EKLER
I- YASAL DÜZENLENMELER
1/95 sayılı Türkiye-AB Ortaklık Konseyi Kararı (OKK)’nın 8 ila 11 inci maddeleri Türkiye’nin AB’nin ortak mevzuatını ulusal mevzuata uyumunu öngörmüştür.
Avrupa Birliği Ülkeleri ticarette teknik engellerin kaldırılması amacıyla ürün grupları için direktifler hazırlamış ve her üye Ülke bu direktifleri uygulamakla yükümlü olmuştur. Ülkemiz Avrupa Birliği üyesi olamamakla birlikte bu birliğe katılabilmek için söz konusu direktifleri uyumlaştırarak kendi mevzuatına aktarmak zorundadır. AB direktifleri yeni yaklaşım ve klasik yaklaşım olmak üzere ikiye ayrılmaktadır.
Yeni Yaklaşım Direktifi; CE işareti öngören direktiflerdir ki oyuncaklar direktifi de yeni yaklaşım direktifi olduğundan bu ürünlerin CE işareti iliştirmek suretiyle piyasaya arz edilmeleri gerekmektedir.
Bu uyum çalışmaları çerçevesinde ilk olarak Dış Ticaret Müsteşarlığı tarafından 4703 sayılı “Ürünlere İlişkin Teknik Mevzuatın Hazırlanması ve Uygulanmasına Dair Kanun” (Çerçeve Kanun) ve kanunun uygulama Yönetmelikleri hazırlanmış ve yürürlüğe koyulmuştur.

Bu kapsamda Bakanlığımız oyuncaklarla ilgili gerekli mevzuatı hazırlamıştır.
Oyuncakların Güvenliği İle İlgili Üye Devletlerin Kanunlarının yakınlaştırılması Hakkındaki 3 Mayıs 1988 tarihli Konsey direktifi (88-378-EEC) ve onu tadil eden 22 temmuz 1993 tarihli Konsey direktifi (93-68) uyumlaştırılmıştır.
ÇERÇEVE KANUN
11.07.2001 Tarih ve 24459 Sayılı Resmi Gazetede yayımlanmış olup; 11.01.2002 tarihinde yürürlüğe giren bu kanun esas itibarıyla piyasaya sadece teknik düzenlemesine uygun ve güvenli ürünlerin arz edilebilmesi için Devletin, üreticilerin ve uygunluk değerlendirme kuruluşlarının üzerine düşen vazifeleri belirlemek amacıyla çıkarılmıştır.
Bu itibarla Kanun, anılan nihaî amacın gerçekleştirilmesi için gerekli olan sistemin genel hatlarını ve sistemde yer alan bütün aktörlerin hak ve yükümlülüklerini düzenlemektedir.
Çerçeve Kanunun Uygulama Yönetmelikleri :
1- CE Uygunluk İşaretinin Ürüne İliştirilmesine ve Kullanılmasına Dair Yönetmelik,
17.01.2002 Tarih ve 24643 Sayılı Resmi Gazetede yayımlanarak 11.01.2002 tarihinden itibaren geçerli olmak üzere yürürlüğe giren bu Yönetmelik 4703 sayılı Kanun ile belirlenen sistem içerisinde bazı ürünlerinin ilgili teknik düzenlemelerine uygun olarak üretildiklerini ve bu uygunluğun üretici ya da onaylanmış kuruluşlar tarafından doğrulandığını ifade eden “CE” uygunluk işaretinin ürüne iliştirilmesinde izlenecek yöntemler ile bu işaretin kullanılmasında riayet edilecek kuralların belirlenmesini amaçlamaktadır.
CE uygunluk işaretinin iliştirilmesine ve kullanılmasına dair genel esasları belirleyen bu Yönetmelik, 23 üncü maddesinde de belirtildiği gibi, ancak ürüne “CE” uygunluk işareti iliştirilmesini öngören teknik düzenlemelerin yetkili kuruluşlarca Resmi Gazetede yayımlanarak yürürlüğe konulmasını müteakip, söz konusu teknik düzenlemelerle birlikte uygulanır. Oyuncak yönetmeliğinin 17.11.2003 tarihinde yürürlüğe girmesiyle bütün oyuncakların CE işareti taşıması zorunluluğu getirilmiştir
2- Ürünlerin Piyasa Gözetimi ve Denetimine Dair Yönetmelik
17.01.2002 Tarih ve 24643 Sayılı Resmi Gazetede yayımlanarak 11.01.2002 tarihinden itibaren geçerli olmak üzere yürürlüğe giren, Piyasa gözetimi ve denetimi sisteminin ülkemizde tam olarak oluşturulması ve etkin bir şekilde sürdürülmesi bakımından kuralları belirleyen bu Yönetmelik, ürün güvenliğine yönelik piyasa kontrollerini Devletin görevi olarak belirlemekte ve güvenli olmadığı tespit edilen ürünler hakkında alınacak önlemleri ayrıntılı olarak düzenlemektedir. Söz konusu Kanun;
• Ürünlere ilişkin teknik düzenlemelerin hazırlanması ile teknik düzenlemelere uygunluk ve ürün güvenliğine ilişkin esasları,
• Ürünlerin piyasaya arzında üretici ve dağıtıcıların yükümlülüklerini, piyasa gözetimi ve denetimine ilişkin usul ve esasları,
• Ürünlerin piyasaya arzı veya dağıtımı aşamasında veya ürünler piyasada iken ilgili teknik düzenlemelere uygun ve güvenli olup olmadığının tespiti konusunda yetkili kuruluşların yetki ve sorumluluklarını,
Piyasa gözetimi ve denetimi çerçevesinde alınacak önlemleri ve yetkili kuruluşlar arasında koordinasyonun sağlanmasını teminen Piyasa Gözetimi ve Denetimi Koordinasyon Kurulunun teşkili ile bu Kurulun görevleri ve çalışma usul ve esaslarını belirlemektedir.
3-Uygunluk Değerlendirme Kuruluşları İle Onaylanmış Kuruluşlara Dair Yönetmelik
17.01.2002 Tarih ve 24643 Sayılı Resmi Gazetede yayımlanarak 11.01.2002 tarihinden itibaren geçerli olmak üzere yürürlüğe giren Bu Yönetmelik; bir teknik düzenleme kapsamında bulunan ve piyasaya arz edilmesi hedeflenen ürünlerin ilgili teknik düzenlemeye uygunluğunun test edilmesi, muayene edilmesi ve/veya belgelendirilmesi amacıyla faaliyette bulunacak uygunluk değerlendirme kuruluşları ve onaylanmış kuruluşların çalışma usul ve esaslarını, taşıması gereken asgari kriterleri ve faaliyetleriyle ilgili olarak uygulanacak müeyyideleri kapsar. .(EK-1)
4- Teknik Mevzuatın ve Standardların Türkiye İle AB Arasında Bildirimine Dair Yönetmelik
03.04.2002 tarih ve 24715 sayılı Resmi Gazetede yayımlanarak 03.05.2002 tarihinde yürürlüğe giren bu Yönetmelik, teknik mevzuatın ve standartların Avrupa Birliğine bildirimine ilişkin usul ve esaslar ile teknik mevzuat hakkında Avrupa Birliğinden Türkiye’ye intikal eden bildirimlerin yetkili kuruluşlara iletilmesine dair usul ve esasları kapsar. .(EK-2)
5- Sağlık Bakanlığınca Yapılacak Piyasa Gözetimi ve Denetiminin Usul ve Esasları Hakkında Yönetmelik
25 Haziran 2007 tarih ve 26563 sayılı Resmi Gazetede yayımlanarak yayımı tarihinde yürürlüğe giren bu Yönetmelik Sağlık Bakanlığının görev alanına giren ürünlerin piyasaya arzı veya dağıtımı aşamasında veya ürünler piyasada iken, ilgili teknik düzenlemeye uygun ve güvenli olup olmadığının gözetimine ve denetimine ilişkin usul ve esaslar ile alınacak önlemleri, bu alanda Sağlık Bakanlığının görev, yetki ve sorumlulukları ile üretici ve dağıtıcıların yükümlülüklerini, piyasa gözetimi ve denetimi faaliyetlerini yürütecek personelin hizmet içi eğitimi ve sertifikalandırılmasına ilişkin usul ve esasları düzenlemektedir. 6- Oyuncaklar Hakkında Yönetmelik
17.05.2002 tarih ve 24758 sayılı Resmi Gazetede yayımlanarak 17.11.2003 tarihinde yürürlüğe giren bu yönetmelik Oyuncakların güvenliği ile ilgili olarak yerine getirilecek temel gerekleri, piyasaya arzı, dağıtımı ile piyasa gözetim ve denetimine ilişkin usul ve esasları belirlemeyi amaçlamaktadır
II-OYUNCAKLAR HAKKINDA YÖNETMELİK
88/378 /EEC sayılı Oyuncak Direktifini uyumlaştıran Oyuncaklar Hakkında Yönetmelik 17.05.2002 tarih ve 24758 sayılı Resmi Gazetede yayımlanmış ve 17.11.2003 tarihinde yürürlüğe girmiştir. Oyuncaklar Hakkında Yönetmelikte Değişiklik Yapılmasına Dair Yönetmelikler ise 18.11.2003 tarih ve 25293 sayılı Resmi Gazete ile 22.11.2006 tarih ve 26354 sayılı Resmi Gazetede yayımlanarak yürürlüğe girmişlerdir.(EK-4) Ayrıca 2005/84/EC sayılı Direktif dikkate alınarak Avrupa Birliği mevzuatına uyum kapsamında Oyuncak ve Çocuk Bakım Eşyalarındaki Phthalatlar Hakkında Tebliğ yayımlanarak yürürlüğe girmiştir.(EK:5)
Yönetmeliğin amacı;Oyuncakların güvenliği ile ilgili olarak yerine getirilecek temel gerekleri, piyasaya arzı, dağıtımı ile piyasa gözetim ve denetimine ilişkin usul ve esasları belirlemeyi amaçlamaktadır.
Yönetmeliğin kapsamı;Yönetmelik, temel güvenlik gereklerini belirtir, detaylı teknik spesifikasyonlar ise standardlarda belirtilir.

Oyuncak nedir
Oyuncak 14 Yaşından küçük çocukların oyunlarında kullanmak amacıyla tasarlanan veya imal edilen her türlü ürün ve oyun araç ve gereçleridir.
Oyuncaklar Avrupa Standardizasyon Komitesi CR 14379: 2002 raporuna göre şu şekilde sınıflandırılmıştır (EK: 6 ).

Oyuncak olarak kabul edilmeyen ürünler;
Bazı ürünler ise ilk bakışta oyuncak olarak düşünülse bile;
-Çocuklar için tasarlanmamışsa,
-Yönetmeliğin kapsamadığı özel bir risk içeriyorsa oyuncak olarak kabul edilmez. Aslında Yönetmelikteki “oyuncak” tanımı ürünün oyuncak olup olmadığı konusunda sınıflandırma yapacak kadar nettir.
Ancak sınıflandırması zor olan gri alanda olan ürünler vardır. Bu ürünlerin oyuncak olup olmadığına karar verebilmek için;
-Satış yeri ( örneğin; koleksiyonerler için olan ürünler özel mağazalarda satılır),
- Reklam ve ambalajlamaya göre hedef kitle (çocukların ilgisini çekecek ambalajlama ve reklam ürünün oyuncak olduğunu gösterir),
- Fiyat (örneğin koleksiyonerler ve yetişkinler için olan ürünler pahalıdır),
- Boyut ,
- Çifte kullanım (oyun amacı dışında başka bir amacı varsa sadece önemli oyun değeri olması durumunda oyuncak olarak kabul edilir, örneğin; anahtarlığa bağlı oyuncak) dikkate alınır.Oyuncak olarak kabul edilmeyen ürünler Yönetmelik EK:I de belirtilmektedir.
Bunlar;
1) Yılbaşı süsleri,
2) Yetişkinler ve koleksiyoncular için detaylı model maketler,
3) Çocuk bahçelerinde topluca kullanılmak üzere üretilen oyun araç ve gereçleri,
4) Spor malzemeleri,
5) Derin suda kullanılması amaçlanan su aletleri,
6) Yetişkin koleksiyoncular için folklorik ve dekoratif bebekler ve diğer benzer malzemeler,
7) Alışveriş merkezleri, istasyonlar gibi kamunun faydalandığı alanlara yerleştirilen mesleki oyuncaklar ve maketler,
8) Uzmanlar için hazırlanmış 500 parçadan fazla veya resimsiz yap-bozlar,
9) Havalı tabanca ve tüfekleri,
10) Özellikle oyuncaklar için tasarlanmış patlama kapsülleri dışındaki patlama kapsüllerini de içeren havai fişekleri, (yürürlükte olan ve daha sıkı mevzuat hükümleri saklı kalmak kaydıyla, oyuncaklarda kullanılan tüfek kapsülleri hariç),
11) Sapan ve benzeri oyuncaklar,
12) Metalik uçlu ok setleri,
13) 24 Volttan fazla anma gerilimi ile çalışan elektrikli fırınlar, ütüler veya diğer fonksiyonel ürünler,
14) Bir öğrenim programı çerçevesinde, bir yetişkinin gözetimi altında kullanılmak amacıyla üretilmiş ısıtıcı parçalar içeren ürünler,
15) Eksoz motorlu araçlar,
16) Buharlı oyuncak makinaları,
17) Kaldırımlarda spor yapmak veya seyahat etmek amacıyla tasarlanan bisikletler,
18) 24 volttan fazla anma gerilimiyle çalışan ve bir video ekranına bağlanan video oyuncakları,
19) Bebek emzikleri,
20) Gerçek ateşli silahların aslına uygun kopyaları,
21) Çocuklar için taklit mücevherler.
Oyuncakların piyasaya arzı
Piyasaya arz; oyuncağın tedarik veya kullanım amacıyla bedelli veya bedelsiz olarak piyasada yer alması için yapılan faaliyettir. Çocukların normal davranışları da dikkate alınmak suretiyle imal edilen ve amacına uygun veya öngörüldüğü şekilde kullanıldığında, kullanıcıların veya üçüncü kişilerin güvenlik ve/veya sağlığını tehlikeye atmayan oyuncaklar piyasaya arz edilir
Piyasaya arz edilen bir oyuncak, öngörülen süre ve kullanım amacı dikkate alındığında, bu Yönetmelikte belirtilen temel gerekleri karşılamalıdır.
Bu Yönetmelik hükümlerine uygun oyuncakların piyasaya arz edilmesi engellenemez.
Piyasaya arzda sorumluluklar
-Devletin sorumluluğu
• Devletin birinci yükümlülüğü söz konusu ürün üretimini yapan üreticilerin, ürünün tüketiciler ve risk altındaki diğer varlıklar açısından azami güvenlik sağlayacak şekilde üretilmesi için uymaları gereken kuralları belirlemektedir.
• Devletin ikinci yükümlülüğü, ürünün piyasaya arzı öncesi denetimini, üçüncü taraf uygunluk değerlendirmesi yöntemiyle yapması ve etkinliğini artırmasıdır. Aslında, getirilen yeni sistemin kilit noktası da budur. Çerçeve Kanun’un olanaklı kıldığı sistem ile, devlet ürünün piyasaya arz edilmeden önce etkin bir şekilde denetimini üçüncü taraf değerlendirme kuruluşu olarak nitelendirilen uygunluk değerlendirme kuruluşları/onaylanmış kuruluşlar aracılığıyla yapabilecektir.
• Nihayet devletin son yükümlülüğü, ürün piyasaya arz edildikten sonra yapacağı gözetim ve denetim faaliyetleridir. Piyasadaki ürünlerin mevzuata uygun ve güvenli olup olmadığını denetler.
-Üretici sorumluluğu
Üretici, bir ürünü üreten, imal eden, ıslah eden veya ürüne adını, ticari markasını veya ayırt edici işaretini koymak suretiyle kendini üretici olarak tanıtan gerçek veya tüzel kişidir.Üreticinin Türkiye dışında olması halinde ithalatçıdır.
• Üretici piyasaya mutlaka güvenli ürün arz etmek zorundadır.
• Üretici güvenli ürün üretirken, ilgili teknik mevzuat izin veriyorsa/zorunlu kılıyorsa üçüncü taraf değerlendirmesine tabi olmayı seçebilir, Yani üretici ürünün mevzuata uygunluğunu bir uygunluk değerlendirme kuruluşuna test ettirmek suretiyle doğrular ancak ürün güvensiz çıkarsa yine de nihai sorumlu üreticidir.
Ürünün güvensiz tespit edilmesi durumunda ürünün taşıdığı güvensizlik unsurlarından haberdar edilmesi yükümlülüğü üreticiye aittir. Üreticilerin güvenli üretim yapmalarını zorlayacak ve tüketicilerin güvenliğini maksimize edecek en önemli unsur güvensiz ürünün piyasaya arz sonrası gözetim ve denetim esnasında tespit edilmesi durumunda, ürünü satın almış ve kullanmakta olan tüketicilerin, ürünün taşıdığı güvensizlik unsurlarından haberdar edilmesi yükümlülüğünün üreticilere verilmesi, bu çerçevede üreticinin basın yayın organlarında güvensiz ürün ürettiğini ilan edecek olmasıdır. Ayrıca gerektiğinde piyasaya arz edilmiş ürünlerden numuneler alarak test etmek, şikayetleri soruşturmak ve yapılan denetim sonuçlarından dağıtıcıları haberdar etmek, riskleri önlemek amacı ile güvensiz bulunan ürünlerin piyasadan toplatılması, güvensizliklerinin giderilmesi ve gerekiyorsa imha edilmeleri üretici sorumluluğundadır.
• Üretici, ilgili teknik düzenlemede belirtilen tüm belgeleri (teknik dosya) 10 yıl boyunca muhafaza etmek ve istenilmesi halinde yetkili kuruluşlara ibraz etmekle yükümlüdür.
-Dağıtıcı/Satış Yeri Sorumluluğu
- Dağıtıcı güvenli olmadığını bildiği ürünleri piyasaya arz edemez.
- Yetkili kuruluşça belirlenecek süre içinde üreticinin veya malı tedarik ettiği kişinin kimliğini bildirmeyen dağıtıcı, üretici olarak kabul edilir.
Çerçeve Kanunda idari para cezaları hükümlerine yer verilmiştir, ancak bu hükümler sistemin belkemiği değildir. Para cezaları konusunda ilgili kamu kuruluşlarınca ilgili ürün ya da ürün grupları için mevcut mevzuatta aynı fiil için herhangi bir idari para cezası öngörülmüyorsa Çerçeve Kanun’da yer verilen cezaî müeyyideler devreye girmektedir.
Güvenli ürün;
- Oyuncaklar için; insan sağlığı, can ve mal güvenliği ile tüketicinin korunması açısından asgari güvenliği sağlayan üründür.
- Yönetmeliğe uygun ürün güvenli ürün olarak kabul edilir.
Oyuncakların Uygunluğu;
Yönetmeliğin öngördüğü şekilde CE işareti taşıyan oyuncakların, uygunluk değerlendirme işlemleri de dahil olmak üzere, bu Yönetmelik hükümlerine uygun olduğu kabul edilir.
CE işareti
- Oyuncaklara iliştirilmesi zorunludur
- Üreticinin uygunluk değerlendirme prosedürlerini tamamladığının beyanıdır.
- En az 5 mm boyunda, ürüne, etiketine, ambalajına görünür, okunabilir ve silinmeyecek şekilde iliştirilir.

Bu Yönetmeliğin kapsamında bulunan oyuncaklarla ilgili uyumlaştırılmış ulusal standardlara uygun olarak üretilmiş oyuncağın, EK-II’de öngörülen temel gereklere uygun olduğu kabul edilir. Bu standartlar;

