La Legislatura de la Ciudad Autónoma de Buenos Aires sanciona con fuerza de Ley:
Identidad real en archivos, registros o bases de datos
Articulo 1°.- Objeto.- La presente Ley, complementaria de la Ley 1845, tiene por objeto facilitar la rectificación de los datos personales que se encuentran asentados en registros, archivos o bases de datos públicos o privados dentro de la jurisdicción de la Ciudad Autónoma de Buenos Aires de todas personas que figuran en ellos bajo identidad adulterada, rectificada por resolución judicial o que se han acogido a la normativa vigente de derecho de identidad de género.
Artículo 2°.- Autoridad de Aplicación.- La Autoridad de Aplicación es la Defensoría del Pueblo de la Ciudad Autónoma de Buenos Aires.
Articulo 3°.- Solicitud de Rectificación.- A solicitud de las personas que figuran en registros, archivos o bases de datos públicos o privados bajo identidad adulterada, rectificada por resolución judicial o que se han acogido a la normativa vigente de derecho de identidad de género, la Autoridad de Aplicación lleva a cabo todas las acciones tendientes a registrar la identidad real actualizando los datos asentados.
Tal solicitud puede ser revocada en cualquier momento por la persona solicitante.
La reglamentación fija la documentación y procedimientos correspondientes para llevar a cabo las disposiciones de la presente Ley.

Artículo 4°.- Autorizados a colaborar en las gestiones.- Las personas que soliciten la intervención de la Autoridad de Aplicación pueden autorizar a otras entidades públicas o a fin de llevar acabo las acciones previstas en colaboración con la Autoridad de Aplicación.
Artículo 5°.- Sujetos Obligados.- Se encuentran obligados por la presente ley todos los registros, archivos o bases de datos públicos o privados obrantes en la ciudad, incluyendo registros históricos en historias clínicas, certificados estudiantiles y antecedentes culturales y deportivos, siendo pasibles de las sanciones previstas en la Ley 1845 de Protección de Datos Personales y Habeas Data.

The Buenos Aires City Legislature hereby enacts the following Law:
True identity in files, records or databases
Section 1. Purpose. The purpose of this Law, supplementary to Law No. 1845, is to facilitate the rectification of personal data which is recorded in public or private records, files or databases within the City of Buenos Aires of any individual whose identity has been altered, rectified by a court decision or established pursuant to the current gender identity law.
Section 2. Enforcement Authority. The Enforcement Authority of this Law shall be the Buenos Aires City Ombudsman’s Office [Defensoría del Pueblo de la Ciudad Autónoma de Buenos Aires].
Section 3. Request for rectification. The Enforcement authority shall, upon request of any individual whose identity has been altered, rectified by a court decision or established pursuant to the current gender identity law, carry out any action necessary to record the true identity of such individual, updating the recorded data.
Such request may be withdrawn at any time by the individual making the request.
The relevant regulations shall provide for the documents and procedures which are required in order to carry out the provisions of this Law.

Section 4. Entities authorized to cooperate. The individuals who request the involvement of the Enforcement Authority may authorize other public or private entities to carry out the actions contemplated in this Law in cooperation with the Enforcement Authority.
Section 5. Applicability. All public or private records, files or databases within the City of Buenos Aires, including historical data contained in medical records, educational records and records of an individual’s involvement in cultural or sporting activities shall be subject to the provisions of this Law and to the penalties provided for in Law No. 1845 on Personal Data Protection and Habeas Data [a legal action for the protection of personal data].
