Les circonstances dans lesquelles la question du retour ou de la restitution de biens culturels se pose sont d'une grande variété. La dépossession peut avoir plusieurs causes : le trafic illicite (vol ou exportation sans autorisation), les spoliations du fait de guerres ou les prises ou échanges marchands en période de colonisation ou d'occupation. Ces différentes hypothèses de dépossession reçoivent un traitement juridique distinct, mobilisant tour à tour des outils du droit privé et du droit public.
Or, les obstacles à la restitution des biens culturels exportés illicitement demeurent nombreux : difficulté de prouver la provenance et la propriété des biens, en raison des lacunes des inventaires et des objets issus de fouilles clandestines ; législations des pays importateurs qui ne reconnaissent pas le caractère illégal de l’exportation et protège l’acquéreur de bonne foi ; les coûts financiers des procédures judiciaires ; la lourdeur des procédures administratives et judiciaires ; la méconnaissance des législations des pays importateurs, des mécanismes généraux d’entraide administrative et judiciaire internationales ainsi que des conditions de restitution formulées par la Convention de l’UNESCO de 1970 ou par les accords bilatéraux.

فيما يتعلق بإرجاع واسترداد الممتلكات الثقافية، فإن الأوضاع والظروف المحيطة بهذا الأمر في تقلب وتغير مستمر. ويرجع عدم حيازة هذه الممتلكات إلى عدة أسباب منها: الإتجار غير المشروع (كالسرقة والتصدير دون صدور إذن أو ترخيص)، وعمليات السلب والنهب بسبب الحروب أو الحصول على غنائم، أو عمليات التبادل التجاري خلال الإستعمار أو الإحتلال. وفي محاولة للبحث عن حل لمثل هذه الأسباب المتعلقة بعدم حيازة الممتلكات، فهناك مسعى قانوني يختلف في محتواه عن ناظريه حيث أنه يجمع بين أدوات القانون الخاص والعام في آن واحد.
إلا أنه، لا تزل هناك العديد من العقبات التي تقف حاجزًا أمام عمليات إسترجاع واسترداد الممتلكات الثقافية والتي تم تصديرها بطرق غير مشروعة، وهناك عقبات عديدة؛ منها صعوبة إثبات مصدر وملكية هذه الممتلكات، ويرجع ذلك إلي عدم وجود ذكر لمثل هذه الممتلكات في قوائم الجرد وكذلك الأشياء التي يتم اكتشافها أثناء عمليات التفتيش والتنقيب السرية؛ وهناك أيضًا عقبة عدم إعتراف الدول المستوردة بطابع التصدير غير المشروع حيث تقوم بتوفير كامل الحماية للمالك بحسن نية؛ ومن بين العقبات أيضًا التكاليف المالية الخاصة بالإجراءات القضائية؛ وكذلك بطء كل من الإجراءات الإدارية والقضائية؛ بالإضافة إلى عدم إقرار تشريعات الدول المستوردة وكذلك الآليات العامة للتعاون الإداري والقضائي لمثل هذا النوع من المسائل، ويضاف إلى كل ذلك الشروط المتعلقة باسترداد الممتلكات، الشروط المنصوص عليها في إتفاقية اليونسكو المبرمة عام 1970، والإتفاقيات الثنائية.

وعلى صعيد أخر فإن المؤسسة تنظم مؤتمر رجال القانون في البحر المتوسط والمقرر عقده في روما عام 2010 وذلك بعد انعقاده في نيس عام 2008 وفى القاهرة عام 2009 .
كما تقترح المؤسسة عمل أجندة إلكترونية تتضمن الأحداث الدولية التي تهم رجال القانون.

المادة -3- تكون المحاكمات بموجب هذا القانون على نوعين:-
أولاً- أ- المحاكمات الموجزة وهي التي تجري أمام آمر الضبط التي يصدر بها قراراته على من تحت إمرته ضمن نطاق صلاحياته القانونية.
ب- يقصد بآمر الضبط هو الأقدم رتبة أو الأعلى منصباً والمخول قانونا صلاحية فرض العقاب على من هو تحت إمرته ضمن نطاق سلطته في جرائم الضبط ويعد المكلف بمهمة التفتيش في قوى الأمن الداخلي آمر ضبط لجميع أجهزة قوى الأمن الداخلي عند قيامه بتفتيشها كلاً ضمن اختصاصه.
ثانياً- المحاكمات غير الموجزة وهي التي تجري أمام محاكم قوى الأمن الداخلي.

