RESOLUTION 15/04
CONCERNING THE IOTC RECORD OF VESSELS AUTHORISED TO OPERATE IN THE IOTC AREA OF COMPETENCE

The Indian Ocean Tuna Commission (IOTC),
RECALLING that IOTC has been taking various measures to prevent, deter and eliminate the IUU fisheries conducted by large-scale tuna fishing vessels;
FURTHER RECALLING that IOTC adopted the Resolution 01/06 Concerning the IOTC Bigeye Tuna Statistical Document Programme at its 2001 meeting;
FURTHER RECALLING that IOTC adopted the Resolution 01/02 [superseded by Resolution 13/02, then
Resolution 14/04, then Resolution 15/04] Relating to control of fishing activities at its 2001 meeting;
NOTING that large-scale fishing vessels are highly mobile and easily change fishing grounds from one ocean to another, and have high potential to operate in the IOTC area of competence without timely registration with the
Commission;
NOTING that supply or support vessels can increase the fishing capacity of purse seine vessels in an uncontrolled manner by setting fish aggregating devices [in areas closed to fishing];
RECALLING that the FAO Council adopted on 23 June 2001 an International Plan of Action aiming to prevent, to deter and to eliminate illegal, unregulated and unreported fishing (IPOA), that this plan stipulates that the regional fisheries management organisations should take action to strengthen and develop innovative ways, in conformity with international law, to prevent, deter and eliminate IUU fishing and in particular to establish records of vessels authorised and records of vessels engaged in IUU fishing;
RECALLING that the IOTC Record of Active Vessels was established by the Commission on 1 July 2003, via Resolution 02/05 Concerning the establishment of an IOTC record of vessels authorised to operate in the IOTC area of competence [superseded by Resolution 05/02, then Resolution 07/02, then Resolution 13/02, then Resolution 14/04, then Resolution 15/04];
RECOGNISING the need to take further measures to effectively eliminate the IUU large scale tuna fishing vessels; ADOPTS, in accordance with paragraph 1 of Article IX of the IOTC Agreement, that:
1. The Commission shall maintain an IOTC Record of fishing vessels that are:
a) 24 metres in length overall or above; or
b) in case of vessels less than 24 meters, those operating in waters outside the Economic Exclusive Zone of the Flag State; and that are authorised to fish for tuna and tuna-like species in the IOTC area of competence (hereinafter referred to as „authorised fishing vessels‟, or AFVs).
For the purpose of this Resolution, fishing vessels including auxiliary, supply and support vessels that are not entered in the IOTC Record are deemed not to be authorised to fish for, retain on board, tranship or land tuna and tuna-like species or supporting any fishing activity or set drifting fish aggregation devices (DFADs) in the IOTC area of competence. This provision shall not apply to vessels less than 24 m in length overall operating inside the EEZ of the flag state.
2. Each Contracting Party and Cooperating Non-Contracting Party (hereinafter referred to as "CPC") shall submit electronically, where possible, to the IOTC Executive Secretary for those vessels referred to 1.a) and
for those vessels referred to 1.b), the list of its AFVs that are authorised to operate in the IOTC area of competence. This list shall include the following information:
a) Name of vessel(s), register number(s);
b) IMO number (if eligible); To allow the necessary time for CPCs to obtain an IMO number for eligible vessels that do not already have one, paragraph 2.b on IMO number is effective as of 1 January 2016. As of this date, CPCs shall ensure that all their fishing vessels that are registered on the IOTC Record of fishing vessels have IMO numbers issued to them. Paragraph 2.b on IMO number does not apply to vessels which are not eligible to receive IMO numbers.
c) Previous name(s) (if any);
d) Previous flag(s) (if any);
e) Previous details of deletion from other registries (if any);
f) International radio call sign(s) (if any);
g) Port of Registration;
h) Type of vessel(s), length and gross tonnage (GT);
i) Name and address of owner(s) and operator(s);
j) Gear(s) used;
k) Time period(s) authorised for fishing and/or transhipping.
