Texto de origen - inglés Selective globalization of trade, rapid movement of savings and investments in and out of countries, to take advantage of interest rates and currency fluctuations, and the concentration of scientific and technological knowledge in a reducing number of large companies and quasi-government institutions, stands to reduce, instead of increase legitimate competition on which so much of Western economic promise is anchored.
Sequestering S&T in a few centres is not only reducing the number of independent choices on an international scale, but is also affecting the sharing of information on which the scientific establishment has flourished since its inception, and indeed, on which benefits have flowed to the developing countries.
The fact that four out of the five most valuable companies in the world are in the communications industry, highlights the social power of media conglomerates. The compression of time and space by these mega corporations has created conditions which crowd out local voices, which do not have access to the powerful information technologies which these companies posses. Even conventional technologies, like the telephone, are still concentrated in eight industrialised countries which boast 75% of the 5 world’s units. Also, the cost of simple batteries for radios are relatively so high, that radio technology, which was supposed to have allowed scattered poor populations to be connected with their societies, is still a luxury for most of these citizens.
Industrial property rights, which are the main coercive instruments of the privileged, have been so overplayed, that instead of being a stimulus for research and development (R&D) and innovation, they threaten to shut down the exchange of information, which is pivotally crucial to the scientific process. Current information generation is so rapid that to restrict knowledge flows is to make them obsolete before they are maximally deployed. Needless to say, strong industrial property rights stifle innovation by increasing transaction costs. The one-sided nature of these developments is reflected in the fact that over zealous intellectual property positioning of the first world has sought to patent knowledge once freely available to the developing countries. While at the same time, the traditional knowledge of the poor, and the use of their biological resources, are portrayed as communal property, open for all comers.
The pound of flesh approach to industrial property has already begun to have untoward effects. For example, to acquire equity and maintain fairness, the poorer countries have taken steps to protect their biodiversity and control what they consider bio-piracy by wealthy concerns. Unfortunately, their biodiversity export laws have tended to restrict the supply of seeds to seed banks, which were valuable repositories for tropical research, and from which many important new varieties of food crops have arisen. The green revolution, which now feeds some 500 million people, and adds some US$50 billion a year to the developing country’s food economy, appears now in jeopardy.
The old open system which has benefited both the rich as well as the poor is being overthrown without being adequately replaced. There are several examples of the rich countries benefiting from what obtained, among these are, plant varieties taken from Central America and West Asia to North America and Europe, breeding stocks from East Africa to Australia, forage grasses from South America to almost everywhere, and African fish now are being farmed in the fjords of Scandinavia. Determining the genome sequences of food crops, such as soya, which has its widest biodiversity in China, creates the potential for those who conduct the work, proclaiming dominion over the entire resource. These excesses of the current intellectual property rights system essentially are throwing out the baby with the bath water, and the poor and the rich stand to loose significantly.
Traducción - español La globalización selectiva del comercio, el rápido movimiento de ahorros e inversiones hacia y fuera de los países, para tomar partida de las tasas de intereses y la fluctuación en los mercados monetarios, y la concentración del conocimiento científico y tecnológico en un cada vez más reducido número de empresas grandes e instituciones seudo gubernamentales, sirve para reducir, en vez de incrementar, la competencia legítima en la cual mucho de la promesa económica de occidente está basada.
Apropiando la ciencia y tecnología (S&T por sus siglas en inglés) a unos cuantos centros no está solamente disminuyendo el número de opciones independientes a una escala internacional, sino que también está afectando la colaboración de información en la cual el establecimiento científico ha prosperado desde sus comienzos, y efectivamente, en base a lo que los beneficios han fluido hacia los países en vías de desarrollo.
El hecho de que cuatro de las cinco empresas más valiosas en el mundo están en la industria de las comunicaciones resalta el poder social de los conglomerados en medios de comunicación. La compresión de tiempo y espacio por estas mega corporaciones han creado situaciones que aprietan las voces locales, las cuales no tienen acceso a las poderosas tecnologías informáticas que estas empresas poseen. Aún las tecnologías convencionales, como el teléfono, todavía están concentradas en ocho países industrializados quienes ostentan 75% de las 5 unidades mundiales. Además, el costo de las simples baterías para radios es relativamente tan alto que la tecnología de la radio, que supuestamente habría permitido que poblaciones pobres desperdigadas se conecten con sus sociedades, es aún un lujo para la mayoría de sus ciudadanos.

