must be fed”, alternative feeding methods (the worst of which is the bottle) are then used, resulting in worsening of the situation and the beginning of a vicious circle.
There is no evidence that a healthy full term newborn must feed every three hours during the first few days. There is no evidence that they will develop low blood sugars if they don’t feed every three hours (the whole issue of low blood sugars has become a mass hysteria in newborn nurseries which, like all hysterias, results from a grain of truth, perhaps, but actually causes more problems than it prevents, including the problem of many babies getting formula when they don’t need it, and being separated from their mothers when they don’t need to be, and not latching on). Babies should be together, skin to skin with their mothers, 24 hours a day (See handout 1a The importance of Skin to Skin Contact). When they are ready, most will start looking for the breast. Having the baby with the mother skin to skin immediately after birth, and allowing the baby and the mother the time to “find” each other, will prevent most situations of the baby not latching on. Mother and baby skin to skin will also keep the baby as warm as being under a heating lamp. Having the baby and mother together for 5 minutes though, is not the answer. The mother and baby should be together until the baby latches on, without pressure, without time limits (“we’ve got to weigh the baby”, “we’ve got to give the baby vitamin K,” etc—these procedures can wait!). This might take 1-2 hours or more.
But the baby is not latching on!
Okay, so how long can we wait? There is no obvious answer to that. Certainly, if the baby has shown no interest in nursing or feeding by 12 to 24 hours after birth, it may be worthwhile to do something, mostly because hospital policies usually require the mother to be discharged by 24 to 48 hours. What can be done?
1. The mother should start expressing her milk, and that milk (colostrum), either alone, or mixed with sugar water, should be fed to the baby, preferably by finger feeding. If it is difficult to get colostrum (often hand expression works better than a pump in the first few days), then sugar water alone is fine for the first few days. With finger feeding, most babies will start sucking, and many will wake up enough to attempt going to the breast. As soon as the baby is sucking well, finger feeding should be stopped and the baby tried at the breast. Finger feeding is essentially a procedure to prepare the baby to take the breast, not primarily a method to avoid the bottle, though it will do that too. Therefore it is done before attempting the baby at the breast, to prepare him to take the breast. See handout #8 Finger Feeding.
2. Before discharge, early, competent help needs to be arranged so that the mother and baby are getting help by day four or five at the latest. Many babies not able to latch on in the first few days will latch on beautifully once the mother’s milk supply has increased substantially as it usually does around day 3 or 4. Getting help at this time avoids the negative associations with the breast that many babies develop as time goes on.
3. A nipple shield started before the mother’s milk becomes abundant (day 4 to 5) is bad practice. Starting a nipple shield before the mother’s milk “comes in” is not giving time a chance to work. Furthermore, used improperly (as I see it often being used), a nipple shield may result in severe depletion of the milk supply.
I’m home from hospital. The baby won’t latch on. What do I do?
The single most important factor influencing whether or not the baby latches on is the mother’s developing a good milk supply. If the mother’s supply is abundant, the baby will latch on by 4 to 8 weeks of life no matter what. What we try to do at the clinic is get the baby latching on earlier, so that you won’t have to wait that long. So, it is more important you keep up your supply, than avoid a bottle. The bottle interferes, and it is better you use other methods (such as a cup) if you can, but if you feel you have no choice, you should do what you need to do.
Learn how to get the best position and latch from an experienced lactation specialist (see also handout A: When Latching and see the videos at www.thebirthden.com/Newman.html). As the baby comes onto the breast, compress the breast so that the baby gets a gush of milk. Try the baby on the breast he seems to prefer, or the breast that has more milk, not the breast he resists more.
• If the baby latches on, he will start sucking and start drinking (get information on how to know a baby is actually getting milk at the breast—see handout #4. Is My Baby Getting Enough Milk? And see the videos at www.thebirthden.com/Newman.html ).
• If the baby doesn’t latch on, don’t try to force him to stay on the breast; it won’t work. He will either get hysterical or “go limp”. Move him away from the breast and start again. It is better to go on-off, on-off several times than to push him into the breast when he hasn’t latched on.
• If the baby goes to the breast and sucks once or twice, he hasn’t latched on a little; he hasn’t latched on at all.
