Hello everyone,

I am translating a partnership agreement into UK English and the following sentence appears in one of the contract clauses:

----------Las partes acuerdan que XXX no queda, en ningún caso, obligado a responder del *saneamiento por evicción* de la titularidad de las MARCAS, ni del KNOW HOW frente al COLABORADOR.----------

I am not sure about how to translate "saneamiento por evicción" correctly. Can anyone help? Could it be translated as follows:

---------The parties agree that XXX does not, under any circumstances, remain obligated to the COLLABORATOR to guarantee that the ownership of the BRANDS or EXPERTISE is free of encumbrances.------------

Sometimes confused an as implied warranty, the warranty of title is not an implied warranty but a warranty wherein the seller of goods warrants that he has the right to sell the goods to the buyer. The warranty of title ensures to the buyer that the goods are not stolen, have patent infringements or already sold to someone else. This theoretically saves a buyer from having to "pay twice" for a product, if it is confiscated by the rightful owner, but only if the seller can be found and makes restitution.

neutral cmwilliams (X) : 'hidden defects' not really necessary here. I think it would mention something like 'vicios ocultos' if that were the case.

Thank you. However, the purpose of giving the two options, I thought, would lend clarity to the meaning! It is the asker's choice to adapt and she may chose not to include, but IMO, the English was more straightforward & understandable, so I disagree.
