Darüber hinaus kann dieser Unterschied nicht patentbegründend sein, da ein Verwendungsanspruch der Kategorie "Verfahrensanspruch" entspricht und im vorliegenden Fall damit ein unter das Patentierungsverbot gemäß Art. 52(3) fallen des chirurgisches/therapeutisches Behandlungsverfahren geschützt würde.