Texto de origen - español ARTICULO 20. CARACTER DE INDEPENDENCIA
La invalidez o la no aplicabilidad de cualquiera de los Artículos de este contrato no afectarán de ninguna forma la validez o cumplimiento de ninguno de los demás artículos o partes del mismo. Cualquier cláusula inválida o que no pueda cumplirse será considerada excluida de este contrato y el resto del contrato será interpretado y ejecutado como si el contrato no tuviera esa porción o cláusula inválida o sin aplicabilidad.
ARTICULO 21. CONDICION RESOLUTORIA EXPRESA.
Todas las causas por virtud de las cuales en este contrato se establece la facultad de terminación del contrato por decisión unilateral de LA COMPAÑIA se entienden pactadas como CONDICION RESOLUTORIA EXPRESA por determinación de LA COMPAÑIA. En consecuencia el contrato terminará con la comunicación de LA COMPAÑÍA en los eventos y bajo los respectos prevenidos en el ARTICULO 14 de este contrato.
ARTICULO 22. PENA PECUNIARIA (NO APLICA)
El incumplimiento total o parcial de los plazos pactados de ejecución de LOS TRABAJOS objeto del presente contrato, facultarán a LA COMPAÑIA para imponerle la siguiente pena pecuniaria a EL CONTRATISTA, a saber:
En caso de retrasos imputables a EL CONTRATISTA en la ejecución y terminación de LOS TRABAJOS, se aplicará un descuento del 1% del valor total del trabajo (valor Orden de Trabajo) por cada semana de atraso a partir de la fecha de finalización indicada en este contrato, hasta el límite del 10%, superado el cual se accederá sin más a la Rescisión por Causas imputables al CONTRATISTA.
Los retrasos no imputables a EL CONTRATISTA y/o aquellos ocasionados por causas de fuerza mayor de acuerdo al Artículo 12 del presente contrato, no serán contabilizados en el cálculo del
retraso para los efectos de esta cláusula.
"incumplimiento parcial" se refiere a hitos de cumplimiento intermedio, claramente definidos en el Cronograma de Trabajos

The invalidity or unenforceability of any of the Articles of this contract shall not affect, in any way, the validity, or enforceability of any other items or parts thereof. Any invalid clause or that cannot be met shall be deemed severable from this contract and the rest of the contract shall be construed and enforced as if the contract did not have that invalid or not applicable portion or clause.
ARTICLE 21. IMPLICIT DISSOLVING CONDITION
All causes, by virtue that in this contract the termination of contract by unilateral decision of COMPANY, are understood as agreed as IMPLICIT DISSOLVING CONDITIONS by determination of COMPANY. Pursuant to this, the contract shall end with the notice from COMPANY in the situations and under the circumstances provided in Article 14 of this contract.
ARTICLE 22. PECUNIARY PENALTY (NOT APPLICABLE)
Total or partial beach of the terms agreed for the execution of the WORK under this contract shall entitle COMPANY to impose the following monetary penalty to CONTRACTOR, namely:
In case of delays attributable to CONTRACTOR in the implementation and completion of the work, a discount of 1% of total value of the work (value of the Work Order) for each week of delay from the completion date shown in this contract shall be applied, up to the limit of 10%. Once this is reached, termination by reasons attributable to CONTRACTOR shall be invoked.
Delays not attributable to CONTRACTOR and/or those caused by force majeure in accordance with Article 12 of this contract will not be counted in the calculation of the delay for the purposes of this clause.
“Partial breach” refers to fulfillment of intermediate milestones, clearly defined in the Work Schedule.