In assessing compliance with the paragraph above, the Commission shall take into account exceptional circumstances in which a vessel owner is not able to obtain an IMO number despite following the appropriate procedures. Flag CPCs shall report any such exceptional situations to the IOTC Secretariat.
3. All CPCs which issue authorisations to fish to their flag vessels to fish for species managed by the IOTC shall submit to the IOTC Executive Secretary, an updated template of the official authorisation to fish outside National Jurisdictions, and update this information whenever this information changes. This information includes:
a) name of the Competent Authority;
b) name and contact of personnel of the Competent Authority;
c) signature of the personnel of the Competent Authority;
d) official stamp of the Competent Authority.
The IOTC Executive Secretary shall publish the above information in a secure part on the IOTC website for MCS purpose.
4. The template in paragraph 3 shall be used exclusively for monitoring, control and surveillance purposes and a difference between the template and the authorisation carried onboard the vessel does not constitute an infraction, but will prompt the controlling State to clarify the issue with the identified Competent Authority of the flag State of the vessel in question.
5. Each CPC shall promptly notify, after the establishment of their initial IOTC Record, the IOTC Executive Secretary of any addition to, any deletion from and/or any modification of the IOTC Record at any time such changes occur.
6. The IOTC Executive Secretary shall maintain the IOTC Record, and take any measure to ensure publicity of the Record through electronic means, including placing it on the IOTC website, in a manner consistent with confidentiality requirements noted by CPCs.
7. The flag CPCs of the vessels on the record shall:
a) authorize their vessels to operate in the IOTC area of competence only if they are able to fulfil in respect of these vessels the requirements and responsibilities under the IOTC Agreement and its Conservation and Management Measures;
b) take necessary measures to ensure that their AFVs comply with all the relevant IOTC Conservation and Management Measures;
c) take necessary measures to ensure that their AFVs on the IOTC Record keep on board valid certificates of vessel registration and valid authorisation to fish and/or tranship;
d) ensure that their AFVs on the IOTC Record have no history of IUU fishing activities or that, if those vessels have such a history, the new owners have provided sufficient evidence demonstrating that the previous owners and operators have no legal, beneficial or financial interest in, or control over those vessels; the parties of the IUU incident have officially resolved the matter and sanctions have been completed; or that having taken into account all relevant facts, their AFVs are not engaged in or associated with IUU fishing;
e) ensure, to the extent possible under domestic law, that the owners and operators of their AFVs on the IOTC Record are not engaged in or associated with tuna fishing activities conducted by vessels not entered into the IOTC Record in the IOTC area of competence;
f) take necessary measures to ensure, to the extent possible under domestic law, that the owners of the AFVs on the IOTC Record are citizens or legal entities within the flag CPCs so that any control or punitive actions can be effectively taken against them.
8. CPCs shall review their own internal actions and measures taken pursuant to paragraph 7, including punitive actions and sanctions and, in a manner consistent with domestic law as regards disclosure, report the results of the review to the Commission annually. In consideration of the results of such review, the Commission shall, if appropriate, request the flag CPCs of AFVs on the IOTC Record to take further action to enhance compliance by those vessels with IOTC Conservation and Management Measures.
9. a) CPCs shall take measures, under their applicable legislation, to prohibit the fishing for, the retaining on board, the transhipment and landing of tuna and tuna-like species by the vessels which are not entered into the IOTC Record.
b) To ensure the effectiveness of the IOTC Conservation and Management Measures pertaining to species covered by Statistical Document Programs:
i. Flag CPCs shall validate statistical documents only for the vessels on the IOTC Record;
ii. CPCs shall require that the species covered by Statistical Document Programs caught by
AFVs in the IOTC area of competence, when imported into the territory of a Contracting Party, be accompanied by statistical documents validated for the vessels on the IOTC Record; and
iii. CPCs importing species covered by Statistical Document Programs and the flag States of vessels shall cooperate to ensure that statistical documents are not forged or do not contain misinformation.
