VISTOS: Para sentencia definitiva de primera instancia estos autos caratulados “MC c/ RE, divorcio sola voluntad”, ficha A/28/90.
RESULTANDO: I) Que en estos autos comparece la actora solicitando la disolución del vínculo matrimonial por su sola voluntad (Art. 187 inc. 3º del C. Civil).
II) Se celebraron las audiencias correspondientes, donde la compareciente mantuvo su voluntad de divorciarse.
III) Obran en autos testimonios de partida de matrimonio de los cónyuges y de nacimiento de los menores hijos, respecto de los cuales se dio cumplimiento a los extremos de los Arts. 350.1 del C. G. P. y 167 del C. Civil.
IV) El Ministerio Público se expidió favorablemente.
CONSIDERANDO: El hecho encuadra dentro de la figura del Art. 187 inciso 3º del C. Civil, por lo que se acogerá la demanda sin condenaciones especiales, por no encontrarse mérito para ello (Arts. 56 del C. G. P. y 688 del C. Civil).
Por lo expuesto, las disposiciones legales citadas y lo dispuesto por los Arts. 197, 198, 337 y sigts. del C. G. P.,
FALLO: Decrétase la disolución del vínculo matrimonial existente entre la Sra. CM y el Sr. RE. Consentida o ejecutoriada, expídanse testimonios, comuníquese y oportunamente archívese.

In view of: the fact that these proceedings under the notation "MC c/ RE, divorcio sola voluntad" /MC v. RE, divorce on the wife's sole will/ are now ready in this court for the final decree in first instance, index card nº A/28/90.
Findings of fact:
Whereas:
I) There appears the plaintiff in these proceedings requesting the dissolution of the marital bond on her sole will (article 187, paragraph 3 of the Civil Code).
II) The corresponding hearings were held, in which the plaintiff stated her desire to get divorced.
III) There appear, in the court records, certified copies of the marriage certificate of the spouses and of the birth certificates of their children, in respect of which the requirements of articles nº 350.1 of the CGP /General Code of Procedure/ and 167 of the Civil Code.
IV) The State Attorney provided accordingly.
Conclusions of law:
Whereas:
The fact fits in the legal description provided for in article 187, paragraph 3 of the Civil Code, thus, the petition shall be upheld with no special impositions, as there was found no justification therefor. (Article 56 of the CGP and 688 of the Civil Code).
According to the above, to the cited legal provisions, and to the provisions of articles 197, 198, 337 et seq. of the CGP,
It is hereby adjudged the following:
The marriage between Ms. CM and Mr. RE is dissolved. Once the decree has been agreed upon and it has become final, let authentic copies thereof be issued, let this decree be communicated and eventually be filed.