El contratista debe suministrar toda la mano de obra especializada, el suministro de todos los materiales, herramientas, maquinarías y equipos, incluido su mantenimiento y reparación e insumos y repuestos, transporte del personal del Contratista desde y hacia su lugar de trabajo; el combustible, su alimentación y todo lo necesario para la correcta, segura y oportuna ejecución y supervisión de los trabajos descritos en los alcances de obra encargados mediante OT de acuerdo a las especificaciones, bases técnicas, documentos, planos, gráficos, etc., preparados para tal fin en dicho documento. El Plazo de movilización de los recursos solicitados en una OT aprobada será de 5 (cinco) días calendarios luego de recibida y aceptada la OT por el Contratista. En general el contratista deberá proveer:
• Supervisión, Control Técnico, verificación y confirmación del cumplimento de las especificaciones y planos de los trabajos asignados, cumplir con los estándares del Proyecto.
• Efectuar todos los cálculos, cuantificaciones, estimación de recursos que sean necesarias previa a la ejecución de las obras, de acuerdo con los controles establecidos en cada Orden de Trabajo que serán a Tarifa Horaria. Los recursos estimados indicados en las Ordenes de Trabajo son solo referenciales, el valor reconocido al contratista por cada Orden de Trabajo corresponderá a la totalidad de los recursos debidamente aprobados por el representante de LA COMPAÑÍA por medio de los reportes diarios correspondientes.
• En caso justificado, en que se establezca que existen recursos de Personal y/o Equipo Stand-By no atribuible al Contratista, se deberá indicar en los Reportes Diarios y evaluar a las tarifas del contrato.
• Recursos computacionales y personal calificado para los trabajos solicitados de acuerdo a las especificaciones y requerimientos del Proyecto.
• Entregar reportes diarios del personal y equipo asignado, indicando las actividades realizadas, para cada obra en ejecución, resúmenes de los trabajos desarrollados en reportes diarios, semanales y mensuales.

The limit for mobilization of resources requested in a WO will be five (5) calendar days after receipt and acceptance of the WO by Contractor. In general, Contractor shall provide:
• Supervision, technical control, verification and confirmation of compliance with specifications and assigned job drawings, and Project standards
• Perform all calculations, quantifications, estimates of required resources prior to the execution of the works, in accordance with the controls established in each Work Order that will be based on Hourly Rates. The estimates of resources shown in the Work Orders are only for reference; the amount to be recognized to Contractor for each Work Order shall be for all of the resources duly approved by the COMPANY representative through the corresponding daily reports.
• If it is determined and justified that there are staff resources and/or stand-by equipment not attributable to Contractor, this shall be indicated in the Daily Reports and evaluated at the contract rates.
• Computer resources and qualified personnel for the works requested in accordance with the specifications and requirements of the Project.
• Deliver daily reports of assigned personnel and equipment, showing the activities carried out for each work being executed; summaries of the ongoing jobs in daily, weekly and monthly reports.

PRIMERO: Los objetivos generales que orientarán el presente Memorando de Entendimiento son:
a. Establecer relaciones de cooperación y entendimiento entre el IXXXX, el YYYY y la XXX, con el fin de apoyar la promoción y desarrollo del talento humano y formación profesional.
b. Impulsar el desarrollo institucional mediante una alianza estratégica de largo plazo para la generación, intercambio y transferencia conjunta de conocimientos y tecnologías.
c. Realización de acciones y servicios de formación profesional y asistencia técnica en los diversos campos tecnológicos que se requieran.
SEGUNDO: Las acciones de cooperación y asistencia técnica que se impulsarán en el marco de este Memorando de Entendimiento, serán el resultado de la iniciativa común de Las Partes y según las posibilidades concretas de financiamiento, enmarcadas dentro de los objetivos generales del presente documento.