If the baby refuses the breast, don’t keep at it until he’s angry. Try finger feeding a few seconds to a minute or two, and try again, perhaps on the other side. Finger feeding is to prepare the baby to take the breast, not primarily to avoid a bottle.
If the baby doesn’t latch on, finish the feeding with whatever method you find easiest.
Using a lactation aid at the breast may be helpful, but often requires an extra hand.
At about two weeks after birth, a change in what you have been doing often seems to send a message to the baby that “there’s more than one way to do this”. If you have been finger feeding only, a change to a cup or bottle will sometimes work, or using a nipple shield will often work. If you have been bottle feeding only, switching to finger feeding may work (only before attempting the baby at the breast is good enough if finger feeding is too slow, and finishing the feeding with cup or bottle).
How to maintain and increase milk supply
Express your milk as often as is practical, at least 8 times a day, using a reliable pump that expresses both breasts at the same time. Using compression while pumping increases the efficiency of pumping and increases the milk supply (another hand is helpful, but mothers have rigged up the pump so that they don’t have to hold onto the tubing or flanges while pumping and thus can compress without help).
If the baby hasn’t latched on by day 4 or 5, start fenugreek and blessed thistle to increase milk flow. See handout #24. Miscellaneous Treatments. Domperidone may also be useful. See handouts 19a and 19b, Domperidone 1 and 2.
If you must use a nipple shield, do not use one at least until the milk supply is well established (at least 2 weeks after the baby is born). Get good hands on help first.
Do not get discouraged. Even if your milk supply is not up to the needs of your baby, many babies will still latch on. Get good help. Do not do this on your own.

¿Por qué un bebé puede no querer el pecho?
Hay muchas razones para que un bebé se pueda negar a prenderse al pecho. Por lo general hay una combinación de motivos. Por ejemplo, un bebé puede prenderse aun con un frenillo corto, siempre que no haya otros factores en contra; pero si, por ejemplo, se le da mamadera en forma temprana, esto puede muy bien hacer cambiar la situación de “bastante buena” a “totalmente deficiente”.
1. Si los pezones de la madre son particularmente grandes, o están invertidos hacia adentro, o son chatos, esta variante en los pezones puede causar que el agarre del pecho se haga más difícil, aunque no siempre imposible.
2. Algunos bebés no quieren el pecho, o chupan poco, como resultado de alguna medicación que recibieron durante el trabajo de parto. Los narcóticos son los responsables de muchas de estas situaciones y la meperidina (Demerol) es especialmente dañina, ya que permanece en la sangre del bebé durante un largo tiempo y afecta su forma de chupar durante varios días. Hasta la morfina administrada en una epidural puede causar que el bebé no tenga ganas de alimentarse o de prenderse al pecho, ya que la medicación de una epidural definitivamente pasa a la corriente sanguínea de la madre e igualmente a la del bebé antes de su nacimiento.
3. La succión vigorosa al momento de nacer puede resultar en que los bebés no chupen bien o no quieran prenderse al pecho. No hay necesidad de realizar succión en un bebé sano, nacido a término.
4. Las anormalidades en la boca en un bebé pueden causar que no se prenda al pecho. El paladar hendido, pero no el labio leporino, causa dificultades severas para prenderse al pecho. Algunas veces el paladar hendido no es notorio, pues afecta únicamente la parte interna de la boca del bebé.
5. Un frenillo corto (el tejido blanquecino debajo de la lengua) puede acarrear dificultades al bebé para prenderse al pecho. Esto no es considerado una anormalidad, estrictamente hablando, y por tanto, muchos médicos no creen que pueda interferir con el amamantamiento, pero están mal informados.
6. Un bebé aprende a alimentarse por medio del amamantamiento. Los pezones artificiales interfieren en la manera en que el bebé se agarra al pecho. Los bebés no son tontos. Si el flujo que obtienen del pecho es lento (como pasa en los primeros días de vida) y reciben un flujo rápido de la mamadera, no se confundirán —muchos lo entenderán muy rápidamente.
