ACTA DA REUNIÃO COM O EMPREITEIRO SOCHEL., LDA; CONTRATADO PARA A EXECUÇÃO DAS OBRAS DE CONSTRUÇÃO DA EPC 7 DE ABRIL E ESG NHAMADJESSA, CIDADE DE CHIMOIO – CAMPANHA 2014

Pelas 11.00 horas do dia 13 de Março de 2015, na sala de trabalho dos técnicos e da UCEE/DPEC de Manica, decorreu uma reunião com o empreiteiro Sochel, contratado para execução dos trabalhos de construção das duas escolas acima.

Objectivo da Reunião
A reunião tinha como objectivo, o seguinte:
• Negociação sobre o corte de objectos de obra face à falta de cabimento orçamental para a efectivação do compromisso assumido.
Desenvolvimento
A reunião foi dirigida pelo Engo António Agostinho Chaora – Coordenador do Programa de Construções Escolares (PCA) em representação do Contratante a DPEC de Manica.

Como nota introdutória, os representantes da DPEC de Manica referiram que aquele encontro visava essencialmente dar a conhecer ao empreiteiro da inexistência de cabimento orçamental para a execução das obras a si ajudicadas em Julho de 2014 na sequência de ter havido redução, por parte do MINEDH, do orçamento inicialmente previsto, cuja consequência, seria a redução de um dos objectos do contrato, nomeadamente a construção das 7 salas da ESG de Nhamadjessa deveriam ficar de fora na condiçào de apenas ser executada uma obra, a construção de 3 salas de aulas na EPC 7 de Abril, cidade de Chimoio.

Adiante, foi explicado ao empreiteiro que mesmo assim, este deveria iniciar os trabalhos com fundos próprios, dado não havia confirmação de quando a DPEC de Manica estará em condições de efectuar os pagamentos das situações de trabalho que forem submetidas.

Reacção do Empreiteiro Sochel, Lda
Depois de ter auscultado a apresentação e desenvolvimento do ponto de agenda, o empreiteiro concordou com o posicionamento da DPEC de Manica em executar os trabalhos previstos na EPC 7 de Abril e iniciar com fundos próprios. O trabalho será executado na medida das suas capacidades e que irá aguardar pelos pagamentos das situações de trabalho que poderão ser submetidas por este, sem contudo, haver um horizonte temporal da sua liquidação.

Conclusão:
Após esta concordância, as duas partes concluiram que estavam criadas as condições para o empreiteiro iniciar com a obra de construção da EPC 7 de Abril constituida por um bloco de 3 salas de aulas, cujo valor contractual é de 2.988.681,18MT (Dois Milhões, Novecentos Oitenta e Oito Mil, Seiscentos Oitenta e Um meticais e Dezoito Centavos), tal como consta no Auto de Consignação desta obra, efectuada a 15 de Setembro de 2014.

Não havendo mais assunto a discutir, a reunião foi encerrada quando eram 11.30 horas e para fazer fé, foi elaborada a presente acta que vai ser assinada pelos participantes.

MINUTES OF THE MEETING BETWEEN CONTRACTORS SOCHEL., LTD; CONTRACTED FOR UNDERTAKING CONSTRUCTION WORK AT EPC ABRIL 7 AND ESG NHAMADJESSA, CITY OF CHIMOIO – 2014 CAMPAIGN

On March 13, 2015, at 11 am, a meeting was held with the contractor Sochel contracted to undertake the construction of the above-mentioned schools in the technicians’ workshop of the UCEE/DPEC of Manica.

Purpose of the meeting
The purpose of the meeting was to
• Negotiate on reducing work agreed under the contract due to a reduced budget line to undertake the commitments made.

Development
The meeting was chaired by Eng. António Agosto Chaora – Programme Coordinator for the Programme for the Construction of Schools (PCA) representing the contracting party, the DPEC of Manica.

The meeting also included Engineers Erménio Chume Ngoca and James Mateus Shamu representing the contracting party (DPEC of Manica) on the one hand and Eng David Chadreque Chale, the contractor, representing SOCHEL Ltd on the other hand.

During the introductory remarks, the representatives of DPEC Manica advised that the purpose of the meeting was essentially to advise the contractor that there was no budget for the construction work commissioned in July 2014 because the MINEDH had reduced the initial budget resulting in having to set aside some work under the contract, namely the construction of 7 classrooms at ESG Nhamadjessa (Nhamadjessa Secondary School). The only work remaining essentially being the construction of 3 classrooms at EPC 7 de Abril in the City of Chimoio.

Furthermore the contractor was advised to initiate the construction using his own resources as it was not yet clear when the DPEC of Manica would be able to effect payments for requests that had been submitted.

Response by the Contractor Sochel Ltd
After the presentation and discussion of the agenda items, the contractor agreed with the position of DPEC of Manica to start the work scheduled for EPC 7 de Abril using his own funds. He will perform the work to the best of his ability while awaiting payment for work executed without a time frame for settlement.

Conclusion
Following this agreement, the two parties concluded that the conditions were set for the contractor to start the construction of a block 3 classrooms at EPC Abril 7 amounting to 2.988.681.18MT (Two Million Nine Hundred and Eighty Eight Thousand, Six Hundred and One Thousand Meticais and Eighteen cents) as contained in the offer letter issued on 15 September 2014.

There being no further business, the meeting ended at 11.30 and as a sign of legitimacy these minutes were issued and signed by the participants.
