Nach § 7a Abs. 1 bis 3 gilt dort (verab-schiedete Fassung vom 25. Oktober 2008): „Der Zuschlag beträgt je Millimeter Nenndurchmesser der neu verlegten Wärmeleitung einen Eu-ro pro Meter Trassenlänge. Der Zuschlag nach Satz 1 darf
20% der ansatzfähigen Investitionskosten des Neu- oder Ausbaus, ins-gesamt aber 5 Millionen Euro je Projekt, nicht überschreiten. Ansatzfä-hige Investitionskosten sind alle Kosten, die für erforderliche Leistungen Dritter im Rahmen des Neu- oder Ausbaus von Wärmenetzen tatsäch-lich angefallen sind. Die Summe der Zuschlagszahlungen für Wärme-netze darf 150 Millionen Euro je Kalenderjahr nicht überschreiten.“
