Specifically, no matter how carefully you draft your independent contractor agreement, franchise agreement, or similar contracts (which are often held to be non-controlling), you can still be found to be your drivers’ employer if you suggest that such is the case in your literature, and/or on your website. To avoid having statements in your literature and on your website used against you, it is important that you be extremely careful about what you say, and how you say it. Look at each statement, and ask, “Could these statements be construed as showing that I hold my drivers out to the public as employees of the company?”