Oyuncaklar için temel gerekler
Üreticinin, uyumlaştırılmış ulusal standardları uygulamadığı veya belirli bir bölümünü uyguladığı veya böyle bir uyumlaştırılmış ulusal standardın bulunmadığı durumda oyuncağın, AT Tip İncelemesi Belgesi aldıktan sonra onaylanmış tipe uygunluğunu gösteren CE işareti iliştirilmesi ile EK-II’de belirtilen temel gerekleri karşıladığı kabul edilir.
I)- Oyuncakların genel esasları
1-Kullanıcılar ve üçüncü kişiler,
-Sağlık zararı
-Fiziksel yaralanma risklerine karşı korunmalıdır
Bu riskler
-Oyuncağın tasarımı, üretimi veya bileşimine ilişkin riskler
-Oyuncağın amacına uygun kullanımından kaynaklanan tamamen giderilemeyecek risklerdir. (örneğin mutfak setlerindeki bıçakların keskinliği, bu oyuncağın doğasında var ancak etikette ilgili ikaz olması gerekir-yetişkin gözetiminde kullanılması gerekmektedir )
2- Kullanıcının yeteneği göz önünde bulundurularak özellikle 36 aydan küçükler için minimum yaş belirtilmeli
Oyuncağın kullanımı esnasında mevcut olan risk derecesi, gerektiğinde çocukların bakıcılarının üstesinden gelebilmeleriyle veya kullanıcıların yeteneğiyle orantılı olmalıdır. Kullanıcıların , becerileri, kullanılabilirlikleri göz önüne alınarak minimum yaş özellikle 36 aydan küçük çocukların minimum yaşının ve/veya yalnız yetişkin bir kişinin gözetimi altında kullanılması gerektiği oyuncağın etiketi üzerinde belirtilmelidir.
3- Oyuncağın kullanımıyla bağlantılı riskler ve bunlardan korunma yolları, oyuncaklar ve/veya ambalajların üzerindeki etiketlerde ve kullanım kılavuzlarında belirtilmelidir (Yönetmelik EK:IV’de belirtildiği şekilde)
II)- Özel Riskler
Bu bölüm Güvenli oyuncak yapmak ve tasarlamak için gerekli kuralları gösterir.
Aşağıdaki bu kurallar çocuk veya denetmenlik yapan bakıcısının oyuncağı normal şartlarda ve tavsiye edilen şekilde kullandığında ortaya çıkabileceği düşünülen risklerdir.
1. Fiziksel ve Mekaniksel özellikler.
a) Mekanik sağlamlılık olmalıdır.
Oyuncaklar ve parçaları ve bu parçaların oyuncağa iliştirilmesi halinde aksamları, mekanik sağlamlığa sahip olmalı ve gerektiğinde fiziksel yaralanmaya neden olabilecek kırılma ve eğilme olmadan, kullanım esnasında meydana gelebilecek zorlamalara karşı dayanıklı olmalıdır.
Örneğin;Çocuk pusetleri (oyun amaçlı) bebek taşımak için kullanılıyor ama kendiside oyun amaçlı oturduğu için kullanılan materyaller belli bir yüke dayanıklı olmalıdır.
b) Temasla meydana gelebilecek fiziksel yaralanma riski taşımamalıdır.
Fiziksel Oyuncakların kenarları, çıkıntıları, yayları, kabloları ve monte edilen parçaları, temasla meydana gelebilecek riskleri mümkün olduğu kadar azaltacak şekilde tasarlanmalı ve üretilmelidir.
Örneğin; Yaylar ve oklarda kullanılan uçlar metalden yapılmamalıdır (metal uçlu dartlar kapsam dışıdır)
Çocuk kütlesini taşıması için tasarlanan oyuncaklar (Bisikletler, üç tekerlekliler, motosikletler ve arabalar) keskin kenarlar ve sivri uçlar bulundurmamalı.
Çıkıntı şeklinde borular ve parçaların çocuğa batmaması için tedbir alınmalıdır. (örn:Şemsiye tellerinin uçları korunmalıdır.).
c) Oyuncaklar, parçalarının hareketinin neden olabileceği fiziksel yaralanma riskini en aza indirecek şekilde tasarlanmalı ve yapılmalıdır.
Katlanabilir oyuncaklardaki (oyuncak ütü tahtası, katlanır sandalye ve masalar, oyuncak puset gibi) katlama mekanizmalarında bir emniyet durdurma veya kilit tertibatı bulunmalıdır.
Menteşesi olan bir oyuncakta (kapısı olan bir oyuncak, akülü bir araba) elini sıkıştırma riskini en aza indirmek için tedbir alınması gerekir
d) Yutulabilecek boyutta olmamalı
36 ayın altındaki çocukların kullanması için tasarlanmış oyuncaklar, oyuncak parçaları ve ayrılabilir parçaları, 36 aydan küçük çocukların nesneleri ağızlarına götürme alışkanlıkları iyi bilindiğinden emme ve/veya nefesle çekilmesini önleyecek boyutlarda (boğulmaya sebep olmayacak) olmalıdır. Oyuncaklar, maruz kalacakları kayda değer yıpranma ve yırtılmalara da karşı koyacak yeterli dayanıklılıkta olmalıdır. Birbirine yapıştırılmış oyuncaklarda çocuğun sürekli oyuncağı ağzına götüreceği düşünülerek ıslatıldığında ayrılmayacak şekilde yapıştırılmış olması gerekmektedir.
Örneğin;Çıngırak gibi oyuncakların ise kaplamalarının da dayanıklı olması, Oyuncakların gözlerinin çıkmaması, dikişlerin sökülmemesi gerekir.
e) Boğulma riski içermemeli
Perakende olarak satılan oyuncaklar, parçaları ve ambalajları boğulma riski içermemelidir.
Örneğin; Maskeler ve kasklarda uygun havalandırma bulunmalıdır(kişisel korunma techizatı olarak kullanılanlar değil, tamamen oyun amaçlı olanlar). Esnek maskelerin nefes almayı zorlaştıracak şekilde çocuğun yüzüne yapışmaması gerekmektedir. Yüzü kaplayan ve geçirgen olmayan malzemeden yapılan maskeler ve kasklarda, birbirinden en az 150 mm arayla yerleştirilmiş ve tıkanmamış olan iki hava deliğinin olması gerekir.
Özellikle yumuşak naylondan olan ambalajlar çocuklar başlarına geçirdiklerinde boğulmalara sebep olmaktadır. Bu nedenle yumuşak naylondan olan ambalajlar da hava delikleri olmalı, üzerine “oyuncak değildir” diye yazılmalı.
Ağız ile ilgili oyuncakların veya bu oyuncakların ağız parçalarının kasıtlı olmadan yutulması ve kullananda asfiksi ile ölüme sebep olmaması için içe çekilebilecek küçük parçalardan oluşmaması gerekir. Bu gibi oyuncaklar kadar oyuncağın hareketli veya çıkartılabilir ağız parçalarının (bir trompetteki ağız parçası gibi) kasıtlı olmadan yutulabilecek veya içe çekilebilecek kadar küçük olmaması gerekir. Bu özellik oyuncağın düşünüldüğü çocuğun yaşı dikkate alınmaksızın uygulanır.
Genleşen malzemelerden yapılmış oyuncaklar ve oyuncak parçalarının sıvı içerisine konulduğunda % 50’den fazla genleşmemesi gerekmektedir.
f) Suyun üzerinde çocuğu taşıma ve destekleme yeteneğine sahip ve sığ suda kullanılması amaçlanan oyuncaklar, tavsiye edilmiş kullanımı nazara alındığında su üstünde durabilme ve çocuğu suda destekleme yeteneği kaybolmayacak şekilde tasarlanmalı ve üretilmelidir. Suda oynanan şişirilebilir oyuncaklarda, oyuncağa sabit olarak bağlanmış geri dönüşsüz valfler bulunmamalıdır. Oyuncak şişirildiğinde tapa, oyuncağın yüzeyinden çıkıntı yapmayacak şekilde, oyuncağın içine itilebilmelidir. İşaretleme tam olmalıdır.
g) Kolayca açabilecek bir çıkış yeri olmalı
Oyuncağın bir çocuğu kaplayacak veya kaplayamayacak şekilde tasarlanmış olmasına bakılmaksızın, bir çocuğun girebileceği çerçevelenmiş boşluk oluşturan bütün oyuncaklarda (Çadırlar, oyuncak sandıklar v.b ve uzay başlıkları gibi başı kaplayıcı oyuncaklar) havalandırma sağlanmalı ve çocuğun dışarıdan yardım almaksızın bu boşluktan çıkması mümkün olmalıdır.
Örneğin oyuncak ev öyle tasarımlanmalıdır ki çocuk tehlike anında yardım almaksızın çabuçak çıkabilmelidir.
h) Hareket kontrolünü sağlayan fren sistemi içermeli ve fırlatılma ve yaralanma riski içermemelidir.
Kullanıcıyı hareket ettiren oyuncaklarda mümkün olabildiği ölçüde, oyuncak tipine uyarlanmış ve oluşturduğu kinetik enerjiye orantılı bir fren sistemi oluşturulmalıdır. Kullanıcıyı hareket ettiren oyuncaklar oyuncak tipine uyarlanmış ve çocuğun kolayca kullanabileceği sisteme sahip olmalıdır. Bu sistem, kullanıcının fırlatılma ve yaralanma ve üçüncü kişilerin yaralanma riski olmaksızın kolayca kullanılmalıdır.
i) Ateşlemeli oyuncaklar fiziksel yaralanma riski minimum olmalıdır.
Ateşlemeli tasarlanan bir oyuncağın ateşlenmesi halinde oluşacak fırlatıcı cisimlerin yapısı ve bileşenleri ile kinetik enerjiden kaynaklanan kullanıcıların veya üçüncü kişilerin fiziksel yaralanma riski, oyuncağın yapısı dikkate alındığında kabul edilebilir sınırlar dışında olmamalıdır.
Oyuncakda risk en aza indirilmiş olsa bile mermili oyuncaklarda 3 şey önemlidir.
- Anne ve babanın bilgisi ve dikkati,
- İşaretler ve uyarılar olması,
- Merminin kinetik enerji ölçümü yapılması.
j) Isıtıcı parçaları içeren oyuncaklar yanma ve fiziksel yaralanmaya neden olmamalıdır.
Isıtıcı parçaları içeren oyuncaklar, aşağıdaki kriterleri sağlayacak şekilde üretilmelidir:
(1) Herhangi bir iletken yüzeyin azami sıcaklığı, dokunulduğunda yanmaya neden olmamalıdır.
(2) Oyuncağın içinde bulunan sıvı ve gazlar, oyuncağın fonksiyonlarına uygun nedenlerin dışında oyuncaktan sızması halinde, yanma, buhar yanığı veya diğer fiziksel yaralanmaya neden olabilecek şekilde sıcaklık ve basınca ulaşmamalıdır.
2.Alevlenebilirlik
a) Oyuncaklar, çocuğun çevresinde yanabilir tehlikeli bir durum meydana getirmemelidir. Bu nedenle oyuncaklar;
(1) Bir alev, kıvılcım veya diğer ateş çıkartabilecek maddelerle doğrudan karşı karşıya kaldığında yanmayan,
(2) Kolayca yanmayan (Ateşin nedeni yok olur olmaz alevi sönen),
(3) Tutuştuğunda, yavaş yanan ve alevin yayılma oranı düşük olan (yavaş yanan olmalı ki çocuk hemen içinden çıkabilmeli , elinden atabilmeli)
(4) Yanma süresini geciktirici maddelerden oluşmalıdır.
Bu çeşit yanabilir maddeler, oyuncaklarda kullanılan diğer maddeleri tutuşturma riski oluşturmamalıdır.
Sentetik çabuk yanabilen malzeme olmamalıdır.
Bu oyuncaklar; çocuk tarafından giyilen temsil kıyafetleri, peruk, doldurulmuş oyuncaklar, çocuğun içine girebileceği oyuncaklar ve v.b oyuncaklardır.
b) Tehlikeli Kimyasallar Yönetmeliğinde tanımlanan tehlikeli madde veya preparatları, içermemelidir.
c) Patlayıcı olmamalı veya patlamaya müsait madde veya parçaları içermemelidir. Bu hüküm, Özellikle kimyasal oyun ve oyuncaklar:
(1) Karıştırıldığında, ısınarak veya okside maddelerle birleşerek patlayabilen,
(2) Havada yanabilen ve buhar/hava karışımında yanabilen veya patlamaya müsait buharlı parçaları içeren madde veya preparatları içermemelidir.
Özetle yanabilecek materyal içermemelidir.
3) Kimyasal özellikler
a) Yutulduğunda, solunduğunda veya deri, göz ve deri ile temasında sağlık tehlikesi oluşturmamalıdır.
Belirli tehlikeli madde veya preparatların etiketlenmesi, kullanımının yasaklanması, kısıtlanması veya ürünlerin belirli sınıflandırmalarına ilişkin olarak ilgili mevzuata uygun olmalıdır.
b) Aşağıdaki maddelerin çözülebilir ekstraktın sahip olduğu toksikolojik değeri aşağıdaki düzeyleri geçmemelidir:
0.2 mikrogram antimon
0.1 mikrogram arsenik
25.0 mikrogram baryum
0.6 mikrogram kadmiyum
0.3 mikrogram krom
0.7 mikrogram kurşun
0.5 mikrogram civa
5.0 mikrogram selenyum
Vücuda girdiğinde vücuttan atılması zor olan bu maddeler sınırları geçmemelidir.
c) Tehlikeli Kimyasallar Yönetmeliğinde belirtilen tehlikeli maddeleri içermemelidir.
Bazı oyuncakların fonksiyonları itibariyle gerekli olması durumunda, belli bir miktarda madde veya preparatlara; özellikle, kimyasal deneylerde, maket yapımında, plastik veya seramik kalıplarda, minelemede, fotoğrafçılıkta veya benzer faaliyetlerde kullanılan maddelere, oyuncakların kullanımında alınacak tedbirlere ilişkin uyarı ve işaretlere ve etiketleme konusundaki düzenlemelere uygun olarak ve her madde için tanımlanan maksimum değerler çerçevesinde izin verilir.
4-Elektriksel Özellikler:
- Elektrikli oyuncakların anma gerilimi 24 voltu geçmemeli ve oyuncağın hiçbir parçasındaki anma gerilimi de 24 voltu geçmemelidir.
- Oyuncağın, kablolarla veya bu kablolara elektrik ileten diğer iletken maddelerle birlikte elektrik şokuna neden olabilecek elektrik kaynağıyla bağlantılı veya bağlantı kurabilecek parçaları, böyle şok riskini önlemek amacıyla uygun bir şekilde izole edilmeli ve mekanik olarak korunmalıdır.
-Elektrikli oyuncaklar, doğrudan temas edilebilecek yüzeylerinin ulaştığı azami sıcaklıklarının dokunulduğunda yanmaya neden olmayacak şekilde olmalıdır.
Elektro Manyetik Uyumluluk ve Alçak Gerilim Yönetmeliği de pille veya elektrikle şarj edilen oyuncakları kapsar.
5- Hijyen: Oyuncaklar, herhangi bir enfeksiyon, hastalık ve mikrop kapma riskini önleyici hijyen ve temizlik şartlarına uygun tasarlanmalı ve üretilmelidir.
6- Radyoaktivite: Oyuncaklar, çocuk ve diğer şahısların sağlığına zarar verebilecek yapı ve oranda radyoaktif maddeler veya parçalar içermemelidir. Bu konuda 24/3/2000 tarihli ve 23999 sayılı Resmi Gazete’ de yayımlanan Radyasyon Güvenliği Yönetmeliği uygulanacaktır.
Oyuncağın etiketinde/ambalajında olmazsa olmazlar
- CE işaretinin yanı sıra imalatçının veya ithalatçının adı ve/veya ticari adı ve/veya ticari markası görünür, kolayca okunur ve silinmez şekilde ya oyuncağın etiketine yada ambalajın üzerine iliştirmelidir. Küçük oyuncak veya küçük parçalardan oluşan oyuncaklarda ise, bu bilgiler aynı şekilde ambalaja, etikete veya broşüre iliştirilir.
- Bakanlık, piyasaya arz edilecek bütün oyuncakların ambalajlarında, etiketlerinde ve broşür/kullanım kılavuzlarında yer alan bilgilerin tamamını ve özellikle bazı oyuncaklar için aşağıda yer alan tedbirlerin ve uyarıların veya bunların bir kısmının Türkçe olarak hazırlanmasını talep eder.
1) 36 aydan küçük çocuklar için tasarlanmayan oyuncaklar
36 aydan küçük çocuklar için tehlikeli olabilecek oyuncaklar, kullanım kılavuzunda bu kısıtlamayı gerektiren riskleri belirten kısa bir not ile birlikte "36 aydan küçük çocuklar için uygun değildir" veya "üç yaşından küçük çocuklar için uygun değildir" gibi bir uyarı taşımalıdır. Yaş uyarısı EN 71-6 Oyuncak Güvenliği- Bölüm 6 standardında belirtildiği gibi bir sembollede değiştirilebilir.
Yukarıdaki husus kendi fonksiyonuna, boyutlarına, karakteristiklerine, özelliklerine veya diğer sebepler açısından 3 yaşından küçük çocuklara belirgin şekilde uygun olmayan oyuncaklara uygulanmaz.
3 yaş altı çocuğun kullanacağı oyuncaklara 3 yaş altı uyarısı konulması haklı görülemez.
3 yaş altı çocuğun kullanacağı oyuncaklara örnekler; Basit tasarımlı olan yap bozlar, çocuğun kendi bebeği veya kardeşi olarak görebileceği basit tasarımlı bebekler, yumuşak oyuncaklar ve yumuşak dolgulu oyuncaklar.
2) Çocuk kızakları, bir kirişe bağlanan asılı oyuncaklar, çemberler, trapezler, ipler ve benzeri oyuncaklar
Böyle oyuncaklara; kontrolünün ve askı, bağlantı parçaları, demirleme yeri gibi ana parçalarının bakımının belli aralıklarla yapılması gerektiği ve bu kontrollerin yapılmaması durumunda, oyuncağın düşme ve devrilmesi halinde yaratabileceği tehlikelere ilişkin açıklamaları içeren talimatlar iliştirilir.
Talimatlar, yanlış kurulması halinde tehlike arz edebilecek parçaları belirterek, oyuncağın doğru olarak kurulmasına ilişkin bilgileri de içerir.
3) İşlevsel oyuncaklar
İşlevsel oyuncaklardan kastedilen, yetişkinlerin kullanımına yönelik olan araç veya aletlerin, aynı işleve sahip küçük ölçekli modelleridir.
İşlevsel oyuncaklarda veya ambalajlarında "Dikkat: Yetişkin birinin gözetiminde kullanılacaktır." ibaresi yer almalıdır.
Bu oyuncaklara, kullanıcı tarafından alınacak tedbirlerle ve çalıştırma talimatları ile bu tedbirlerin alınmaması durumunda kullanıcıya verebileceği zararlarla birlikte, oyuncağın bir prototipi veya taklidine ilişkin talimatlar da iliştirmelidir. Ayrıca bu talimatlarda, oyuncağın çok küçük çocukların ulaşamayacağı yerde saklanması gerektiği de belirtilmelidir.
4) Tehlikeli madde veya preparatları içeren oyuncaklar
Kimyasal oyuncaklar;
a) Tehlikeli Kimyasallar Yönetmeliği hükümleri saklı kalmak kaydıyla, yapısı gereği tehlikeli maddeleri veya preparatları içeren oyuncakların kullanım talimatları; bu maddelerin veya preparatların tehlikeli yapısına ve oyuncağın türüne tam uygun olan madde veya preparatlarla birleştiğinde oluşacak tehlikelerden kaçınmak için kullanıcı tarafından alınması gereken tedbirlere ilişkin uyarıları içermelidir. Bu tür oyuncağın kullanımından kaynaklanan ciddi kazalarda, yapılması gereken ilk yardım belirtilmelidir. Bu oyuncaklarda çok küçük çocukların ulaşamayacağı yerde muhafaza edilmesine ilişkin bilgi de yer almalıdır.
b) (a) bendinde belirtilen talimatlara ek olarak, kimyasal oyuncakların, ambalajlarında aşağıda belirtilen uyarı yer almalıdır:
"Dikkat: Sadece (*) yaşın üzerindeki çocuklar içindir. Yetişkinlerin gözetiminde kullanılır.“
Özellikle, kimya setleri, plastik yerleştirme setleri, seramik minyatür atölyeler, mineleme veya fotoğrafçılık ve benzeri oyuncaklar, kimyasal oyuncaklar olarak kabul edilir.
5) Paten ve kaykaylar
Bu ürünler, oyuncak olarak satışa sunulduğunda, "Dikkat: Koruyucu ekipman giyinmelidir." “Vücut ağırlığı 20 kg’dan fazla olan çocuklar için uygun değildir” uyarısını üzerinde taşımalıdır. Ayrıca kullanım kılavuzu, oyuncakların üçüncü kişilere ve kullanıcılara zarar verebilecek düşme veya çarpmalardan kaçınmaları için azami dikkat ve özen göstererek kullanılması gerektiğini belirten uyarıyı içermelidir. Tavsiye edilen kask, eldiven, dizlik, dirseklik gibi koruyucu ekipman hakkında açıklayıcı bilgiler de verilmelidir.
6) Suda kullanılan oyuncaklar
Suyun üzerinde çocuğu taşıma ve destekleme yeteneğine sahip ve sığ suda kullanılması amaçlanan oyuncaklardır. Simitler, küçük deniz yatakları v.b (Kol bantları oyuncak değil yüzme yardımcıdır.) Banyo küvetinde kullanılan banyo oyuncakları, su içinde değil de esas olarak kumda oynanan şişirilebilir deniz topları da bu kapsamda değerlendirilmiyor
Suda kullanılan oyuncaklar, "Dikkat: Sadece çocuğun boyunu geçmeyen derinlikteki suda ve gözetim altında kullanılacaktır." uyarısını içermelidir:
7) Kauçuk Balonlar
Kauçuk Balonların ambalajı aşağıdaki uyarıyı taşımalıdır.
“Dikkat sekiz yaşından küçük çocuklar şişirilmemiş veya patlak balonları şişirirken boğulabilirler veya solukları tıkanabilir. Yetişkin gözetimi gereklidir. Şişirilmemiş balonları çocuklardan uzak tutunuz. Patlak balonları hemen atınız.”
Kauçuk balonlarda alerji riski mevcut bu nedenle doğal kauçuk balonların ambalajı “Doğal lastik kauçuktan yapılmıştır” ibaresini taşımalıdır.
8) Mermiler
Mermili oyuncaklarda, imalatçı tarafından verilen veya tavsiye edilenler dışındaki mermileri kullanmanın tehlikelerine dikkat çeken kullanma talimatları bulunmalıdır.
0.08 J’den daha fazla kinetik enerjili mermi fırlatabilen oyuncaklarda aşağıdaki uyarı bulunmalıdır.
“Dikkat Gözlere veya yüze doğrultmayınız.”
9) Koruyucu maskeler ve kaskların taklitleri
Koruyucu maskelerin ve kaskların taklitleri olan oyuncaklar (motosiklet kaskları, endüstriyel güvenlik kaskları ve itfaiyeci kaskları gibi) ve varsa bu oyuncakların ambalajı aşağıdaki uyarıyı taşımalıdır:
“Dikkat bu bir oyuncaktır. Koruma sağlamaz.”
10) Oyuncak Uçurtmalar
Oyuncağı çocuğa bağlayan ve uzunluğu 2 m’yi aşan ipleri bulunan oyuncak uçurtmalar ve diğer uçan oyuncaklar aşağıdaki uyarı taşımalıdır.”
“Dikkat Yüksek gerilim hatlarına yakın yerlerde ve şimşekli fırtınalar esnasında kullanmayınız.”
İpler yalıtılmış bir malzemeden olmalıdır. Elektrik teline takılabilir.
11) Beşik, bebek karyolası veya bebek arabasına gerilmek üzere tasarlanan oyuncaklar
Sicimler, ipler, elastikler veya bantlar vasıtasıyla bir beşiğe, bebek karyolasına veya bebek arabasına gerilmek üzere tasarlanan oyuncaklar aşağıdaki uyarıyı taşımalıdır:
“Dikkat Dolaşma sebebiyle oluşabilecek muhtemel yaralanmaları önlemek için, oyuncağı bebek emeklemeye başladığında çıkartınız.”
12) Sıvı doldurulmuş diş kaşıyıcıları
Sıvı doldurulmuş diş kaşıyıcılarında aşağıdaki talimat bulunmalıdır:
“Sadece ev tipi buzdolabında soğutulmalı, derin dondurucuya korunmamalıdır.”
Dişlikler delinmemeli, sıvı zararsız olmalıdır
13) Oyuncaklarda kullanmak için özel olarak tasarımlanan patlatma kapsülleri
Patlatma kapsüllerinin ambalajı aşağıdaki uyarıyı taşımalıdır:
“Dikkat Kapalı yerlerde veya gözlerin ve kulakların yakınında ateşlemeyiniz. Kapsülleri açık olarak cebte taşımayınız.”
14) Akustikler
Yüksek darbeli ses seviyeleri çıkaran oyuncaklar veya bu oyuncakların ambalajı aşağıdaki uyarıyı taşımalıdır:
“Dikkat Kulağa yakın olarak kullanmayınız. Yanlış yerde kullanmak işitme kaybına yol açabilir.”
Patlatma kapsülleri kullanan oyuncaklara ekleyiniz:
“Kapalı yerlerde ateşlemeyiniz
15) Oyuncak Bisikletler
Oyuncak bisikletler aşağıdaki uyarıyı taşımalıdır.
“Dikkat Bisiklete binilirken koruyucu kask takılmalıdır.”
Ek olarak, kullanma talimatlarında bu bisikletin işlek yollarda kullanıma uygun olmadığını belirten bir ibare de bulunmalıdır. Bunun dışında ebeveynler veya bakıcılar, çocukların oyuncak bisiklet kullanımında ve özellikle de fren sistemlerinin güvenli kullanımında gerektiği gibi bilgilendirildiklerinden emin olmalıdır.
2 tekerlekli bisikletlerde fren sistemi olmalıdır.
3 tekerlekli bisikletlerde denge unsuru aranmalıdır.
16) Bir çocuğun kütlesini taşıması tasarlanan oyuncak
Yapımları,dayanıklılıkları, tasarımları veya diğer faktörlere bağlı olarak 36 aylıktan büyük çocuklar için uygun olmayan oyuncaklar, aşağıdaki kısıtlamayı gerektiren özel sebebin (yetersiz dayanıklılık gibi) kısa bir açıklaması ile birlikte:
“Dikkat 36 aylıktan büyük çocuk tarafından kullanılmamalıdır” şeklinde bir uyarı taşımalıdır.
Yaş uyarısı mamulün satıldığı yerde açıkça okunabilmelidir.
17) Tek lifli elyaflar içeren oyuncaklar
Kumaş bir tabana tutturulan ve düz uzunluğu 50 mm’den fazla olan tek lifli elyaflar içeren oyuncaklar aşağıdaki gibi etiketlenmelidir:
“Dikkat uzun saçlarından ötürü 10 aylıktan küçük çocuklar için uygun değildir.”
III. OYUNCAKTA UYGUNLUK DEĞERLENDİRMESİ
Ürünün teknik düzenlemesine uygunluğunun test edilmesi ve belgelendirmesi işlemidir
I)Üretici Beyanı
-Üretici standardları uygular; tasarım, imalat ve faaliyetine ilişkin teknik dosyasını hazırlar
-İmalat sürecinin dolayısı ile ürünün teknik dosyasına uygunluğunu garanti altına alır
-Üretici CE işaretini, kendi adını ve adresini ürünü piyasaya arz etmeden önce oyuncağın üzerine ve/veya etiket ve/veya ambalajına iliştirir
- Üretici, yetkili kuruluş tarafından istendiği takdirde sunmak üzere teknik dosyasını 10 yıl boyunca muhafaza eder.

