تمهيد
يعد قطاع الإتصالات الشريان الرئيسي والقلب النابض للإقتصاد في جميع دول العالم، ويحظى بأهمية إستراتيجية كونه يعد من أهم المساهمين في تطوير عجلة التنمية المستدامة الى جانب قطاعات العمل الاخرى، وكذلك لكونه أحد مكونات البنية التحتية لقيام أي مشروع استثماري، كما انه يسهم بشكل كبير في زيادة التبادل التجاري بين الدول وانتعاش الإقتصاد العالمي والمحلي لأي دولة، وتتزايد أهمية قطاع الاتصالات يوماً بعد يوم نظراً لما حققه من تطور وازدهار في جميع القطاعات الإقتصادية الأخرى كالتعليم والصحة التي تطورت بفضل قطاع الاتصالات وما حققه من وسائل سهلت عملية الإتصال والتعلم على المستوى المحلي والدولي.
وفي ظل التطور السريع لقطاع الاتصالات على المستوى الدولي أدركت الحكومات أهمية فتح المجال أمام القطاع الخاص للاستثمار فيه، فقامت العديد من دول العالم بإعادة هيكلة سوق الاتصالات لديها وذلك لتحرير هذا القطاع وفتح المجال أمام القطاع الخاص للاستثمار في القطاع وتوفير قاعدة عريضة من المنتجات والخدمات التي كانت الحكومة تدير عملية توفيرها للمواطنين، وبدأت الحكومات بالانسحاب إما بشكل جزئي أو كامل من القطاع لإتاحة الفرصة للقطاع الخاص للاستثمار وتوفير خدمات جديدة للمستفيدين بأسعار مناسبة وبجودة عالية ومنحهم فرصة الإستفادة من الخيارات المتعددة من الخدمات والعروض التي يوفرها المستثمرون الجدد.
وقد كان لجلالة الملك عبد الله الثاني النظرة الثاقبة والشاملة والرؤية المستقبلية التي رسمت ملامح تطور قطاع الإتصالات وتكنولوجيا المعلومات، فقد عبّر عن ذلك بقوله الشهير "إدراكاً منا بأن استثمار القطاع الخاص هو المحرك الحقيقي للتنمية الاقتصادية المستدامة، فقد اعتمدنا خطة عمل تهدف إلى تشجيع هذا الإستثمار في القطاعات الرئيسة في الإقتصاد الأردني، وتتضمن هذه الخطة سنّ التشريعات الهادفة إلى تحرير هذه القطاعات من خلال الخصخصة والتنظيم الملائم وضمان المنافسة العادلة ".
وقد أدركت الحكومة منذ البداية أهمية مواكبة التطور العالمي في هذا الإتجاه، وأن الإستثمار في البينة التحتية وخدمات الاتصالات لن يتأتى إلا من خلال فتح المجال أمام القطاع الخاص للإستثمار في توفير خدمات الاتصالات، كما وأدركت أن إصلاح الهيكل التنظيمي هو أكثر الطرق فاعلية في تحفيز المستثمرين وجذبهم للاستثمار في القطاع وابتكار خدمات جديدة لخدمة المستفيدين والإقتصاد الوطني بشكل عام.
وقد خطت الحكومة خطوات هامة في هذا الاتجاه، إذ قامت بوضع برنامج لإعادة هيكلة القطاع والذي كان نتيجته فصل دور المنظم عن مقدّم الخدمات وعن واضع السياسات، فتم إصدار قانون اتصالات لعام 1995 والذي أنشئت بموجبه هيئة تنظيم قطاع الاتصالات لتكون هيئة مستقلة مالياً وإدارياً ولتتولى كذلك مهام تنظيم القطاع وتنفيذ سياسة الحكومة في هذا الخصوص، كما تم لاحقاً تحويل مؤسسة الاتصالات السلكية واللاسلكية إلى شركة مساهمة عامة في عام 1997، وأنيط بوزارة الاتصالات مسؤولية اقتراح السياسات الخاصة بالقطاع.

Preamble
Telecommunication sector is considered the economy’s primary artery and the spring heart worldwide. It enjoys a strategic importance being considered among the major contributors in developing the wheel of continual development along with other work sectors, and also being one of the infrastructure components to establish an investment project. Moreover, it contributes massively in increasing the trade exchange between countries and refresh world and local economy in any country. The telecommunications sector importance increases day by day in view of its accomplishments in developing and prospering other economical sectors like education and health thanks to the telecommunication sector and its devising of means that facilitated communication and learning on the national and international level.
The rapid and prevailing development in telecommunication sector globally lead the governments to realize the importance to pave the way for the private sector to invest in it. Numerous countries restructured its own telecommunication market to liberalize this sector enabling the private sector to invest in it and provide a broader basis of products and services the governments was running an operation to provide the citizens with such things. The government start to withdraw either partially or completely from the sector to allow the private sector to invest and provide the beneficiaries with money value services of high quality and granting them the opportunity to benefit from the multiple choices of services and offers provided new investors.
His Majesty King Abdullah the second envisaged the introspective, comprehensive and futuristic vision that helped shape the development of telecommunication and information technology, where he expressed explicitly: “our awareness that the private sector investment is the real engine for the economical development continuity; we adopted an action plan that aims at encouraging this investment in primary sectors of the Jordanian economy. This action plan includes setting legislations that aim at liberalizing these sectors through privatizations, proper organization and fair competition”
From the beginning the government began to realize the importance of keeping the pace with international development in this field; and the investment in infrastructure and telecommunication service would be achieved by means of opening the way for the private sector investment in providing telecommunication services. Also, the government realized that the organizational structure amendment is the most effective way in stimulating and attracting investors to invest in the sector and creating new services to serve the beneficiaries and the national economy in general.
The government took a few pioneering steps in this direction: it established a program to reorganizing the sector which resulted in separating the regulator and the services provider and policy setter; telecommunication law has been issued in the year 1995, by which TRC was founded to be an independent commission financially and administratively and take over the sector organization duties and implement the government policy in this regards, also the later shift of Jordan Telecommunication Corporation into a public shareholding company in 1997, and the Ministry of Telecommunication was commissioned to propose the sector special policies.
