1. Plaintiff incorporate by reference paragraphs 1 through 64, inclusive, as if fully set forth herein at length.
2. The aforesaid injuries and damages were caused by the negligence and liability producing conduct of defendants, XXX Healthcare Workers #1-10, acting individually, jointly, severally and/or in the alternative, which consisted of, among other things, the following:
a. Failure to order and/or perform a proper neurological examination under the circumstances;
b. Failure to order and/or perform a proper neurological workup under the circumstances;
c. Failure to order and/or perform laboratory testing;
d. Failure to order and/or perform full vital sign assessment of minor Plaintiff under the circumstances;
e. Failure to order or perform appropriate observation of minor Plaintiff under the circumstances;
f. Improperly discharging minor plaintiff from the hospital and/or emergency department under the circumstances on July 3, 1996;
g. Failure to timely and/or properly admit minor plaintiff to the hospital under the circumstances;
h. Failure to timely, properly and/or adequately diagnose and/or treat the conditions from which XXX suffered;
i. Improperly diagnosing the condition and/or distress of XXX
j. Failure to timely, properly and/or adequately request, recommend or order a consultation with a doctor specializing in, among other things, infectious diseases, neonatology, and/or neurology;
k. Destroying and/or losing applicable medical records;
l. Allowing the spoliation of applicable medical records;
m. Failure to timely, properly and/or adequately request, recommend or order administration of antibiotics to XXX;
n. Failure to timely, properly and/or adequately consider and/or act on the possibility that XXX was suffering from infection, meningitis and/or sepsis in light of her symptomotology, signs and/or test results;
o. Failure to timely, properly and/or adequately institute an appropriate course of treatment given the possibility that XXX was suffering from infection, meningitis and/or sepsis in light of her symptomotology, signs and/or test results;
p. Failure to timely, properly and/or adequately order and/or perform testing to rule in/out that XXX was suffering from infection, meningitis and/or sepsis in light of her symptomotology, signs and/or test results;
q. Incorrectly diagnosed XXX aforenoted complaints/symptoms;
r. Failure to maintain and/or insure close and/or continuous observation of XXX, given her condition and/or symptoms;
s. Failure to monitor vital signs of XXX on July 4, 1996;
t. Failure to monitor the temperature of XXX on July 4, 1996;
u. Failure to monitor the blood pressure of XXX on July 4, 1996;
v. Failure to treat XXX low temperature on July 4, 1996;
w. Failure to monitor and/or record monitoring of XXX on July 4, 1996;
x. Failure to treat XXX low hemoglobin on July 4, 1996;
y. Failure to treat XXX acidosis on July 4, 1996;
z. Violated JCAHO and Hospital or corporate standards and pertinent governmental regulations with regard to patient care and medical documentation under the circumstances.

1. La parte attrice si richiama integralmente ai propri paragrafi dal n.1 al n.64 compreso così come sopra esposti.
2. Le suddette lesioni ed i suddetti danni derivano dalla negligenza e dalle condotte fonti di responsabilità dei convenuti, XXX Dipendenti del Servizio Sanitario #1-10, i quali hanno agito individualmente, congiuntamente, solidalmente e/o alternativamente, e le cui condotte sono rappresentate da, tra le altre cose:
a. Non aver ordinato e/o eseguito un’adeguata visita neurologica nelle circostanze del caso;
b. Non aver ordinato e/o eseguito un’adeguata analisi diagnostica neurologica nelle circostanze del caso;
c. Non aver ordinato e/o eseguito esami di laboratorio;
d. Non aver ordinato e/o eseguito esami completi dei segni vitali dell’Attrice minorenne nelle circostanze del caso;
e. Non aver ordinato e/o eseguito osservazioni adeguate dell’Attrice minorenne nelle circostanze del caso;
f. Inadeguata dimissione dell’attrice minorenne dall’ospedale e/o dal reparto di pronto soccorso nelle circostanze del caso il giorno 3 luglio 1996;
g. Non aver accettato tempestivamente e/o adeguatamente l’attrice minorenne presso l’ospedale nelle circostanze del caso;
h. Non aver diagnosticato e/o curato tempestivamente, adeguatamente e/o sufficientemente i disturbi di cui soffriva XXX;
i. Non aver diagnosticato adeguatamente la malattia e/o i disturbi di XXX;
j. Non aver richiesto, consigliato od ordinato tempestivamente, adeguatamente e/o sufficientemente un consulto con un medico specialista, tra le altre cose, in malattie infettive, neonatologia e/o neurologia;
k. Distruzione e/o perdita dei registri medici del caso;
l. Aver permesso la distruzione dei registri medici del caso;
m. Non aver richiesto, consigliato od ordinato tempestivamente, adeguatamente e/o sufficientemente la somministrazione di antibiotici a XXX;
n. Non aver considerato e/o agito tempestivamente, adeguatamente e/o sufficientemente riguardo l’eventualità che XXX potesse soffrire di infezione, meningite e/o setticemia alla luce della sintomatologia, dei segni vitali e/o dei risultati degli esami;
o. Non aver iniziato tempestivamente, adeguatamente e/o sufficientemente un appropriato ciclo di cure vista l’eventualità che XXXpotesse soffrire di infezione, meningite e/o setticemia alla luce della sintomatologia, dei segni vitali e/o dei risultati degli esami;
p. Non aver ordinato e/o eseguito tempestivamente, adeguatamente e/o sufficientemente esami per accertare/escludere che XXX potesse soffrire di infezione, meningite, e/o setticemia alla luce della sintomatologia, dei segni vitali e/o dei risultati degli esami;
q. Aver diagnosticato male i suddetti disturbi/sintomi di XXX;
r. Non aver mantenuto e/o assicurato un’osservazione stretta e/o continua di XXX, data la sua condizione e/o i suoi sintomi;
s. Non aver monitorato i segni vitali di XXX il giorno 4 lulio 1996;
t. Non aver monitorato la temperatura di XXX il giorno 4 luglio 1996;
u. Non aver monitorato la pressione sanguigna di XXX il giorno 4 luglio 1996;

TANTO PREMESSO, le parti attrici chiedono che venga emessa sentenza a loro favore e contro i convenuti, XXX Dipendenti del Servizio Sanitario #1-10, individualmente, congiuntamente e solidalmente e/o alternativamente, e che siano condannati al risarcimento dei danni, degli interessi, delle spese giudiziarie, delle spese legali e di ogni altra riparazione che questo tribunale ritenga giusta.