- Ürünün genel tanımı, planlanıyorsa varyantları
- Dizayn çizimleri, planlama metodları ve parçalarının diagramları,
- Üretim aşamaları,

II) AT Tip İncelemesi
-Üretici Uyumlaştırılmış Ulusal Standardlara kısmen uyduğunda veya temel gereklere uygunluk sağladığında; tasarım, imalat ve faaliyetine ilişkin teknik dosyasını hazırlar
- AT Tip incelemesi için üretici, oyuncağın modeli ve tasarım dosyası ile birlikte onaylanmış kuruluşa başvurur
- Onaylanmış Kuruluş incelemeler ve testler gerçekleştirerek oyuncak modelinin temel gereklere uygunluğunu test eder. AT Tip İncelemesi belgesini hazırlar
- İmalat sürecinin dolayısı ile ürünün AT Tip inceleme belgesinde tanımlanan tipe uygunluğunu garanti altına alır
- Üretici CE işaretini, kendi adını ve adresini ürünü piyasaya arz etmeden önce oyuncağın üzerine ve/veya etiket ve/veya ambalajına iliştirir
- Üretici, yetkili kuruluş tarafından istendiği takdirde sunmak üzere At Tip İnceleme belgesinin bir kopyası ile birlikte teknik dosyasını 10 yıl boyunca muhafaza eder.
Teknik dosya;
- Ürünün genel tanımı, planlanıyorsa varyantları
- Dizayn çizimleri, planlama metodları ve parçalarının diagramları,
- Üretim aşamaları,
- Hammaddeler,
- Üreticinin AT Tip İncelemesi için onaylanmış kuruluşa sunduğu belgelerin kopyaları
- Onaylanmış Kuruluş tarafından model için verilen AT Tip İncelemesi belgesinin onaylı bir örneği

- Kullanma talimatları,
- Paketleme şekli ve etiketler,
- Üretici veya ithalatçısının adresi,
-Üretim yerlerinin ve depolarının adresleri,
- Piyasada bulunan aynı oyuncağa dair dağıtım kanalları hakkında bilgiyi içerir.
AT Tip İncelemesi üreticinin Uyumlaştırılmış Ulusal Standardları uygulamadığı, Uyumlaştırılmış Ulusal Standardları kısmen uyguladığı veya bu tür standardları olmayan oyuncaklar içindir.
Bu oyuncaklar;
- EN 71 seri Uyumlaştırılmış ulusal standardlarının uygulama alanı dışında bırakılmış olan oyuncaklar
- Uyumlaştırılmış ulusal standardlarının güvenlik boyutlarını tamamen kapsamadığı oyuncaklar
Bu oyuncaklara en belirgin örnekler; Skooterlar, küçük top içeren çıngıraklar, emme kapları
IV- PİYASA GÖZETİMİ VE DENETİMİ
-Ürünün piyasaya arzı veya dağıtımı aşamasında veya ürün piyasada iken, ilgili teknik düzenlemeye uygun olarak üretilip üretilmediğini,
-Güvenli olup olmadığını denetlemek veya denetlettirmek,
-Güvenli olmayan ürünlerin güvenli hale getirilmesini temin etmek,
-Gerektiğinde yaptırımlar uygulanmasını sağlamak amacıyla Bakanlık tarafından yapılacak her türlü faaliyeti kapsar.
- Bakanlığımız sorumluluğundadır. Bakanlığımız piyasa gözetimi ve denetimini İl Müdürlüklerindeki denetçileri aracılığıyla yürütür, piyasa gözetimi ve denetimi sonucunda gerekli önlemleri alır ve 4703 Sayılı Kanun ve 765 sayılı Türk Ceza Kanunu’na göre cezai müeyyideleri uygular.
Piyasa Gözetimi ile İlgili Prensipler
*Piyasa gözetimi ve denetimi ürünün piyasaya arzı veya dağıtımı aşamasında veya ürün piyasada iken ilgili mevzuata uygun olarak üretilip üretilmediğini, güvenli olup olmadığını denetlemesi veya denetlettirmesi faaliyetini içermektedir.
*Piyasa gözetimi özellikle ürünlerin mevzuat gereklerine uyup uymadığının kontrolünü ve uygun olmayan ürünlerin uyumunu ve gerektiğinde tedbirler alınması suretiyle, yeni yaklaşım direktiflerinin uygulanması için etkili bir araçtır.
* Piyasa gözetimi kamu mercilerinin sorumluluğudur.(Bakanlık)
*Vatandaşlar ürünün menşei ile ilgili olmaksızın bütün Ülke piyasası kapsamında eşit bir korumaya tabidirler.
* Devlet piyasa gözetiminden ve ilgili mercileri kurmaktan sorumludur. Bu merciler gözetim faaliyetleri için gerekli kaynaklara ve güce sahip olmalı, personellerinin teknik kifayetini ve mesleki tutarlılıklarını temin etmeli, bağımsız ve ayrım yapmaksızın hareket etmelidirler
* Devlet ürünlerin doğru olarak inşa, tesis edildiği ve bakımı yapıldığı veya amacına uygun kullanıldığı durumlarda, sadece insan sağlık ve güvenliğini veya mevzuatın kapsadığı diğer menfaatleri tehlikeye atmadıkları takdirde piyasaya arz edilmesini ve hizmete sokulmasını temin edecek gerekli tedbirleri almalıdır.
* Piyasa gözetimi mercileri gözetim faaliyetlerini yerine getirebilecekleri gerekli kaynak ve güce sahip olmalıdır. Böylece piyasaya arz edilen ürünleri izlemek ve uygunsuzluk durumunda uygunluğu sağlamak için gerekli tedbirleri alabilirler
* Bakanlık kararlar üzerindeki bütün sorumluluğu almak kaydıyla ve bu mercinin gözetim görevleriyle diğer kuruluşun uygunluk değerlendirme faaliyetleri arasında menfaat çatışması olmaması şartıyla, teknik görevleri (test ve muayene gibi) taşerona devredebilir.
* Genel bir kural olarak onaylanmış kuruluşların piyasa gözetiminden sorumlu olması uygun değildir. Menfaat çatışmasını engellemek için uygunluk değerlendirmesi ( ürün piyasaya konulmadan önce gerçekleştirilen) ve piyasa gözetimi ( ürün piyasaya sunulduktan sonra gerçekleşen) arasında açık bir ayrım yapılmalıdır.

Piyasa gözetimi 2 ana aşamadan oluşur
1) Bakanlık piyasada bulunan ürünlerin Oyuncaklar Hakkında Yönetmelik hükümlerine uygunluğunu izler,
2) Gerektiğinde sonradan uygunluğu sağlayacak önlemleri alır
Piyasadaki Ürünlerin İzlenmesi
- Piyasadaki ürünleri izlemedeki amaç; bu ürünlerin piyasada iken ilgili mevzuat ile uyum içinde olduğunu doğrulamaktır. Bu konuda Teknik dosya piyasa gözetimini yapan birimlere ürün hakkında gerekli bilgileri sağlayacaktır.
- Temel olarak piyasa gözetimi ve denetimi, üreticinin genellikle CE işareti iliştirmek suretiyle ürünün uygunluğu ile ilgili olarak resmi sorumluluğu üzerine almasından önce, yani tasarım ve üretim aşamalarında gerçekleştirilemez.
- Her ne kadar piyasa gözetimi temel olarak, tasarım ve üretim aşamalarında gerçekleştirilemiyorsa da, İl Müdürlükleri uygunsuzluk tespit edildikten sonra sabit bir hatanın oluşup oluşmadığını doğrulamak için üretim yerinde kontrollerde bulunabilir.
- Uyguladığımız mevzuatlara uygun olmayan ürünlerin “uygun hale gelinceye kadar piyasaya sürülmeyeceğinin ve hizmete sunulmayacağının” açık bir şekilde belirtilmesi ve gerektiğinde kişilerin korunması bakımından sergi boyunca gerekli önlemlerin alınması şartıyla, sergi ve fuarlarda uygunsuz ürünlerin gösterimine izin verilebilmektedir. Ancak İl Müdürlükleri bu yükümlülüğe riayet edilip edilmediğini (Uygun olmayan ürünlerinin sadece gösterim amacıyla geldiğini ve piyasa sürülmediğini)izlemelidirler.
- Piyasa gözetim ve denetiminde öncelikle CE işareti ve bunun iliştirilmesi, ürünle birlikte bulunması gereken bilgiler (etiket/ambalaj bilgileri) ve uygunluk değerlendirme prosedürlerinin doğru seçimi gibi hususlar tetkik edilir. Ancak ürünün uygunluğunu doğrulamak için bunun yanında daha esaslı kontroller gereklidir. Örneğin; uygunluk değerlendirme prosedürlerinin doğru uygulanıp uygulanmadığı, temel gereklere uygunluğu gibi)
Teknik Dosyanın talebi ile ilgili prosedür;
- Piyasa gözetimi sırasında ürünle ilgili olarak bilgi almayı sağlayacak araç teknik dosyadır. Teknik dosya; üretici, Ülkedeki yetkili temsilcisi veya belli koşullarda ithalatçı veya ürünün piyasaya arzından sorumlu kişi tarafından kontrole hazır tutulmalıdır. Dağıtıcılar, perakendeciler, tedarikçiler veya taşeronlar gibi öteki tüzel ve gerçek kişiler bunları hazır bulundurmakla yükümlü değildirler. Ancak bunları elde etmede Bakanlığa yardımcı olabilirler.
- Teknik dosya söz konusu risk ve öneme uygun bir zaman süresi içinde Bakanlık veya İl Müdürlüklerinin kullanımına sunulmak üzere hazır bulundurulmalıdır, fakat Bakanlık veya İl Müdürlükleri bunları sistematik bir şekilde isteyemez. Genel olarak, yalnızca piyasa gözetimi amacıyla yapılan rasgele kontroller esnasında veya bir ürünün hiçbir bakımdan koruma düzeyini sağlamadığı yönünde bir endişenin bulunduğu durumlarda istenebilir. İlk olarak, eğer hazırlanmışsa, izin verilen makul bir süre içinde Bakanlık veya İl Müdürlüklerine teknik dosyanın sadece bir özeti(temel teknik veriler) sağlanabilir. Daha detaylı bilgiler(örneğin; belgeler ve Onaylanmış Kuruluşun kararları) ürünün mevzuata uygunluğu konusunda ciddi şüphelerin bulunduğu durumlarda talep edilebilir. Teknik dokümantasyonun tamamı ancak, açıkça gerekli olduğu durumlarda talep edilebilir ve örneğin sadece bir detayın kontrol edilmesi zarureti gibi durumlarda istenemez. Bu talep oranlılık ilkesine uygun olarak değerlendirilmeli ve bu yüzden de kişilerin sağlık ve emniyeti ve direktifte öngörülen öteki kamu yararlarını temin etme ve ekonomik operatörleri gereksiz yüklerden koruma ihtiyacı göz önünde bulundurularak değerlendirilmelidir. Ayrıca, Bakanlık veya İl Müdürlükleri tarafından yapılan haklı bir isteğe karşılık kabul edilebilir bir gecikme süresi içerisinde gerekli belgelerin sunulamaması, mevzuatın gereklerine uygunluğun mevcut olmadığı şüphesi için yeterli bir gerekçe oluşturabilir.
Bakanlık veya İl Müdürlükleri teknik dosyanın Türkçe birer tercümesini talep edebilir. Bakanlık veya İl Müdürlükleri tercümeyi gerekli görürse dokümantasyonun tercümesi yapılacak kısmını açıkça belirlemek ve tercümenin yapılabilmesi için makul bir süre izin vermesi gerekmektedir. Tercüme ile ilgili olarak çeviriyi yapacak olanın akredite edilmiş veya yetkili kamu kuruluşları tarafından tanınmış olması gereği gibi daha başka koşullar getirilemez
Teknik dosyayı Ülke içinde kullanıma hazır bulundurmak mümkün olmalıdır. Bunun kullanıma hazır tutulmasından kasıt teknik dosyanın Bakanlık veya İl Müdürlüklerinden gelen talep üzerine, bu sorumluluğu taşıyan kişinin dosyayı yanında bulundurması değil istenildiği zaman temin edebilmesidir. Ayrıca, teknik dosya söz konusu risk ve öneme uygun bir süre zarfında hazırlanmasını mümkün kılan herhangi bir formatta bulundurulabilir(örneğin; basılmış evrak veya CD-ROM olarak).
Bakanlık veya İl Müdürlükleri piyasa gözetimi boyunca teknik dosyanın içeriği ile ilgili olarak bilgi alan herkesin ulusal mevzuatta belirlenmiş olan kurallara göre gizliliğe bağlı kalmalarını temin etmek zorundadırlar.
Piyasa gözetiminin etkin olabilmesi için imkanlar, risk ihtimalinin daha yüksek olduğu veya uygunsuzluğun daha sık gerçekleşebileceği veya özel bir çıkarın söz konusu olduğu yerlerde yoğunlaştırılmalıdır. Bu amaçla istatistikler ve risk değerlendirme prosedürleri kullanılabilir.
Düzeltici Önlemler ;
*Bir önlem alınmadan önce ilgili tarafa bildirilmeli ve konu aciliyet göstermiyorsa danışma imkanı sağlanmalıdır.
*Öncelikle, üretici veya yetkili temsilcisi, ürününü mevzuatla uyumlu hale getirmek ve ihlale çare bulmakla yükümlü kılınmalıdır.
*Nihai olarak ise, yukarıdaki önlemlerin başarısız olduğu ve yeterli olarak görülmediği yerlerde söz konusu ürünün piyasaya sürülmesini ve hizmete sunulmasını kısıtlayıcı veya yasaklayıcı ve piyasadan toplatılmasını temin edici bütün uygun önlemler alınmalıdır.
-Düzeltici önlemler uygunsuzluğun derecesine bağlı olarak değişirler ve bu yüzden orantılılık ilkesine uygun olmak zorundadırlar. Ancak, tali ve asli uygunsuzluk arasındaki farklılıklar her zaman açık olmamaktadır ve her durum için ayrı ayrı karar verilmelidir. (CE işaretinin yanlış iliştirilmesi, örneğin; tasarım, ebat, görünürlük, silinmezlik ve okunaklılık gibi konular her zaman için tali bir uygunsuzluk olarak görülebilir. Tipik önemsiz uygunsuzluk örnekleri Oyuncaklar hakkındaki yönetmelikte öngörülen öteki uygunluk işaretlerinin yanlış iliştirildiği yerlerde veya gerekli olduğu halde ürünle birlikte bulunmadığı yerlerde veya Yönetmelikte ürüne öteki bilgilerin eşlik etmesi gereğine uyulmadığı durumlarda söz konusu olabilir.
Oyuncaklar Hakkındaki Yönetmelikteki Temel gereklere uygunsuzluk asli bir uygunsuzluk olarak kabul edilmelidir ve çünkü bu örneğin; vatandaşların sağlık ve emniyeti açısından potansiyel veya gerçek bir risk oluşturabilir. )
- Uygunluğun sağlanması üreticiyi, yetkili temsilcisini veya öteki sorumlu kişileri gerekli önlemleri almaya zorlamakla başarılabilir. Bakanlık ile yapılan danışmaların veya resmi veya gayrıresmi uyarıların bir sonucu olarak eğer gerekli önlemler (örneğin; ürün değiştirilebilir veya piyasadan toplatılabilir) alınırsa düzeltici faaliyet de yerine getirilmiş olur.
Tali uygunsuzluğa karşı alınan önlemler iki düzeyde olabilir:
- İlk olarak, Bakanlık, üreticiyi veya yetkili temsilcisini piyasaya sürmeyi planladığı ürününü gerekiyorsa piyasaya daha önce sürülmüş olan ürününü de, ilgili hükümlerle uyumlu hale getirmeye ve ihlale çözüm bulmaya zorlamalıdır.
- İkinci olarak, bir sonuca varılamazsa, Bakanlık nihai olarak, ürünün piyasaya arzını kısıtlayıcı veya yasaklayıcı olan veya piyasada bulunan ürünleri toplamayı temin edecek daha ileri aşamadaki bir önlemi alabilirler.
Önemli derecede bir uygunsuzluğun olduğu durumlarda, Bakanlık uygunluğu temin amacıyla bütün önlemleri almak zorundadır.
Nihai olarak, öteki çözümlerin hiçbiri mevzuatta öngörülen yüksek düzeyde bir korumayı sağlamada yeterli olmazsa Bakanlık ürünün piyasaya arzını kısıtlar veya yasaklar ve piyasadan toplatılmasını temin eder.
Ürünün piyasaya sürülmesini kısıtlamaya veya yasaklamaya yönelik tedbirler, Bakanlığa ürünün tehlikesi veya öteki asli derecedeki uygunsuzluğu ile ilgili yeterli kanıt elde etmelerine imkan sağlayacak şekilde evvela geçici tedbirler olarak uygulanabilirler.
Bakanlık tarafından ürünün piyasaya arzını kısıtlamak veya yasaklamak veya ürünü piyasadan toplatmak amacıyla alınan kararlarda bu kararların esas aldıkları dayanaklar tam olarak belirtilmelidirler (4703 sayılı kanun ve bu kanunla ilgili yönetmelikler ve oyuncaklar hakkında yönetmelik ). - Tehlikeye maruz olabilecek kişileri uyarma, tehlikeli ürünleri yok etme ve ihracatlarını yasaklama, bu tür ürünlerin kullanımını yasaklama ve belgelerin geri çekilmesini temin etme imkanına sahip olmak
Oyuncak Yönetmeliği uygun olmayan ürünlere CE işareti iliştiren kişilere karşı önlemler alınmasını da gerektirmektedir. Bu tür önlemler uygun olmayan ürünün piyasaya arzından sorumlu olan üreticiye ve öteki kişilere karşı da alınmalıdır. Bu önlemler yasal süreçleri veya uyarıları kapsayabilir.
Genellikle, aynı ürün serisinden gelen bazı ürünler daha önce satılmış olacaklardır, hatta uygunsuzluğun tespitinden önce kullanıma bile sokulmuş olacaklardır. Bu tür durumlarda, bir üründen kaynaklanan tehlikelere maruz kalabilecek olan kişilerin bilgilendirilmesinin temini önem arz etmektedir. Ulusal önlemlerin haklılığını gösteren bulgular Bakanlığın kendi insiyatifleri ile veya üçüncü bir taraftan(tüketiciler, rekabetçiler, tüketici dernekleri gibi) alınan bilgiye dayanarak tesis edilir. Ayrıca, ulusal önlemler ürünün tasarımında ve üretimindeki kusurları ve ürünlerin doğru bir biçimde üretilip, kurulup, bakımı yapıldığında ve tasarlanan amaca uygun kullanıldığında bile taşıyabileceği muhtemel ve gerçek tehlikeleri göstermek için yeterli araç oluşturan kanıtlara(örneğin; test ve incelemeler) dayanmak zorundadır. I-LEGAL REGULATIONS
The Article 8 and 11 of the Turkey-EU Partnership Council decision No:1/95 stipulates the transposition of Turkey’s national legislations with the EU Acquis.
The European Union adopted directives for each product group in order to remove the technical obstacles in front of trade and each Member Country was obliged to implement these directives. Turkey, though not a member of the European Union yet, in order to join the union, has to transpose the said directives and incorporate them into its own legislations. EU directive falls into two categories as the new approach and the classical approach.
The New Approach; stipulates the use of the CE Mark. The Toys Directive being a new approach directive stipulates the affixing of the CE mark to products before placement on the market.
Within the scope of the mentioned transposition tasks, the Legislation no. 4703 on “The Preparation and Implementation of the Technical Legislation on Products” (the framework legislation) and Regulations for the Implementation of the Legislation were enforced .
These regulations are;

* Regulation on Conformity Assessment Organizations and Notified Bodies
* Regulation On The Notification Of Technical Legislation And. Standards Between Turkey And The EU
In this respect our ministry has prepared the necessary applicable legislation on toys.
And it was transposed with the Council Directive 88/378/EEC of May 3 1988, on the approximation of the laws of the Member States concerning the safety of toys and the Council Directive 93/68 dated July 22,1993 which amended it.
THE FRAMEWORK LEGISLATION
This legislation which was published in the Official Gazette Issue no:24459 of July 11,2001 and entered into force on January 11 2002, was essentially introduced to lay down duties of the State, manufacturers, and conformity assessment organizations in ensuring that products placed in the market are safe and do comply with applicable technical legislations.
In this respect, the legislation lays down the general guidelines of the system necessary for attaining the aforementioned overarching goal, as well as the rights and liabilities of all the actors within the chain.
Regulations for Implementation of the Framework Legislation
1. Regulation on “Affixing the CE Conformity Marking of Products and its use”
This Regulation which was published in the Official Gazette Issue no:24643 of January 17,.2002 and entered into force on January 11 2002, aims to lay down the methods to be followed in affixing of the “CE” Conformity Mark to products, which certifies that certain products were manufactured in conformity with the applicable technical regulations, and this conformity was verified by the manufacturer or the authorized bodies within the framework of the system stipulated by the Legislation No: 4703. It also lays down the rules to be followed during use of this mark.
This regulation which lays down the general guidelines for affixing the CE conformity Mark to products as well as the use of this mark, as mentioned in Article 23, are implemented only together with the mentioned technical regulations following their publication in the official gazette and entry into force. With the enforcement of the Toy Regulation on November 17 2003, all toys are required to carry the CE marking.
2. The Regulation on Surveillance and Inspection of Products
This regulation, published in the Official Gazette Issue no:24643 on January 17,.2002 and entered into force on January 11 2002; lays down the rules for establishment of the Market Surveillance and Inspection system in our country and its effective pursuance; It puts the state in charge of the market control for product safety and arranges in detail, the measures to be taken about products detected to be unsafe. The said legislation lays down and defines :
• Principles on the preparation of the technical regulations pertaining to products, conformity to relevant technical regulations and product safety,
• Responsibilities of manufacturers and distributors in placing products on the market and the principles and guidelines for market surveillance and inspection.
• Powers and responsibilities of the authorized organizations in detecting whether products do comply with related technical regulations, during their placement, distribution and sales in the market,
• Establishment of the Market Surveillance and Inspection Coordination Board for the purpose of ensuring coordination between the authorized organizations; duties of this board and the guidelines and principles for its operation.
3. Regulation on Conformity Assessment Organizations and Notified Bodies
This regulation which was published in the Official Gazette Issue no:24643 of January 17, 2002 and entered into force on January 11, 2002, lays down the guidelines and principles of operation for; conformity assessment organizations and notified bodies, which test, examine and certify the conformity of products (that are aimed to be placed on the market), to applicable technical regulations. It also covers the basic criteria the said organizations are expected to meet and defines the penal sanctions to be imposed in connection with their operations. (Annex-1)
4. Regulation On The Notification Of Technical Legislation And. Standards Between Turkey And The EU
This regulation which was published in the Official Gazette Issue no:24715 of April 3 , 2002 and entered into force on May 3, 2002, covers the principles and procedures for the notification of EU about the technical legislation and standards, as well as the principles and procedures for the communication of notifications received from the EU to the authorized organizations in Turkey.
5. The Regulation on Guidelines and Principles for Market Surveillance and Inspection to be conducted by the Ministry of Health
This regulation which entered into force and published in the Official Gazette Issue no:26563 of June 25, 2007 lays down the principles and guidelines for surveillance and inspection of whether products in the field of operation of the Ministry of Health do comply with related technical regulations, during their placement, distribution and sales in the market, measures to be taken, as well as the powers and responsibilities of the Ministry of Health in this field and the liabilities of the manufacturer and , and the principles and guidelines for the in-service training and certification of the personnel to conduct the market surveillance and inspection. 6. Regulation on Toys
This regulation which was published in the Official Gazette Issue no:24758 on May 17,.2002 and entered into force on November 17 2003 lays down the essential requirements that needs to be met regarding safety of toys as well as the principles and guidelines for placement of toys on the market, as well distribution, and surveillance and inspection in the market.
II. REGULATION ON TOYS
Regulation on Toys which transposed the Council Directive 88/378/EEC on Toys, was published in the Official Gazette Issue no: 24758 on May 17,.2002 and entered into force on November 17 2003. Amendments to the Regulation on Toys entered into force following their publication in the Official Gazette Issue no: 25293 on November 18,.2003 and the Official Gazette Issue no:26354 on November 22,.2006. (Annex 4). Also, within the scope of the adjustment to EU acquis, predicated on the Council Directive 2005/84/EC, the Communiqué on Phalates in Toys and Child Care Appliances entered into force following its publication in the Official Gazette Issue no:25972 on October 20, 2005.
Purpose of the Regulation: aims to define the essential requirements regarding safety of toys as well as the principles and guidelines for placement and distribution of toys in the market, as well as surveillance and inspection in the market.
Scope of the Regulation: The regulation lays down the essential safety requirements, while the detailed technical specifications are laid down in the standards.