Sin embargo, una de las causas más comunes para que los bebés se nieguen a prenderse surge de la creencia errónea que los bebés en los primeros días deben amamantarse cada 3 horas, o a algún otro tipo de ritmo insano. Esto resulta en reacciones de ansiedad de parte del equipo médico cuando el bebé no se alimenta, por ejemplo, por tres horas luego del nacimiento, lo cual muchas veces trae como consecuencia que los bebés se vean forzados al pecho cuando todavía no están prontos para alimentarse. Cuando el bebé es forzado al pecho y lo mantenemos por la fuerza cuando no tiene interés o no está pronto, no debemos sorprendernos que el bebé desarrolle una aversión al pecho. Si este enfoque erróneo luego termina en pánico, y “el bebé debe alimentarse”, se utilizan entonces métodos de alimentación alternativa (de los cuales el peor es la mamadera), con lo que la situación empeora y es el comienzo de un círculo vicioso.
No hay ninguna evidencia de que un niño sano nacido a término deba alimentarse cada tres horas durante los primeros días de vida. No hay ninguna evidencia de que vayan a desarrollar bajo nivel de azúcares en sangre si no se alimentan cada tres horas (todo el problema de bajos niveles de azúcares en sangre se ha convertido en una histeria masiva en las nurseries de recién nacidos, la que, como todas las histerias, se originan en algunas verdades, quizás, pero realmente causan más problemas de los que previenen, incluyendo el problema de muchos bebés tomando leches alternativas cuando no las necesitan, y terminan siendo separados de sus madres cuando no lo necesitan, y no prendiéndose al pecho). Los bebés deben estar junto con sus madres piel con piel, 24 horas al día (ver el repartido 1a La importancia del Contacto Piel con Piel). Cuando están prontos, la mayoría de ellos empezarán a buscar el pecho. El dejar al bebé con la madre piel con piel inmediatamente después del nacimiento, y darle al bebé y a la madre el tiempo para encontrarse el uno con el otro, prevendrá la mayoría de las situaciones en que el bebé no se prenda al pecho. También el dejar a la madre y al bebé piel con piel mantendrá al bebé tan calentito como si estuviera bajo una lámpara de calor. Sin embargo, el dejar al bebé y la madre juntos por 5 minutos, no es la solución. La madre y el bebé deben estar juntos hasta que el bebé se prenda, sin presiones, sin límites de tiempo (“debemos pesar al bebé”, “debemos darle al bebé vitamina K”, etc. –estos procedimientos pueden esperar). Esto puede llevar 1-2 horas o más.
¡Pero el bebé no se prende!
Ok, ¿cuánto tiempo podemos esperar? No hay respuestas claras a esto. Evidentemente, si el bebé no ha mostrado ningún interés en tomar el pecho ni alimentarse de 12 o 24 horas después del parto, sería conveniente hacer algo, especialmente porque la política de los hospitales establece que se dé el alta a la madre a las 24 o 48 horas. ¿Qué se puede hacer?
1. La madre deberá empezar a sacarse la leche, y esa leche (calostro) se le dará al bebé, o bien sola, o mezclada con agua azucarada, preferiblemente por medio del dedo. Si es difícil de obtener calostro (muchas veces el exprimirse con la mano es mejor que utilizando una bomba en los primeros días), entonces sólo agua azucarada será suficiente durante los primeros días. Mediante la alimentación con el dedo, la mayoría de los bebés empezarán a chupar, y muchos se despertarán lo suficiente para intentar ir hacia el pecho. Tan pronto como el bebé esté chupando bien, se interrumpirá la alimentación por el dedo, y se probará de poner al bebé al pecho. La alimentación con el dedo es esencialmente un procedimiento para preparar al bebé a tomar el pecho, no un método para evitar la mamadera, aunque servirá para esto también. Por lo tanto, se hace antes de intentar poner al bebé al pecho, para prepararlo para tomar el pecho. Ver repartido #8 Alimentación con el dedo.
2. Antes del alta médica, se debe obtener ayuda competente y temprana para que la madre y el bebé tengan la atención necesaria a más tardar el cuarto o el quinto día. Muchos bebés que no son capaces de prenderse al pecho en los primeros días, lo harán divinamente cuando el suministro de la leche de la madre haya aumentado en forma importante, como es habitual hacia el 3er o 4o día. El obtener ayuda en este momento evita que los bebés desarrollen asociaciones negativas con el pecho como pasa con muchos de ellos cuando se avanza en el tiempo. .
