Source text - English The Edinburgh European Council of December 1992 defined the basic principles underlying subsidiarity and laid down guidelines for interpreting Article 5 (former Article 3b), which enshrines subsidiarity in the EU Treaty. Its conclusions were set out in a declaration that still serves as the cornerstone of the subsidiarity principle.
The Treaty of Amsterdam has taken up the overall approach that follows from this declaration in a Protocol on the application of the principles of subsidiarity and proportionality annexed to the EC Treaty. Two of the things this Protocol introduces are the systematic analysis of the impact of legislative proposals on the principle of subsidiarity and the use, where possible, of less binding Community measures.
In the framework of the Intergovernmental Conference launched in February 2000, the Committee of the Regions has asked for the principle of subsidiarity to be amended to formally recognise the role of loca1 and regional authorities.
Each year the European Commission produces a report ("Better lawmaking") for the European Council and the European Parliament which is devoted mainly to the application of the subsidiarity principle.
SUBSIDIARY POWERS
Article 308 of the EC Treaty (former Article 235) reflects the realisation by those who drafted the Treaty of Rome that the powers specifically allocated to the Community (executive powers) might not be adequate for the purpose of attaining the objectives expressly set by the Treaties themselves (competence ratione materiae).
This article can be used to bridge that gap, since it lays down that "If action by the Community should prove necessary to attain…one of the objectives of the Community and this Treaty has not provided the necessary powers, the Council shall, acting unanimously on a proposal from the Commission and after consulting the European Parliament, take the appropriate measures".
Translation - Russian На заседании Европейского Совета в Эдинбурге в декабре 1992 года были сформулированы основные принципы, лежащие в основе субсидиарности и утверждены нормы для интерпретации статьи 5 (прежде статья 3б), которая закрепляет принцип субсидиарности в Договоре о Евросоюзе. Решения саммита были изложены в декларации, которая и сейчас является краеугольным камнем принципа субсидиарности.
Амстердамский договор утвердил общие положения, вытекающие из этой декларации в протоколе, ставшим дополнением к Договору о Евросоюзе. Двумя пунктами, представленными в этом протоколе, являются систематический анализ влияния законопроектов на принцип субсидиарности и применение, по возможности, менее обязывающих законов Евросоюза.

СУБСИДИАРНЫЕ ПОЛНОМОЧИЯ

Так как это положение отводит Европарламенту чисто консультативную роль, его неправильное применение может отрицательно повлиять на внутриорганизационный баланс.
Во избежание этого, использование статьи 308 в качестве правовой основы очень часто сопровождается другими статьями Договора, предоставляющими Парламенту больше законодательных полномочий.

The proposals have been developed in response to the initial client brief and in consultation with professional spa consultant.
The Spa is designed to operate as a commercially viable business enterprise and will provide facilities consistent with luxurious spas that have proved successful in all areas of the globe.
Some facilities offered may differ slightly from those requested in the client brief. Where changes have been made this has been on the basis of advice from the spa consultant as to what will work on an operational and commercial basis. The exact content of the spa facilities is of course, still flexible at this stage.

Спа спроектирована как коммерчески рентабельный проект, где предлагаемые условия будут соответствовать роскошным спа курортам, ставших коммерчески успешными во всех регионах мира.