What are Toys?
Toys are all sorts of products, play materials and equipment designed and manufactured exclusively, for use in play by children under 14 years of age.
According to report CR 14379: 2002 of the European Committee for Standardization the classification of toys are as follows :(Annex 6)

Products Not Regarded As Toys
Though some products may appear as toys at the first look; they shall not be regarded as so if they;
-are not designed for children
-or contain risks that are not covered in the regulation.In fact, the definition of "toy" in the Regulation is clear enough to a distinction on the Classification of a product as toy or not. Nevertheless, there are some grey zone products that are difficult to classify.
In order to decide whether or not a product is a toy or not, the following shall be taken into consideration:
• Place of sale (Ex: Products for adults collectors are usually sold in specialized shops)
• target audience according to the advertising and packaging (packaging and advertising designed to attract children would indicate that the product is a toy)
• Price (products intended for adults and collectors are expensive);
• Size;
• double use: (when a product has a intended playing use as well as another intended use ,it could be considered as toy if it has a significant playing value)
Products which are not regarded as toys are listed in Annex-1
These are:
1. New Year's decorations.
2. Detailed scale models for adult collectors.
3. Equipment intended to be used collectively in playgrounds.
4. Sports equipment.
5. Aquatic equipment intended to be used in deep water.
6. Folk dolls and decorative dolls and other similar articles for adult collectors.
7. ‘Professional’ toys installed in public places (shopping centers, stations etc.).
8. Puzzles with more than 500 pieces or without picture, intended for specialists.
9. Air guns and air pistols.
10. Fireworks, including percussion caps.
11. Slings and catapults.
12. Sets of darts with metallic points.
13. Electric ovens, irons or other functional products operated at a nominal voltage exceeding 24 volts.
14. Products containing heating elements intended for use under the supervision of an adult in a teaching context.
15. Vehicles with combustion engines.
16. Toy steam engines.
17. Bicycles designed for sport or for travel on the public highway.
18. Video toys that can be connected to a video screen, operated at a nominal voltage exceeding 24 volts.
19. Babies’ dummies
20. Faithful reproductions of real firearms.
21. Fashion jewellery for children.
Placement of Products on the Market
“Placing of products in the market” means putting toys in the market as supply or as consumption goods, either for sale or free of charge. Only such toys, which protect, the users of toys as well as third parties, against health hazards and risk of physical injury when toys are used as intended or in a forseeable way, bearing in mind the normal behaviour of children, shall be placed on the market
Products that are placed on the market must meet the essential requirements stated in this regulation when used as prescribed within the intended lifespan.
Products complying with the provisions of this regulation may not prevented from being placed on the market.
Responsibilities in Placement of Products on the Market
-State's Responsibility
• Primary responsibility of the State is to lay down the rules to be followed by the manufacturers in question so as to ensure products are manufactured in a way that will ensure the highest possible level of safety for consumers and other beings under risk.
• Secondary Responsibility of the State is to conduct inspection of the product prior to placement on the market, through third party conformity assessment, and boost the effectiveness of the inspection process.
In fact this is the very essence of the newly introduced system. Through the system arranged under the Framework Legislation, the State will be able to make an effective inspection of the product prior to its placement on the market through the conformity assessment organizations/notified bodies which are regarded as third party assessment organizations.
• The Final Responsibility of the State is the surveillance and inspection works to be conducted after the product is placed on the market. The state inspects whether or not products in the market are safe and in conformity with the legislations.
-Manufacturer Responsibility Manufacturer refers to real or legal persons which manufacture or refurbish toys, or introduce themselves as manufacturer by printing their trademark or distinctive brand on the product; or the importer for that matter in cases where the manufacturer is based abroad.
• The Manufacturer must place safe products on the market.
• The Manufacturer when manufacturing safe products may choose to resort to 3rd Party Assessment, if the applicable technical legislation allows or stipulates so. In other words the manufacturer verifies the conformity of the product by having a conformity assessment organization examine the product. However if the product nevertheless proves to be unsafe in the end, the manufacturer is the ultimate responsible party.
Should the product prove to be unsafe, the manufacturer is obliged to notify and announce the unsafe elements. The most important factor that will force the manufacturers to make safe products and maximize the safety of the consumers is the obligation of Manufacturers (in the event that the unsafety is detected in the surveillance and inspection conducted after placement in the market) to notify and inform the consumers who have purchased and are using the product, about elements of unsafety, and declare that it has manufactured an unsafe product, through the media an press organs. Furthermore it is the manufacturer's responsibility to take samples from the products placed of the market, to make tests, to investigate the complaints and inform the distributors about the results of the inspection, as well as recalling products found to be unsafe, correcting the unsafety or disposing the products.
• The manufacturer is obliged to save all the documents (technical dossier) stipulated in the applicable technical regulation for duration of ten years and present it to the authorized institutions when requested.
Responsibilities of the Distributors/Dealers
- The distributor may not place on the market products it knows to be unsafe
- Any distributor who fails to identify the manufacturer or whom he supplied the products from, within the timeframe allowed by the Authorized Organization, shall be treated as the manufacturer.
The Framework Legislation features provisions stipulating fines, however these fines are not the backbone of the system. If the relevant public institutions do not foresee fines for the same act under existing legislation, only then the penal sanctions stipulated by the Framework Legislation shall apply.
Safe Products;
- are toys that satisfy the minimum safety requirements in regards to human health, safety of human life and property, as well as protection of consumers.
- Products complying with the regulation are presumed to be safe
Compliance of Toys
Products which bear the CE Mark as stipulated by the Regulation, are presumed to be in conformity with the provisions of the Regulation; this is so also so during the conformity assessment procedures.
CE Mark
- must be affixed to the Toys
- It is a declaration that the manufacturer has completed the conformity assessment procedures.
- A. CE Mark in a visible, easily legible and indelible form and not smaller than 5mm in height, must be affixed to the product, its labeling and packaging.
Harmonised National Standards
The toys covered under this regulation which are produced in conformity with the applicable harmonized standards, are presumed to be in compliance with the basic requirements in Annex II.

Essential Requirements for Toys
In cases where the manufacturer has not applied thetranspposed national standards referred to in paragraph 1, or has applied them only in part, or for which no such standards exist, satisfy the essential requirements referred to in Annex II, where, after receipt of an EEC type-examination certificate, their conformity with the approved model has been certified by the affixation of the EC mark
I) Guidelines for Toys
a) Users and third persons should be protected against
- health hazards
- and physical injury risks.
These risks are:
- which are connected with the design, construction or composition of the toy;
- which are inherent in the use of the toy and cannot be completely eliminated (For Ex: The sharpness of the knives in the toy kitchen sets, comes from the nature of this toy. However, a warning should be placed on the labeling- saying children should only play with these under adult supervision.)
2. The ability of the users shall be taken into account, in particular, in the case of toys which are intended for use by children under 36 months, the minimum intended age should be stated.
The degree of risk present in the use of a toy must be commensurate with the ability of the users, and where appropriate their supervisors, to cope with it. This applies in particular to toys which, by virtue of their functions, dimensions and characteristics, are intended for use by children of under 36 months.
To observe this principle, a minimum age for users of toys and/or the need to ensure that they are used only under adult supervision must be specified in the labeling
(As mentioned in Annex IV)
II. Peculiar Risks
This section explains the rules to be followed in the making and designing safe toys.
The rules listed below cover the inherent risks during use of toys by children or supervisors attending them, under normal circumstances and recommended conditions .
1. Physical and Mechanical Properties
Toys;
1) should be mechanically durable
Toys and their parts and, in the case of fixed toys, their anchorages, must have the requisite mechanical strength and, where appropriate, stability to withstand the stresses to which they are subjected during use without breaking or becoming liable to distortion at the risk of causing physical injury.
For example baby strollers (toys) are used to carry dolls but because sometimes children may sit in it themselves for play, materials used in the making must be able to carry a certain load.
2) should not carry risks of physical injury upon contact.
Accessible edges, protrusions, cords, cables and fastenings on toys must be designed and manufactured in such a way that the risks of physical injury from contact with them are reduced as far as possible.
For example; the edges of bows and arrowheads should not be made of metal. (Sets of darts with metallic points are excluded)
Toys intended to bear the mass of a child, (bicycles, tricycles, motorcycles and cars) should not have sharp laterals and pointed edges. Precautions should be taken to prevent pipes and other components protruding from toys, from injuring children (for ex: edges of umbrella wires should have protective coating).
3) Toys must be so designed and constructed as to minimize the risk of physical injury which could be caused by the movement of their parts.
Folding toys (ironing table, folding chairs, and tables and toy strollers) should have a safety hatch or a lock mechanism
Precautionary measures should be taken in toys that have a hinge (a toy with a door, a battery-operated car) in order to minimize the risk of hands crushing
4) should not be small enough to risk swallowing
Toys, and their component parts, and any detachable parts of toys which are clearly intended for use of children under 36 months must be of such dimensions as to prevent their being swallowed and/or inhaled.. Toys should be made durable enough to endure tearing and wearing out. Toys that are fixed to each other should be glued in way that would not come apart when wet, considering that the children will constantlyput the toy in their mouth.
This also applies to other toys which are intended to be put in the mouth, and to their component parts and any of their detachable parts.
For example coating of toys like rattles need to be durable, eyes of toys should not come off, and stitches should not come undone.
5) should not pose risk of suffocation, strangulation or asphyxiation.
The toys, component part of toys and the packaging in which toys are contained for retail sale must not present a risk of strangulation or asphyxiation.
For example:
Masks and helmets should have suitable vents. Flexible masks should not have a tight grip on the children's face in a way that could impede respiration. Masks and helmets that are not made of permeable material should have two unobstructed vent holes with a 150mm of minimum distance between them.
Components and packaging of Toys should not carry risk of suffocation (especially packaging that is made of soft plastic should not cause suffocation if the children wear it over their heads. Therefore packaging made of soft plastic should have vent holes and a warning printed on it saying it is not a toy.)
Mouth toys or mouth components of toys should not be composed of parts that are small enough to risk accidental swallowing or asphyxiation related mortality Also , the detachable and movable mouth components of toys (like the mouth piece of a trumpet) should not be small enough to risk accidental swallowing or inhalation. This applies regardless of the intended age group of toys.
Toys or their components made of dilating materials should not expand more than 50% of theis mass.
6) Aquatic toys intended for use in shallow water which is capable of carrying or supporting a child on the water; should be designed and manufactured so as to reduce as far as possible, taking into account the recommended use of the toy, any risk of loss of buoyancy of the toy and loss of support afforded to the child.
Inflatable toys intended for playing in the water, should not have fixed valves. The tap must be designed in way to allow pressing it into the toy when it is inflated in order to ensure it will not protrude. Labeling should be complete.
7) Toys should have easy to open exits
Regardless of whether or not they were designed to house a child, toys which it is possible to get inside and which thereby constitute an enclosed space for occupants (tents, toy chests etc. toys with helmets like space helmets) must have sufficient ventilation and a means of exit which the intended user can open easily from the inside without help.
For example the house must be designed in a way so that the child should be able to easily exit without help from outside.
8) must incorporate a braking system and should not pose risk of ejection or physical injury.
Toys conferring mobility on their users must, as far as possible, incorporate a braking system which is suited to the type of toy and is commensurate with the kinetic energy generated by it. Such a system must be easy for the user to operate without risk of ejection or physical injury for the user or for third parties.
i) Physical injury risk should be minimized in Projectile toys.
The form and composition of projectiles and the kinetic energy they may generate when fired from a toy designed for that purpose must be such that, taking into account the nature of the toy, there is no risk of physical injury to the user or to third parties.
Even though the risks may be minimized with these toys, three things are still important:
- Awareness and attention of the parents,
- Presence of signs and warnings,
- Kinetic measurement of the bullets.
j) Toys with heating components should not cause burns or injuries.
Toys must be manufactured so as to ensure that:
(1) the maximum temperature of any accessible surfaces does not cause injury when touched; and
(2) liquids and gases contained within the toy do not reach temperatures or pressures which are such that their escape from the toy, other than for reasons essential to the proper functioning of the toy, might cause burns, scalds or other physical injury.
2.Flammability
a) Toys must not constitute a dangerous flammable element in the child’s environment. They must therefore be composed of materials which fulfil one or more of the following conditions:
(1) they do not burn if directly exposed to a flame or spark or other potential source of fire;
(2) they are not readily flammable (the flame goes out as soon as the fire cause disappears);
(3) if they do ignite, they burn slowly and present a low rate of spread of the flame; (so that the children can quickly exit from it, or drop it)
(4) they are made of materials designed so to delay the combustion process.
Such combustible materials must not constitute a risk of ignition for other materials used in the toy.
They should not be composed of easily combustible synthetic materials.
Toys such as: costumes, disguises, wigs worn by the child (intended to imitate) soft filled toys, toys meant to be entered by the child. etc. fall under this category.
.
b) Toys should not contain the dangerous substances or mixtures listed in the Regulation on Dangerous Chemicals.
c) Toys should not be explosive or contain materials or parts that are explosive.
Toys and, in particular, chemical games and toys, must not contain as such substances or mixtures:
(1) which, when mixed together, may explode through chemical reaction or through heating; or when mixed with oxidizing substances;
(2) which contain volatile components which are flammable in air and liable to form a flammable or explosive vapor/air mixture.
In other words they should not contain flammable substances.
a) Toys should not pose health hazards when swallowed, inhaled or when contacted with the skin or the eyes.
They should be in compliance with applicable legislations on labeling, prohibition, and restriction of dangerous substances and mixtures as wll as classification of products
Toys, for reasons essential to their functioning, are allowed to contain certain substances or mixtures, in particular materials and equipment for chemistry experiments, model assembly, plastic or ceramic moulding, enamelling, photography or similar activities, as such, up to the maximum level defined for each substance provided that they comply with regulations on warnings and signs about precautions to be taken during use, as well as regulations for labeling.
- Toys shall not be powered by electricity of a nominal voltage exceeding 24 volts, and their accessible parts shall not exceed 24 volts. Parts of toys which are connected to, or liable to come into contact with, a source of electricity capable of causing electric shock, together with the cables or other conductors through which electricity is conveyed to such parts, must be properly insulated and mechanically protected so as to prevent the risk of such shock.Hygiene
Toys must be designed and manufactured in such a way as to meet hygiene and cleanliness requirements in order to avoid any risk of infection, sickness or contamination.
6. Radioactivity
Toys should not contain substances or be composed of parts with radioactivity at levels that could be hazardous for a child or other persons. Radiation Safety Regulation which was published in the Official Gazette Issue no:24459 of July 11,2001 shall apply
Prerequisites for labeling/packaging of toys
- The CE mark as well as the name and/or trade name and/or mark and address of the manufacturer or his authorized representative or the importer shall as a rule be affixed either to the toy or on the packaging in a visible, easily legible and indelible form. In the case of small toys and toys consisting of small parts these particulars may be affixed in the same way to the packaging, to a label or to a leaflet.
- The Ministry requires all of the information presented on the packaging, labeling, brochures/ and manuals of instruction and for some toys the precautions and warnings listed below, or a part of these to be printed in Turkish.
1) Toys not intended for use by children under 36 months
Toys which might be dangerous for children under 36 months of age shall bear a warning such as ‘Not suitable for children under 36 months’ or ‘Not suitable for children under three years’. These warnings shall be accompanied by a brief indication, which may appear in the instructions for use, of the specific hazard calling for this precaution. The graphic symbol defined in the standard "EN 71-6 Toy Safety: Part 6" may be used instead of the age warning.
This point shall not apply to toys which, on account of their function, dimensions, characteristics or properties, or on other cogent grounds, are manifestly unsuitable for children under 36 months.
Affixing a ‘Not suitable for children under three years" warning to Toys actually intended for children under three years, cannot be justifiable.
Examples of toys intended for use of children under three years; simple designed puzzles and simple role play dolls, soft toys and soft filled toys.
2) Child Slides, suspended swings and rings, trapezes, ropes and similar toys attached to a crossbeam.
Activity toys attached to a crossbeam as well as other activity toys, where appropriate, shall be accompanied by instructions drawing attention to the need to carry out checks and maintenance of the main parts (suspensions, fixings, anchorages, etc.) at intervals, and pointing out that, if these checks are not carried out, the toy may cause a fall or overturn.
Instructions must also be given as to the correct assembly of the toy, indicating those parts which can present a danger if incorrectly assembled.
3) Functional Toys
'Functional toy’ means a toy which performs and is used in the same way as a product, appliance or installation intended for use by adults, and which may be a scale model of such product, appliance or installation.
Functional toys shall bear the following warning: ‘To be used under the direct supervision of an adult’.
In addition, these toys shall be accompanied by directions giving working instructions as well as the precautions to be taken by the user, with the warning that failure to take these precautions will expose the user to the hazards – to be specified – normally associated with the appliance or product of which the toy is a scale model or imitation. It shall also be indicated that the toy must be kept out of the reach of children under a certain age, which shall be specified by the manufacturer.
4) Toys containing inherently dangerous substances or mixtures
Chemical Toys;
a) Without prejudice to the application of the provisions laid down in Regulation on Hazardous; the instructions for use of toys containing inherently dangerous substances or mixtures shall bear a warning of the dangerous nature of these substances or mixtures and an indication of the precautions to be taken by the user in order to avoid hazards associated with them, which shall be specified concisely according to the type of toy. The first aid to be given in the event of serious accidents resulting from the use of this type of toy shall also be mentioned. It shall also be stated that the toy must be kept out of reach of little children.
b) In addition to the instructions provided for in paragraph (a), chemical toys shall bear the following warning on their packaging:
‘Not suitable for children under (*) years. For use under adult supervision’.
In particular, the following are regarded as chemical toys: chemistry sets, plastic embedding sets, miniature workshops for ceramics, enamelling or photography and similar toys.
5) Skates and Skateboards
Where these toys are offered for sale as toys, they shall bear the following warning: ‘Protective equipment should be worn.' , 'Not suitable for children with a body mass of more than 20 kg’. Moreover, the instructions for use shall contain a reminder that the toy must be used with caution, since it requires great skill, so as to avoid falls or collisions causing injury to the user or third parties. Some indication shall also be given as to recommended protective equipment like helmets, gloves, knee-pads, elbow-pads, etc.
6) Aquatic toys
Aquatic toy means a toy intended for use in shallow water which is capable of carrying or supporting a child on the water. Swim rings, little water beds etc. (Inflatable arm bands, are not toys and are considered swimming gear.) Generally speaking toys used in the bathtubs and inflatable sea balls intended for play on sand, are not considered in this category).
Aquatic toys shall bear the following warning: ‘Only to be used in water in which the child is within its depth and under adult supervision’.
7) Rubber Balloons
Rubber Balloons must carry the following warning.
"Caution! Children under eight (8) years old may choke or suffocate while blowing un-inflated or broken balloons. Adult supervision is required. Keep un-inflated balloons out of the reach of children broken balloons should be disposed off right away."
Rubber Balloons pose allergy risks and therefore packaging of balloons must bear the warning “made on natural rubber”.
8) Bullets
Toys with bullets should carry warnings pointing out dangers of using bullets other than provided or recommended by the manufacturer.
All toys which can shoot bullets with a kinetic energy higher than 0.08J should bear the following warning.
“Do not point toward the eyes or the face.”
9) Imitations of protective masks and helmets
Imitations of protective masks and helmets (motorcycle, industrial safety and fireman helmets) and their packaging if any shall bear the following warning:
“This toy does not provide protection”
10) Toy Kites
Toys which have ropes that tie them to the ground or kites with ropes longer than 2ms or other flying toys should bear the following warning:
"Caution! should not be flown near high tension power lines"
Ropes should be insulated. It can get caught up in electric lines.
11) Toys intended to be strung across a cradle, cot or perambulator by means of strings, cords, elastics or straps.
Toys intended to be strung across a cradle; cot or perambulator by means of strings, cords, elastics or straps shall carry the following warning on the packaging, which shall also be permanently marked on the toy:
‘To prevent possible injury by entanglement, remove this toy when the child starts trying to get up on its hands and knees in a crawling position’.
12) Liquid-filled Teethers
Liquid-filled Teethers must bear the following instructions
"Should be refrigerated only in domestic fridges and not be put in deep freezers"
Toys with liquid fillings should not have cracks, and the liquid filling should not be hazardous.
13) Percussion caps specially designed for toys
Packaging of Percussion caps must bear the following warning
“Warning! do not fire indoors, near the eyes or the ears. Do not carry unpacked caps in pockets.”
14) Sound Emitting Toys
Toys which are designed to emit a sound and their packaging shall bear the following warning.
"Caution! Do not use close to the ears! Misuse may cause hearing impairment."
Add the following to toys with percussion caps:
“Do not fire indoors”
15) Toy Bicycles
Bicycles should carry the following warning.
"Caution! A protective helmet should always be worn while riding."
Moreover, the manual should include a reminder that the bicycle is not suitable for riding in busy motorways Furthermore parents should make sure their children are well informed about how to ride a bike especially how to safely use the break system of bikes.
Bicycles should have a break system.
Tricycles should be well balanced.
16) . Toys designed to carry the mass of children
Toys which are not suitable for children above 36 months, by their composition, durability, design and other factors, aside from a brief explanation of specific cause for restriction shall bear the following warning:
“Warning! Should not be used by children above 36 months.”
The age warning should be easily readable at the place of sale.
17) Toys with fibre strands
Toys with Fibre strands longer tan 50 mm in length, fixed to a fabric, longer tan 50 mm must be labelled.
“Not suitable for use of children under 10 months
III. CONFORMITY ASSESSMENT FOR TOYS
It is the assesment and certification of the products’s conformity technical regulations
I) Manufacturer’s Declaration of Conformity
- The manufacturer satisfies the standards; and prepares the technical dossier on design and manufacturing activities
- Ensures the compliance of the manufacturing process and therefore the technical dossier of the product.
- The Manufacturer affixes the CE mark, its name and address to the toy or/and labeling or/and packaging before placing the toy on the market.
- The manufacturer shall save the technical dossier for a duration of ten years and present it to the authorized institutions when requested.
The Technical Dossier contains the following;
- A general description of the product as well as its variants if any
- Designs, planning methods and diagrams of the components
- Manufacturing stages
- Raw materials
- Test results
- Toxicity reports
- Manual of Instructions
- Packaging Methods and Labeling
- Addresses of the Manufacturer or the Importer
- Addresses of places of manufacturing and storage
- Information on the chain and distribution of distribution of the products in question
II) EC Type Examination
- The manufacturer prepares the technical dossier pertaining to the design, and manufacturing processes once it has satisfied the harmonized national standards in part, or complied with the essential requirements.
- The manufacturer submits the model of the toy as well as a technical dossier to a Notified Body for the EC Type Examination.
- The Notified Body checks if the model complies with the essential requirements of the Directive. If this is the case, it issues an EC type-examination certificate.
- And ascertains and certifies the conformity of a product and its manufacturing process to the type defined in the EC type-examination certificate
- The Manufacturer affixes the CE mark, its name and address to the toy or/and labeling or/and packaging before placing the toy on the market.
- The manufacturer shall save the technical dossier for duration of ten years and present it to the authorized institutions when requested.
The Technical Dossier contains the following;
- A general description of the product as well as its variants if any
- conceptual design data or drawings, planning methods and diagrams of the components
- Manufacturing processes and steps
- Description of Raw materials
- Copies of the documents submitted by the Manufacturer to the Notified Body for the EC type-examination
- A certified copy of the EC type-examination issued by the Notified Body for the model in question
- Toxicity reports
- Manual of Instructions
- Packaging Methods and Labeling
- Addresses of the Manufacturer or the Importer
- Addresses of places of manufacturing and storage
- Information on the chain and channels of distribution.
An EC type-examination is carried out when the manufacturer:
has not applied the harmonized national standards, has applied them only in part or no such standards exist for that specific product.
Toys not considered in the standards are;
- Toys which are not covered within the scope of the Harmonised National Standards (EN 71 series)
- Toys for which harmonised national standards do not fully cover the safety aspects
- Examples of such toys are: scooters, rattle balls and sucking cups .
IV) Market Surveillance and Inspection
Market Surveillance and Inspection covers all activities conducted by the Ministry with the purposes of:
- examining or having others examining whether or not products comply with applicable technical regulations, during their placement , distribution and sales in the market,
- and ensuring that unsafe products are made safe
- as well as imposing sanctions when necessary.
- The Ministry conducts the market surveillance and inspection through its inspectors employed in the Provincial Directorates General and takes necessary precautionary measures and imposes penal sanctions in line with the Law no:4703 and Law no 765 of the Turkish Penal Code.
Principles of Market Surveillance
• Market Surveillance and Inspection is examining or having 3rd parties examine whether or not products are safe and in conformity with the legislations, during their placement , distribution and sales in the market,
• Market Surveillance is an important instrument for implementation of the new approach directives, by way of inspecting conformity of products to the legislations, during their placement and distribution in the market, and taking necessary measures ensuring non-complying products are brought into conformity.
• Public institutions (the Ministry) are responsible with conducting market surveillance.
• All citizens are equally protected in the national market regardless of the origin of the products
• The state is responsible with conducting the market surveillance and establishing the necessary organs. These bodies must have the required resources and power; must ensure their personnel carry out the conformity assessment activities with the highest degree of professional integrity and the requisite technical competence and should act independently and impartially.
• The state must take all the measures to ensure that only products, manufactured equipped, and maintained in compliance with requirements which do not in any way present a risk to the health and safety of persons or other issues of public interest ,are placed and made available in the market.
• Market Surveillance Authorities must be equipped with the necessary power and resources in order to monitor the products placed in the market and take the required measures to ensure that non-complying products are brought into conformity.
• The Ministry may appoint a subcontractor with technical tasks (testing and examination) provided that the Ministry takes take full responsibility for the decisions taken by subcontractors and ensures non-competence between it and other organizations during conformity assessment procedures.
• As a general rule, it is not appropriate for the notified body to be also assigned with market surveillance. In order to prevent competition, a clear distinction between conformity assessment (conducted before the product is placed on the market) and market surveillance (conducted after the product is placed in the market) should be made.

