Îmbătrânirea populaţiei este un fenomen mondial. Conform proiecţiilor Comisiei Europene, rata fertilităţii riscă să se menţină la un nivel scăzut şi chiar, în anumite ţări să scadă. Într-un raport elaborat sub egida Comisiei se spune: „se poate ca indivizii să fie mulţumiţi de a nu avea copii sau de a nu avea decât doi. Societatea, deopotrivă, are nevoie de a asigura solidaritatea şi continuitatea între generaţii, ceea ce reclamă o importantă proporţie de familii mai numeroase”.
Un caz particular îl reprezintă evoluţiile din Europa centrală şi de est unde se înregistrează un declin brutal al fertilităţii ca urmare a schimbărilor economice şi politice care au urmat căderii regimurilor comuniste.
România se înscrie în acest tablou general confruntându-se cu schimbări demografice care au implicaţii pe termen mediu şi lung. Populaţia ţării a scăzut, în intervalul 1992 şi 2005, cu un milion de persoane şi continuă să scadă constant. Această tendinţă este determinată de fertilitatea scăzută (1,3 copii la o femeie, în loc de 2,1, care ar asigura înlocuirea populaţiei) şi de migraţia externă mare (aproximativ 2 milioane de români se află legal peste hotare, iar numărul celor emigraţi ilegal este necunoscut). În acelaşi timp, însă, România se bucură de un nivel mediu al ratei mortalităţii şi de creşterea speranţei de viaţă, ceea ce determină o îmbătrânire semnificativă a populaţiei. Dacă în prezent, din cele 21,6 milioane de locuitori, 10,5 milioane sunt adulţi, 5 milioane – tineri şi copii şi 6 milioane sunt vârstnici, peste 50 de ani tabloul demografic va arăta complet diferit: pensionarii vor reprezenta mai mult de jumătate din populaţia ţării, va scădea numărul adulţilor şi copiilor, piramida vârstelor îngustându-şi semnificativ baza.
Translation - English Determiners of the demographic aging process in the rural environment
Demographic aging is a worldwide spread phenomenon. According to the European Commission’s projections, the fertility rate risks to remain at a low level, and in certain countries, even to decrease. In a report issued under the shield of the Commission the following can be read: „it is possible for the individuals to be content for not having children or for having just two. The society needs to ensure the solidarity and continuity between generations, claimed by an important proportion of more numerous families”.
A special case is represented by the evolutions in Central and Eastern Europe, where a brutal decline of fertility is registered as a consequence of the economical and political changes that followed the fall of the communist regimes.
Romania is part of this general framing facing demographical changes with short and long term implications. The country’s population decreased, between 1992 and 2005, with one million persons and continues to constantly decrease. This tendency is determined by the low fertility (1.3 children per woman, instead of 2.1, which would assure the population replacement) and by the high external migration (approximately 2 million Romanians are legally abroad, and the number of the illegal emigrants is unknown). At the same time, though, in Romania there is a medium level of mortality rate and of life expectancy increase, which determines a significant population aging. If, at the present moment, from the 21.6 million inhabitants , 10.5 million are adults, 5 million – juveniles and 6 million are old people, in 50 years the demographic framing will be completely different: pensioners will represent more than half of the country’s population, the number of adults and infants will decrease, the age pyramid narrowing significantly its base.

I. The present procedural system and the necessity to elaborate a new criminal proceedings legislation
Starting from the obvious realities of the present legal life, which have disclosed both the lack of celerity of the criminal proceedings’ development in general, the disbelief of the law makers in the act of justice, as well as the social and human costs sometimes significant, translated in the high consumption of time and financial resources, all of these creating a high level of distrust and incertitude, the necessity to establish a modern criminal proceedings system has emerged, in order to respond to the need to create a modern justice adapted to social expectations, as well as to the increase of the of this public service.
This way, the legislative program of the Ministry of Justice has included the elaboration of the new Code of Criminal Procedure of Romania.
