Tenendo presente che il 'guardian' ha dei poteri molto più ristretti del genitore esercente la patria potestà.
In generale comunque la 'parental authority' è un concetto ignoto alla common law, perché esprime solo in parte il concetto nostrano di patria podestà. Tanto per fare un esempio la 'guardianship' non comporta l'amministrazione dei beni del minore.
