Source text - Romanian Art. 8. — (1) La solicitarea unei autorizații de mediu sau, după caz, cu minimum 45 de zile înainte de expirarea unei autorizații de mediu existente, titularul activității este obligat să depună la ACPM un dosar cuprinzând următoarea documentație:
a) cererea pentru eliberarea autorizației de mediu;
b) fișa de prezentare și declarație, potrivit anexei nr. 2;
c) dovada că a făcut publică solicitarea prin cel puțin una dintre metodele de informare prevăzute în anexa nr. 3;
d) planul de situație și planul de încadrare în zonă a obiectivului;
e) procesul-verbal de constatare a respectării tuturor condițiilor impuse prin acordul de mediu întocmit potrivit Ordinului ministrului apelor și protecției mediului nr. 860/2002 pentru aprobarea Procedurii de evaluare a impactului asupra mediului și de emitere a acordului de mediu, cu modificările și completările ulterioare, sau, după caz, nota privind stadiul de realizare a programului pentru conformare existent;
f) formularul de înregistrare prevăzut în tabelul nr. 1 din anexa nr. 5, însoțit de documentele specificate de acesta, pentru autorizarea activității grădinilor zoologice, acvariilor publice și centrelor de reabilitare și/sau îngrijire.
(2) Nu se primesc solicitări care nu conțin documentele prevăzute la alin. (1).
(3) ACPM verifică amplasamentul, analizează documentele prezentate la alin. (1), stabilește dacă sunt necesare informații, acte sau documente suplimentare și le solicită în scris titularului activității. Pentru activitățile grădinilor zoologice, acvariilor publice și centrelor de reabilitare și/sau îngrijire, ACPM completează, la verificarea în teren, formularul de verificare a criteriilor necesare autorizării din tabelul nr. 2 și raportul din tabelul nr. 3, prevăzute în anexa nr. 5.
(4) Pentru activități noi pentru care a fost emis acordul de mediu, ACPM, după derularea etapelor prevăzute la alin. (2) și (3), face publică decizia de emitere a autorizației de mediu, precum și programul de consultare a documentelor care au stat
la baza acesteia, prin afișare la sediul propriu și postare pe pagina proprie de internet.
(5) Decizia prevăzută la alin. (4) poate fi contestată în termen de 15 zile lucrătoare de la data publicării.
Art. 9. — (1) Pentru activitățile de eliminare a deșeurilor documentația prezentată conține în plus cerințele specifice prevăzute în Ordonanța de urgență a Guvernului nr. 78/2000 privind regimul deșeurilor, aprobată cu modificări prin Legea nr. 426/2001, cu modificările și completările ulterioare, în Hotărârea Guvernului nr. 128/2002 privind incinerarea deșeurilor, cu modificările și completările ulterioare, și în Hotărârea Guvernului nr. 349/2005 privind depozitarea deșeurilor, cu completările ulterioare.
Translation - English The issuance of the environmental authorization
Art. 8. — (1) Upon the request for an environmental authorization or, depending on the case, with a minimum of 45 days prior to the expiration date of an environmental authorization already enforce, the owner of the activity is obliged to submit to the CAEP a file containing the following documents:
a) the request for the issuance of an environmental authorization;
b) the presentation and statement sheet, according to appendix no. 2;
c) the proof that it has made public the request at least through the use of one of the information means stipulated in appendix no. 3;
d) the situational plan and the whereness plan of the objective;
e) the ascertainment minutes of the fact that all conditions imposed through the environmental agreement have been respected according to the Order issued by the minister of water management and environmental protection no. 860/2002 in order to approve the Procedure for the evaluation of the impact over the environment and of issuance of the environmental agreement, with the subsequent modifications and addenda, or, depending on the case, the notes concerning the status of the existing compliance programme;
f) the registration form presented in table no. 1 from appendix no. 5, along with the specific documents mentioned in the appendix, related to the authorization of the zoological gardens, public aquariums and the rehabilitation and/or care centers.
(2) The requests that do not include the documents mentioned in paragraph (1) shall not be taken into consideration.
(3) CAEP verifies the location, analyses the documents presented in paragraph (1), decides whether other information or additional acts and documents is necessary and it requests them in writing from the owner of the activity. For the activities of the zoological gardens, public aquariums and the rehabilitation and/or care centres, CAEP fills out, upon field inspection, the inspection form containing the criteria necessary for the issuance of the authorization from table no. 3, stipulated in appendix no. 5.
(4) For the new activities for which the environmental agreement has been issued, CAEP, after the deployment of the phases mentioned in paragraph (2) and (3), makes public the decision of issuing the environmental authorization, as well as the verification programme of the documents on the basis of which the authorization was issued, by displaying them in its registered quarters or by posting it on its personal website.
(5) The decision stipulated in paragraph (4) can be appealed in a 15 working days term from its publication date.
Art. 9. — (1) For the activities implying residues exhaust the documents presented should contain additional specific requirements stipulated in the Governmental Emergency Order no. 78/2000 concerning the residues regime, approved with modification through the Law no. 426/2001, with the subsequent modifications and addenda in the Government Act no. 128/2002 concerning the incineration of the residues, with the subsequent modifications and addenda, and in the Governmental Act no. 349/2005 concerning the depositing of residues, with the subsequent addenda.