10. Each CPC shall notify the IOTC Executive Secretary of any factual information showing that there are reasonable grounds for suspecting vessels not on the IOTC Record to be engaged in fishing for and/or transhipment of tuna and tuna-like species in the IOTC area of competence.
11. a) If a vessel mentioned in paragraph 10 is flying the flag of a CPC, the IOTC Executive Secretary shall request that Party to take measures necessary to prevent the vessel from fishing for tuna and tuna-like species in the IOTC area of competence;
b) If the flag of a vessel mentioned in paragraph 10 cannot be determined or is of a non-Contracting Party without cooperating status, the IOTC Executive Secretary shall compile and circulate such information to all CPCs, without delay.
12. The Commission and the CPCs concerned shall communicate with each other, and make the best effort with FAO and other relevant regional fishery management bodies to develop and implement appropriate measures, where feasible, including the establishment of records of a similar nature in a timely manner so as to avoid adverse effects upon tuna resources in other oceans. Such adverse effects might consist of excessive fishing pressure resulting from a shift of the IUU fishing vessels from the Indian Ocean to other oceans.
13. Each Contracting Party and Cooperating Non-Contracting Party with the IOTC shall:
a) Ensure that each of its fishing vessels carry on board documents issued and certified by the competent authority of that Contracting Party or of that Cooperating Non-Contracting Party with IOTC, including, at a minimum, the following:
i. License, permit or authorisation to fish and terms and conditions attached to the licence, permit of authorisation;
ii. Vessel name;
iii. Port in which registered and the number(s) under which registered; iv. International call sign;
v. Names and addresses of owner(s) and where relevant, the charterer;
vi. Overall length;
vii. Engine power, in KW/horsepower, where appropriate.
b) Verify above documents on a regular basis and at least every year;
c) Ensure that any modification to the documents and to the information referred to in 13.a) is certified by the competent authority of that Contracting Party or of that Cooperating Non-Contracting Party with the IOTC.
14. Each Contracting Party and Cooperating Non-Contracting Party with the IOTC shall ensure that its fishing vessels authorised to fish in the IOTC area of competence are marked in such a way that they can be really identified with generally accepted standards such as the FAO Standard Specification for the Marking and Identification of Fishing vessels.
15. a) Each Contracting Party and Cooperating Non-Contracting Party with the IOTC shall ensure that each gear used by its fishing vessels authorised to fish in the IOTC area of competence is marked appropriately, e.g., the ends of nets, lines and gear in the sea, shall be fitted with flag or radar reflector buoys by day and light buoys by night sufficient to indicate their position and extent;
b) Marker buoys and similar objects floating and on the surface, and intended to indicate the location of fixed fishing gear, shall be clearly marked at all time with the letter(s) and/or number(s) of the vessel to which they belong;
c) Fish aggregating devices shall be clearly marked at all time with the letter(s) and / or number(s) of the vessel to which they belong.
16. Each Contracting Party and Cooperating Non-Contracting Party with the IOTC shall ensure that all their respective fishing vessels of 24 meters or above and vessels less than 24 meters if fishing outside their EEZ,
and are registered on the IOTC Record of fishing vessels and authorised to fish in the IOTC area of competence, keep a bound fishing national logbook with consecutively numbered pages. The original recordings contained in the fishing logbooks shall be kept on board the fishing vessel for a period of at least 12 months.
17. This Resolution supersedes Resolution 14/04 Concerning the establishment of an IOTC record of vessels authorised to operate in the IOTC area.