3. Un protector de pezón colocado antes que la leche de la madre sea abundante (día 4 ó 5) es mala práctica. El colocar un protector de pezón antes que la leche de la madre empiece a bajar no da tiempo a la posibilidad de que la cosa funcione. Es más, si se utiliza en forma incorrecta (como lo veo usar muchas veces) un protector de pezón puede causar una severa disminución en el suministro de leche.
Estoy en casa de regreso del hospital. El bebé no se prende al pecho. ¿Qué hago?
El principal y único factor que influye para que el bebé se prenda o no al pecho es que la madre tenga un buen flujo de leche. Si el suministro de la madre es abundante, el bebé se prenderá antes de las 4 a 8 semanas, sin que nada importe. Lo que tratamos de hacer en la clínica es que el bebé se prenda antes, para que usted no tenga que esperar tanto. Por tanto, es más importante que mantenga el suministro, que evitar la mamadera. La mamadera interfiere, y es mejor que use otros métodos, (como una taza) si puede, pero si usted siente que no tiene alternativa, debe hacer lo que necesite hacer.
Aprenda cuál es la mejor posición y manera de que el bebé se prenda al pecho, de un especialista experimentado en lactancia (ver repartido A: Cuando el bebé se prende al pecho y vea los videos en www.thebirthden.com/Newman.html. Cuando el bebé venga al pecho comprima el pecho para que el bebé reciba un chorro de leche. Pruebe de colocar al bebé del lado que él parezca preferir, o el pecho que tenga más leche, no el pecho que ofrezca mayor resistencia.
• Si el bebé se prende, empezará a chupar y a tomar (obtenga información de cómo saber si el bebé realmente está tomado leche en el pecho –ver repartido #4 ¿Es que mi bebé está tomando suficiente leche? Y vea los videos en www.thebirthden.com/Newman.html ).
• Si el bebé no se prende, no trate de forzarlo para que permanezca en el pecho, no funcionará. O bien se pondrá histérico o quedará “inmóvil”. Retírelo del pecho y comience de nuevo. Es mejor sacarlo y ponerlo, sacarlo y ponerlo varias veces, que empujarlo hacia el pecho cuando no se haya prendido.
• Si el bebé se acerca al pecho y chupa uno o dos veces, no se ha prendido un poco; no se ha prendido para nada.
Si el bebé rechaza el pecho, no lo deje allí hasta que se enoje. Trate de alimentarlo con el dedo unos pocos segundos hasta uno o dos minutos, y pruebe de nuevo, quizás del otro lado. La alimentación con el dedo es para preparar al bebé para que tome el pecho, no esencialmente para evitar la mamadera.
Si el bebé no se prende, termine de alimentarlo con cualquier método que le resulte más fácil.
Usar un aparato de lactancia en el pecho puede ser útil, pero muchas veces requiere que alguien la ayude.
A las dos semanas después del parto, un cambio en lo que ha estado haciendo muchas veces parece enviar un mensaje al bebé que “hay más de una manera de hacer esto”. Si lo ha estado alimentando sólo con el dedo, un cambio a una taza o mamadera suele a veces funcionar, o utilizando un protector de pezón puede muchas veces funcionar. Si usted lo ha alimentado solamente con mamadera, cambiar por el dedo puede funcionar (sólo antes de ponerlo al pecho es suficiente si la alimentación con el dedo es muy lenta, y terminando la alimentación con taza o mamadera).
Cómo mantener y aumentar el suministro de leche
Exprima el pecho tan frecuentemente como le resulte práctico, por lo menos 8 veces por día, utilizando una bomba confiable que exprima los dos senos a la vez. Utilizando la compresión mientras se bombea aumenta la eficiencia del bombeado e incrementa el suministro de leche (la ayuda de otra persona puede ser útil, pero las madres se las ingenian con la bomba para no tener que sostener los tubos o bordes mientras bombean y así pueden comprimir sin ayuda).
