Source text - Ukrainian 4.1. Страхова сума за цим Договором встановлюється у розмірі 100% від заявленої вартості вантажу та складає __________ гривень (прописом).
4.2. Цей Договір укладається на умовах виплати «Пропорційна виплата». За умови «Пропорційної виплати» у випадку, якщо страхова сума, зазначена в пункті 4.1 цього Договору, виявиться менше за дійсну вартість застрахованого Вантажу на момент настання страхового випадку, збитки і витрати Страхувальника (Вигодонабувача) відшкодовуються Страховиком пропорційно співвідношенню страхової суми, зазначеної в пункті 4.1 цього Договору, до дійсної вартості застрахованого Вантажу на момент настання страхового випадку.
4.3. Дійсна вартість визначається як вартість Вантажу за ціною виробника та/або постачальника не включаючи витрати по перевезенню, зберіганню, фрахт, митні витрати, комісію тощо.
Translation - English 4.1. Insured Sum under this Agreement shall be established in the amount of 100% from the announced cost of cargo and shall make UAH__________ (in writing).
4.2. This Agreement shall be concluded under the payment condition «Proportional payment». On condition of «Proportional payment» in case, if the insured sum specified in Paragraph 4.1 of this Agreement shall appear less than the real value of the insured Cargo as at the moment occurrence of the insured event, the losses and expenses of the Insured (Beneficiary) shall be indemnified by the Insurer proportionally to the ratio of the insured sum specified in Paragraph 4.1 of this Agreement to the real value of the insured Cargo as at the moment of occurrence of insured event.
4.3. The real value shall be determined as the cost of Cargo at the manufacturer’s and/or supplier’s price not including expenses in transportation, storage, freight, customs expenses, commissions, etc..

Source text - English 2.4. All other quality parameters are in accordance of EU regulations 1829/2003, 1830/2003 and 1881/2006. The Seller warrants that at the time of shipment the Commodity shall comply with pesticide regulations in force in the EU at that time and that the buyer has the right to take samples at loading/ instore to test the rapeseed prior railcars` dispatch. An independеnt Surveyor (at Sellers expense) will carry cleanliness of compartments inspection (LCI) before loading of the commodity.
2.5. Commodity should be sound, loyal, of merchantable quality, in healthy condition, without selfwarming and without dry damaging, normal colour and odour and free from any foreign odour (without musty, malty, mouldy, sour and sweetish smell).
2.6. Commodity must be free from GMO, quarantine objects and live insects. Commodity should correspond to medicobiological requirements, phytosanitary norms of quality, which are in force in Ukraine, and to be accomplished by established format.

Продавець гарантує, що підчас відвантаження рівень вмісту пестицидів у Товарі повинен відповідати чинному законодавству ЄС, а також підтверджує право Покупця брати зразки підчас відвантаженням/зберігання перед відправленням вагонів. Незалежний сюрвеєр (за рахунок Продавця) повинен провести інспекцію з чистоти тари (залізничних вагонів) перед завантаженням Товару.
2.5. Товар повинен бути нормальної товарної якості, в здоровому стані, без самозігрівання і теплового пошкодження під час сушки; мати нормальний запах, властивий здоровому насінню (без затхлого, солодового, запліснявілого, стороннього запаху); нормальний колір, властивий здоровому насінню.
2.6. Зараженість Товару шкідниками хлібних запасів і наявність карантинних бур’янів, наявність ГМО не допускається. Товар повинен відповідати медико-біологічним вимогам, фітосанітарним нормам якості, прийнятим в Україні і супроводжуватися сертифікатами встановленого зразку.

The Borrower should obtain all the necessary approvals of the National Bank of Ukraine or other relevant Government Bodies of Ukraine. The Borrower should immediately inform the Lender about the receipt of the registration certificate of the National Bank of Ukraine.
Article 3.2. The additional terms of Loan.
The obligations of the Lender to make the payments shall be subject to the following conditions:
All documents and agreements stipulated by Article 3.1. of this Agreement remain valid.
The Parties duly perform all their obligations under this Agreement.
No law, rule, regulation, or order shall have been enacted, promulgated or issued that restrains, or prohibits the transactions contemplated by the Agreement.
Between the date of this Agreement and the Closing Date of the Loan the Parties shall conduct their Business in the ordinary course.
The Lender received from the Borrower the disbursement request in time.
The Lender received from the Borrower other documents, which are necessary according to this Agreement.

Позичальник зобов’язується до отримання Позики чи її частини отримати всі необхідні погодження Національного банку України чи інших державних органів України. Позичальник негайно повідомляє Позикодавця про отримання реєстраційного свідоцтва Національного банку України.
Стаття 3.2. Додаткові умови надання Позики.
Зобов’язання Позикодавця по наданню Позики обумовлюється дотриманням наступних умов:
Всі документи, отримані Позичальником згідно із статтею 3.1. цього Договору, зберігають чинність.
Сторони належним чином виконують всі свої зобов’язання за цим Договором.
Не буде введено в дію, проголошено чи прийнято будь-який закон чи інший нормативний акт, яким обмежується або забороняється проведення операцій, передбачених даним Договором.
Між датою укладення даного Договору та датою завершення Договору Сторони здійснюють господарську діяльність у звичайному режимі.
