O artigo 80 do CPP estabelece que é facultada ao juiz a separação dos processos quando as infrações tiverem sido praticadas em circunstâncias de tempo ou de lugar diferentes ou quando, pelo excessivo número de acusados e para não prolongar a prisão provisória dos denunciados, ou por outro motivo relevante, a autoridade judicial reputar conveniente o desmembramento.
