Yes I agree with saying "they" as well. Another great option. I just said "he/she" because I wasn't sure if they were talking about a "particular" student or "the students" in general. If that's the case, "they" would definitely be more appropriate. Americans say he/she all the time! Nothing wrong with that. I really like Ralph's suggestion too. Some Americans say the following is fine: When the student arrives late, they will be penalized. I personally do not like this. I use s/he instead of he/she (same thing but shorter). Also, Ralph´s suggestion is great if you can rephrase the sentence.

Instead of saying "When the student arrives late, the person is penalized", you should say "The student who arrives late shall be penalized". No repetition, better style.

Then you should say like this: "When the student arrives late, he/she will be penalized". There is nothing wrong with saying "he/she". Nothing wrong at all and it's perfectly fine. :)

In this case, "the person" fits fine.
Now, what if we were talking about a student?
It would sound strange saying something like:
"When the student arrives late, the person is penalized".
See where I am trying to get at?