Si el bebé no se ha prendido al 4º. o el 5o. día, comience con Alholva, también conocido por Semillas de Fenogreco (Trigonella foenum-graecum) y Cardo Santo (Benedictus Cnicus) para aumentar el flujo de leche. Ver repartido #24 Tratamientos Varios. La Domperidona puede también ser útil. Ver repartidos 19ª y 19b, Domperidona 1 y 2.
Si usted debe usar un protector de pezón, no use uno por lo menos hasta que el suministro de leche sea pleno (por lo menos 2 semanas después del parto). Obtenga buena ayuda primero.
No se desanime. Aunque el flujo de leche no esté a la altura de las necesidades de su bebé, muchos bebés se prenderán de todos modos. Obtenga buena ayuda. No haga esto sola.

1. Introduction
Holding, financing and licensing companies are treated favourably in the
Netherlands. One of the country’s major tax advantages is the exemption
of qualifying dividends and capital gains from corporate income tax. A
number of amendments to the Dutch Corporate Income Tax Act,
broadening this exemption, were implemented on 1 January 2007.
Moreover, the Netherlands does not levy any withholding tax on royalties
and interest payments (except for payments relating to certain profit
sharing loans or bonds). By virtue of the Netherlands’ extensive network of
tax treaties, it is possible to receive tax free capital gains on shareholdings
and also dividends, interest and royalties may be channelled from one
country to another at a reduced foreign withholding tax rate or without any
foreign withholding tax at all.
2. The participation exemption and its conditions
Under the Dutch participation exemption, dividends derived from shares in
a subsidiary as well as capital gains realised upon the alienation of such
shares are free from Dutch corporate income tax when received by a
corporate taxpayer in the Netherlands; provided, however, that certain
conditions are met. These conditions can be briefly summarized as follows:
a. The corporate taxpayer, on its own or together with a related entity,
must hold at least 5% of the shares in the capital of the subsidiary,
and
b. The subsidiary is not a low taxed passive company.
Should a subsidiary be considered as a low taxed passive company,
dividends and capital gains relating thereto are fully taxable with Dutch
corporate income tax. However, the foreign profit taxes paid by the
subsidiary may be credited in accordance with certain credit mechanisms.
An annual mark-to-market revaluation applies to substantial (25% or more)
investments in low taxed passive companies, provided the assets of the
subsidiary consist, directly or indirectly, of 90% or more of portfolio
investments.

3. The subsidiary is not a low taxed passive company
In order for a subsidiary not to be considered a low taxed passive company,
one of the following three conditions must be met:
3.1 The profits of the subsidiary calculated according to Dutch tax
rules are effectively subject to a tax rate of more than 10% (“effective
tax rate test”);
3.2 Less than 50% of the assets of the subsidiary qualify as freely
disposable portfolio investments (“the portfolio investment test”), or
3.3 More than 90% of the subsidiary’s assets are real estate assets.
3.1 Effective tax rate test
The taxable profit of the subsidiary must be determined as if Dutch tax
rules applied. This results in a certain “fictitious Dutch profit”. Should the
fictitious Dutch profit have been taxed at a rate equal up to or greater than
10% (in principle ignoring any applicable foreign tax loss carried forward
and carried back, foreign group relief and foreign tax relief rules), the
participation exemption applies.
3.2 The portfolio investment test
For the purpose of the portfolio investment test, the fair market value of
the assets of the subsidiary of the Dutch resident company claiming the
participation exemption may not consist, for more than 50%, of freely
disposable portfolio investments. Assets are regarded as freely disposable
portfolio investments if they are merely held with a view to their expected
return on investment, and not because they are necessary for the
continuation of a business activity. According to the Dutch State Secretary
of Finance, this is a dynamic test that must be applied within the context of
the business of the subsidiary. For example, real estate that is in use as a
factory within the enterprise of the subsidiary is not held as a freely
disposable portfolio investment. Marketable securities are likely to be
regarded as freely disposable portfolio investments, unless, for instance,
such securities are owned by an insurance company and are held for the
purpose of covering obligations under insurance policies.