Te realization of this legal proceeding is subdued to the identification of some solutions in order to improve the regulative frame and, subsequently, to ensure a better and more unitary enforcement of the law.
The intention of the new CCP is not to include original solutions on any account, in comparison with the existing legal solutions which have proved to be viable in practice or whose usage constitutes a habit for the practice, but more to modify accordingly all those solutions that have become old or that proved a series of anomalies in practice, an to introduce new solutions, based on positive comparing experiences or oriented toward the expected favourable experiences, all of them following a the study of the doctrine of the criminal proceedings law in the internal and European systems.
As a consequence, the CCP will keep its European continental predominant character, but, as the present tendency is, typically for the majority of other modern criminal proceedings, it will presuppose many elements emerged from the Anglo-Saxon proceeding, respectively, from the adversary type one, but in a manner to adapt them accordingly to our own legislative concept. The combination of the elements of the two great legislations is a form to converge the best compared solutions, keeping though the fundamental premises of the classic European criminal proceeding. Such an approach represented a tendency in the modern law of criminal proceeding in the previous years, and nowadays the most traditionalist European states such as Germany, Italy or France include in their criminal proceedings some solutions that originated in the criminal proceedings of adversary type.
Therefore, although the purpose is that of keeping all the good solutions in the present CCP, it is necessary to introduce a series of new solutions focusing on facilitating a fast deciding proceeding and efficient in a criminal case, granting at the same time the respect due to the rights and fundamental liberties of the defendant, including the rights of the other subjects of the criminal proceeding.
The span of the quantitative amendments, under the aspect of its content and quality will determine not just the creation of a new CCP, but also of a significant conceptual different model of criminal procedure, with respect for our legal system’s particularities.
The objectives followed by the Code are the following:
1) To create a legal frame in which the criminal proceeding is faster and more efficient, and significantly less expensive;
2) The unitary protection of the human rights and liberties granted by the Constitution and the international regulative acts;
3) To harmonize the solutions derived from the CCP with the provisions of the special laws with criminal proceeding provisions;
4) The conceptual harmonization with the provisions of the new criminal code, a special attention being given to the new definition of the deed that constitutes a crime;
5) The adequate regulation of the international obligations assumed by our country regarding the regulative acts in the area of criminal proceedings law;
6) To establish an adequate equilibrium between the requirements for an efficient criminal proceeding, to protect the elementary proceeding rights, but also the fundamental rights of the man for the participants to the criminal proceeding and to jointly respect the principles that regard the equitable development of the criminal proceeding.

I. Actualul sistem procedural şi necesitatea elaborării unei noi legislaţii procesual penale
Pornind de la realităţile evidente ale vieţii juridice actuale, care au relevat atât lipsa de celeritate a desfăşurării proceselor penale în general, neîncrederea justiţiabililor în actul de justiţie, cât şi costurile sociale şi umane uneori semnificative, traduse în consumul ridicat de resurse de timp şi financiare, toate acestea creând un grad ridicat de neîncredere şi incertitudine, a apărut necesitatea gândirii unui sistem procedural penal modern, care să răspundă imperativelor creării unei justiţii moderne adaptate aşteptărilor sociale, precum şi creşterii calităţii acestui serviciu public.
Astfel, în programul legislativ al Ministerului Justiţiei a fost cuprinsă elaborarea noului Cod de procedură penală al României.
Realizarea acestui demers legislativ se subsumează identificării unor soluţii de natură a îmbunătăţi cadrul normativ şi, subsecvent, a asigura o mai bună şi unitară aplicare a legii.
