Explanation: Ich denke "hier" bezieht sich auf die Eintragung der Scheidung in die Court Records und nicht auf das vorliegende Dokument Ganz unten bei der Unterschrift steht ja auch noch einmal "Entered", was darauf schließen lässt, dass damit bestätigt wird, dass der Vorgang irgendwo eingetragen wird. https://info.legalzoom.com/article/what-does-entry-judgment-divorce-california-mean |

" Da dieses Eintragen in Deutsch schwer auszudrücken ist, möchte ich hier die vereinfachte Version vorschlagen. Ein (Scheidungs)Urteil in Deutschland hat ja immer zur Folge, dass der Beschluss in den Akten bei Gericht eingetragen und rechtskräftig irgendwo vor sich hin modert. Der Teufel steckt im Detail. Du hast Recht: Weiter unten wird ja Präsens benutzt : "WHEREFORE, ON MOTION OF THE PLAINTIFF, IT IS HEREBY ORDERED AND ADJUDGED AS FOLLOWS: 1. The parties are awarded a Judgment of Dissolution Of Marriage so that the bonds of matrimony existing between the Petitioner, ________________________, and the Respondent, _____________________, are hereby dissolved. " ALLERDINGS ist an o.g. Stelle "F. A Judgment of Dissolution of Marriage should be entered herein." dieses Urteil noch nicht vom Richter gefällt/unterschrieben (man befindet sich ja gerade in der Anhörung). Unter G findet sich dann ebenfalls: "... was entered into freely and voluntarily between the parties hereto, is not unconscionable, and ought to receive the approval of this Honorable Court." An dieser Stelle sollten also alle Vorraussetzungen und Dokumente für eine erfolgreiche Scheidung (ohne einseitiges Verschulden einer der Parteien - "When a couple files for divorce on the grounds of irreconcilable differences, they are filing for a no-fault divorce. " - ganz wichtig diese Kategorisierung im vorliegenden Fall und für das US Rechtssystem) vorliegen. Folgerichtig sollte also nichts mehr im Wege stehen, dass der Richter hierzu sein ok gibt (Hat er aber an dieser Stelle noch nicht). Ab "WHEREFORE, ON MOTION OF THE PLAINTIFF.." wird dann Präsenz verwendet und noch Mal erwähnt, was jetzt konkret Verhandlungsgegenstand ist, welche dann rechtskräftig gelten und schließlich die Unterschrift , Hammer, fertich ! :)) Also noch mal kurz: Am Tag X erschienen hier beide Parteien ... Der Richter befindet (Präsens)- "...having considered all of the evidence, and now being fully advised in the premises; FINDS THAT:" ..... dass er zuständig ist (Präsens) ... dass X zum Zeitpunkt 90 Tage in IL LEBTE... dass die beiden verheiratet WAREN... die Parteien getrennt GELEBT HABEN...dass Beweise für den Grund der Scheidung vorgelegt WURDEN... dass beide Parteien folgerichtig einer Scheidung zugestimmt HABEN (shall -should = in der Folge, das richtige zu tun)... dann Punkt G (Perfekt) ... dann Punkt H (Präteritum) Also abgehakt, dass alle Vorraussetzungen erfüllt wurden, um die Scheidung am heutigen Tag rechtskräftig zu machen. |