When the subsidiary holds an interest of less than 5% of the issued shares

of another company, this is considered to be a portfolio investment. If the
subsidiary holds an interest equal to or greater than 5% in another
company, the assets (and not the liabilities) of this other company are
allocated, on a pro rata basis, to the subsidiary. For example: in the case of
a 40% interest, 40% of the assets of that other company will be allocated to
the subsidiary. After the allocation of the assets, the character of the assets
will determined as outlined above.
If a foreign subsidiary’s activities relate, directly or indirectly and to an
extent greater than 50%, to the direct or indirect financing of entities
related to the corporate taxpayer or assets of such entities, including
making use thereof or providing the right of use in relation to them, the
subsidiary’s assets are considered to be freely disposable portfolio
investments, unless it can be shown that the activities of the foreign
subsidiary should be considered as active financing activities according to
certain conditions set by ministerial decree.
4. Transitional rule
Transitional rules apply to Dutch corporate income taxpayers no longer
entitled to the participation exemption regime with respect to certain
shareholdings due to the legislative changes effective on 1 January 2007.
Under this transitional rule, if dividends or capital gains received by a
Dutch company stem from the period prior to 1 January 2007, the
participation exemption shall still apply to such dividends or capital gains,
although the dividends or capital gains were actually received after 1
January 2007. Also, grandfathering rules may apply to participations of less
than 5% that qualified prior to 1 January 2007.

Translation - Spanish REGIMEN DE EXENCION DE HOLANDA
1. Introducción
En Holanda, las compañías tenedoras, de financiamiento y licenciatarias gozan de ciertos beneficios. Una de las mayores ventajas impositivas del país es la exención del impuesto a la renta corporativa sobre dividendos elegibles y ganancias de capital. Una serie de enmiendas aplicadas a la Ley de Impuestos Corporativos de Holanda mediante las cuales se amplió esta exención, fueron puestas en vigencia a partir del 1º de enero de 2007. Asimismo, Holanda no aplica ninguna tasa de retención sobre regalías ni sobre el pago de intereses (con excepción de aquellos pagos vinculados con ciertas rentas de préstamos o bonos compartidos). Debido a la amplia red de tratados holandeses sobre impuestos, es posible recibir ganancias de capital exentas de impuestos sobre la tenencia de acciones. También pueden canalizarse de un país a otro dividendos, intereses y regalías aplicando una tasa de retención extranjera reducida o sin la aplicación de ninguna tasa de retención extranjera.
2. Régimen de exención y sus condiciones.
En el marco del régimen de exenciones de participación, los dividendos provenientes de acciones de una subsidiaria, así como la renta de capital obtenida de la enajenación de estas acciones, están exentos del impuesto a la renta corporativa holandesa, cuando son recibidos por un contribuyente corporativo en Holanda; sin embargo, esto es así siempre y cuando se cumplan determinadas condiciones. Dichas condiciones se describen brevemente a continuación:
a. El contribuyente corporativo, ya sea actuando individualmente o vinculado a una entidad relacionada, debe poseer como mínimo el 5% de las acciones dentro del capital de la subsidiaria, y
b. La subsidiaria no debe ser una compañía pasiva que se beneficia de una tasa impositiva reducida.
Si la subsidiaria es considerada una compañía pasiva que se beneficia de una tasa impositiva reducida, el impuesto corporativo holandés sobre dividendos y ganancias de capital es aplicable en su totalidad. Sin embargo, el impuesto a la renta extranjero pago por la subsidiaria puede ser descontado en conformidad con determinados mecanismos de crédito.
En aquellas compañías pasivas a las que se aplican tasas impositivas reducidas, un ajuste anual del valor corriente del mercado se aplica a las inversiones importantes (del 25% o más), con la condición de que los activos de la subsidiaria representen, directa o indirectamente, el 90% o más del portafolio de inversiones.
3. La subsidiaria no es una compañía a la que se aplican tasas impositivas reducidas.
Para que una subsidiaria no sea considerada una compañía pasiva con tasas impositivas reducidas, debe cumplir con una de las tres condiciones descriptas a continuación.