Market Surveillance has two legs:
1-Import Control
2-Domestic Market Control
a) Import Control
Under Directive No: 2010/10 on Standardization of Foreign Trade, import control of toys is conducted by the Underdecretariat of Foreign Trade.
b) Domestic Market Control
Market surveillance is composed of two stages:
I. The Ministry monitors the conformity of marketed products to the “Regulation on Toys”
II. It takes the necessary measures to bring products into conformity
Monitoring of Products in the Market
- The purpose of monitoring products in the market is to verify that these products are in conformity with the applicable legislations. The technical dossier will provide the inspecting units with the necessary data in this respect.
- Essentially the market surveillance and inspection may not be conducted in the designing and manufacturing stages, at which point the manufacturer has not yet taken the legal responsibility regarding conformity of the product by affixing the CE mark.
- However, once nonconformity is detected, the Provincial directorates of Health may make controls in the places of manufacturing, in order to see if there is any systematic fault.
- Toys not bearing a CE marking or which do not otherwise comply with this regualtion may be shown and used at trade fairs and exhibitions, provided that all safety measure for protection of visitor are taken and they are accompanied by a sign which clearly indicates that they do not comply with this Directive and that they will not be made available in the market before being brought into conformity.However Provincial Directorates should monitor if such parties are fulfilling this commitment (that noncomplying products are only brought for display and they are not placed on the market).
- During market surveillance and inspection, initially the affixing of the CE mark and information that must be affixed to the products (labeling/packaging information) and choice of conformity assessment procedures should be examined. However, more detailed controls are required to verify the conformity of products.( For example: whether the conformity assessment procedures were conducted correctly, or whether essential requirements were met)
Procedure on Requesting the Technical Dossier
- Technical dossier is the instrument through which the necessary data on products will be obtained during market surveillance. The technical dossier should be kept ready for controls by : the manufacturer, its authorized representative in the country, or sometimes the importer or the person in charge of placing the product on the market. Distributors, retailers, dealer or subcontractors are not obliged to keep this ready. But they may help the Ministry in obtaining the dossier.
- The technical dossier should be kept ready, to be submitted to the use of the Ministry or the provincial directorates in a reasonable amount of time commensurate with the emergence and risks associated with the product. However the Ministry or the provincial directorates may not request the dossier on regular basis. Generally speaking, the dossier may be requested only during random (spontaneous) controls, or if the product is suspected to be unsafe in every way. Initially, if available, an outline of the technical dossier (essential technical data) may be provided to the Ministry or the provincial directorates, in a reasonable duration allowed by the authorities. More detailed information may only be required (for example: documents and assessments of the notified bodies) if there are serious doubts over the conformity of the product to the regulations. The entire technical documentation may only be requested when it is an unequivocal necessity; for instance it may not be required just to check a single detail. Such requests should be viewed with respect to principle of proportionality, looking out for the health and safety of people as well as other public interests, while at the same time protecting economic operators from unnecessary burden. But apart from this, failure to present documents duly requested by the Ministry and the Provincial directorates in a reasonable period of time may create well founded doubts over the conformity of the product to requirements of the regulations.
The Ministry or the provincial directorates may request a translation of the technical document. If the Ministry or the provincial directorates find that a translation of the documentation is necessary, they must specify the parts to be translated and allow a reasonable amount of time for the translation. Additional requirements such as an accredited translator or a translator recognized by public institutions may not be imposed.
The technical dossier should be made available at all times inside the country. Making available here does not mean the respondent has to carry the dossier with him/her; it means the respondent must be able to present the dossier when requested by the Ministry and the provincial directorates. Furthermore the technical dossier may be presented in any medium that will enable the respondent to draw up the dossier in a time frame commensurate with the risks associated with or the emergence of the product (ex: in printed document or data CDs).
The Ministry or the Provincial Directorate must make sure all parties involved in the conformity assessment procedures , observe professional secrecy with regard to all information obtained in carrying out their tasks
For more effective market surveillance, resources should be focused on areas of higher risks where nonconformity is likely to occur more frequently, or areas of specific interest. Statistics and risk management procedures may be employed for these purposes.
Corrective Measures
The related party should be notified before a measure is taken and if the issue at hand is not an emergency, it should be allowed to seek counsel.
Principally, the manufacturer or its authorized representatives should be obliged to bring the product into conformity with the regulations, and correct the non-conformity.
Ultimately if the above mentioned measures fail or fall short, all other measures shall be taken to restrict or prohibit the toy being made available on the market, or to ensure that it is recalled or withdrawn from the market.
Corrective measures may vary depending on the degree of nonconformity and therefore should be in accordance with the proportionality principle. However the difference between major and minor nonconformities is not always so clearly distinctive and assessment should be made on a case by case basis. (Incorrect affixing of the CE mark, for instance the design, dimensions, visibility, legibility and indelibility of the toy can always be seen as a major nonconformity. Examples of typical minor nonconformity can be observed in incorrect affixation of other conformity marks required in the Regulation on Toys, or in cases where these marks are missing or when other information required to accompany products are missing.
Nonconformity to essential requirements shall be treated as a major nonconformity as this may be present potential or actual health and safety hazards for citizens)
Conformity can be ensured by urging the manufacturer, its authorized representative or other responsible economic operators to take the necessary measures. If required measures are taken (if the product can be modified, recalled or withdrawn from the market) as a result of consultations with the ministry, or as a result of the official or unofficial warnings, the non conformity would be corrected.
Measures taken in cases of minor nonconformity can be on two levels:
- Firstly, the Ministry must urge the manufacturer or its authorised agent to bring the products, that are planned to be placed in the market or those products that may already be made available in the market, in conformity with the applicable provisions and correct the infringement .
- Secondly, if the above mentioned measures fail to get the desired results, the Ministry can ultimately take further measures to restrict or prohibit the toy being made available on the market, or to ensure that it is recalled or withdrawn from the market.
In cases of major nonconformity, the Ministry must take all necessary measures to maintain conformity.
Finally, in case all other solutions do not suffice to ensure a high level of protection as predicted by the Regulation, the Ministry shall restrict or prohibit the toy from being made available on the market, or to ensure that it is recalled or withdrawn from the market.
Measures aimed at restricting or prohibiting the placement of goods in the market can firstly be implemented as temporary measures so as to enable the Ministry to obtain adequate evidence pertaining to hazards or other major nonconformities of the product.
The grounds of the decisions taken by the Ministry for restriction or prohibition of the placement of the product in the market or recall or withdrawal of products must clearly be indicated (Law No. 4703 and applicable regulations related with the said law and regulation on toys). The concerned party, particularly the manufacturer or its authorised agent in the country, must be notified.
Complementary Acts
- In order to implement the Regulation effectively, in addition to the above mentioned market surveillance procedures, market surveillance agencies must also:
- act in cooperation with the manufacturer and suppliers,
- take necessary measures against people who affix CE mark to a nonconforming product (which does not meet essential requirements stated in the Regulation on Toys) and who are responsible for the nonconformity of the product, and
- have the necessary measn for warning people who might be exposed to danger, disposing of the dangerous products and prohibiting their export, and ensuring the prohibition of use of such products as well as its denotifation.
Regulation on Toys also requires taking measures against people affixing CE mark to nonconforming products. Such measures must be taken against the manufacturer and other parties responsible for the placement of nonconforming products to the market. These measures can include legal processes or notices.
Generally speaking, certain products manufactured in the same line of product might be already sold; or might even be put into use before the detection of nonconformity. In such cases, it is important to ensure notification of people who might be exposed to the hazards presented by a product. Principally, this must be viewed as the responsibility of the manufacturer or distributor, particularly in the case ofconsumer goods. Warnings can be publicly announced in a broadcast or, if a limited of people are in danger, be made directly to these people. The Ministry must also assess whether it is necessary to restrict the use of products which proved to be dangerous.
Findings indicating the legitimacy of national measures shall be based on the ministry’s own iniatives or on information received from third parties (such as consumers, competitors, consumer associations, etc.) Furthermore, national measures must be based on evidence (e.g. tests and examinations) which serve as a suitable instrument to detect the defects in the design and manufacturing of a product, and inherent and actual hazards which might arise even when the products are manufactured, installed, maintained and used properly. There exists a grey area between proper and improper use and maintenance, and to a certain extent, the products can be thought to be safe even if the maintenance is not carried out reasonably as prescribed and they are not used properly.
The Regulation on Toys requires products to ensure that under normal and reasonably foreseeable conditions of use, the toys they place on market are safe for children. Data presented by the manufacturer on the labeling, instructions, manual or advertisement materials (for toys that are required to bear these) must be taken into consideration when assessing this issue.
Protection of the CE Mark
- Provincial Health Directorates must check whether the CE Mark is affixed and used properly and if rules pertaining to additional marks are followed or not.
- They must inform the Ministry and if necessary, the Ministry must take corrective measures to protect the CE mark.
Coverage of expenses incurring during market surveillance and inspection:
In case the concerned public body uses the facilities of another test, inspection and/or certification body and it is ascertained that the product is not safe; costs of tests and inspection shall be covered by the manufacturer as specified in the 2nd paragraph of Article 10 of Law No. 4703. If the products prove to be safe, the costs shall be covered by the Ministry.
On the other hand, in case the product proves to be unsafe as a result of the controls conducted within the framework of market surveillance and inspection, costs arising during the measures taken by the Ministry shall also be covered by the manufacturer. These measures are as follows:
a. prohibition of placement of products to the market,
b. recall and withdrawal of supplied products,
c. partial or complete disposal of the products depending on the risks they present, in cases where the products are not made safe by the manufacturer or where it is impossible to make the products safe, and
d. Announcement of necessary information regarding these measures, in two national newspapers and two national television channels or notification of the people exposed to these hazards, though local broadcasts and newspapers, where possible.
ANNEX 6 – THE REGULATION ON GUIDELINES AND PRINCIPLES OF MARKET SURVEILLANCE AND INSPECTION TO BE CONDUCTED BY THE MINISTRY OF HEALTH

PART I
Goal, Scope, Grounds and Definitions
Goal
ARTICLE 1 – (1) This regulation lays down the principles and guidelines for surveillance and inspection of whether products in the field of operation of the Ministry of Health do comply with related technical regulations, during their placement, distribution and sales in the market, measures to be taken, as well as the powers and responsibilities of the Ministry of Health in this field and the liabilities of the manufacturer , and the principles and guidelines for the in-service training and certification of the personnel to conduct the market surveillance and inspection.
Scope
ARTICLE 2 – (1) This regulation lays down the principles and guidelines for market surveillance and inspection, the measures to be taken by and the powers and responsibilities of the Ministry of Health as well as the duties, authorities and responsibilities of personnel assigned with inspection and the liabilities of the manufacturer and the distributors.
Grounds
ARTICLE 3 – (1) This regulation is predicated on Law No: 4703 on Preparition and Implementatiton of Technical Legislation on Products of June 29,2001; and the General Sanitation Law No:1593 dated April 24 1930, and the Cosmetics Law No: 5324 of March 24, 2005, Article 43 of Decree No: 181 on Organisation and Duties of Ministry of Health, December 12,1983.
Definitions
ARTICLE 4 – (1) Following are the terms mantioned in this Regulation:
a) Ministry: Ministry of Health
b) Framework Regulation: Regulation on Market Surveillance and Inspection of Products, which entered into force with the Cabinet Decree No: 2001/3529 of November 13, 2001.
c) Personnel assigned with the task of inspection: Certified personnel of the Ministry, appointed and qualified for the task of conducting market surveillance and inspection.
d) , Sensory Tests: The initial examination conducted by the inspector using his/her senses, before a product is made subject to a test or examination.
e) Supplementary Report: The report given in Annex 4 of this Regulation, which includes additional assessments on the product made by the personnel assigned with inspection, other than those issues defined in paragraph (k) of this article,.
f) Safe product: refers to products which pose no hazards or a tolerable level of hazards under normal and reasonably foreseeable conditions of use also considering the normal behavior of children, and also ensuring maximum level of safety in respect to the essential requirements stated in this regulation, taking into account the intended use and the lifespan of the product.
g) Code of Best practices: Guideline for health and safety oriented practices in the light of current level of technology and scientific criteria in the related sector.
h) The Legislation: Legislation No: 4730 on Preparation and Implementation of Technical Legislation on Products.
i) The Commission: Market Surveillance and Inspection Coordination Commission established by articles 25, 26 and 27 of this Regulation.
j) Directorate: Provincial health directorates,
k) Sample: Sample product taken for examinations, tests and analyses in accordance with the procedures defined in the applicable legislations and standards, at a quantity and quality enough to represent the bulk and party in every aspect.
l) Certificate: The certificate issued in the end of the in-service training given by the Ministry to

AMAÇ
Bu el kitabının amacı oyuncakların piyasaya arzı veya dağıtımı aşamasında veya oyuncaklar piyasada iken gözetimi ve denetimine ilişkin usul ve esaslar ile alınacak önlemleri, piyasa gözetimi ve denetimi konularında Bakanlığımızın görev, yetki ve sorumlulukları ile üretici ve dağıtıcıların yükümlülüklerini açıklamaktır.

