Texto de origen - inglés 1. CONTROL OF DAMAGED GOODS
Where subject matter insured is damaged and/or has been exposed to circumstances that has or may have led to its integrity being breached then with the consent of the Assured the damaged and/or compromised items are to be repaired and the cost of such repair shall, subject otherwise to the terms and conditions of this cover, be recoverable hereunder.
If, in the opinion of the Assured in consultation with independent specialists and the Insurer, repair of the subject-matter insured would not restore its absolute integrity then, subject to the consent of the Assured, the damaged and/or compromised items are to be sold or otherwise disposed of and the proceeds paid to the Insurer against the settlement of a claim for constructive total loss.
In no case shall the Insurer's liability exceed the insured value of the item.
2. EXPEDITING PLUS ADDITIONAL REPAIR EXPENSES
In the event of loss or damage to the subject matter insured, the Insurer agree to pay costs of expediting the damaged goods to manufacturers for repair and return or the expediting of replacement goods from suppliers to destination notwithstanding the original mode of transportation.
In addition to ordinary costs for repair or replacement, the Insurer shall indemnify the Insured in respect of extra charges for restoring the goods such as overtime work, production costs, express freight and airfreight and similar costs, when such costs are incurred in connection with an indemnifiable loss or damage insured hereunder.
Traducción - español 1. CONTROL DE BIENES DAÑADOS
Cuando el objeto asegurado es dañado y/o ha sido expuesto a circunstancias que hayan o puedan haber llevado a la ruptura de su integridad, los bienes de esta forma dañados y/o comprometidos deberán ser reparados, con el consentimiento del Asegurado, y el costo de dicha reparación será recuperable conforme a este seguro, sujeto a los términos y condiciones de esta cobertura.
Si, a juicio del Asegurado, en consulta con especialistas independientes y el Asegurador, la reparación del objeto asegurado no restablecería su integridad absoluta, siempre sujeto al consentimiento del Asegurado, los ítems dañados y/o comprometidos deberán ser vendidos o de alguna forma enajenados y lo recaudado deberá ser pagado al Asegurador contra el pago de un reclamo por pérdida total constructiva.
La responsabilidad del Asegurador no excederá en ningún caso el valor asegurado del objeto.
2. GASTOS DE ENVÍO MÁS REPARACIÓN ADICIONAL
En caso de pérdida o daño al objeto asegurado, el Asegurador acepta pagar los gastos de envío de los bienes dañados a los fabricantes para su reparación y devolución o el envío de bienes de reemplazo desde los proveedores hasta el destino, no obstante el modo original de transporte.
Además de los gastos normales para la reparación o el reemplazo, el Asegurador deberá indemnizar al Asegurado por los gastos extra para restaurar los bienes tales como las horas extraordinarias de trabajo, los costos de producción, el flete expreso y aéreo y gastos similares, cuando tales gastos se incurren en relación con una pérdida o daño indemnizable asegurados por esta póliza.
