Source text - Persian (Farsi) افزون براين به موجب مادة 6 قانون الحاق موادي به قانون تنظيم بخشي از مقررات مالي دولت در 15/8/1384 مقرر گرديده كه در اجراي قانون سرمايه‌گذاري به منظور جلب سرمايه‌گذاري خارجي جهت اجراي طرحهاي زيربنايي و توليدي از قبيل طرحهاي نيروگاهي، انتقال نيرو، پالايشگاه تأمين و انتقال آب، فاضلاب، راه‌آهن، راه و آزادراه، فرودگاه، بندرها، ناوگان ريلي و طرحهاي مخابراتي با اولويت سرمايه‌گذار ايراني دولت بتواند علاوه بر تضمينهاي قابل ارائه در چارچوب قانون سرمايه‌گذاري، تضمينهاي ذيل را نيز ارائه دهد:
1- نسبت به تضمين پرداخت تعهدات قراردادي شركتهاي دولتي ايراني طرف قرارداد (كه نهايتاً كالا و خدمات آنها الزاماً مي‌بايست توسط دولت خريداري شود) اقدام كند؛
2- در صورتي كه بنا بر تصميم دولت يا قوانين رايج، بهاي فروش محصول (كالا يا خدمات) توليدي اين طرحها به مشتريان كمتر از قيمت خريد تضميني آن توسط دولت و شركت دولتي از سرمايه‌گذار باشد، مابه‌التفاوت آن توسط سازمان مديريت و برنامه‌ريزي كشور در بودجه سنواتي پيش‌بيني و پرداخت آن توسط دولت تضمين شود؛
3- در صورت اتخاذ تصميم دولت به فروش شركتهاي دولتي عامل، شرايط فروش به نحوي پيش‌بيني شود كه تعهدات شركت به سهامداران جديد منتقل و تضمينهاي دولت تا آخرين مراحل اجراي قرارداد معتبر و نافذ بماند؛
4- وزارت امور اقتصادي و دارايي با تصويب دولت، تعهدات مذكور را از محل وجوه و منابع متعلق به اين شركتها و با حق برداشت وجه از كليه حسابهاي بانكي و وجوه و منابع متعلق به آنها به نحوي كه تعهدات آن از محل وجوه و منابع عمومي دولت نباشد، تضمين نمايد.
Translation - English In addition to this, by article 6 of the “Elhagh Mavadi” Law to a division of the financial government laws legislated on 6-11-2005 implements the investment law in order to attract foreign investors, prioritizing Iranian investors, for executing fundamental and manufacturing projects such as power plant projects, transferring power, providing and transferring water refineries, wastewater, railway, road and highway, airport, seaports, navy railway, and telecommunications projects. The government can provide the following guarantees in addition to the guarantees provided in the framework of the investment law:
1- To take measures regarding the guarantee of paying commitments of the Iranian governmental institutions contract party (whose goods and services must finally be purchased by the government).
2- In the case that, upon the choice of the government or current laws, the product (goods or services) manufactured by these projects is sold at a lower price than that of the guaranteed purchase of the government and a governmental institution from the investor, the difference in the annual budget will be estimated by the Country’s Management and Planning Organization and the payment will be made by the government.
3- In the case that the government makes the choice to sell running governmental organizations, the conditions of selling would be anticipated in a way that the institute’s commitments to the new shareholders will be transferred and the governments assurances will be in place and effective until the last stages of the contract implementation.
4- The Ministry of Economic Affairs guarantees the above-mentioned commitments from the location of funds and resources related to these institutions and with the right to withdraw funds from all bank accounts and funds and sources related to them. This will be done in a way that their withdrawals will not be from the public governmental fund locations and resources.