Güvenli ürün: Kullanım süresi içinde, normal kullanım koşullarında risk taşımayan ve kabul edilebilir ölçülerde risk taşıyan ve temel gerekler bakımından azami ölçüde koruma sağlayan ürünü ifade eder.
PİYASA GÖZETİMİ VE DENETİMİNDEKİ GENEL ESASLAR:
Piyasa gözetimi ve denetimi; ürünün piyasaya arzı veya dağıtımı aşamasında veya ürün piyasada iken, ilgili teknik düzenlemeye uygun olarak üretilip üretilmediğini, güvenli olup olmadığını denetlemek veya denetlettirmek; güvenli olmayan ürünlerin güvenli hale getirilmesini temin etmek, gerektiğinde yaptırımlar uygulanmasını sağlamak amacıyla Bakanlık tarafından yapılacak her türlü faaliyeti kapsar.
Yönetmeliğe uygun ürünlerin güvenli olduğu kabul edilir.
Oyuncakların piyasa gözetimi ve denetimi aşağıdaki esaslar çerçevesinde yapılır:
1- Genel Müdürlüğümüz piyasa gözetimi ve denetimini (EK-1) re’sen veya şikayet üzerine İl Müdürlüklerindeki denetçileri aracılığıyla yürütür, piyasa gözetimi ve denetimi sonucunda gerekli önlemleri alır ve cezai müeyyideleri uygular.
Piyasa gözetimi ve denetimi konusunda, denetçiler denetleme, inceleme, araştırma ile görevli ve yetkilidirler,
2- Denetçiler ve diğer kamu kuruluşlarının yaptıkları denetimler sonucunda ortaya çıkan ürüne ilişkin mevzuata uygunsuzluklar; bir kazanın nedenleri araştırılırken ortaya çıkan bilgiler; tüketici, kullanıcı, rakip üreticiler, dağıtıcılar, uygunluk değerlendirme kuruluşları ve onaylanmış kuruluşlar, diğer kamu kuruluşları ve sivil toplum örgütleri tarafından ürünün teknik düzenlemeye uygunsuzluğu ve güvensizliği konusunda yapılan ihbarlar, şikayetler ve bu çerçevede elde edilen bilgiler piyasa gözetimi ve denetimi amacıyla kullanılabilir.
3- Bilgi, ihbar ve şikayetlerin en kısa sürede sonuçlandırılması gerektiğinden İl Müdürlükleri tarafından bu bilgilerin en kısa sürede Bakanlığa gönderilmesi gerekir.
DENETİM YAPILACAK YERLER:
Denetim, ürünlerin;
1) Mağaza, dükkan, ticarethane, depo, ambar ve nakil araçları ve benzeri gibi her türlü depolandığı ve/veya satıldığı yerlerde,
2) Gerekli hallerde, ürünlerin üretildikleri, işlendikleri, ambalajlandıkları veya montaj yapıldıkları yerlerde de,
re’sen veya şikayet üzerine yapılır.
Denetimler, denetim yapılan yerlerde yapılan çalışmaları engellemeyecek şekilde yapılır.
DENETİMDE KİM MUHATAP ALINIR?
Denetlemede üreticinin muhatap alınması esastır. Bu husus, dağıtıcının 4703 sayılı Kanunun 5 inci maddesinin 9 uncu fıkrasında düzenlenen yükümlülüklerini ortadan kaldırmaz. Dağıtıcının iş yerinde yapılan denetimde, üreticinin adı ve adresi tespit edilir. Piyasa gözetimi ve denetimi faaliyetleri sonucunda güvenli olmadığı belirlenen ürünlere ilişkin olarak üreticinin tespit edilemediği durumlarda, İl Müdürlüğünce belirlenen süre içinde (5 iş günü) üreticinin veya ürünü tedarik ettiği kişinin kimliğini bildirmeyen dağıtıcı, üretici olarak kabul edilir.
DENETLEME GÖREVİ NE ŞEKİLDE YERİNE GETİRİLİR.
Denetleme görevi, üretici veya dağıtıcıya ait bilgi ve belgelerin ilgili mevzuat çerçevesinde incelenmesi ile malların duyusal incelemesinin yapılması ve gerektiğinde her türlü test ve muayenenin yapılması veya yaptırılması suretiyle yerine getirilir,
Genel Müdürlük, piyasa gözetimi ve denetiminde gerekli görülen durumlarda, test ve muayene laboratuarları dahil olmak üzere Bakanlığın imkanlarından veya gözetim ve denetime konu ürüne ilişkin uygunluk değerlendirmesi işlemlerinde yer almayan ancak bu konuda yeterliliği olan test, muayene ve/veya belgelendirme kuruluşlarının imkanlarından yararlanabilir. Ancak, test ve kontrol sonucuna göre karar verme yetkisi ilgili Genel Müdürlüğe aittir,
Denetlenmiş ürünler Genel Müdürlük gerekli görüldüğü taktirde yeniden denetlenebilir,
DENETİMDE UYGULANMASI GEREKENLER:
(1) Piyasa gözetimi ve denetimi, aşağıdaki hususlardan bir veya birkaçını kapsayacak şekilde yapılır.
a) Teknik düzenlemenin öngördüğü işaretler veya belgeler üzerinde inceleme,
b) Denetçi kontrol listesine (Ek-2) göre duyusal inceleme ve muayene,
c) Test veya muayene.
(2) Denetimle görevli personel, ürünün test ve muayenesini gerekli gördüğü takdirde, her türlü testi yaptırmak üzere denetlenen ürünlerden numune alabilir. Numune miktarı, her durumda, ürünün yapısına ve özelliğine göre, test veya muayenelerin gerektirdiği ölçüyü aşmamak üzere, şahit numune alınması fiilen mümkün olmayan haller hariç, biri şahit numune olmak üzere en az iki takım olarak alınır.
(3) Denetleme sırasında alınan numuneler için üç nüsha halinde tutanak (Ek-3) düzenlenir ve tutanağın numune Alma kısmı doldurularak tutanakta numune alma gerekçesi belirtilir. Numuneler özelliklerine göre mühürleri bozulmadan açılmayacak şekilde denetçi tarafından üretici veya dağıtıcı ile birlikte mühürlenir ve üzerlerine tutanakla bağlantılarını açık olarak gösteren ve tarafların isim, unvan ve imzalarını taşıyan etiketler konulur. Alınan numunelerin bir takımı ile birlikte Numune Alma Tutanağının bir nüshası üreticiye veya dağıtıcıya verilir. Test ve muayene yapılması için alınan numunenin bir takımı ile birlikte tutanağın bir nüshası,İl Müdürlüğü kanalı ile Genel Müdürlüğe Genel Müdürlük tarafından da belirlenen test, muayene ve/veya belgelendirme kuruluşuna gönderilir. Denetçi alınan şahit numuneyi ise İl Müdürlüğüne teslim eder. Test veya muayeneyi yapan kuruluş tarafından, mücbir sebepler hariç olmak üzere en geç kırkbeş (45) işgünü içerisinde numune ile ilgili rapor düzenlenir ve ilgili müdürlüğe gönderilir.
(4) Alınan numunelerin başka yere taşınması veya korunması güç ya da sakıncalı ise, numuneler, üretici veya dağıtıcıya saklanmak üzere bırakılır ve durum tutanağa yazılır.
(5) Test ve muayene sonucunda, teknik düzenlemesine uygun ve güvenli olduğunun tespit edilmesi durumunda, bu husus üreticiye, üreticinin Türkiye dışında olması halinde, üretici tarafından yetkilendirilen temsilciye, Genel Müdürlük tarafından bildirilir. Üretici, üreticinin Türkiye dışında olması halinde, üretici tarafından yetkilendirilen temsilci bu bildirinin yapıldığı tarihten itibaren on beş gün içinde şahit numuneleri geri alabilir veya aldırabilir. Bu süre içinde alınmayan ürünler, Bakanlıkça tasarruf edilir.
(6) Piyasa gözetim ve denetimi kapsamında yukarıda belirtilen faaliyetlerin masrafları Bakanlık tarafından karşılanır. Ancak, ürünün teknik düzenlemesine uygun veya güvenli olmadığının, teknik düzenlemenin bulunmadığı hallerde ise güvenli olmadığının tespit edildiği durumlarda masraflar üreticiye aittir. Piyasa gözetimi ve denetimi sonucunda güvenli olmadığı tespit edilen ürünlerin piyasaya arzının yasaklanması, toplatılması, imhası ve risk altındaki kişilere duyurulması konusunda yapılacak masraflar da üretici tarafından karşılanır.
UYGUNSUZLUK VE GÜVENSİZLİK HALİNDE ALINACAK ÖNLEMLER VE UYGULANACAK MÜEYYİDELER
A- Uygunsuzluk Halinde Alınacak Önlemler Ve Uygulanacak Müeyyideler
(1)-Denetçi, ürünün teknik düzenlemesine uygun olup olmadığını tespit etmek amacıyla, öncelikle ürünün, ilgili teknik düzenlemede öngörülen işaret veya belgeleri taşıyıp taşımadığına bakar. Bu işaret ve/veya belgeleri taşımadığı ve/veya ilgili teknik düzenlemenin diğer kriterlerine uymadığı tespit edilen ürünler hakkında, teknik düzenlemeye uygunsuzluk nedeniyle tutanak düzenlenir. Bu durumda Tutanağın Aykırılık kısmı doldurulur. Bu uygunsuzluğun insan sağlığı, can ve mal güvenliğine bir tehdit arz etmemesi koşuluyla, İl Sağlık Müdürlüğü uygunsuzluğun giderilmesi amacıyla belirli bir süre vererek üreticiyi yazılı olarak uyarır ve yazının bir örneğini de Genel Müdürlüğe gönderir. Verilen süre sonucunda yapılan kontrol sonucu Genel Müdürlüğe bildirilir. Eğer sonuçta uygunsuzluk devam ediyorsa, Genel Müdürlük, Kanunun 12 nci maddesinin birinci fıkrasının (a) bendinde belirtilen idari para cezasını uygular.
Ayrıca, ilgili teknik düzenlemeye uygun olmayan veya CE işareti taşımayan ürünlerin, aykırılığı giderilinceye veya analiz raporları çıkıncaya kadar, piyasaya arzının geçici olarak durdurulmasına denetimle görevli personelin görüşü üzerine ilgili müdürlüğün teklifiyle Bakanlıkça karar verilir.
(Aykırılık Durumu:CE işaretinin olmaması veya yanlış yerleştirilmesi, CE benzeri işaretlerle tüketicinin yanıltılması,teknik dosyanın olmaması veya belge eksiğinin bulunması,üreticinin adının ve adresinin etiket üzerinde olmaması, uyarı gerektirdiği halde uyarılarının bulunmaması veya uyarıların yanlış yerleştirilmesi (örneğin 0-3 yaş grubuna uygun oyuncağın üzerine 0-3 yaşa uygun değildir işaretinin olması )v.b )
(2)- Uygunluk işaretinin veya uygunluk değerlendirme işlemleri sonucunda verilen belgelerin tahrif veya taklit edildiğinin veya usulüne uygun olmadan kullanıldığının (örneğin üretmekte olduğu bir oyuncak için yapmış veya yaptırmış olduğu analiz ve diğer belgeleri diğer bir oyuncak için de kullanıyor olması) tespit edilmesi halinde uygunsuzluk nedeniyle tutanak düzenlenir. Bu durumda Tutanağın Usulsüzlük kısmı doldurulur, Tutanağın bir örneği Genel Müdürlüğe gönderilir. Genel Müdürlük tarafından Kanunun 12 inci maddesinin birinci fıkrasının (f) bendinde öngörülen idari para cezasını uygulanır.
B-Güvensizlik Sonucunda Alınacak Önlemler Ve Uygulanacak Müeyyideler
(3)- (1) deki ilgili teknik düzenlemeye uygunsuzluk hali ile (2) deki uygunluk işaretinin veya uygunluk değerlendirme işlemleri sonucunda verilen belgelerin tahrif veya taklit edilmesi veya usulüne uygun olmadan kullanılması halinin, ürünün güvensizliğine dair ciddi şüphelere yol açtığı durumlarda, güvensizlik nedeniyle tutanak düzenlenir. Bu durumda Güvensizlik Şüphe kısmı doldurulur ve duyusal inceleme ve/veya test veya muayeneye başvurulur. Duyusal incelemenin yeterli olmadığı durumlarda numune alınır ve tutanağın numune alma kısmı da doldurulur. Bu durum, ilgili teknik düzenlemeye uygunluğu belgelenmiş ürünler için de geçerlidir.
Güvensizlik Şüphesi: Ürünün ilgili teknik düzenlenmesinde öngörülen işaret ve/veya belgeleri taşımaması veya bunların teknik düzenlemede belirtilen hususlara uygun olmaması ya da tahrif veya taklit edilmesi veya usulsüz olarak kullanılması ürünün güvensizliğine dair ciddi şüpheye yol açabilir. Güvensizlik şüphesi ile güvensizlik belirtisi arasındaki farkı açıklamak için bir örnek vermek gerekirse, oyuncağın teknik dosyasındaki herhangi bir eksiklik, ürünün güvensizliği konusunda bir şüphe doğmasına yol açar. Ancak 36 ayın altındaki çocukların kullanması için tasarlanan oyuncaklar ,oyuncak parçaları ve ayrılabilir parçaları emme ve/veya nefesle çekilmesini önleyecek boyutta olmaması hali oyuncağın güvensiz olduğunun belirtisidir.
(4)- (1) deki ilgili teknik düzenlemeye uygunsuzluk hali (2) deki uygunluk işaretinin veya uygunluk değerlendirme işlemleri sonucunda verilen belgelerin tahrif veya taklit edilmesi veya usulüne uygun olmadan kullanılması halinin ürünün güvensizliğine dair kesin belirti ortaya çıkardığı durumlarda tutanak düzenlenir. Bu durumda Güvensizlik Belirti kısmı doldurulur ve numune alınarak Çerçeve Yönetmeliğin 10 uncu maddesi uygulanır. Bu durum, güvenli olmadığına ilişkin kesin belirti bulunan ilgili teknik düzenlemeye uygunluğu belgelenmiş ürünler için de geçerlidir
(5)- (3) ve (4) de belirtilen işlemler sonucunda ürünün güvenli olmadığının tespit edilmesi halinde tutanak düzenlenir. Bu durumda Güvensizlik Nedeni kısmı doldurulur ve Tutanağın bir örneği Genel Müdürlüğe gönderilir. Genel Müdürlük tarafından Çerçeve Yönetmeliğin 11 inci maddesi uygulanarak dağıtıcının Kanunun 5 inci maddesinin dokuzuncu fıkrasının birinci cümlesinde belirtilen yükümlülüğü saklı kalmak kaydıyla üreticiye;
a) Güvenli olmadığı tespit edilen ürünün aynı zamanda ilgili teknik düzenlemesine de uygun olmadığı durumlarda,
b) Güvenli olmadığı tespit edilen ürünün uygunluk işaretinin veya uygunluk değerlendirme işlemleri sonucunda verilen belgelerin aynı zamanda tahrif veya taklit edildiği veya usulüne uygun kullanılmadığı durumlarda,
30/3/2005 tarihli ve 5326 sayılı Kabahatler Kanununun genel hükümleri göz önünde bulundurularak, 4703 sayılı Kanunun 12 nci maddesinin birinci fıkrasının (b) bendinde belirtilen göre idari para cezası uygulanır."
(6) İlgili teknik düzenlemesine uygunluğu belgelenmiş olmakla birlikte güvenli olmadığı tespit edilen ürünlerden güvenli olmadığı tespit edilenler hakkında üreticiye Kanunun 12 nci maddesinin birinci fıkrasının (b) bendinde belirtilen idari para cezası uygulanır.
(7) Üretici, güvenli olmadığı tespit edilen ürünün kendisi tarafından piyasaya arz edilmediğini veya ürünün güvenli olmaması halinin ilgili teknik düzenlemeye uymaktan kaynaklandığını kanıtladığı takdirde sorumluluktan kurtulur
NOT: Piyasa denetim ve gözetim tutanağını firma yetkilisinin imzadan imtina etmesi durumunda tutanağın firma yetkilisinin imzalaması gereken kısmına kişinin imzadan imtina ettiği yazılır ancak, tutanağın bir örneği firmaya bırakılmaz İl Sağlık Müdürlüğü tarafından firmaya resmi yazışma ile gönderilir.
YILLIK KAYITLAR VE FAALİYET RAPORU
İl Müdürlükleri, yürüttüğü piyasa gözetimi ve denetimi faaliyetlerine ilişkin yıllık kayıtları (Ek-4) tutarlar. Bu kayıtlar, denetlenen satış yerinin ticari adı ve adresi, denetlenen ürünün üretici/ithalatçı firmasının ticari adı ve adresi, denetlenen ürünün adı, denetlenen ürünün yerli mi ithal mi olduğu, ithal ürünlerin gümrük tarife istatistik pozisyon numaraları, giriş gümrüğü, denetimin hangi teknik düzenleme çerçevesinde yapıldığı, denetimin resen mi şikayet üzerine mi olduğu, denetimin şekli, denetim sonucu uygulanan önlem ve yaptırımlara ilişkin bilgileri içerir. Bu kayıtlar çerçevesinde müdürlükler, yıllık olarak piyasa gözetimi ve denetimi faaliyet raporu hazırlayarak, ocak ayının 15’ine kadar Bakanlığa gönderir.
DENETÇİNİN GÖREV, YETKİ VE SORUMLULUKLARI
Bakanlık tarafından verilen eğitimi tamamlayan ve sınavlarda başarı gösteren ve denetimle görevlendirilen denetçi;
a) Denetimle görevli personelin görev ve yetkileri:
1) İlgili mevzuat hükümleri uyarınca, görev alanına giren konularda piyasa gözetimi ve denetimini yapmak, gerekli tutanak ve raporları hazırlamak ve ilgili yerlere sunmak,
2) Kanunda belirtilen ceza ve önlemler hariç olmak üzere, denetim faaliyeti sırasında, ilgililerin cezai sorumluluğunu gerektiren eylemleri saptadığında, durumu Genel Müdürlüğe yazılı olarak bildirmek,
3) Görev alanına giren konularda ve ilgili mevzuatın uygulanmasında ortaya çıkan ihtiyaçlar çerçevesinde inceleme ve araştırma yapmak, görüş ve önerilerini İl Müdürlüğüne ve Genel Müdürlüğe sunmak,
4) Denetlenecek ürünlerden numune almak,
5) Yürüttüğü denetim görevi için gerekli gördüğü dosya ve belgeleri gizli de olsa, denetim yaptığı kuruluş ve kişilerden istemek, bunları incelemek, bunların yetkili merciler tarafından onaylanmış örneklerini almak, üretim ve depolama yerleri de dahil olmak üzere ürünlerin satıldığı veya kullanıldığı yerler ile denetime konu olan sabit ve seyyar her türlü diğer yerlerde inceleme, sayım ve araştırma yapmak, bunları mühürlemek, bu konularda her derecedeki yetkili ve ilgiliden her türlü yardım ve bilgiyi istemek ,
6) Üretici veya dağıtıcının piyasa gözetimi ve denetimi faaliyetini engellemesi durumunda, güvenlik güçlerinden yardım istemek ve onların nezaretinde denetim yapmak,
7) Yaptığı denetimlerde denetlenen her ürün için ayrı ayrı olmak üzere başlangıçtan sonuca kadar yapılan tüm işlemlerin (Yazışmalar, tutanak örnekleri vb.) dosyasını tutmak,
8) Piyasa gözetimi ve denetimi sırasında, gerekli görülmesi durumunda, Bakanlık ve Bakanlığın yetki devrettiği hallerde ilgili valilik onayı ile refakat etmek üzere, işin niteliğine uygun uzman kişileri davet etmek, bunların görüş ve önerilerinden yararlanmak ve rapor istemek
b) Denetçinin Sorumlulukları:
1) Bakanlık tarafından verilen kimlik ile görevlendirme belgesini, denetimden önce üretici veya dağıtıcıya ibraz etmek,
2)Denetlediği üretici veya dağıtıcı kuruluşların yönetim ve yürütme işlerine karışmamak,
3) Piyasa gözetimi ve denetimi görevini, mevzuata uygun olarak bağımsız ve tarafsız yürütmek,
4) Piyasa gözetimi ve denetimi sırasında elde ettiği her türlü bilgi ve belgelere ilişkin olarak gizlilik ilkesine riayet etmek.
ÜRETİCİNİN VEYA DAĞITICININ DENETİM VE GÖZETİM FAALİYETLERİ İLE İLGİLİ SORUMLULUKLARI
a) Üretici ve dağıtıcı, Kanunun 5 inci maddesi ve Çerçeve Yönetmeliğin 6 ncı ve 7 nci maddelerinde belirtilen sorumlulukların yanı sıra denetim görevinin gereği gibi yürütülmesi için denetçiye görevi süresince uygun bir çalışma yeri sağlamak. Uygun yer bulunamadığında veya denetime uygun koşullar oluşturulmadığında, denetçinin isteği üzerine ürüne ait tüm dosya ve belgeleri denetçinin çalışma yerine getirerek kendisine teslim etmek,
b) İlgili teknik düzenlemede belirtilen tüm belgeleri on yıl boyunca muhafaza etmek, istenilmesi halinde denetçiye ibraz etmek;
c) Denetimle görevli personelin, piyasa gözetimi ve denetimi ile ilgili olarak istediği tüm bilgi ve belgeleri gizli de olsa denetimle görevli personele sunmak zorundadırlar.
EK-1 DENETİM AKIŞ ŞEMASI
EK-2 OYUNCAKLAR İÇİN DENETÇİ KONTROL LİSTESİ
• Kontrolü yapılan ürünün oyuncak olup olmadığının tespiti için Yönetmeliğin EK-1’ne bakılır.
• Ürün oyuncak ise üzerinde CE İşareti bulunmalıdır.
• CE işareti yönetmeliğin EK-V’de belirtildiği şekilde yerleştirilmiş olmalıdır.
• Üreticinin adı ve/veya ticaret ünvanı ve/veya markası ve adresi, oyuncağın etiketi veya ambalajına yerleştirilmiş olmalıdır.
• Kullanma talimatı gerektiren bir oyuncak ise kullanma talimatı olmalıdır.
• Üretim yerlerinde yapılacak kontrollerde oyuncaklarda kullanılan malzeme özellikle gözle görünür derecede temiz ve böceklenmemiş olmalıdır.
• Oyuncaklar, herhangi bir enfeksiyon, hastalık ve mikrop kapma riskini önleyici hijyen ve temizlik şartlarına uygun tasarlanmalı ve üretilmelidir.
• 36 ayın altındaki çocukların kullanması için tasarlanan oyuncaklar,oyuncak parçaları ve ayrılabilir parçaları emme ve/veya nefesle çekilmesini önleyecek boyutta olmalıdır.
• 36 aydan küçük çocukların nesneleri ağızlarına götürme alışkanlıkları iyi bilindiğinden bu yaş kategorisine giren oyuncaklar ile oyuncak bölümlerinin, asfiksiye (oksijensiz kalmak, boğulmak) sebep olmayacak asgari boyutta olmaları gereklidir.
Oyuncaklar, maruz kalacakları kayda değer yıpranma ve yırtılmalara da karşı koyacak yeterli dayanıklılıkta olmalıdır. Birbirine yapıştırılmış oyuncaklarda çocuğun sürekli oyuncağı ağzına götüreceği düşünülerek ıslatıldığında ayrılmayacak şekilde yapıştırılmış olması gerekmektedir.
• 36 aydan küçük çocuklar için düzenlenen oyuncaklar küçük parçaların birleştirilmesinden oluşuyorsa bunların kayda değer yıpranma ve eskime sonucunda ayrılmaması gerekmektedir. (Çıngırak gibi oyuncakların ise kaplamalarının da dayanıklı olması, Oyuncakların gözlerinin çıkmaması, dikişlerin sökülmemesi gerekir)
• Oyuncakların parçaları ve ambalajları boğulma riski içermemelidir.(özellikle yumuşak naylondan olan ambalajlarda çocuklar başlarına geçirdiklerinde boğulmalara sebep olmaktadır. Bu nedenle yumuşak naylondan olan ambalajlar da hava delikleri olmalı, üzerine “oyuncak değildir” diye yazılmalı.)
• 36 aydan küçük çocuklar için tasarlanmayan ancak cazip ve tehlikeli olabilecek oyuncaklarda, bu kısıtlamayı gerektiren özel zararlarla birlikte “Yaş uyarı sembolü” veya “36 aydan/3 yaşından küçük çocuklar için uygun değildir.” İfadeleri yer almalıdır. Ancak bu özellik fonksiyonları, boyutları, karakteristikleri, özellikleri veya diğer bakımlardan 36 ayda küçük çocuklar için uygun olmadığı açıkça belli olan oyuncaklara uygulanmaz.
• Maskeler ve kasklarda uygun havalandırma bulunmalıdır. Esnek maskelerin nefes almayı zorlaştıracak şekilde çocuğun yüzüne yapışmaması gerekmektedir. Yüzü kaplayan ve geçirgen olmayan malzemeden yapılan Maskeler ve kasklar, birbirinden en az 150 mm arayla yerleştirilmiş olan ve tıkanmamış olan iki hava deliklerinin olması gerekir.
• Ağız ile ilgili oyuncakların veya bu oyuncakların ağız parçalarının kasıtlı olmadan yutulması ve kullananda asfiksi ile ölüme sebep olmaması için içe çekilebilecek küçük parçalardan oluşmaması gerekir. Bu gibi oyuncaklar kadar oyuncağın hareketli veya çıkartılabilir ağız parçalarının (bir trompetteki ağız parçası gibi) kasıtlı olmadan yutulabilecek veya içe çekilebilecek kadar küçük olmaması gerekir. Bu özellik oyuncağın düşünüldüğü çocuğun yaşı dikkate alınmaksızın uygulanır.
• Oyuncağın bir çocuğu kaplayacak veya kaplayamayacak şekilde tasarlanmış olmasına bakılmaksızın, bir çocuğun girebileceği çerçevelenmiş boşluk oluşturan bütün oyuncaklarda (Çadırlar, oyuncak sandıklar v.b ve uzay başlıkları gibi başı kaplayıcı oyuncaklar) havalandırma sağlanmalı ve çocuğun dışarıdan yardım almaksızın bu boşluktan çıkması mümkün olmalıdır.
• Potansiyel oturma genişliği 140mm üzerinde olan katlama ve kayma mekanizmaları olan oyuncaklar aşağıdaki özelliklere sahip olmalıdır.
-Çocuğun üzerine katlanabilecek bir tutamak veya diğer yapısal elamanı olan çocuk arabası ve pusetle, kilit tertibatı ve emniyet mandalı bulundurmalıdır. (oyuncak olanlar burada kast edilmiştir)
-Emniyet durdurma veya kilit tertibatı, oyuncak tam (Oyuncak puset veya bebek
arabasının kilitleme tertibatı birbirine geçmeden kısmen açılanları da var bunlar yönetmeliğe aykırı değil) açıldığında otomatik olarak birbirine geçmelidir.
• Oyuncaklar, parçalarının hareketinin neden olabileceği fiziksel yaralanma riskini en aza indirecek şekilde tasarlanmalı ve yapılmalıdır. Menteşesi olan bir oyuncakta (kapısı olan bir oyuncak, akülü bir araba) elini sıkıştırma riskini en aza indirmek için tedbir alınması gerekir. Katlanabilir oyuncaklardaki (oyuncak ütü tahtası, katlanır sandalye ve masalar, oyuncak puset gibi) katlama mekanizmalarında bir emniyet durdurma veya kilit tertibatı bulunmalıdır.
• Oyuncaklar ve parçaları ve bu parçaların oyuncağa iliştirilmesi halinde aksamları, mekanik sağlamlığa sahip olmalı ve gerektiğinde fiziksel yaralanmaya neden olabilecek kırılma ve eğilme olmadan, kullanım esnasında meydana gelebilecek zorlamalara karşı dayanıklı olmalıdır. Örneğin çocuk pusetleri (oyun amaçlı) bebek taşımak için kullanılıyor ama kendiside oyun amaçlı oturduğu için kullanılan materyaller belli bir yüke dayanıklı olmalı
• Temasla meydana gelebilecek fiziksel yaralanma riski taşımamalı; Yaylar ve oklarda kullanılan uçlar metalden yapılmamalı, çocuk kütlesini taşıması için tasarlanan oyuncaklar (Bisikletler, üç tekerlekliler, motosikletler ve arabalar) Keskin kenarlar ve sivri uçlar bulundurmamalı. Çıkıntı şeklinde borular ve parçaların çocuğa batmaması için tedbir alınmalıdır. (örn:Şemsiye tellerinin uçları korunmalıdır.).
• Kırık camlardan meydana gelebilecek kesik riskini azaltmak için 36 aylıktan büyük çocukların oyuncakların yapısında, sadece oyuncağın fonksiyonu bakımından gerekli olduğunda (optik oyuncaklar, cam ampuller, vb) takviye etmek için, cam elyafında, sert cam bilyelerde ve bebeklerin sert cam gözlerinde cam kullanılabilinir. Porselen örnek olarak oyuncak çay setlerinde kullanılmakta ve halen 36 aylıktan büyük çocuklar için izin verilmektedir.
• Kullanıcıyı hareket ettiren oyuncaklarda mümkün olabildiği ölçüde uyarlanmış ve oluşturduğu kinetik enerji ile orantılı bir firen sistemi olmalı ve bu sistem kullanıcının fırlatılma ve yaralanma ve üçüncü kişilerin yaralanma riski olmaksızın kolayca kullanılmalıdır.
• Serbest tekerlek tertibatı bulunan bütün üzerine binilebilir oyuncakların, bir frenle teçhiz edilmesi gerekmektedir.Pedalları ön tekerlekte olan üç tekerlekli bisikletler ile arabalar ve elektrikle sürülen arabalar gibi doğrudan transmisyonlu oyuncaklar, çocuğun ayakları serbest kalındığından ve aracı frenlemek üzere kullanılabileceğinden hariç tutulmalıdır.
• Suda oynanan şişirilebilir oyuncaklarda, oyuncağa sabit olarak bağlanmış geri dönüşsüz valfler bulunmamalıdır. Oyuncak şişirildiğinde tapa, oyuncağın yüzeyinden çıkıntı yapmayacak şekilde, oyuncağın içine itilebilmelidir. (Geniş şişirilebilir botlar gibi, boyutları ve tasarımları gereği derin sularda kullanılacağı tasarlanan diğer mamuller kapsam dışındadır Kol bantları ve deniz koltukları oyuncak olarak değil de yüzme aracı olarak kabul edildiğinden, hariç tutulmuştur. Genel olarak Kapalı mekanlarda, banyo küvetinde kullanılan banyo oyuncakları kapsamda değerlendirilmemektedir.)
• Yalnız ev içinde ve bahçesinde kullanılmak üzere tasarlanan salıncaklarda çocuğun oturaktan düşmesini önleyen arkalık ile güvenlik tertibatı bulunması gerekmektedir. Küçük çocukların bu gibi salıncaklardan, oturağın devrilmesi ile düşmeler sonucu kazalar meydana gelmektedir. Bu nedenle asma halatlarının, çocuğun ağırlık merkezini tutabilmeleri için oturağın köşelere en yakın yerlerden tutturulması önem taşımaktadır. Salıncakların yapısında halatlar veya kordonlar kullanıyorsa bunlar, çocuğun başının iplere dolanmasından doğacak boğulma riskini azaltacak şekilde tasarımlanmalıdır. (Çocuk bahçelerinde kullanılan teçhizatın oyuncaklar hakkında yönetmeliğin kapsamında olmayıp oyuncak teçhizatı ile ilgili standart kapsamında değerlendirilmektedir.)
• Isıtıcı parçalar içeren oyuncaklarda her hangi bir iletken yüzeyin azami sıcaklığı dokunulduğunda yanmaya neden olmamalıdır,ayrıca oyuncağın içinde bulunan sıvı ve gazlar oyuncağın fonksiyonlarına uygun nedenler dışında oyuncaktan sızması halinde, yanma, buhar yanığı veya diğer fiziksel yaralanmaya neden olabilecek şekilde sıcaklık ve basınca sebep olmamalıdır.
• Fonksiyonel ısı kaynağı ihtiva eden oyuncaklar sürekli olarak çalıştırıldığında alev almamalıdır.
• Oyuncak patlayıcı olmamalı veya patlamaya müsait madde veya parçacıklar içermemelidir.
• Elektrikli oyuncaklar, 24 voltu geçen anma gerilimiyle donatılmamalı ve oyuncağın hiçbir parçası 24 voltu geçmemelidir.
• Oyuncağın, kablolarla veya bu kablolara elektrik ileten diğer iletken maddelerle birlikte elektrik şokuna neden olabilecek elektrik kaynağıyla bağlantılı veya bağlantı kurabilecek parçaları, böyle şok riskini önlemek amacıyla uygun bir şekilde izole edilmeli ve mekanik olarak korunmalıdır.
• Elektrikli oyuncaklar, doğrudan temas edilebilecek yüzeylerinin ulaştığı azami sıcaklıkları dokunulduğunda yanmaya neden olmayacak şekilde tasarlanmalı ve üretilmelidir.
• Kauçuk balonların ambalajında “Dikkat Şişirilmemiş veya patlak balonlar, özellikle bebekler ve çocuklarda tıkanma veya boğulma tehlikesine sebep olabilir.” “Balonları yetişkinler şişirmeli ve sekiz (8) yaşından küçük çocukların balonla oynamaları izlenmelidir. Patlak balonlar hemen atılmalıdır.” Uyarıları yer almalıdır.
• Suda oynanan oyuncaklar ile ambalajları aşağıdaki uyarıyı taşımalıdır.

