This term occurs all throughout a legal brief.

Here is the context: An "international" (PCT) patent application was submitted. What they are calling a "Teilpatent" is simply a specific patent based on that PCT application that is obtained in a country. For instance, a PCT application is filed and then a Teilpatent is obtained in France, another one is obtained in Germany etc.

I am having trouble coming up with this term in English - thanks for any insight or help.

What is an importation patent?
or"importation patent":

An importation patent can be granted to the foreign applicant who is an owner of a foreign patent. It is granted for the invention patented abroad, on which examination has been conducted pursuant to all the criteria of patentability. The importation patent gives the patent owner the exclusive right to use, produce or sell the goods, however, it does not give him right to prohibit the third party to import such product from abroad (Patent Law, Article 4, Paragraph 1,2,3 ).

Asker: Here's what's bothering me: Usually a divisional application (Teilanmeldung) is part of an original application that is carved out from broader subject matter - it involves subject matter, not geography. The term Teilpatent involves a subordinate patent in terms of geography here, though.

Divisional patent application


Explanation:
Under the EP / PCT procedure a patent application may be found to contain more than one invention (= non-unity situation) and consequently is split into two or more applications related to the first. These are divisional patent applications which go through the normal PCT/EP examination and granting procedure and then subsequently into the national phase, to which the term Teilpatent does not refer.

In the US procedure there may also be subdivision and recombination of patent applications before publication, with a slightly different legal basis.

In other words , if its the publication per country, the translation of Teilpatent is "national patent"