إضافة لاستذكار تبنى هيئة مصايد أسماك التونة في المحيط الهندي للقرار رقم 01/02( الموقوف بالقرار رقم 13/02،ثم القرار رقم 14/04، ثم القرار رقم 15.04) لضبط أنشطة صيد الأسماك في اجتماعها في العام 2001،
وإذ تلاحظ أن قطاع كبير من سفن الصيد تتحرك بسرعة عالية وتغير بسهولة مناطق صيدها من محيط إلى آخر، وتعمل بإمكانات عالية في مناطق اختصاص هيئة مصايد أسماك التونة في المحيط الهندي دون قيامها بالتسجيل في حينه لدى اللجنة،
وإذ نشير إلى إمكانية زيادة صيد سفن الدعم والإمداد بالشباك الكيسية غير المتحكم به بأجهزة تجميع الأسماك } في مناطق الصيد المقفولة{،
واستذكارا لتبنى مجلس منظمة الأغذية العالمية في 23 يونيو 2001 لخطة عالمية لمنع وإيقاف وإزالة النطاق الكبير من سفن صيد التونة غير القانونية وغير المسجلة، وتنص هذه الخطة على التزام المؤسسات المنظمة للمصائد الإقليمية باتخاذ أجراء لتقوية وتنمية وسائل إبداعية تتطابق مع القانون الدولي لمنع وإيقاف وإزالة سفن الصيد غير القانونية وغير المسجلة وعلى وجه الخصوص أنشاء سجلات للسفن غير المرخصة وسجلات للسفن التي تزاول أعمال الصيد غير القانونية وغير المسجلة،
واستذكارا إلى أن سجل هيئة مصايد أسماك التونة في المحيط الهندي للسفن النشطة قد أسس في الأول من يوليو 2003 عبر القرار رقم 02/05 المتعلق بسجل لجنة تونة المحيط الهندي لعمل السفن المرخصة في مناطق اختصاص هيئة مصايد أسماك التونة في المحيط الهندي } الموقوف بالقرار رقم 05/02، ثم القرار رقم 07/02، ثم القرار رقم 13/02، ثم القرار رقم 14/04، ثم القرار رقم 15/04{:
وإدراكا لضرورة اتخاذ إجراءات اكثر فعالية لمنع وإيقاف وإزالة النطاق الكبير من سفن صيد التونة غير القانونية، ووفقا للفقرة 1 من البند 6 من اتفاقية هيئة مصايد أسماك التونة في المحيط الهندي فقد تم تبنى الآتي:
1. احتفاظ اللجنة على سجل لسفن صيد هيئة مصايد أسماك التونة في المحيط الهندي التي:
(أ) التي يبلغ طولها 24 متر أجمالا أو اعلى أو،
(ب) كانت السفن اقل من 24 متر، وتعمل في المياه خارج المنطقة الاقتصادية الخاصة لدولة العلم، وتلك السفن المرخصة التي تعمل على صيد التونة والأنواع المشابهة لها في منطقة اختصاص هيئة مصايد أسماك التونة في المحيط الهندي (المشار إليها لاحقا بسفن الصيد المرخصة).
ولأغراض هذا القرار، لأغراض هذا القرار، تعتبر سفن الصيد بما في ذلك سفن الأسناد وسفن الإمداد والدعم التي لم تدخل في سجل هيئة مصايد أسماك التونة في المحيط الهندي غير مصرح لها بصيد اسماك التونة أو اسماك التون أو الأنواع التي تشبه سمك التونة الاحتفاظ بها على متنها أو النقل من سفينة لأخرى أو دعم أي نشاط صيد أو وضع أجهزة لتجميع الأسماك في مجال اختصاص هيئة مصايد أسماك التونة في المحيط الهندي. لا ينطبق هذا الحكم على السفن التي يقل طولها الإجمالي عن 24 متراً والتي تعمل داخل المنطقة الاقتصادية الخالصة لدولة العلم.
2. يجب على كل الأطراف المتعاقدة والأطراف غير المتعاقدة المتعاونة (يشار إليه فيما يلي باسم الأطراف غير المتعاقدة المتعاونة) أن تقدم قائمة إلكترونية، حيثما أمكن ذلك، إلى الأمين التنفيذي لهيئة مصايد أسماك التونة في المحيط الهندي لتلك السفن المشار إليها في الفقرة 1 أ) و( السفن الأخرى المشار إليها في الفقرة 1.ب)، بسفن الصيد المرخص لها بالعمل في مجال اختصاص هيئة مصايد أسماك التونة في المحيط الهندي. ويجب أن تتضمن هذه القائمة المعلومات التالية:
(أ) اسم السفينة/ السفن، رقم/ أرقام التسجيل،
(ب) رقم المنظمة البحرية الدولية (إن كان مؤهلا)؛ للسماح بالوقت اللازم للأطراف غير المتعاقدة المتعاونة للحصول على رقم المنظمة البحرية الدولية لتأهيل السفن التي ليس لديها واحد بالفعل، وتعتبر الفقرة 2.