• Fonksiyonel oyuncaklar veya ambalajlarında aşağıdaki uyarılar bulunmalıdır:”Dikkat! Bir yetişkinin doğrudan gözlemi altında kullanılmalıdır.” Buna ilaveten, bu tür oyuncaklar, çalışma tariflerinin yanı sıra gerekli tedbirlerin alınmaması halinde, oyuncağın maket modeli veya taklidi olduğu alet veya mamulle tabii olarak bağlantılı olan zararlara maruz kalınabileceğine dikkat çeken bir uyarı ile birlikte, kullanıcı tarafından alınması gerekli tedbirleri de açıklamalıdır. Oyuncağın çok küçük çocukların ulaşamayacağı bir yerde muhafaza edilmesi gerektiği de belirtilmelidir.
• Fonksiyonel Kenarlar , Fonksiyonel Uçlar:Fonksiyonel keskin kenarları veya sivri uçları olan oyuncaklarda, bu gibi uçların ve kenarların potansiyel zararlarına, ambalaj üzerinde ve oyuncakla birlikte verilen kullanım kılavuzlarında dikkat çekilmelidir.(Oyuncağın foksiyonu için gerekli olması halinde 36 aylıkdan büyük çocuklar için tasarlanan oyuncaklarda sivri uçlar kullanılabilinir.)
• Mermili oyuncaklarda üretici tarafından sağlanan veya tavsiye edilen dışındaki mermileri kullanmanın zararlarına ve mermileri çok yakından ateşlemenin tehlikelerine dikkat çekecek uyarılar bulunmalıdır.
• Bütün katı mermilerin uç yarıçapları en az 2mm olmalıdır. Fırlatma mekanizmalarının oyuncak ile birlikte verilenler dışındaki maddeleri de fırlatabilmesi halinde, yanlış madde kullanmanın potansiyel zararlarına, kullanıcıların dikkati çekilmelidir.
• Patlatma kapsüllerinin ambalajı aşağıdaki uyarıyı taşımalıdır:
“Dikkat Kapalı yerlerde veya gözlerin ve kulakların yakınında ateşlemeyiniz. Kapsülleri açık olarak cebte taşımayınız.”
• Üreticilere oyuncakları, oyuncakla birlikte verilenler dışında madde fırlatmayacak şekilde tasarlamaları önemle tavsiye edilmelidir.
• Taklit Koruyucu teçhizat aşağıdaki uyarıyı taşımalıdır ve şeffaf kısımlarında çatlama olmamalıdır.
“Dikkat!Bir Kaza Halinde koruma sağlamaz.”
• Oyuncağı yere bağlayan ve 2 m’yi aşan ipleri bulunan uçurtmalar ile diğer uçan oyuncaklar, aşağıdaki uyarıları taşımalıdır.
“Dikkat ! Yüksek gerilim hatlarının yakınında kullanılmamalıdır.”
(Üreticilere fırtınada uçurulmaması gerektiğine dair uyarı yazılması tavsiye edilebilinir)
• İpler, Kordonlar, lastikler veya bantlar kullanılarak bir beşiğe, bez yatağa veya bebek arabasına gerilecek oyuncaklar aşağıdaki uyarıları taşımalıdır.
“Dikkat ! dolaşmadan oluşabilecek muhtemel yaralanmaları önlemek için oyuncak, bebek emeklemeye başladığında çıkarılmalıdır.”
• Sıvı doldurulmuş diş kaşıyıcıları, aşağıdaki uyarıları taşımalıdır.
“Sadece ev tipi buzdolaplarında soğutulmalı, derin dondurucuya konulmamalıdır.”
İçi sıvı dolu olan oyuncakların yüzeyinde, sıvıyı dışarıya sızdırabilecek çatlakların
olmaması gerekmektedir.
• Yüksek darbeli ses seviyeleri çıkartan oyuncaklarda veya ambalajlarında aşağıdaki uyarılar bulunmalıdır.
“Dikkat ! Kulağa yakın olarak kullanmayınız. ! Bu oyuncak işitme kaybına sebep olabilir.”
• Bisikletler aşağıdaki uyarıyı taşımalıdır.
“Dikkat ! daima Koruyucu kask giyilerek kullanılmalıdır.”
Ek olarak kullanım talimatlarında, araba yolunda çocuklara daima bir büyüğün eşlik etmesi gerektiğini hatırlatıcı bir ibare bulunmalıdır. İlave olarak ebeveynler çocukların, özellikle fren sistemlerini güvenli kullanımı olmak üzere, bisiklet kullanımı ile ilgili olarak uygun şekilde bilgilendirildiklerinden emin olmalıdır.
• Oyuncak olarak satışa sunulmuş paten ve kaykaylar aşağıdaki uyarıyı taşımalıdır.
“Dikkat ! koruyucu teçhizat giyilmelidir.” “Vücut ağırlığı 20 kg’dan fazla olan çocuklar için uygun değildir”
Kullanım tariflerine ilaveten, oyuncağın büyük yetenek gerektirmesinden ötürü kullanıcının ve üçüncü şahısların yaralanmasına sebep olan düşmeler veya çarpışmalardan kaçınılması için dikkatle kullanılması hususunda bir uyarıda bulunmalıdır. Tavsiye edilen koruyucu teçhizat (Kasklar, eldivenler, Dizlikler, dirseklikler, v.b.)
• Kimyasal oyuncakların, ambalajlarında aşağıda belirtilen uyarı yer almalıdır:
“Dikkat: Sadece (*) yaşın üzerindeki çocuklar içindir. Yetişkinlerin gözetiminde kullanılır.”
• Yalnız ev içinde ve bahçesinde kullanılmak üzere tasarlanan kaydıraklar, salıncaklar ve bir kirişe tutturulmuş halkalar, trapezler, ipler ve benzeri oyuncakların (askılar, bağlamalar, ankrajlar v.b.) belirli aralıklarla bakım ve onarımının yapılması ihtiyacına dikkat çeken ve bu bakımlarının yapılmaması halinde, oyuncağın düşebileceğini veya devrilebileceğini belirtilen uyarılar bulunmalıdır. Pratik olması halinde, uyarılar oyuncağın üzerine yapıştırılmalıdır. Bu uyarılar, yanlış montaj halinde tehlike arz edecek parçaları da belirterek, oyuncağın doğru montajı hakkında bilgi verilmelidir.

AÇIKLAMALAR
(1) Yetkili Kuruluş: Ürünlere ilişkin mevzuat hazırlamaya ve yürütmeye yasal olarak yetkili bulunan ve 4703 sayılı Ürünlere İlişkin Teknik Mevzuatın Hazırlanması ve Uygulanmasına Dair Kanun hükümlerini kendi görev alanına giren ürünler itibariyle uygulayacak olan kamu kurum veya kuruluşudur.
(2) Dosya: Bir denetime ilişkin tüm bilgi, belge, tutanak ve yazışmalardır. Tespit edilen aykırılığın izlenmesi ile ilgili işlemler bu dosyada yer alır.
(3) Yetkili kuruluşun istemesi durumunda bildirimin denetmene ulaştığı gün ve saat belirtilmelidir.
(4) Aykırılık tespitine mütakip, Aykırılık izleme süreci başlamalı ve her iki tutanak da aynı dosyada tutulmalıdır.
(5) Üretici:Bir ürünü üreten, ıslah eden veya ürüne adını, ticari markasını veya ayrıt edici işaretini koymak suretiyle kendini üretici olarak tanıtan gerçek veya tüzel kişiyi; üreticinin Türkiye dışında olması halinde, üretici tarafından yetkilendirilen temsilci ve/veya ithalatçıyı; ayrıca, ürünün tedarik zincirinde yer alan ve faaliyetleri ürün güvenliğine ilişkin özelliklerini etkileyen gerçek veya tüzel kişiyi ifade eder. Üreticinin tespit edilmediği durumlarda, üreticiyi bildirmeyen ya da bilmeyen dağıtıcı, üretici olarak kabul edilir.
(6) Dağıtıcı:Ürünün tedarik zincirinde yer alan ve faaliyetleri ürünün güvenliğine ilişkin özelliklerini etkilemeyen gerçek veya tüzel kişidir.
(7) Ticaret Sicil No: Ticarethane, fabrika ya da ticari şekilde işletilen diğer müesseseler ticari işletme sayıldığından, bu müesseselerin 6762 sayılı Türk Ticaret Kanunu’nun ilgili maddeleri uyarınca almış oldukları ticaret sicil numarasıdır.
(8) Ürünün Tanımı için adı, markası, cinsi, modeli, tipi v.b arasından uygun olanlar yazılacaktır.
(9) Üretim no. için parti no., kod no., seri no., v.b. arasından uygun olanlar yazılacaktır.
(10) Fatura bilgisi, denetimin satış noktalarında yapılması durumunda, üreticiye ulaşmak amacıyla istenmektedir.Üretim yerinde yapılan denetimler için bu bilgiye ihtiyaç yoktur.
(11) İlgili Teknik Düzenleme: Bir ürünün, ilgili idari hükümler de dahil olmak üzere, özellikleri, işletme ve üretim yöntemleri, bunlarla ilgili terminoloji, sembol, ambalajlama, işaretleme, etiketleme ve uygunluk değerlendirmesi işlemleri hususlarından bir veya bir kaçını belirten ve uyulması zorunlu olan her türlü düzenlemeyi ifade eder. Teknik düzenlemenin olmaması halinde, ulusal veya uluslar arası standartlar; bunlarında olmaması halinde söz konusu sektördeki iyi uygulama kodu veya bilim ve teknoloji düzeyi ya da tüketicinin güvenliğine ilişkin makul beklentisi dikkate alınır.
(12)Tip Onay No: Ürüne ilişkin tip onay numarası varsa yazılır.
(13)Belgelendirme Kuruluşunun Adı ve Kimlik No: Ürün herhangi belgelendirme kuruluşundan belge almış ise yazılacaktır.
(14) Onaylanmış Kuruluş: Test, muayene ve/veya belgelendirme kuruluşları arasından, bir veya birden fazla teknik düzenleme çerçevesinde uygunluk değerlendirme faaliyetinde bulunmak üzere, yetkili kuruluş tarafından belirlenerek, bu Kanunda ve ilgili teknik düzenlemede belirtilen esaslar çerçevesinde yetkilendirilen özel veya kamu kuruluşunu ifade eder.
(15)Uygunluk Değerlendirme Kuruluşu:Ürünün ilgili teknik düzenlemeye uygunluğunun test edilmesi, muayene edilmesi ve/veya belgelendirilmesine ilişkin faaliyette bulunan özel veya kamu kuruluşunu ifade eder.
(16)Gümrük Beyannamesi Tarih ve No:Ürünün ithal ürün olması durumunda yazılır.
(17)G.T.İ.P.:Yalnızca kesin olarak bilinen durumlarda yazılır.
(18)Ürünün uygunluğunu gösteren “CE”, “E”, “e”, “€” veya “II”gibi her türlü işaret, uygunluk beyanı, tip onayı, teknik dosyası gibi her türlü belgeyi ifade eder.
(19)Güvensizlik Şüphesi: tek başına kullanılmaz. Bu tespitin yapılabilmesi için, aynı ürünle ilgili olarak
Aykırılık ya da Usulsüzlük Tespiti bulunması gerekir. Ayrıca Güvensizlik Şüphesinin tespit edilmesi durumunda, ortaya çıkan güvensizliğe dair şüphenin giderilmesi için duyusal incelemenin yeterli olmadığı durumlarda, üründen numune alınarak, Numune Alma formunun da doldurulması ve ürünün teste gönderilmesi gerekir.
(20) Ürünün ilgili teknik düzenlenmesinde öngörülen işaret ve/veya belgeleri taşımaması veya bunların teknik düzenlemede belirtilen hususlara uygun olmaması ya da tahrif veya taklit edilmesi veya usulsüz olarak kullanılması ürünün güvensizliğine dair ciddi şüpheye yol açabilir. Güvensizlik şüphesi ile güvensizlik belirtisi arasındaki farkı açıklamak için bir örnek vermek gerekirse, bir ütünün teknik dosyasındaki herhangi bir eksiklik, ürünün güvensizliği konusunda bir şüphe doğmasına yol açar. Ancak ütünün kablosunun düzgün şekilde yalıtılmadığı ya da bağlantılarının düzgün yapılamamış olması ütünün güvensiz olduğu konusunda açık belirtidir. Herhangi bir şüpheye neden olan hususlar bu başlık altında belirtilir.
(21)Güvensizlik Belirtisi tespitinin amacı,güvensizlik konusunda şüphe bulunması durumu ile, belirti bulunması durumu arasında bir ayrıma gidilmesi gereğidir. Ürünün piyasaya arzının geçici olarak durdurulması güvensizlik şüphesiyle değil, ancak kesin bir güvensizlik belirtisinin tespit edilmesiyle mümkündür. Bu tutanak tutulduğu takdirde, üründen numune alınarak, Numune Alma Formunun da doldurulması ve 24 saat içerisinde kontrollere başlaması gerekir. Buna uymayan ürün ise güvensiz kabul edilir.
(22)Güvenli/ Güvensiz Ürün: Kullanım süresi içinde, normal kullanma koşullarında risk taşımayan veya kabul edilebilir ölçülerde risk taşımayan veya kabul edilebilir ölçülerde risk taşıyan ve temel gerekler ((ürünün insan sağlığı, can ve mal güvenliği, hayvan ve bitki yaşam sağlığı, çevre ve tüketicinin korunması açısından sahip olması gereken asgari güvenlik koşulları) Bakımından azami ölçüde koruma sağlayan üründür.
(23)Güvensizlik Tespiti, Güvensizlik Şüphesi ya da Güvensizlik Belirtisine müteakip, teste gönderilen ürünün güvensiz olması halinde yapılır.
(24)Ürün üzerinde yapılan duyusal inceleme/test/muayene sonucunda, ürünün güvensizliğinin niteliği, uygulanacak cezayı belirleneceğinden, buna ilişkin açıklamanın ayrıntılı olarak yapılması gerekir. Söz konusu güvensizlik, ürünün teknik dosyasına uygun olmamasından kaynaklanabilir veya ilgili teknik düzenlemesine uygun olmakla birlikte ürün yine de güvensiz olabilir. Ayrıca, güvensiz üründe tahrif veya taklit edilmiş ya da usulüne uygun olmadan kullanılmış işaret veya belge bulunuyorsa, bu durum tutanakta belirtilir.
(25)Uygunluk Teyidi, denetim sırasında ürünün güvenli bulunması halinde işaretlenir. Ürünün güvenli olduğu ayrıca el yazısı ile tutanağa yazılır. Eğer ürün uygun bulunmayıp numune alınırsa, Numune alma formu da doldurulur.
(26)Numune alımına ilişkin bilgiler, numune alınması halinde doldurulur.
(27)Numune alındığı yerde bulunan toplam ürün miktar, miktarın ölçülebilir olması durumunda yazılır.
(28)Şahit numune dahil olmak üzere, alınan numune takım miktarının adet, uzunluk, ağırlık, alan veya hacim v.b. birimlerden biriyle ifade edilmesi gerekir.
(29)Numunenin temin edilme şekli, numunenin hangi yoldan temin edildiği belirtilir (örneğin satın alınarak, firma rızası ile herhangi bir ücret ödemeden v.b.)