Intenţia nu este ca noul Cod de procedură penală să conţină soluţii originale cu orice preţ, în comparaţie cu soluţiile de drept existente care s-au dovedit a fi viabile în practică sau a căror utilizare constituie o obişnuinţă pentru practică, ci mai degrabă să modifice corespunzător toate acele soluţii care au devenit desuete sau care au evidenţiat o serie de anomalii în practică şi să introducă noi soluţii, bazate pe experienţe comparative pozitive sau orientate către efectele favorabile aşteptate, toate ca urmare a studiului doctrinei dreptului procesual penal din sistemul intern şi din sistemele europene.
Prin urmare, Codul de procedură penală îşi va păstra caracterul predominant continental european, dar, aşa cum este tendinţa în prezent, în mod tipic pentru majoritatea altor proceduri penale moderne, el va presupune multe elemente care îşi au originea în procedura anglo-saxonă, respectiv cea de tip adversial, dar într-o manieră care să le adapteze corespunzător la propriul nostru concept legislativ. Combinarea elementelor din cele două mari sisteme de procedură penală existente în lume este o formă de convergenţă a celor mai bune soluţii comparate, păstrând însă premisele fundamentale ale procedurii penale europene clasice. O asemenea abordare a reprezentat o tendinţă în dreptul modern de procedură penală în anii anteriori, şi astăzi cele mai tradiţionaliste ţări europene cum sunt Germania, Italia sau Franţa au în procedura lor penală unele soluţii care şi-au avut originea în procedurile penale de tip adversial.
Aşadar, deşi scopul este acela de a menţine toate soluţiile bune din actualul Cod de procedură penală, este necesar să se introducă o serie de soluţii noi care se concentrează în esenţă pe facilitarea unui proces de decizie rapid şi eficient într-o cauză penală, acordând în acelaşi timp respectul cuvenit drepturilor şi libertăţilor fundamentale ale inculpatului, inclusiv drepturilor celorlalţi subiecţi ai procedurii penale.
Anvergura modificărilor cantitative, sub aspectul conţinutului şi al calităţii acestuia va determina nu doar crearea unui Cod de procedură penală nou, ci şi a unui model conceptual semnificativ diferit de procedură penală, în respectul pentru particularităţile sistemului nostru juridic.
Obiectivele urmărite de Cod sunt următoarele:
1) Crearea unui cadru legislativ în care procesul penal să fie mai rapid şi mai eficient, prin urmare, în mod semnificativ mai puţin costisitor;
2) Protecţia unitară a drepturilor omului şi a libertăţilor garantate de Constituţie şi de actele normative internaţionale;
3) Armonizarea soluţiilor derivate din Codul de procedură penală cu dispoziţiile legilor speciale cu dispoziţii procesual penale;
4) Armonizarea conceptuală cu prevederile noului Cod penal, o atenţie deosebită fiind acordată noii definiţii a faptei care constituie infracţiune;
5) Reglementarea adecvată a obligaţiilor internaţionale asumate de ţara noastră privind actele normative din domeniul dreptului procesual penal;
6) Stabilirea unui echilibru corespunzător între cerinţele pentru o procedură penală eficientă, protejarea drepturilor procedurale elementare, dar şi a celor fundamentale ale omului pentru participanţii la procesul penal şi respectarea unitară a principiilor care privesc desfăşurarea echitabilă a procesului penal.

Bio
For 12 years I studied music at my parents' wish because they thought I was talented. Maybe I was, but it certainly wasn't what I wished for. Later on I discovered my skills in foreign languages. I studied English and French in school and I thought I should continue. Therefore, I attended the faculty of foreign languages and I became specialized in English and Italian. I knew that I wanted to be a translator. I started working in the field of translations since I was a student, at first, as a secretary, translating correspondence both in/from English and Italian and different brochures and instructions manuals for diesel marine engines. Later on, I obtained an interpreting job within a PHARE project in the legal field, that meant a lot to me.
I worked in a Translation Services Company in order to achieve experience and learn how to use different translation tools.
Currently, I am working as a freelance translator (since 2008) in collaboration with different companies and translation agencies. In 2013 I also started teaching English in kindergartens and I enjoy it.
