disagree  Luis Arri Cibils: Your references simply show that those documents were initialed, not that rubricar is "to put the initials" One for instance talks that the corrections to a doc. were initialed; other than a preliminary pact was "initialed" and sealed with a handshake.

Me quedé pensando e investigué un poquito.

En rigor de verdad la rúbrica no es ni la firma ni la inicial. En rigor de verdad rúbrica es un "rasgo, trazo que completa las letras de la firma. Es una costumbre poner la rúbrica a continuación o debajo del nombre o apellido. En ciertas actuaciones judiciales y administrativas, el funcionario público se limita a rubricar, sin necesidad de poner la firma".... Es decir ni firma, ni inicial, sino un "firuletito" después de la firma.

Diccionario Jurídico de Cabanellas (aclaro que NO es el bilingüe).

PERO, el uso determina que la rubrica sea la firma.

Acaban de llegar abogados de uno de nuestros estudios para la rúbrica y todos entendemos que vienen para la firma de un contrato.

Ratifico mi agree que expresé más arriba, pero me pareció interesante agregar estos datos.

Aclaración, dos puntos:

A ver si así queda más claro...


1) QUÉ ES RÚBRICA \"EN RIGOR DE VERDAD\":

Rasgo, trazo que completa las letras de la firma. Es costumbre poner la rúbrica a continuación (o debajo) del nombre o apellido. En ciertas actuaciones judiciales y otras administrativas, el funcionario público se limita a rubricar, sin necesidad de poner la firma /// En los libros antiguos, epígrafe, o denominación de los títulos de un texto jurídico, legal que solían estamparse comúnmente con tinta roja. (texto jurídico del Dr. Guillermo Cabanellas)


Es inevitable pensar en las firmas \"antiguas\" que tenían dibujos por arriba y por abajo y a veces \"dibujitos\" a los costados, pero no necesariamente eran las iniciales, sino algo que también podía representar al firmante (a veces arbolitos, estrellitas).


2) QUÉ ENTENDEMOS POR RÚBRICA HOY (USO VIVO DEL IDIOMA):

Es la firma, porque hoy en día el acto de la firma de un contrato no tiene otra forma de describirse que esa: FIRMA. Aunque algunos siguen haciendo unas firmas ostentosas (si bien jamás como las que seguramente originaron la palabra).

agree  Luis Arri Cibils: Hi, Au. I saw that RAE's def b/4 entering my answer. Puzzled, I looked also for "rubricar":" 2. tr. Suscribir, firmar un despacho o papel y ponerle el sello o escudo de armas de aquel en cuyo nombre se escribe." Thus, rubricado = firmado = signed.