(ذ) اسم وعنوان المالك/ الملاك، والمشغل/ المشغلين،
(ر) المحرك/ المحركات المستخدمة.
(ز) الوقت المرخص به للصيد/ أو النقل.
عند تقييم الامتثال للفقرة أعلاه، تأخذ اللجنة في الاعتبار الظروف الاستثنائية التي لا يستطيع فيها مالك السفينة الحصول على رقم المنظمة البحرية الدولية رغم اتباع الإجراءات المناسبة. يجب على الأطراف غير المتعاقدة المتعاونة لدولة العلم أن تبلغ عن أي حالات استثنائية من هذا القبيل إلى أمانة هيئة مصايد أسماك التونة في المحيط الهندي.
3. يجب على جميع الأطراف غير المتعاقدة المتعاونة التي تصدر تصاريح للصيد لسفنها التي ترفع علمها للصيد للأنواع التي تديرها هيئة مصايد أسماك التونة في المحيط الهندي أن تقدم إلى الأمين التنفيذي لـهيئة مصايد أسماك التونة في المحيط الهندي، نموذجًا محدثًا من الإذن الرسمي بالصيد خارج الولايات القضائية الوطنية، وتحديث هذه المعلومات كلما تغيرت هذه المعلومات، وتتضمن هذه المعلومات:
(أ) اسم الجهة أو السلطة المختصة.
(ب) اسم وعنوان شخصي للجهة المختصة.

5. على كل الأطراف غير المتعاقدة المتعاونة أن تخطر على الفور، بعد إنشاء سجلها المبدئي بهيئة مصايد أسماك التونة في المحيط الهندي، الأمين التنفيذي لهيئة مصايد أسماك التونة في المحيط الهندي بأي إضافة أو أي حذف و / أو أي تعديل لسجل هيئة مصايد أسماك التونة في المحيط الهندي في أي وقت تحدث فيه هذه التغييرات.
6. يحتفظ الأمين التنفيذي لهيئة مصايد أسماك التونة في المحيط الهندي بسجل هيئة مصايد أسماك التونة في المحيط الهندي، ويتخذ أي إجراء لضمان نشر السجل من خلال الوسائل الإلكترونية، بما في ذلك وضعه على الموقع الإلكتروني لهيئة مصايد أسماك التونة في المحيط الهندي، بما يتمشى مع متطلبات السرية التي تشير إليها الأطراف غير المتعاقدة المتعاونة.