SIXTH: Any party may withdraw from this Memorandum at any time and thus terminate its effect by written notice to the other party.

Texto de origen - español 1.- FIANZAS DE CUMPLIMIENTO Y DE PAGO
Antes de la iniciación de los trabajos EL CONTRATISTA contratará con una compañía de Seguros legalmente constituida y aceptada por la COMPAÑÍA las pólizas y fianzas que a continuación se indican con garantías que mantendrá vigente en cuanto al monto y término que allí se expresa, en las cuales el Asegurado y Beneficiario será la COMPAÑÍA y en ellas constará que no podrán cancelarse, rescindirse ni modificarse sin autorización y conocimiento previos de la COMPAÑÍA.
1.1 El Contratista deberá presentar la fianza de cumplimiento y la fianza de pago dentro del término de diez (10) días hábiles siguientes al perfeccionamiento del contrato.
1.2 La COMPAÑIA sólo aprobará y aceptará fianzas de cumplimiento y de pago cuando sean emitidas por una “Aseguradora Autorizada”.
1.3 Se entiende por “Aseguradora Autorizada”, toda compañía de seguros legalmente establecida en la República de Panamá y autorizada por la Superintendencia de Seguros de la República de Panamá para suscribir negocios de fianzas
1.4 La fianza de cumplimiento garantiza el cumplimiento del contrato u obligación de ejecutar fielmente su objeto, y una vez cumplido éste, de corregir los defectos a que hubiere lugar. La cobertura de la fianza será del (30%) del monto del contrato. Su vigencia corresponde al período de ejecución del contrato principal más un término de un (1) año tratándose de bienes muebles para responder por vicios redhibitorios, tales como mano de obra, material defectuoso o cualquier otro vicio o defecto en la cosa objeto del contrato, y por el término de tres (3) años para responder por defectos de construcción o de reconstrucción de obra o bienes inmuebles.
1.5 La fianza de pago garantiza el pago a terceros por servicios de mano de obra prestados y suministros de bienes utilizados en la ejecución del contrato principal. Su monto corresponderá al veinte por ciento (20%) del monto del contrato. Su período de vigencia corresponderá al período de ejecución del contrato, más el término de ciento ochenta (180) días contados a partir de su recibo a satisfacción por la COMPAÑIA

Before the commencement of the work, CONTRACTOR shall contract with an insurance company legally incorporated and accepted by THE COMPANY for the policies and bonds that are indicated below. Such guarantees shall remain in effect for the amount and term therein indicated, in which the Insured and the Beneficiary would be THE COMPANY. Such guarantees shall state that they cannot be cancelled, terminated, or modified without prior authorization and knowledge of THE COMPANY.
1.1. The CONTRACTOR shall submit the performance bond and the payment bond within ten (10) business days following the signature of the contract.
1.2. The COMPANY will only approve and accept performance and payment bonds issued by an “Authorized Insurer.”
1.3. The term “Authorized Insurer” means any insurance company legally established in the Republic of Panama and authorized by the Superintendencia de Seguros of the Republic of Panama to subscribe guarantee transactions.
1.4. The performance bond guarantees the performance of the contract or obligation to execute its purpose faithfully, and once it is completed, the correction of defects that may arise. The coverage of the bond will be thirty percent (30%) of the contract amount. Its validity will be for the period of execution of the principal contract plus a term of one (1) year, in the case of movable property to answer to redhibitory defects such as labor, material defects, or any other defect subject to the contract. If the recovery of the vehicle is necessary a mechanic must be appointed to ensure a thorough risk assessment of the intended activity is completed and a Job Safety & Environment Analysis (JSEA) has been developed that has adequate controls in place to manage the risks such as other traffic interactions, overloading and failure of slings and other recovery devices, proximity of people and potential collision, etc. The identified competent person must personally supervise the recovery operation to coordinate the operation and ensure adherence to the JSEA.
When a vehicle is disabled on a roadway the operator shall:
• Pull over well to the right or completely off the road if a safe area is available. Park and activate the emergency flashers.
• Notify your supervisor;
• Position warning devices such as triangles;
• Provide traffic control, if warranted and safe to do so; and
• Do not abandon the vehicle, if the vehicle’s position presents a hazard to traffic.
Personnel must not work on roadways without:
• Reflective clothing that meets the site requirements;
• A risk assessment of the work or operation, and of any proposed changes to traffic flows that may be required;
• Controls in place to manage the risks identified in the risk assessment. These may include notification and communication, warning signs, lighting and traffic control systems to manage the risks of collision between light vehicles/equipment and people; and
Drivers and operators must exercise considerable caution in the vicinity of road construction and maintenance activities including but not restricted to road watering, grading, rolling, etc. The usual positive radio communications for entering working areas, overtaking and give way rules apply.

