السبب الأول
القصور في التسبيب
1-تنص المادة (310) من قانون الإجراءات الجنائية على أنه "يجب أن يشتمل الحكم على الأسباب التي بُنى عليها، وكل حكم بالإدانة يجب أن يشتمل على بيان الواقعة المستوجبة للعقوبة، والظروف التي وقعت فيها، وأن يشير إلى نص القانوني الذي حكم بموجبه".
2. وبموجب هذا النص أن الحكم الجنائي يجب أن يكون مشتملاً على أسباب كافية لحمل قضائه، وأن تكون هذه الأسباب دالة بذاتها على أن المحكمة حين قضت في الدعوى بالإدانة قد ألمت إلماما صحيحا بمبنى الأدلة القائمة فيمها وأنها تبينت الأساس الذي تقوم عليه شهادة كل شاهد [نقض 22/3/1976، في الطعن رقم 1819 لسنة 45 ق، مج س 27، ص 337 ونقض 10/1/1972في الطعن رقم 1507 لسنة 41 ق، مج س 23، ص 57].
3. والمراد بالتسبيب الكافي تحرير الأسانيد والحجج التي بنى الحكم عليها، فأدت به إلى النتيجة التي انتهى إليها سواء من حيث الواقع أم من حيث القانون، وأن يكون ذلك في بيان جلي مفصل بحيث يستطاع الوقوف على مسوغات ما قضي به الحكم. أما إفراغ الحكم في عبارات عامة معممة أو وضعه في صورة مجملة مجهلة فإنه لا يحقق الغرض الذي قصده الشارع من إستيجاب تسبيب الأحكام، ويعجز محكمة النقض عن مراقبة صحة تطبيق القانون على الواقعة كما أصبتها الحكم [نقض 27/4/1975 في الطعن رقم 624 لسنة 45 ق، مج س 26، ص 358، ونقض 29/1/1973، وفي الطعن رقم 1429 لسنة 42 ق، مج س 24، ص 114، ونقض 12/1/1982 في الطعن رقم 2559لسنة 51ق، مج س 33، ص 26 ونقض 19/1/1982 في الطعنين رقمي 2618 و 2625 لسنة 51 ق، مج س 33، ص 46].
Translation - Arabic GROUNDS OF APPEAL
THE FIRST REASON
LACKING IN SUBSTANTIATION
1. Article (310) of the Code of Criminal Procedure states that "the judgment must include the grounds on which it was based, and each sentence of conviction must include a statement of the fact of the penalty and the circumstances in which it occurred and refer to the text of the law under which it was pronounced."
2. Under this provision, the criminal judgment must have sufficient grounds. These grounds must be self-evident that the court, when adjudicating the case, has received a correct knowledge of the evidence structure and has established the basis for the testimony of each witness. See(Rev. of 22/3/1976 Appeal in Cassation No. 1819 of 45 J, Vol. S. p. 337, and 10/1/1972, in Appeal in Cassation No. 1507 of year 41 J, Vol. S 23, p. 57).
3. What is meant by enough substantiation is to liberate the grounds and arguments upon which the judgment was built and led to that result, both in terms of reality or in terms of law and that shall be in a detailed clear statement so that one can understand the credentials of the ruling. Phrasing of the ruling in general terms or in the form of a vague sentence does not meet the purpose of the legislator who necessitates that judgments must be caused. This makes the Court of Cassation unable to monitor validity of application of the law to the incident as proved by the judgment.
