Policy on Land Rights and Land Management
Background
Port & Shipping Law No. 17 retains two classifications of port land from previous legislation. They are intended to provide Government with planning control over the use of port land as follows:
• Port Working Area; denoting land required for physical port operations
• Port Interest Area; denoting land required for safety purposes, channels, anchorages and future development
In practice these are titular rather than effective. More comprehensive land use control is required to provide adequate Government oversight on port planning. This is one underpinning reason why Port & Shipping Law No. 17 implemented the landlord port structure.
Port & Shipping Law No. 17 is clear on the intended structure of the industry. The structure involves a Port Organizer (Port Authority or Port Operating Unit) as Landlord and Port Business Enterprises to operate terminals and provide other port services. This paper, after considering legal and practical constraints, describes the policies that could be used “make it happen”.
Key Aspects and Alignments for Policy on Port Land
In connection with ports there are two key aspects to Land Rights and Land Rights Management in Indonesia:
• The structure of the industry in terms of regulation and operation
• The needs of a Port Organiser or Port Business Enterprise in terms of investment, financing and operation
From the perspective of the Port Organiser or Port Business Enterprise it is important that he has:
• Clear and undisputed access to the land and the right to develop and operate it as a port or terminal
• The ability to use that undisputed access and the right to develop and operate to assist in raising of development or operating finance
The Port Organiser or Port Business Enterprise needs to be enabled (or facilitated) in these areas by any policy.
Any policy on port land needs to align with proposals related to approvals for setting up Port Authorities and Port Operating Units as well as approvals provided for the Location, Development and Operation or terminals and port services.

As in many countries, Indonesian ports are made up of a collection of land parcels with often complex provenance. Any attempt to regulate or impact land use in ports through planning controls

Latar Belakang
Undang - Undang Pelabuhan dan Pelayaran No. 17 mempertahankan dua klasifikasi tentang tanah pelabuhan dari perundangan sebelumnya. Perundangan ini dirancang untuk memberikan Pemerintah kendali perencanaan atas Penggunaan tanah Pelabuhan sebagai berikut:
• Daerah Lingkungan Kerja pelabuhan; memasang tanda batas diwajibkan untuk operasi pelabuhan fisik
• Daerah Lingkungan Kepentingan Pelabuhan; memasang tanda batas diwajibkan untuk tujuan-tujuan Keselamatan, alur-pelayaran, kolam pelabuhan dan Pengembangan di masa depan.
Pada praktiknya, perundangan ini hanya title semata dan tidak efektif. Pengendalian penggunaan tanah yang lebih menyeluruh diwajibkan untuk memberikan pengawasan Pemerintah yang layak atas perencanaan pelabuhan. Ini merupakan alasan utama mengapa Undang-Undang Pelabuhan dan Pelayaran No. 17 mengimplementasikan struktur penyelenggara pelabuhan.
Undang-Undang Pelabuhan dan Pelayaran No. 17 menyatakan dengan jelas rancangan struktur industri tersebut. Struktur tersebut meliputi pelabuhan (Otoritas Pelabuhan atau Unit Penyelenggara Pelabuhan) sebagai Pemilik dan Badan Usaha Pelabuhan untuk melaksanakan kegiatan kepelabuhan dan menyediakan pelayanan jasa kepelabuhan lainnya. Naskah ini, setelah mempertimbangkan berbagai kendala praktis dan hukum, menguraikan berbagai kebijakan yang dapat digunakan untuk “mewujudkannya”.
Aspek-Aspek Kunci dan Berbagai Penyesuaian untuk Kebijakan di Tanah Pelabuhan
Dalam kaitannya dengan pelabuhan, ada dua aspek kunci mengenai Hak – Hak Atas Tanah dan Pengelolaan Hak Atas Tanah di Indonesia:
• Struktur dari industri ini dalam butir-butir ketentuan Peraturan dan Pelaksanaan
• Kebutuhan akan Penyelenggara Pelabuhan atau Badan Usaha Pelabuhan yang berkaitan dengan investasi, pendanaan dan pelaksanaan
Dari sudut pandang Penyelenggara Pelabuhan atau Badan Usaha Pelabuhan, adalah sangat penting untuk memiliki:
• Akses jalan masuk yang jelas dan bebas dan hak untuk mengembangkan serta mengelola lahan sebagai pelabuhan atau terminal
• Kemampuan untuk menggunakan akses bebas dan hak untuk mengembangkan dan mengelola tersebut untuk membantu meningkatkan perkembangan atau finansial pengelolaan
Penyelenggara Pelabuhan atau Badan Usaha Pelabuhan membutuhkan dukungan atau difasilitasi pada wilayah – wilayah tersebut oleh Kebijakan apapun.
Kebijakan apapun pada tanah pelabuhan harus sesuai dengan proposal-proposal yang menyangkut pengesahan untuk membentuk Otoritas Pelabuhan dan Unit Penyelenggara Pelabuhan, begitu pula dengan pedoman yang ada untuk penetapan Lokasi, Pengembangan dan Pengoperasian atau jasa terminal dan jasa kepelabuhan.
