Si durante el periodo de vacaciones el empleado llegara a tener una incapacidad expedida por el Seguro Social, estos días no impactarán su saldo de vacaciones.

Is this referring to disability benefit? And am a little unsure as to what 'estos dias' refers - days taken off as a result of disability?

agree  Marsha Way: Right, and "estos días" refers to the days the person was sick over vacation (which really sucks!)In Mexico at least, if you have "sick leave" during holiday or on a weekend, you get that many days off at the end of the break or weekend.

There are regular benefits for sick days and the long term disability benefit that, if prolonged, it is paid by Social Security. These days should not affect vacation days.

Looking at teh expression used in similar contexts (e.g. see end of page 3 in this PDF http://www.naalc.org/migrant/spanish/pdf/mgmexwpr_sp.pdf),

it seems quite clear that it's what the Spanish call a baja.

Si durante el periodo de vacaciones el empleado llegara a tener una incapacidad expedida por el Seguro Social, estos días no impactarán su saldo de vacaciones.

If an employee is issued with a (sick) certificate from the SS during his/her holidays, these days will not be counted as holidays.

OR

Vacation period days for which a (sick) certificate has been obtained from the SS will not be counted as holidays.

In other words, if you can prove you were ill, by means of a proper cert obtained from the SS, then these days will not be counted as holiday - seems only fair and logical:-)

It's goy nothing to do with 'incapacity'. Refer to the PDF: it's a pregnant woman's right to be paid her salary when she is "certifiably" sick during her pregnancy.

The "estos dias" refers to the days of sick leave. If you took 30 days hols, and 4 of them were certified as sick, then after you came back, you would still be entitled to those 4 days.