Situatiile financiare pentru anul incheiat la 31 decembrie 2007 au fost intocmite in conformitate cu urmatoarele principii contabile:
Principiul continuitatii activitatii - societatea isi va continua in mod normal functionarea intr-un viitor previzibil fara a intra in imposibilitatea continuarii activitatii sau fara reducerea semnificativa a acesteia.
Principiul permanentei metodelor - aplicarea acelorasi reguli, metode, norme privind evaluarea, inregistrarea si rezentarea in contabilitate a elementelor patrimoniale, asigurand comparabilitatea in timp a informatiilor contabile.
Principiul prudentei - s-a tinut seama de toate ajustarile de valoare datorate deprecierilor de valoare a activelor, precum si de toate obligatiile previzibile si de pierderile potentiale care au luat nastere in cursul exercitiului financiar incheiat sau pe parcursul unui exercitiu anterior.
Principiul independentei exercitiului - au fost luate in considerare toate veniturile si cheltuielile exercitiului, fara a se tine seama de data incasarii sau efectuarii platii.
Principiul evaluarii separate a elementelor de activ si pasiv - in vederea stabilirii valorii totale corespunzatoare unei pozitii din bilant s-a determinat separat valoarea fiecarui element individual de activ sau de pasiv.
Principiul intangibilitatii exercitiului - bilantul de deschidere al exercitiului corespunde cu bilantul de inchidere al exercitiului precedent, cu exceptia anumitor reclasificari facute intre anumite posturi bilantiere pentru a asigura comparabilitatea cu situatiile financiare la 31 decembrie 2007.
Principiul necompensarii - valorile elementelor ce reprezinta active nu au fost compensate cu valorile elementelor ce reprezinta pasive, respectiv veniturile cu cheltuielile, cu exceptia compensarilor intre active si pasive admise de OMFP 1752/2005.
Principiul prevalentei economicului asupra juridicului - informatiile prezentate in situatiile financiare reflecta realitatea economica a evenimentelor si tranzactiilor, nu numai forma lor juridica.
Principiul pragului de semnificatie - orice element care are o valoare semnificativa este rezentat distinct in cadrul bilantului.
Translation - English A. Accounting principles
The financial statements for the year ending on December 31st 2007 have been drawn up in conformity with the following accounting principles:
The principle of activity continuity – the company will continue its functioning in normal terms in the predictable future without entering in a situation of imposibility to continue the activity and without reducing it significantly.
The principle of method permanency – the application of the same rules, methods, norms concerning the evaluation and the recording from the accounting of the patrimony elements, ensuring the comparison in time of the accounting information.
The principal of prudence – attention was given to all the value adjustments due to assets value depreciations as well as to all the predicted obligations and potential losses that emerged during the conclusion of the financial exercise or during a previous exercise.
The principle of exercise independence – all incomes and expenses of the exercise have been taken into consideration, regardless of the cashing date or date of invoice payment.
The principle of separate evaluation of the active and passive elements – in order to set the corresponding total value of a position in the balance sheet, the value of each individual element of active and passive was set.
The principle of exercise intangibility – the opening balance sheet of the exercise corresponds with the closing balance sheet of the previous exercise, except for several re-classifications made between the balance sheet positions in order to insure the comparison with the financial statements performed on December 31st, 2007.
The principle of non-compensation – the value of the elements that represent actives has not been compensated with the value of the elements that represent the passives, respectively the incomes with the expenses, except for the compensations between the actives and passives approved by the OMFP 1752/2005.
The principle of economic prevelance over the legal – the information presented in the financial statements reflect the economic reality of the events and transactions, not only their legal form.
The principle of signification landmark – any element that has a significant value is presented distinctiverly within the balance.

• Informaţii confidenţiale (“Informatiile)”– sunt toate Informaţiile care sunt si vor ramane proprietatea unica si exclusiva a Societatii si/sau a Afiliatilor acesteia incluzand dar fara a se limita la: documente, date, planuri, informatii verbale si/sau pe suport material, date stocate electronic, de care Salariatul ia cunoştinţă în vederea încheierii şi pe toată perioada executarii Contractului, cu condiţia ca aceste Informaţii să nu fie publice. Sunt considerate “confidenţiale” inclusiv, dar fără a se limita, Informaţiile cu privire la:
a) pieţele de desfacere, afacerile, activităţile, clienţii şi/sau furnizorii Societatii si/sau a Afiliaţilor acesteia;
b) secrete profesionale sau comerciale, sisteme, know-how, produse, procese (inclusiv procesul de fabricaţie), invenţii, patente, mărci înregistrate, (reverse) engineering, programe software pentru computer, tehnici de vânzare şi/sau de marketing, licenţe, procese de fabricatie, specificatii tehnice, studiile, cercetarile, analizele, mostrele;
c) condiţiile financiare, listele de preturi, costurile, dobânzile comerciale, iniţiativele, obiectivele, planurile si/sau strategiile, politicile comerciale, cotele de piaţă, studiile de piaţă;
d) informatii de natura corporativa, comerciala, tehnica si/sau stiintifica;
e) lansarea produselor (detalii ale proiectelor, data de lansare, etc) şi/sau planurile de marketing (nivelul investiţiei şi orice detalii privind orice campanii de publicitate, sub orice formă etc);
f) toate celelalte informaţii care sunt:
i) identificate de către Societate si/sau de Afiliatii acesteia ca fiind confidenţiale, prin marcarea documentului, în orice formă ca fiind ’Confidential’;
ii) primite de către Societate de la terti sub titlu de confidentialitate;
ii) considerate confidentiale în conformitate cu legislatia in vigoare.
Translation - English 1.1. In order to avoid any doubt due to interpretation, the terms below shall have the following meaning:
• Confidential information (“Information”– is all the information that is and shall remain the unique and exclusive property of the Company and/or of its Affiliates including but without being limited to: documents, data, plans, verbal information and/or in print, data saved in electronic format, that the Employee acknowledges when signing the Contract or during its execution, with the condition that this Information is not made public. f) Any other information that is:
i) Identified by the Company and/or by its Affiliates as being confidential, by marking the document, under any form as being “Confidential” ;

ii) considered confidential according to the legislation enforce.