Louisiana State University and Agricultural and Mechanical College had its origin in certain grants of land made by the United States government in 1806, 181 I, and 1827 for the use of a seminary of learning. In 1855, the Legislature founded the Louisiana State Seminary of Learning and Military Academy, locating it at Pineville, Louisiana. The institution was opened January 2, 1860, with Col. William Tecumseh Sherman as Superintendent. Its exercises were suspended June 30, 1861, on account of the Civil War. It was reopened April I, 1862, with Col. William E. M. Linfield as acting superintendent, who was succeeded in office, April I, 1863, by Professor William A. Seay. It was again closed on April 23,
1863, due to the invasion of the Red River Valley by the Federal Army. The losses sustained by the institution during the war were heavy, and it began again with bare walls. The Seminary reopened October 2, 1865, with Col. David F. Boyd as Superintendent. The college building was burned October 15, 1869, and on November I, 1869, the institution resumed its exercises in Baton Rouge, where it has since remained.
In 1870, the name of the institution was changed to Louisiana State University.
Louisiana State Agricultural and Mechanical College was established by an Act of the Legislature, approved April 7, 1874, to carry out the United States Act of 1862, granting lands for this purpose. It temporarily opened in New Orleans, June I , 1874, where it remained till its merger with the University. On January 2, 1877, the Act, as passed by the Legislature in 1876, uniting the State University and the Agricultural and Mechanical College, and locating the same temporarily at Baton Rouge, became a law; and it was duly promulgated June I, 1877. The two state institutions began their first joint session on October 5, I 877, under the name and legal title of the Louisiana State University and Agricultural and Mechanical College- the name it retains today.
First Baton Rouge home of LSU was in the quarters of the School for the Deaf. In 1886, the federal garrison grounds (now the site of the state capitol) were formally declared the domicile of the University. Land for the present campus was purchased in 1918, construction was begun in 1922, and the move was begun in 1925; it was not, however, until 1932 that the move was finally completed. Formal dedication of the present campus took place on April 30, I 926. After some years of enrollment fluctuation, student numbers began a steady increase, new programs were added, curricula and faculty were expanded, and from chaotic and humble beginnings a true state university emerged.
The major academic divisions were founded as follows: Law School, 1906; the Colleges of Agriculture, Arts and Sciences, Education, and Engineering, 1908; the Graduate School, 1909; the Division of Continuing Education, 1924; the College of Business Administration, 1928; the Graduate School of Library Science, the College of Chemistry and Physics, and the School of Music, 1931; Junior Division, 1933; the School of Social Welfare, 1937; University College, 1951; the School of Veterinary Medicine, 1968; the Graduate Division of Education, 1970; General College, 1974; and the College of Design, 1979 (originally founded in 1965 as the School of Environmental Design). In 1977, the Law Center (formerly the Law School) was made an autonomous division of the LSU System.
In 1978, LSU was named a sea grant college-the 13th university in the nation to be so designated and the highest classification attainable in the program.