7. يجب أن تعمل الأطراف غير المتعاقدة المتعاونة لدول العلم في السجل على الآتي:

(ب) اتخاذ التدابير اللازمة لضمان امتثال سفن صيدها المرخص لها لجميع تدابير المحافظة والإدارة الخاصة بهيئة مصايد أسماك التونة في المحيط الهندي ذات الصلة،
(ج) اتخاذ التدابير اللازمة لضمان أن تظل سفن صيدها المرخص لها في سجل هيئة مصايد أسماك التونة في المحيط الهندي محتفظة على ظهر السفينة بشهادات صالحة لتسجيل السفينة وتصريح ساري لصيد أو لنقل الصيد من سفينة لأخرى،
(د) التأكد من عدم وجود تاريخ للأطراف غير المتعاقد المتعاونة في سجل هيئة مصايد أسماك التونة في المحيط الهندي لأي نوع من أنشطة الصيد غير القانوني وغير المسجل والمنظم أو إذا كان لتلك السفن لها تاريخ في ممارسة هذه الأنشطة، على الملاك الجدد تقديم أدلة كافية تثبت أن المالكين والمشغلين السابقين ليس لديهم مصلحة قانونية أو فوائد مالية أو انتفاع خاص لتلك السفن أو التحكم عليها؛ أو أن أطراف سفن الصيد غير القانوني وغير المسجل والمنظم قامت بحل الواقعة وحل المسألة رسميًا وتم الانتهاء من العقوبات؛ أو أنه بعد أخذ جميع الحقائق ذات الصلة في الاعتبار، أن سفن صيدها غير القانونية وغير المسجلة والمنظمة لا يشاركون في الصيد غير القانوني وغير المسجل والمنظم ؛
(ه) التأكد، إلى الحد الممكن بموجب القانون الداخلي، من أن مالكي ومشغلي سفن الصيد غير القانوني وغير المسجل والمنظم لديهم في سجل هيئة مصايد أسماك التونة في المحيط الهندي لا يزاولون أنشطة صيد سمك التونة الذي تقوم بها سفن الصيد غير القانوني وغير المسجل في سجل في مجال اختصاص هيئة مصايد أسماك التونة في المحيط الهندي؛

8. تستعرض الأطراف غير المتعاقدة المتعاونة الإجراءات الداخلية الخاصة بها والتدابير المتخذة بموجب الفقرة 7، بما في ذلك الإجراءات العقابية والعقوبات بنحو يتسق مع القانون الداخلي فيما يتعلق بالكشف والتبليغ للجنة بنتائج المراجعة سنويًا. تطلب اللجنة عند النظر في نتائج هذا الاستعراض، إذا كان ذلك مناسبًا، قائمة بالأطراف غير المتعاقدة المتعاونة وسفن الصيد المرخصة لدول العلم المسجلة في سجل هيئة مصايد أسماك التونة في المحيط الهندي لاتخاذ مزيد من الإجراءات لتعزيز امتثال تلك السفن لتدابير الحفاظ والإدارة في هيئة مصايد أسماك التونة في المحيط الهندي.
9. أ- تقوم الأطراف غير المتعاقدة المتعاونة بموجب تشريعاتها المعمول بها باتخاذ إجراءات لحظر الصيد والاحتفاظ بالتونة والأنواع الشبيهة بالتونة على ظهرها أو نقلها أو إنزالها بواسطة السفن التي لم تدخل في سجل هيئة مصايد أسماك التونة في المحيط الهندي،
ب- ضمان فعالية تدابير الحفظ والإدارة المتعلقة بالأنواع التي تغطيها برامج التوثيق الإحصائي بهيئة مصايد أسماك التونة في المحيط الهندي علي النحو التالي:
(أ) على الأطراف غير المتعاقدة المتعاونة لدول العلم المصادقة على السفن المسجلة فقط في سجل هيئة مصايد أسماك التونة في المحيط الهندي،
(ب) تطلب الأطراف غير المتعاقدة المتعاونة لدول العلم التي تستورد الأنواع المشمولة تحت برامج التوثيق الإحصائي التي تصطادها سفن صيد غير مرخصة في مجال اختصاص هيئة مصايد أسماك التونة في المحيط الهندي أن تطلب عند استيرادها إلى أراضي الطرف المتعاقد، برنامج الوثائق الإحصائية المصادق عليها للسفن المسجلة على سجل هيئة مصايد أسماك التونة في المحيط الهندي؛ و
(ج) تعمل الأطراف غير المتعاقدة المتعاونة التي تستورد الأنواع المشمولة ببرامج التوثيق الإحصائية ودول العلم لضمان عدم تزوير الوثائق الإحصائية أو عدم احتوائها على معلومات خاطئة.
10. يتعين على كل الأطراف غير المتعاقدة المتعاونة إخطار الأمين التنفيذي لـهيئة مصايد أسماك التونة في المحيط الهندي بأي معلومات واقعية توضح وجود أسباب معقولة للاشتباه في وجود سفن غير مدرجة في سجل هيئة مصايد أسماك التونة في المحيط الهندي تشارك في صيد و / أو إعادة شحن التونة أو الأنواع الشبيهة بالتونة وأنواع التونة في منطقة اختصاص هيئة مصايد أسماك التونة في المحيط الهندي.