3.1 La renta de la subsidiaria calculada de acuerdo a la regulación holandesa de impuestos está efectivamente sujeta a una tasa impositiva mayor al 10% (“prueba efectiva de tasa impositiva”);
3.2 Menos del 50% de los activos de la subsidiaria cumplen con las condiciones necesarias para integrar la cartera de valores de inversión libremente disponibles (“prueba de cartera de valores de inversión”), o
3.3 Más del 90% de los activos de la compañía son activos inmobiliarios.
3.1 Prueba para determinar la tasa impositiva efectiva
La renta de la subsidiaria sujeta a impuestos, se debe determinar tal como si se aplicara la reglamentación impositiva holandesa. Esto resulta en una cierta “renta ficticia holandesa”. En caso que a la renta ficticia holandesa se le hubiese aplicado una tasa impositiva igual o mayor a 10% (ignorando, en principio, toda pérdida de impuesto extranjero aplicable correspondiente a años anteriores o a años subsiguientes, cualquier regla de exención aplicable a un grupo extranjero y toda ley de alivio impositivo aplicable a tasas extranjeras), entonces la exención de participación es aplicable.
3.2 Prueba para definir la cartera de valores de inversión
Para realizar la prueba de portafolio de inversión, el valor real de mercado de los activos de la subsidiaria de la compañía residente en Holanda que reclama la exención de participación, no debe estar integrado, en más del 50%, por una cartera de valores de inversión libremente disponibles. Los activos se consideran parte de la cartera de valores de inversión libremente disponibles si el mero objetivo de su tenencia es obtener el esperado retorno de inversión y no son vistos en cambio como imprescindibles para perpetuar la actividad de la compañía. Según opina el Ministro de Finanzas de Holanda, se trata de una prueba dinámica que debe aplicarse dentro del contexto del negocio de la subsidiaria. A título de ejemplo, la propiedad inmobiliaria que se utiliza como planta industrial dentro del emprendimiento de la subsidiaria, no se considera integrante de la cartera de valores de inversión libremente disponibles. Los valores convertibles en el mercado sí pueden ser considerados dentro de la cartera de valores de inversión libremente disponibles, excepto, y a título de ejemplo, si estos valores pertenecen a una compañía de seguros y su tenencia tiene como objeto el cumplimiento de obligaciones inherentes a la política de seguros.
Cuando la subsidiaria tiene un interés inferior al 5% del total de las acciones emitidas por otra compañía, se considera una cartera de valores de inversión. Si la subsidiaria tiene un interés igual o mayor al 5% en otra compañía, los activos (y no el pasivo) de esta otra compañía se asignan y distribuyen, en forma prorrateada en la subsidiaria. A título de ejemplo: en el caso de un 40% de interés, 40% de los activos de la otra compañía serán asignados a la subsidiaria. Luego de la asignación y distribución de los activos, el rol de dichos activos se determinará según se ha descrito anteriormente.
Si las actividades de una subsidiaria extranjera se relacionan directa o indirectamente en un porcentaje mayor al 50%, con la financiación directa o indirecta de entidades vinculadas al contribuyente corporativo o a los activos de dichas entidades, incluyendo el derecho de usufructo de ellas, o el derecho a ofrecer su usufructo, los activos de la subsidiaria se consideran integrantes de la cartera de valores de inversión libremente disponibles, salvo en caso que sea posible demostrar que las actividades de la subsidiaria extranjera deben ser consideradas actividades activas de financiamiento, en conformidad con ciertas condiciones establecidas por decreto ministerial.
4. Reglamento de transición
El reglamento de transición se aplica a contribuyentes holandeses de renta corporativa que, como consecuencia de cambios legislativos vigentes al 1º de enero de 2007,ya no tengan derecho a adherirse al régimen de exención de participación aplicables a la tenencia de ciertas acciones. Bajo esta reglamentación de transición, si los dividendos o ganancias de capital percibidos por una compañía holandesa provienen del período anterior al 1º de enero de 2007, el régimen de exención de participación será aplicable de todas formas a dichos dividendos o ganancias de capital, a pesar de que los dividendos o ganancias de capital hayan sido efectivamente percibidos después del 1º de enero de 2007. Asimismo, una reglamentación de beneficio especial puede aplicarse a las participaciones inferiores al 5% que calificaron con anterioridad al 1º de enero de 2007.
