Source text - English This paper deals primarily with the ethico-legal texts of the Qur’an: those texts that historically as well as today have been associated with law and ethics. Over the last 1,400 years, Muslims have spent time and energy deriving and constructing a system of law based on the Qur’an, Sunnah, and other sources. This process led very early on to the realization that the Qur’anic text was not easy to interpret and that principles and methods had to be developed to assist in the process. The Qur’anic text is in Arabic, and jurists understood that there were difficult words, phrases, and metaphorical expressions in the text. There were also what appeared to be statements that conflict with other statements, along with what appeared to be commands and prohibitions that were not necessarily to be understood as such. Clearly, the process of interpretation was not straightforward, and it was possible to influence the meaning of texts. Developing a way to address these complexities became a major issue in juristic engagement with the Qur’an. Without such principles or methodologies, the Qur’an could be read and understood in a variety of ways by different individuals. Thus, additional tools were needed to ensure greater consistency in interpreting the Qur'an for legal purposes.
Translation - Arabic يتناول هذا البحث النصوص القرآنية ذات الطبيعة الأخلاقية التشريعية: تلك النصوص التي ارتبطت تاريخياً وحتى وقتنا هذا بالأخلاق والتشريع. وظل المسلمون على مدار 1400 عاماً الماضية يبذلون الوقت والجهد في استنباط وبناء نظام تشريعي مستمد من القرآن والسنة وغيرهما من المصادر. وقد أدى هذا إلى الإدراك المبكر لمدى صعوبة تفسير النص القرآني وضرورة تطوير المبادئ والآليات اللازمة للمساعدة في بناء هذه المنظومة. لقد نزل القرآن باللغة العربية وأدرك الفقهاء أن النص القرآني به بعض الألفاظ والاستعارات والتعبيرات المجازية التي يصعب فهمها. وفيه كذلك ما يبدو من ظاهره التعارض، علاوة على بعض المأمورات والمنهيات التي لا يسهل بالضرورة فهمها. وعليه لم تكن عملية التفسير مهمة سهلة ميسورة، ومن المتوقع أن تؤثر على معاني النصوص. من هنا كان من الضروري إيجاد وسيلة للتغلب على تلك الصعوبات في التناول الفقهي والتشريعي للنص القرآني. وبدون هذه المبادئ أو تلك المناهج، يمكن أن تتعدد قراءات القرآن وتختلف الأفهام فيه باختلاف الأشخاص. لهذا كان من الضروري تطوير أدوات إضافية لضمان أكبر قدر ممكن من الاتساق في تفسير النصوص القرآنية لأغراض تشريعية.
English to Arabic: Psychotherapy & Ethics
Source text - English Psychotherapy provides an important context for client’s to come to know themselves and deal with the challenges they are facing in relationships and life. It facilitates a delicate process of healing and maturation, which involves metaphorically passing from the night into the day, the darkness into the light. The therapist may be the guide but for it to be a learning and transformative process for the client it should be co-constructed and driven by the clients needs. This raises ethical dilemmas for psychotherapists about how they ensure that do not misuse their power and impose their views when working with clients who are often in a vulnerable and impressionable state. Ethical codes of conduct go some way towards guiding the therapist and holding them to account by a professional code of ethics. However, it is argued that the therapeutic relationship inevitably is largely mediated by subjective, and not just objective, processes that require a high degree of self awareness and self reflection on the part of the therapist and so ethics cannot be reduced to a set of guidelines, but rather is best approached from a relational perspective. This leads to a critique of modern psyhcohtherapies, that are rooted in the western enlightenment objectives, and that in trying to model themselves on science have to an extent compartmentalized the individual from social ethics. Religon may have a role to play in returning us to ontological questions to help us re-consider the meaning of ethics in a way that can inform the psychohteraoeutic relationship. By considering the Islamic notion of Iklaq and its etemiological root Khalq, it is argued that a meaningful Islamic Ethics could be a foundational framework that develops awareness of our innate human qualities and honors the human being, upholding his/her right of free choice and holds him/her responsible for these choices, helping to return us to truthfulness, to justice, to beauty and to goodness.
Translation - Arabic يوفر الطب النفسي بيئة مهمة لمعرفة النفس ومعالجة التحديات التي يواجهها المرء في علاقاته وحياته، فهو يمهد السبل لعملية بالغة الدقة من العلاج والنضوج، بما تحمله – مجازا - من الولوج من الليل إلى النهار، ومن الظلام إلى النور. ولعله بمقدور المعالج لعب دور المرشد، بيد إنه لا بد لحاجات المرضى أن تسهم في بناء هذه العملية، ودفعها قدما حتى تكون العملية تعليمية ومؤثرة بالنسبة للمرضى. يثير هذا الأمر مشكلات أخلاقية لدى المعالجين النفسيين بشأن التأكد من عدم إساءتهم استخدام سلطتهم أو فرض آرائهم عند العمل مع مرضى كثيرا ما يكونون في حالة وهن تيسر قيادهم والتأثير فيهم. وتعمل المواثيق الأخلاقية على إرشاد المعالجين النفسيين وإلزامهم بميثاق أخلاقيات المهنة، ولكن يقال بأن العلاقة العلاجية لا بد وأن ترتبط على نحو كبير بالجانب الذاتي للعمليات - وليس الموضوعي وحده - التي تتطلب من المعالج النفسي درجة عالية من الوعي بالذات والتفكر بها، ومن ثم يستحيل اختزال قضية الأخلاق في مجموعة من القواعد الإرشادية، بل يجب بحثها من منظور العلاقة التواصلية.
أدى ذلك إلى نقد العلاجات النفسية الحديثة بأنها متجذرة في أهداف التنوير الغربي، ففي خضم سعيها للمواءمة مع العلم كان عليها إلى حد ما تمييز الأخلاق الفردية من الاجتماعية. ولعل هناك دورا للدين يمكنه لعبه في ردنا إلى الأسئلة المعرفية ومساعدتنا في إعادة دراسة معنى الأخلاق بطريقة يمكنها إثراء العلاقة النفسانية، على أن النظر في الفكرة الإسلامية عن الأخلاق وأصل اشتقاقها يدل على وجود أخلاق إسلامية ذات دلالة يمكن أن تشكل هيكلا أساسيا لتنمية الوعي بالخصال الإنسانية الفطرية، كما يحظى الإنسان فيها بالتكريم؛ حيث تقرر حق الإنسان، ذكرا أو أنثى، في حرية الاختيار بالموازاة مع المسئولية الشخصية عن هذه الخيارات، وتدعم مساعينا للعودة لمباديء الصدق والعدالة والجمال والخير.
