Not at all sure about how to phrase this in English. I don't really think "antisocial" works in this context in English:

"Se puede apreciar que XXX no recurrió en su momento a los derechos y acciones que ahora pretende hacer valer (ex. art. 73.1 CISG) en caso de incumplimiento por parte de mi representada, sino que retuvo en parte del precio de las mercaderías recibidas, sin que la CISG le faculte para ello, por lo que la reclamación de daños y perjuicios ahora ejercitada es un ***ejercicio antisocial del derecho***."

The idea of antisocial intent in the exercise of a right is a clear example of a flexible concept....great legal insecurity is created, given this need for the legal arbitrator to mark out when circumstances of the anti social have arisen.....

Maybe a bona fide civil litigator in bith EN & ES can.
Example sentence:
