السيد المحترم ظ السيدة المحترمة
أفكر في كتابة وصية وأرغب في استشارتكم في الأمور التالية:
أفهم أن أي شخص يرغب في كتابة وصيته – الموصي أو الموصية – يجب أن يكون عمره / عمرها أكثر من 18 سنة، وليس شرطا قانونيا الاستعانة بمحام. لقد سمعت أنه من الازم تعيين شخص مسؤول – يكون منفذا للوصية – لضمان تنفيذ شروط الوصية بالضبط بعد وفاة الموصي.
وسمعت أيضا أن الموصي يجب أن يعلن بوضوح انه ذو / أنها ذات قدرة عقلية سليمة. كما سمعت أن عبارة "الوصية والرغبة الأخيرة" يجب أن تظهر بوضوح على وجه سند الوصية.
هل صحيح أنه يُطلب من شخصين راشدين مستقلين (لا يستفيدان مالياً من الوصية) أن يكونا شاهدين على توقيع الموصي؟ وانه يجب على الموصي توقيع السند الكتابي في حضور الشاهدين؟ إنني أعتقد أنه يجب على الموصي أن يظهر توقيعه في نهاية السند.
أرجو من فضلكم أن توضحوا لي : هل يمكن للمستفيدين – أي الذين سيرثون – أن يكونوا شاهدين على توقيع الموصي ؟ وأرجوا أيضا أن توضخوا إن كان القانون يسمح بحرمان زوجة الموصي / زوج الموصية من الوصية؟
وأخيرا أرجوا من فضلكم إحاطتي علما إذا كان القانون يقتضي حفظ الوصايا في خزانة بمكان مخصص كالبنك أو مكتب محام.

Dear Sir / Madam

I am thinking of making a will and I would like to consult you about the following:
I understand that anyone who wants to write his/her will – the testator- must be above 18 years of age and it is not a legal requirement to seek the help of a
lawyer. I’ve heard that it is a must to appoint an executor to safeguard the implementation of the exact conditions of the will after the death of the testator.
I have also heard that the testator must make it clear that he/she has a sound mind and also that the words: “Last wish and will” must be clearly presented in the body of the document.
Moreover, is it true that two (non-beneficiary) independent adults must witness the signature of the testator? And that the testator must sign the written document in the presence of the witnesses? I believe that the testator must present his signature at the end of the document.
Furthermore, could you please explain to me whether the beneficiaries (those who benefit from a will) could be witnesses to the signature of the testator? I would also like you to explain whether the law would permit to exclude the wife / the husband of the testator from the will.
Finally, I would like you to inform me whether the law requires the wills to be kept in a safe in a specific place like a bank or a lawyer’s office.

Bio

I am a qualified translator/ Interpreter (BA, MA and Diploma
with distinction in simultaneous, consecutive interpreting as well as written
translation Arabic to English and vice versa).

I am a native as well as qualified Arabic speaker (Iraq, Gulf
region, Egypt and as the levant). I am also highly qualified and fluent in
English (BA, MA, DPSI) and indeed I can translate and interpret into English
with excellence and distinction as I do when translating into Arabic and this
capability was clearly demonstrated in my work and my qualifications with and
from the Chartered Institute of Linguists (CIOL).

Despite the fact that my specialised qualification in
translation and interpreting is in English law and English legal system, my
background (MA degree, followed by qualification and training as a technical
and specialised translator/interpreter English Law and English legal system), I
am very comfortable and experienced with a wide range of texts and situations (literary,
scientific, financial, security, health, political, as well as legal).
