Caución sustitutoria

español al inglés Jurídico/Patentes Derecho: (general)
This is in the conclusion of a legal report in Spain...

Lisa Mann (asker) Sep 19, 2006:
further explanation A little later in the text it says this:

Sorry, it should say "that operates in lieu of..." I don't know what's wrong with my typewriting...

(posting of) bond in lieu of provisional remedies (or) injunction

I know this question has been closed, but for the sake of the glossaries I would like to offer this translation and explanation, which is what is actually meant in Spain by "caución sustitoria". There is a common ellipsis here, since "caución sustitutoria" actually means "caución sustitoria de las medidas cautelares", i.e., the posting of a bond in lieu of the provisional remedies (injunction, etc.) that one party may request be levied against the other. In certain cases a judge will allow the party who can show that he would be unduly injured by a provisional remedy ("medida cautelar") to substitute that measure for a bond posted with the court.

Thus, in your text the speaker states that an urgent modification of the Court's decision is required and indicates that this may be achieved by three means: a) by filing an appeal, b) by posting a bond in lieu of the provisional remedies, or c) by amending the remedies. (The reference to "medidas" refers to "medidas cautelares" and the "caución sustitoria" is "caución sustitoria de las medidas cautelares").

This ellipsis is obviously not used in the Spanish Civil Procedure Act (Ley the Procedimiento Civil 1/2000) which provides for a "caución sustitutoria de las medidas cautelares" in the following terms:

CAPÍTULO V.
DE LA CAUCIÓN SUSTITUTORIA DE LAS MEDIDAS CAUTELARES

Artículo 746. Caución sustitutoria.

No problem, Alex, it's just that I spotted this as a "Spain-specific" question and since I recently finished reading the LEC 1/2000, well the term "caución sustitoria" sort of rang a bell in my head.
