Source text - English A sequestration issued by the Maritime Courts shall have the object of:
Assign to the competence of the Panamanian Maritime Courts the hearing of lawsuits that arise outside the national territory as a result of facts or acts related to navigation when the Defendant is outside its jurisdiction, and in the lawsuits that arise inside the national territory when the Plaintiff chooses to sequester the Defendant’s property with the object of notifying him/her of the lawsuit. In both cases, the sequestration made pursuant to the provisions of this numeral shall have the effects of a personal notification of the lawsuit; however, the Plaintiff shall also comply with the procedures established in the last paragraph of article 403.
It shall be understood that the Defendant is outside the Panamanian jurisdiction when his/her effective and real business domicile is outside the Republic of Panama even when the corporation may be Panamanian or being foreign is registered in Panama or has branches or subsidiaries, or the vessel is registered in Panama.
Translation - Greek H κατάσχεση που αποφασίζεται από τα Ναυτικά Δικαστήρια έχει ως σκοπό:
. Να εντάσσει υπό την δικαιοδοσία των Ναυτικών Δικαστηρίων του Παναμά την εκδίκαση αγωγών που προκύπτουν εκτός της εθνικής επικρατείας, ως αποτέλεσμα γεγονότων ή πράξεων που σχετίζονται με τη ναυσιπλοΐα όταν ο εναγόμενος είναι εκτός της δικαιοδοσίας του και αγωγών που προκύπτουν εντός της εθνικής επικράτειας όταν ο Ενάγων επιλέγει να κατάσχει την περιουσία του Εναγόμενου με σκοπό να τον ενημερώσει μέσω της αγωγής.
Σε αμφότερες τις περιπτώσεις, η κατάσχεση που πραγματοποιήθηκε δυνάμει των διατάξεων του εδαφίου αυτού θα έχουν την ισχύ προσωπικής κοινοποίησης της αγωγής. Εντούτοις, ο Ενάγων θα συμμορφώνεται με τις διαδικασίες που ορίζει η τελευταία παράγραφος του άρθρου 403.
Ο Εναγόμενος θεωρείται ότι είναι εκτός της δικαιοδοσίας του Παναμά όταν η νόμιμη και πραγματική του έδρα είναι εκτός της Δημοκρατίας του Παναμά ακόμη κι όταν η εταιρεία μπορεί να είναι Παναμέζικη ή, εάν είναι αλλοδαπή, να είναι εγγεγραμμένη στον Παναμά ή να έχει παραρτήματα ή θυγατρικές ή το πλοίο να είναι νηολογημένο στον Παναμά.
