Source text - English The Participant hereby unconditionally and irrevocably waives the benefit of any moral rights under the Copyright, Designs and Patents Act 1988 (the "Act") and under any similar law in any territory in the world whether now or hereafter brought into force and the Participant hereby gives all consents which may be required under the Act to enable ABC to make the fullest use of the rights granted hereunder.
The Participant represents and warrants: (i) that execution of this agreement will not cause or create any conflict with, breach of or default of any contract by which the Participant is bound; (ii) that the Participant will comply with all applicable laws and regulations in providing its Contribution; and (iii) that the Participant will provide services to ABC as an independent contractor and not as an ABC employee; (iv) the Contribution provided by the Participant shall be wholly original and shall not violate or infringe the rights (including any intellectual property rights, privacy rights and publicity rights) of any third parties or expose ABC to criminal or civil proceedings; and (v) the Participant shall render the Contribution with due care and skill and to the best of its ability.
The Participant agrees that ABC has no obligation to use the Contribution in the Production.
The Participant acknowledges that any application to enjoin or restrain the exploitation of the Production or any rights in the Production would be excessively disruptive and unreasonably damaging to the Production and to ABC’s and other third parties’ interest in the Production and the Participant agrees not to apply for any such relief and accepts that the recovery of damages will provide a full and appropriate remedy for any loss or damage incurred by the Participant as a result of any breach of this agreement.
Translation - Slovak Účastník sa týmto bezpodmienečne a neodvolateľne vzdáva výhody akýchkoľvek morálnych práv vyplývajúcich z Autorského zákona z roku 1988 (ďalej len Zákon) a z akéhokoľvek podobného zákona kdekoľvek na svete, ktoré nadobudnú platnosť okamžite alebo po podpísaní tejto zmluvy. V prípade, že tak vyplynie zo Zákona, účastník týmto dáva súhlas ABC, aby mohol v plnej miere využiť práva udelené podľa tejto zmluvy.
Účastník vyhlasuje a zaručuje, že (i) pri vykonávaní tejto dohody nespôsobí alebo nevyvolá konflikt, neporuší, ale naopak splní svoje záväzky plynúce zo zmluvy; (ii) že účastník bude pri poskytovaní príspevku postupovať v súlade s uplatniteľnými právnymi predpismi a nariadeniami; (iii) že účastník poskytne ABC služby ako nezávislý dodávateľ a nie ako zamestnanec ABC; (iv) príspevok, ktorý účastník poskytne, bude samostatný a neporuší alebo nevyvráti práva (vrátane všetkých práv duševného vlastníctva, práv na súkromie a práv na šírenie informácií) tretích strán alebo nevystaví ABC trestnému alebo občianskemu konaniu; a (v) účastník svoj príspevok poskytne s náležitou starostlivosťou, v rámci svojich zručností a podľa svojich najlepších schopností.
Účastník súhlasí, že ABC nie je povinný využiť príspevok vo výrobe.
Účastník potvrdzuje, že akýkoľvek návrh zakázať alebo obmedziť využívanie výroby alebo práva na výrobu by bol príliš rušivý a neprimerane by poškodil výrobu a záujem ABC a iných tretích strán na výrobe. Účastník súhlasí, že nepožiada o podobné oslobodenia a prijíma fakt, že náhrada za škodu pokryje úplnú a relevantnú nápravu straty alebo škody, ktorú spôsobil účastník v dôsledku akéhokoľvek porušenia tejto zmluvy.
