Under a conventional fire and perils, property damage or business pack policy, the insured customer has a common law burden of proof to establish their rights to a claim. This is called the onus of proof and it first falls to the insured to prove a loss has occurred that is covered under the policy. That is, it is caused by a defined event in the policy. Claims officers have to evaluate evidence that the insured supplies, so that they can establish, on the balance of probabilities:
● that an insured event has occurred under a contract indemnifying the customer
● loss or damage was caused by the insured event
● the customer’s pecuniary interests in the property lost or damaged
● the value or amount of loss.
The onus of proof then shifts to the insurer. It is then up to the insurer to prove that exclusion or a policy condition applies and the loss is excluded from the policy.
The burden of proof for the insurer is higher than that for the insured. The insured’s burden of proof is prima facie—on the face of it—and this is established on the balance of probabilities.
The insurer’s burden of proof is not prima facie—it is a stricter test.