Article 3
In accordance with this law, trials are two types:

First-
a- Summary trials which take place before the discipline ‎ officer who issues his decisions concerning his subordinates within his legal jurisdiction.
b- The discipline ‎ officer is the one who is more senior or who has a higher position and is legally entitled to impose punishment on his subordinates within his authority in relation to the discipline violating‎ crimes. The one charged with the task of inspecting the internal security forces prepares a discipline ‎ order for all branches of the internal security forces during its inspection, each according to his competence.
Second- The non- summary trials which are conducted before the courts of the internal security forces.

مجلس التحقيق
المادة -6- لوزير الداخلية تشكيل مجلس تحقيق في مركز وزارة الداخلية من ثلاثة ضباط يكون أقدمهم رئيساً له على أن يكون احدهم من القانونيين حاصلاً على الشهادة الجامعية الأولية في القانون في الأقل, للتحقيق في القضايا التي يحيلها إليه الوزير أو من يخوله, وبعد انتهاء التحقيق ترسل الأوراق التحقيقية إلى المستشار القانوني في الوزارة لتدقيقها وإرسالها إلى امر الإحالة المختص لإحالتها إلى محكمة قوى الأمن الداخلي المختصة أو إعادتها إلى المجلس التحقيقي لإجراء التحقيق فيها مجدداً لإكمال النواقص فيها إن وجدت.
المادة -7- يشكل مجلس تحقيقي عند:
أولاً- فقدان أو تلف أو حصول ضرر في مادة من المواد الخاصة بقوى الأمن الداخلي في إحدى الحالات الآتية:-
أ‌-اذا كانت قيمة الضرر خارج صلاحية آمر الضبط في التضمين.
ب‌-أذا كانت الجريمة ناتجة عن إهمال جسيم.
جـ - اذا كانت الجريمة قد وقعت على السلاح او العتاد او العجلات
وكذلك على أجزاء أي منها, إذا كان الفعل قد ارتكب بإهمال جسيم أو متعمد.
ثانياً- حدوث نقص في حساب الصندوق.
ثالثاً- فقدان أو نفق حيوان.

Section Two
The Investigating Council

Article 6

The Minister of the Interior can set up an investigating council within the ministry of interior composed of three officers to be headed by the most senior of them. One of those officers must at least be a jurist who obtained a first university degree in law. The investigating council is charged with investigating the crimes referred to it by the minister or his deputy. After completing the investigation, the investigation documents are sent to the legal counselor at the ministry in order to be verified and to delegate it to the competent authority for it to be referred the competent internal security forces’ court or to be returned to the investigating council to be re-investigated in order to rectify the investigating errors, if any.

Article-7- An investigating council is formed when:-
First- If there is loss, damage, or harm of one of the interior security forces’ equipment in one of the following cases:-
A- if the value of the damage is above the discipline ‎ officer’s competence.
B- If it resulted from a grave negligence.
C- If the armaments, munitions or tires were the subject of a crime. Also if parts of it were subject of a crime or deliberate or undeliberate negligence.
Second- A shortfall in the fund account.
Third- The loss or death of an animal.

للوزير سحب التحقيق في أية قضية يجري التحقيق فيها وإيداعها إلى سلطة تحقيق أخرى, وله إلغاء القرار الصادر من أي مجلس تحقيقي أو القائم بالتحقيق أو لأسباب تتعلق بتحقيق العدالة أو مخالفة القانون أو لأسباب أخرى مشروعة خلال (15) خمس عشرة يوماً من تاريخ ورود القرار إلى مكتبه أو علمه بالقرار وله طلب إعادة التحقيق وفرض العقوبة المناسبة أو إحالة الأوراق التحقيقية على محكمة قوى الأمن الداخلي المختصة. The minister can change the investigating authority of any case being investigated. He can also cancel the decisions of any investigating council or investigating authority whether for reasons that have to do with upholding justice or illegal conduct or for any other legal reasons within 15 days of the date of his reception of the decision or his knowledge of it. He can ask for a re-investigation, enforce the appropriate punishment or refer the investigating documents to the competent internal security forces’ court.