LIST OF DEFINITIONS MENTIONED IN THE HANDBOOK
Legislation: The Law no. 4703 on “Preparation and Implementation of Technical Legislation on Products
Duplicate Sample: refers to the samples taken by the inspector, to be used in cases where test and examinations are required, in the event that the sample sent to the testing, examination or certification body is ruined, or in cases where test results are disputed.
Sensory Tests: is the initial examination conducted by the inspector using his/her senses, before a product is made subject to a test or examination.
Inspector: The personnel appointed by the Ministry assigned with market surveillance and inspection.
Directorate General: refers to Directorate General for Basic Medical Services responsible with conducting market surveillance and inspection for toys.
Distributor/Sales Store: Real or legal persons in the supply chain whose activities do not affect the safety qualities of the toys.
Manufacturer: refers to real or legal persons which manufacture or refurbish the toys, or introduce themselves as producer by printing their trademark or logo on the product; or their legal representatives if the manufacturer is situated abroad.
Safe Products: refers to products which carry no risk or a tolerable level of risk during usage in prescribed conditions; and which provide maximum safety in reference to essential requirements.
GUIDELINES AND PRINCIPLES FOR MARKET SUPERVISON AND INSPECTION
Market Surveillance and Inspection: covers all activities conducted by the Ministry with the purposes of inspecting or having others inspect whether or not products comply with related technical regulations, during their placement on, distribution and sales in the market, and ensuring that unsafe products are made safe, as well as imposing sanctions when necessary.
Products complying with the Regulation are presumed to be safe.
Market Surveillance and Inspection is made in line with the following guidelines
1- Our General Directorate carries out the market surveillance and inspection ex officio or upon complaints, through its inspectors employed in the Provincial Directorates General and takes the necessary measures and imposes penal sanctions.
In regards to market surveillance and inspection, inspectors are assigned with making inspections, examinations and inquiries.
2- Nonconformity to regulations revealed as a result of inspections conducted by inspectors and other public authorities; information that came to light during an investigation into the causes of an accident, complaints, reportings made by consumers, users, manufacturers, distributors, conformity assessment organization and notified bodies and other public institutions and civil organizations, may be used for market surveillance and inspection purposes.
3- As the complaints and reportings need to be concluded as soon as possible, such information should be conveyed to our ministry at the earliest convenience.
PLACES TO BE INSPECTED
Inspections may be conducted ex officio or upon complaints at the following places:
1) Stores, shops, emporiums, depots, warehouses, transports and all other places where products are stored or sold;
2) And when necessary, places where toys are manufactured, processed, packaged or assembled,
.
Inspections shall be conducted in a way that will not impede works in the place of inspection.
Whom to Take as Respondent During Inspection?
In principle, the manufacturer shall be taken as respondent. This does not free the distributor of its obligations defined in the 9th paragraph of the Article 5 of the Law no.4703. During the inspection of the distributor‘s work place, the producer’s title and address shall be determined. If the manufacturer may not be determined, in cases where toys are found to be unsafe during market surveillance and inspection, any distributor who fails to identify the manufacturer or whom he supplied the. products from, within the timeframe (five days) allowed by the Provincial Directorate, shall be treated as the manufacturer.
HOW THE INSPECTION SHALL BE CONDUCTED:
During the inspection, info and documents pertaining to the manufacturer and the distributor shall be checked, a sensory test shall be conducted on the goods and in cases where necessary, the inspector may conduct or have others conduct all kinds of tests and examinations on goods.
In cases where necessary during the market surveillance and inspection, the Directorate General may resort to facilities of the Ministry, including test and examination laboratories or to other test and examination laboratories or/and licensing organizations in that mater which may not officially be a part of the conformity assessment procedures of the subject product. However the authority to take a decision based on the test and examination results lies with the Directorate General.
Inspected products may be re-inspected when deemed necessary by the Directorate General.
THINGS TO PAY ATTENTION DURING INSPECTION:
1) Market surveillance and inspection shall cover one or more of the aspects mentioned below.
a) Inspection of the marks or documents laid down by the technical document.
b) Sensory test and control in line with the Inspector's Check List (Annex 2)
c) Test or Examination
2) In cases where a test and examination is deemed necessary by the personnel assigned for the inspection, he/she may take samples from the subject of inspection in order to have all sorts of tests conducted on them. Depending on the structure and properties of each product and excluding cases where it is physically impossible to take duplicate samples, the amount of samples to be taken shall be at least two sets, one of which will be taken as the duplicate sample.
3) Three copies of reports (Annex 3) shall be filled for samples taken during inspection. The Sample Taking section of the forms shall be filled out and the reason for taking samples be stated. The samples shall be sealed according to their peculiarities by the inspector, in the presence of the manufacturer or the distributor, in a way that secures it won't be opened without damaging the seal, and labels stating product's connections along with clear names, titles and signatures be affixed to it. A set of samples taken, along with a copy of the report shall be given to the manufacturer or the distributor. The other set of the sample along with a copy of the report will be sent to the Directorate General through Provincial directorates, which will forward it to the designated test and examination center or the certification body. The Inspector shall submit the umpire sample to the Provincial Directorate. The testing or examining organization shall write a report on the sample in no more than forty-five (45) days and send it to the Provincial Directorate, except for cases with compelling reasons
4) If it is arduous or inconvenient to transport or preserve the samples taken, they shall be entrusted to the manufacturer or the distributor, and the situation shall be stated in the report.
5) Should the samples prove to be safe and in conformity with the technical regulations in the end of the test or examination, the manufacturer or in cases where the manufacturer is situated abroad, its legal representative, shall be notified by the Directorate General. The Manufacturer or in cases where the manufacturer is situated abroad, its legal representative, may take back or have the duplicate samples taken back in no more than fifteen days. Products not claimed in the mean time will be disposed by the Ministry.
6) The expenses incurring during the above mentioned works carried out within the scope of market surveillance and inspection shall be paid by the Ministry. However in cases where products prove to be unsafe or in nonconformity with the technical regulations, the expenses shall be paid by the manufacturer. In cases where products prove to be unsafe in the outcome of the market surveillance and inspection, the expenses of prohibition of the placement of products to the market, costs of recall or destruction of products, or notification of potential risk groups will be paid by the manufacturer.
MEASURES TO BE TAKEN AND SANCTIONS TO BE IMPOSED IN CASES OF NONCONFORMITY AND UNSAFETY
A) Precautionary Measures to Be Taken and Sanctions to Be Imposed in Cases of Non-Conformity
(1) In order to determine whether or not a product is in conformity with the technical regulations, the Inspector shall initially check whether or not the product bears the marks and documents stipulated by the technical regulation. In cases where the product is missing the required marks and/or documents and/or it fails to meet other criteria laid down in the technical regulation, a report about products in question for non conformity to technical regulations shall be written. In such situations the "Non-conformity" section of the form should be filled. Provided that the non-conformity in question does not pose a threat to human life or property, the Provincial Health Directorate shall warn the manufacturer in writing, urging it to correct the nonconformity in a given time, and shall forward a copy of the warning to the Directorate General. The result of the control at the end of the deadline should be communicated to the Directorate General. If at the end of the given time the non-conformity continues, the Directorate General issues a fine in line with the clause (a) of the first paragraph Article 12 of the legislation.
Aside from this, market supply of products that are in non-conformity with the technical regulations or products that are missing the CE mark, shall be halted temporarily by the Ministry upon the suggestion of the related Directorate in line with the view stated by the personnel assigned with the inspection.
(Non-Conformity: Missing or misplaced CE mark, misleading of customers with fake CE marks, missing technical dossiers or documents, labels missing name and address of the manufacturer, missing or misplaced warning signs in products that require warnings --ex: printing "not suitable for children between ages 0-3" on a product that is actually suitable for 0-3 age group-- )
(2) In cases where the conformity mark or the document granted as a result of the conformity assessment procedures is forged, imitated or used in infringement of rules ( for ex: if a manufacturer is using the results of an analysis made by him or others or other such documents of a toy under production, for a toy other than the intended product) a report for non-conformity shall be made. In such cases the "İnfringement" section of the form shall be filled out, and a copy of the report will be forwarded to the Directorate General. The Directorate General shall issue a fine as stipulated in the Paragraph (f) of the Article 12 of the legislation.
B) Precautionary Measures to Be Taken and Sanctions to Be Imposed in Cases of Unsafety
(3) In cases where the non-conformity to technical regulations as mentioned in (1) and the forgery, and imitation of the conformity mark or the document granted as a result of the conformity assessment procedures, or its use in infringement of the rules, as mentioned in (2), creates serious doubts that the product may be unsafe, a report for unsafety shall be made. In such cases the Suspected Unsafety section shall be filled and a sensory test or/and a test or an examination is conducted. In cases where a sensory test may not be sufficient a sample shall be taken and the Sample Taking section of the form shall be filled out. The same goes for products with certified conformity to technical regulations.
Suspected Unsafety: Products missing the required marks and/or documents or their failure to meet other criteria laid down in the technical regulation, or forged, and imitated marks and documents or use of marks and documents in violation of rules, may create serious doubts over the safety of products. To give an example on the difference between "suspected unsafety" and "indicators of unsafety": missing elements in the technical dossier of a product may create doubts over the safety of a product, whereas, existence of parts and detachable parts not big enough to secure prevention against swallowing or inhalation, in toys intended for children up to 36 months old, is an indicator of unsafety.
(4) In cases where the non-conformity to technical regulations as mentioned in (1) and the forgery, and imitation of the conformity mark or the document granted as a result of the conformity assessment procedures, or the use of the conformity mark and documents in violation of rules, as mentioned in (2) brings to light unmistakable indicators showing that the product is unsafe, a report shall be written. In such cases the Unsafety Indicator section shall be filled, samples shall be taken and the Article 10 of the Framework Regulation should be enforced. The same goes for products with certified conformity to technical regulations, concerning which an unmistakable indicator of unsafety came to light.
(5) In the event that the product in question prove to be unsafe as a result of procedures mentioned in (3) and (4) a report shall be written. In such cases the "Cause of Unsafety" section shall be filled out and a copy of the report shall be forwarded to the Directorate General. The Directorate General shall execute the Article 11 of the Framework Regulation and in cases where:
a) The products which prove to be unsafe are not in conformity with related technical regulations
b) The conformity mark or the document granted as a result of the conformity assessment procedures of the products in question which proved to be unsafe are at the same time, forged, imitated or used in infringement of rules
it shall, without prejudice to the distributor's liability stipulated in the first sentence of the the paragraph 9 of the Article 5 of the legislation,
fine the manufacturer pursuant to the general provisions of the March 30, 2005 dated Misdemeanor Law 5326 and in line with the paragraph (b) of the Article 12 of the Law 4703.
(6) For products which proved to be unsafe though they were certified to be in conformity with technical regulations, manufacturers shall be issued fines as stipulated by the clause (b) of the first paragraph of the Article 12 of the Legislation.
(7) Should the manufacturer prove that the product which turned out to be unsafe was not put on the market by it or the unsafety occurred as a consequence of compliance to the technical regulation, it shall be freed of its obligations.
Note: If the official of a company refuses to sign the Market Inspection and Surveillance report, this situation will be stated in the signature section designated for the company officials, but a copy of the report shall not be given to the company. Instead, a copy of the report will be sent to the company by the Provincial Health Directorate as legal correspondence.
ANNUAL RECORDS AND REPORT
The annual records of market surveillance and inspection activities shall be kept by the Provincial Directorates (Annex 4). These records contain information on the title and address of the inspected salesrooms, the commercial name and address of the manufacturer/importer, name of the product, origin of the inspected product, harmonized system code of imported products, customs port of entry, the technical regulation the inspection was based on, whether the inspection was conducted ex officio or upon complaint, the method of inspection, the precautionary measures taken and penal sanctions imposed. Based on these records the Directorates shall prepare the annual market surveillance and inspection report and send it to the Ministry until January 15.
DUTIES, POWERS AND RESPONSIBILITIES OF THE INSPECTOR
The Inspector which is assigned with inspection having successfully completed the training given by the ministry:
a) Powers and Duties of the Personnel Assigned with Inspection:
1) To conduct market surveillance and inspection in his/her area of duty in line with the provisions of applicable regulations and make reports and keep records and present these to competent authorities,
2) To notify the Directorate General in writing in the event that they come across actions by respondents creating criminal liability, other than penalties and precautionary measures stipulated by the law.
3) To make research and studies on needs that may arise in the implementation of the related regulations in his/her area of duty, and report its views and suggestions to the Provincial Directorate and General Directorate,
4) To take samples from the products to be inspected,
5) To request files and documents he/she deems necessary for the conduct of the inspection, from the respondent establishments and persons, to examine and take certified official copies of these, to make examination, to take stock and make inquiries in the places where products are sold or used, including manufacturing and storage facilities as well as all mobile and immobile places subject to inspection, and seal these places when necessary, to request information and assistance from officials of all ranks,
6) In the event, the manufacturer obstructs or impedes the inspections: to request assistance from law enforcement and to make the inspection under law enforcement escort,
7) To keep a separate record of all procedures (correspondences, reports etc.) for each product during the conduct of the inspection from the beginning until the end,
8) To consult competent experts qualified for the task for opinions and suggestions and request reports and invite them to accompany during the conduct of market surveillance and inspection, with the approval of the Ministry or the Governorship in cases where the ministry has delegated its powers.
b) Responsibilities of the Inspector
1) To present the ID or mission certification issued by the Ministry, to the manufacturer or the distributor before the inspection.
2) Not to interfere with management and executive works of the manufacturer or distributor establishments being inspected.
3) To conduct the market surveillance and inspection independently and impartially in line with the regulations.
4) To observe professional secrecy with regard to all information and documents obtained in carrying out market surveillance and inspection tasks.
RESPONSIBILITIES OF THE MANUFACTURER OR DISTRIBUTOR PERTAINING TO INSPECTION AND SURVEILLANCE ACTIVITIES
Aside from the responsibilities stipulated by the Article 5 of the Legislation and the Article 6 and 7 of the Framework Regulation, the Manufacturer and the distributor are responsible with:
a) Allocating a suitable working space for the Inspector during his/her conduct of inspection and surveillance duties. In the event that a suitable work place cannot be allocated or suitable conditions for inspection cannot be ensured: taking all the dossiers and documents requested by the Inspector to the work place of the Inspector.
b) Saving all the documents mentioned in the technical regulations for a duration of ten years, and presenting them to the Inspector when requested;
c) They are obliged to present all the requested information and documents regarding the the market surveillance and inspection to the personnel assigned with inspection even though they may be confidential.
ANNEX-1- INSPECTION WORK FLOW
ANNEX 2- TOY CHECK LIST FOR INSPECTORS
• Refer to Annex-1 of the Regulation to detect whether the product is a toy or not
• If the product is a toy it must bear a CE mark on it
• The CE mark must be placed on the toy as stated in the Annex-V
• The manufacturer’s name and/or commercial title and/or trade mark and address must be printed on the labeling or packaging of the toy
• A user's manual must be present with toys that require manuals.
• During controls in places of manufacturing, the materials used in products should be cleanly, and bug free, clearly visible with the eye.
• Toys must be designed and manufactured in such a way as to meet hygiene and cleanliness requirements in order to avoid any risk of infection, sickness or contamination.
• Toys, which are clearly intended for use by children under 36 months, and their component parts and any of their detachable parts must be of such dimensions as to prevent their being swallowed or inhaled..
• As the tendency of children under 36 months, to take objects in their mouths is an established fact, parts of toys intended for this age group should be at a minimum dimension so as to avoid asphyxiation.
Toys should be made durable enough to endure tearing and wearing out. Toys that are fixed to each other should be glued in way that would not come apart when wet, considering that the children will constantly take the toy to their mouth.
• If toys intended for children up to 36 months old are made up of tiny components assembled together, these need to remain intact when exposed to serious tearing and wearing out (coating of toys like rattles need to be durable, eyes of toys should not come off, and stitches should not come undone)
• Components and packaging of Toys should not carry risk of suffocation (especially packaging that is made of soft plastic should not cause suffocation if the children wear it over their heads. Therefore packaging made of soft plastic should have vent holes and a warning printed on it saying it is not a toy.)
• Toys not intended for children under 36 months but which might be dangerous and attractive for them shall bear a warning such as ‘Not suitable for children under 36 months’ or ‘Not suitable for children under three years’. This point shall not apply to toys which, on account of their function, dimensions, characteristics or properties, or on other cogent grounds, are manifestly unsuitable for children under 36 months.
• Masks and helmets should have suitable vents. Flexible masks should not have a tight grip on the children's face in a way that could impede respiration. Masks and helmets that are not made of permeable material should have two unobstructed vent holes with a 150mm of minimum distance between them.
• Mouth toys or mouth components of toys should not be composed of parts that are small enough to risk accidental swallowing or asphyxiation related mortality Also , the detachable and movable mouth components of toys (like the mouth piece of a trumpet) should not be small enough to risk accidental swallowing or inhalation. This applies regardless of the intended age group of toys.
• Regardless of whether or not they were designed to house a child, toys which it is possible to get inside and which thereby constitute an enclosed space for occupants (tents, toy chests etc. toys with helmets like space helmets) must have sufficient ventilation and a means of exit which the intended user can open easily from the inside without help.
• Toys which feature folding or sliding mechanism with an actual seat width larger than 140mms should carry the following qualities.
-Baby carts and strollers with handles and other mechanisms that could fold on the children should have a lock mechanism or safety latch. (toy baby carts and strollers are meant here).
-Safety hatches and lock mechanisms should automatically lock when they are unfolded. (there are also baby carts and strollers that can partially open without the safety mechanism locking, which comply with the regulation)
• Toys should be designed and manufactured in way that would minimize the risk of injury due to the movements of its components. Precautionary measures should be taken in toys that have a hinge (a toy with a door, a battery-operated car) in order to minimize the risk of hands crushing. Folding toys (ironing table, folding chairs, and tables and toy strollers) should have a safety hatch or a lock mechanism
• Toys and their parts and, in the case of fixed toys, their anchorages, must have the requisite mechanical strength and, where appropriate, stability to withstand the stresses to which they are subjected during use without breaking or becoming liable to distortion at the risk of causing physical injury. For example baby strollers (toys) are used to carry dolls but because sometimes children may sit in it themselves for play, materials used in the making must be able to carry a certain load..
• Toys should not carry the risk of injuring upon impact; the edges of bows and arrowheads should not be made of metal. Toys intended to bear the mass of a child, (bicycles, tricycles, motorcycles and cars) should not have sharp laterals and pointed edges. Precautions should be taken to prevent pipes and other components protruding from toys, from injuring children (for ex: edges of umbrella wires should have protective coating).
• In order to avoid injury from shattered glass, glass should be used in toys intended for children older than 36 months, only if: it’s necessary for the functioning of the toy (optic toys, light bulbs etc.), for fortification purposes or in fiberglass, in hard glass marbles, or hard eyeballs of dolls. For example porcelain is used in toy tea sets and allowed for children older than 36 months old.
• Toys conferring mobility on their users must, as far as possible, incorporate a braking system which is suited to the type of toy and is commensurate with the kinetic energy generated by it. Such a system must be easy for the user to operate without risk of ejection or physical injury for the user or for third parties.
• All toys which have a freewheel mechanism meant to be ridden should be equipped with a break system. Direct transmission toys like three cycles and cars with pedals in the front wheel or electric driven cars shall be excluded, as children in these toys can freely move their feet which can be used as a break.
• Inflatable toys intended for playing in the water, should not have fixed valves. The tap must be designed in way to allow pressing it into the toy when it is inflated in order to ensure it will not protrude. (Other products like large inflatable boats which are designed for use in deep waters are excluded. Inflatable arm bands, and inflatable water chairs are excluded as they are considered swimming gear. Generally speaking indoor toys and toys used in the bathtubs are considered in this category)
• Swings intended for use indoors and in gardens must have a back bar and a safety mechanism that prevents children from falling. Often accidents happen as little children fall from the swing when the seat turns over. Therefore it is most important to make sure the swing ropes are fixed as close as possible to the corners of the seats so as to hold center of children's weight. If ropes or cords are used in the making of the swings, these should be designed in a way to minimize risk of strangling. (Gear intended for use in the gardens are not covered under the regulation on toys, but fall under the regulation on toy equipments.)
• Toys with heating components should not cause burns or injuries.
Toys must be manufactured so as to ensure that: the maximum temperature of any accessible surfaces does not cause injury when touched; and liquids and gases contained within the toy do not reach temperatures or pressures which are such that their escape from the toy, other than for reasons essential to the proper functioning of the toy, might cause burns, scalds or other physical injury.
• Toys which contain functional heat sources should not inflame when operated incessantly.
• Toys should not be explosive, or contain explosive materials or components.
• Toys shall not be powered by electricity of a nominal voltage exceeding 24 volts, and their accessible parts shall not exceed 24 volts.
• Parts of toys which are connected to, or liable to come into contact with, a source of electricity capable of causing electric shock, together with the cables or other conductors through which electricity is conveyed to such parts, must be properly insulated and mechanically protected so as to prevent the risk of such shock.
•
• Packaging of rubber balloons should carry the following warnings: “Caution! Children under eight (8) years old may choke or suffocate while blowing un-inflated or broken balloons. Adult supervision is required. Keep un-inflated balloons out of the reach of children broken balloons should be disposed off right away."
• Aquatic toys shall bear the following warning: ‘Only to be used in water in which the child is within its depth and under adult supervision’
This warning should be printed in a contrasting color to the color of the body of the toy. The font size should be a minimum of 3mms and the warning sign should be 100 mms away from one of the valves.
• Functional toys shall bear the following warning: ‘To be used under the direct supervision of an adult’. In addition, these toys shall be accompanied by directions giving working instructions as well as the precautions to be taken by the user, with the warning that failure to take these precautions will expose the user to the hazards – to be specified – normally associated with the appliance or product of which the toy is a scale model or imitation. It shall also be indicated that the toy must be kept out of the reach of little children.
• Functional edges and functional tips: Toys which have functional edges and functional tips, should carry warnings in their packaging and users' manual against probable harms of such tips and edges. (Provided that it is necessary for the function of the toy, pointed tips may be used in toys intended for children older than 36 months.)
• Toys with bullets should carry warnings pointing out dangers of using bullets other than provided or recommended by the manufacturer, or firing from a short distance.
• The tip diameter of all solid bullets should be at least 2mm. If the shooting mechanism is capable of shooting other material than bullets provided with the toy, users should be warned against possible harms of use of wrong materials.
• Packaging of percussion caps should carry the following warnings:
"Do not fire indoors or close to the eyes or the ears. Do not carry open capsules in the pockets.
• Manufacturers should be warned to design toys that would not shoot materials other than those provided with the toy.
• Imitation Protective Gear (masks and helmets) and their packaging, if any, shall bear the following warning: “This toy does not provide protection in the event of an accident"
• Toys which have ropes that tie them to the ground or kites with ropes longer than 2ms or other flying toys should carry the following toys:
"Caution! should not be flown near high tension power lines"
(Manufacturers may be recommended to write a warning that toys should not be flown in stormy weather)
• Toys intended to be strung across a cradle, cot or perambulator by means of strings, cords, elastics or straps shall carry the following warning on the packaging,
‘To prevent possible injury by entanglement, remove this toy when the child starts trying to get up on its hands and knees in a crawling position’.
• Teethers with liquid fillings should carry the following warnings:
"Should be refrigerated only in domestic fridges and not be put in deep freezers"
Toys with liquid fillings should not have cracks through which the liquid could ooze outside.
• Toys emitting high impact sounds should bear the following warnings:
"Caution! Do not use close to the ears! Misuse may cause hearing impairment."
• Bicycles should carry the following warning.
"Caution! A protective helmet should always be warn while riding."
Moreover, a reminder that children should always be accompanied by an adult in motorways should be included. Furthermore parents should make sure their children are well informed about how to ride a bike especially how to safely use the break system of bikes.
• If Skates and skateboards for children are offered for sale as toys they shall bear the marking: should carry he following warnings:
'Warning: protective equipment should be worn',"Not suitable for use of children heavier than 20kgs."
Moreover, as the toy requires a high level of skill,.the instructions for use shall contain a reminder that the toy must be used with great caution, and care, so as to avoid falls or collisions causing injury to the user and third parties. Some indication shall also be given as to recommended protective equipment (helmets, gloves, knee-pads, elbow-pads, etc.).
• Chemical toys shall bear the following marking on their packaging:
"Caution! Only intended for the use of children above the age of (*).. For use under adult supervision."
• Slides, suspended swings and rings, trapezes, ropes and similar toys attached to a crossbeam. Such toys shall be accompanied by instructions drawing attention to the need to carry out checks and maintenance of the main parts (suspensions, fixings, anchorages, etc.) at intervals, and pointing out that, if these checks are not carried out, the toy may cause a fall or overturn. Instructions must also be given as to correct assembly of the toy, indicating those parts which can present dangers if it is incorrectly assembled.

FOOT NOTES
(1) Authorized Organization: The public organization or institution which is legally authorized to prepare and implement regulations on products and which is assigned with enforcing the provisions of the Law no. 4703 on “Preparation and Implementation of Technical Legislation for Products" in issues that fall into its area of duty.
(2) Dossier: is all the information, documents, reports and correspondence about an inspection. The monitoring procedures of a detected non-conformity are recorded in this dossier.
(3) In the event that the Authorized Organization requests it, the date and time the inspector received the notification shall be stated.
(4) Following the detection of nonconformity, the nonconformity monitoring process should be started and both reports should be saved in the same dossier.
(5) Manufacturer: refers to real or legal persons which manufacture or refurbish the toys, or introduce themselves as producer by affixing their trademark or logo on the product; or their legal representative or/and importer if the manufacturer is based abroad; also real or legal persons within the supply chain whose actions affect the safety properties of the product. In cases where the manufacturer may not be determined, any distributor who fails to identify the manufacturer or does not know the manufacturer shall be treated as the manufacturer.
(6) Distributor: Real or legal persons in the supply chain whose activities do not affect the safety qualities of the toys.
(7) Trade Registration No: As all businesses, factories and other establishments that are run commercially are considered commercial establishments, this term refers to the trade registration number these establishments are obliged to get under the relevant provisions of the Turkish Code of Commerce no 6762.
(8) In the Product Definition section relevant info from among: name, brand, class, model, type etc. will be stated.
(9) In the Product Number Section, relevant info from among ‘lot no., code no. serial no etc’ will be stated,
(10) Invoice Info: it is requested in cases where the inspection is made in the salesrooms in order to contact the manufacturer. During inspections conducted in the manufacturing place, this information is not necessary.
(11) Relevant Technical Regulation: refers to all mandatory regulations, including relevant administrative provisions, that regulate one or more of aspects like properties, management and manufacturing methods, terminology on these, symbols, packaging, branding, labeling and conformity assessment. In case no applicable technical regulation is in place, national or international standards apply, in case there are no applicable national standards, best practices code in the sector in question or the level of science and technology or the reasonable expectancy of the consumers are taken into consideration.
(12) Type Approval No: If there is any the Type approval No of the product should be stated.
(13) Name and Registry No. of the Licensing Organization: Any licensing organization that issued licenses for the product in question will be stated here.
(14) Notified Body: Private or Public organization that is chosen from among Testing, Examination, or/and Certification organizations by the Authorized Organization and assigned (within the scope of the legislation and the guidelines stated in the applicable technical regulation) with making conformity assessment based on one or more technical regulations
(15) Conformity Assessment Organization: refers to the private or public organization that carries out activities for testing the product's conformity to the relevant technical regulation, or examining or certifying the product.
(16) Customs Declaration No: It shall be stated for imported products only.
(17) Harmonized System Code: shall be stated only if it is known for sure.
(18) It refers to all the documents, type approval, conformity statement, technical dossier and all the marks like “CE”, “E”, “e”, “€” or “II” which indicates the product's conformity.
(19) Suspected Unsafety may not be solely acted upon. Non-Conformity and İnfringement must also be detected.
When the presence of nonconformity or infringement may create serious doubts over a toy, suspected unsafety occurs. Sensory test is conducted to clear suspicion. In cases where the sensory test is not sufficient a sample shall be taken and the sample taking section of the form shall be filled out. The sample shall be sent to testing
(20) Products missing the required marks and/or documents or their failure to meet other criteria laid down in the technical regulation, or forged, and imitated marks and documents or use of marks and documents in violation of rules, may create serious doubts over the safety of products. To give an example on the difference between "suspected unsafety" and "indicators of unsafety": missing elements in the technical dossier of an iron may create doubts over the safety of the product. However if the cable of the iron is not properly isolated or it’s connections are not made properly, this is a clear indicator of the unsafety of the product. Any issue that is causing suspicion is stated in this section.
(21) The purpose of the detection of unsafety indicator, is to make a distinction between suspected unsafety and presence of indicators of unsafety. The suspension of placement of the product is only possible when an unmistakable indicator of unsafety is detected. When this report is made, a sample of the product should be taken and the Sample Taking Form should also be filled out and the controls should begin in 24 hours. Any product which does not comply with this shaal be presumed unsafe.
(22) Safe Products/Unsafe Products refers to products which carry no risk or a tolerable level of risk during usage in prescribed conditions; and which provide maximum safety in reference to basic requirements (the minimum safety conditions that a product must ensure, in regards to human health, safety of life and property , animal and plant health and protection of the environment and consumers).
(23) Unsafety Detection will be made should the product prove to be unsafe as a result of tests following the unsafety suspicion and indicator.
(24) As the degree of unsafety detected in the sensory test/test/ or examination will determine the sum fine to be issued, the explanation on this issue should be detailed. The unsafety in question might be stemming from non-conformity of the product to the technical regulation. Or the product may be unsafe though it complies with the technical regulation. Aside from these if the products are missing the required marks and/or documents or these are forged or imitated, or the documents and marks are used in violation of rules, these should be reported.
(25) Verification of Conformity: this box is checked when the product is found to be in compliance with the related regulation. The safety of the product will separately be written down in hand writing.
(26) Information on taking samples will be filled out when a sample is taken.
(27) The total number of products will be stated only when the numbe is countable.
(28) The number of set of samples taken should be expressed in one of the following;length, weight, area or volume etc.
(29) The method of sample taking, how the sample was taken will be stated (for example: by purchasing, by consent of the company or free of charge etc.)

NOTE 1-Since the information to be recorded under the "Cause of Non-Conformity," Cause of İnfringement" "Cause of Suspected Unsafety", "Unsafety Indicator" and "Cause of Unsafety" sections in the report might require special explanations, additional forms may be attached to the report for this purpose.
NOTE 2- Assessments in the report pertaining to market surveillance and inspection except the "Cause of unsafety" section, are generally assessments that are made about marks and/or documents stipulated by the technical regulation. Therefore separate reports can be made under the existing regulations or additional reports may be attached to this report.
NOTE 3- As for legal sanctions for violations detected outside the scope of the Law no 4703, legal actions shall be taken in accordance with applicable legislation.