11. (أ) إذا كانت السفينة المذكورة في الفقرة 10 ترفع دول علم الأطراف غير المتعاقد المتعاونة، يطلب الأمين التنفيذي لهيئة مصايد أسماك التونة في المحيط الهندي من الطرف اتخاذ التدابير اللازمة لمنع السفينة من صيد أسماك التونة والأنواع الشبيهة بالتونة في منطقة اختصاص هيئة مصايد أسماك التونة في المحيط الهندي.
(ت) إذا تعذر تحديد علم السفينة المذكورة في الفقرة 10 أو كان طرفًا غير متعاقد ولم يبدى تعاون، يتعين على الأمين التنفيذي لهيئة مصايد أسماك التونة في المحيط الهندي تجميع هذه المعلومات وتعميمها على جميع الدول غير المتعاقدة المتعاونة، دون تأخير.
12. تتواصل الهيئة والأطراف غير المتعاقدة المتعاونة المعنية مع بعضهما البعض، وتبذل قصارى جهدها مع منظمة الأغذية العالمية وغيرها من هيئات إدارة مصايد الأسماك الإقليمية ذات الصلة لوضع وتنفيذ التدابير المناسبة، حيثما كان ذلك ممكنًا، بما في ذلك إنشاء سجلات ذات طبيعة مماثلة في حينه بطريقة لتجنب الآثار السالبة على موارد التونة في المحيطات الأخرى. قد تشكل هذه الآثار السالبة ضغط صيد مفرط ناتج عن تحول سفن الصيد غير القانوني وغير المسجلة والمنظمة من المحيط الهندي إلى المحيطات الأخرى.
13. يتعين على كل طرف متعاقد وطرف غير متعاقد متعاون مع هيئة مصايد أسماك التونة في المحيط الهندي الآتي:
(أ) التأكد من أن كل من سفن الصيد التابعة لها تحمل على متنها مستندات صادرة ومصدقة من السلطة المختصة لذلك الطرف المتعاقد أو الطرف المتعاقد غير المتعاون مع هيئة مصايد أسماك التونة في المحيط الهندي، بما في ذلك، على الأقل، ما يلي:
i. أن الترخيص أو التصريح أو التفويض؛ بالصيد والبنود والشروط مرفقة مع الترخيص، أو التصريح أو التفويض؛
ii. اسم السفينة؛
iii. الميناء الذي تم تسجيله والرقم (الأرقام) الذي سجل بموجبه؛
iv. إشارات الرموز الدولية
v. أسماء وعناوين المالك (المالكين) والمستأجر، عند الاقتضاء؛
vi. الطول الإجمالي؛
vii. قوة المحرك، في الكيلو وات / حصان، عند الاقتضاء،
(ب) التحقق من الوثائق المذكورة أعلاه بشكل منتظم وعلى الأقل كل عام،
(ج) التأكد من أن أي تعديل للوثائق والمعلومات المشار إليها في المادة ( 13 أ) اعتمدته السلطة المختصة لذلك الطرف المتعاقد أو الطرف غير المتعاقد المتعاون مع هيئة مصايد أسماك التونة في المحيط الهندي.
14. يضمن كل طرف متعاقد وطرف غير متعاقد متعاون بالتنسيق مع هيئة مصايد أسماك التونة في المحيط الهندي أن يتم وضع علامة على سفن الصيد المرخص لها بالصيد في منطقة اختصاص هيئة مصايد أسماك التونة في المحيط الهندي بحيث يمكن تعريفها حقًا بالمعايير المقبولة عمومًا مثل معيار مقاييس منظمة الأغذية والزراعة للتسويق والرقم التعريفي لسفن الصيد.
15. أ- يضمن كل طرف متعاقد وطرف غير متعاقد غير متعاون مع هيئة مصايد أسماك التونة في المحيط الهندي أن كل معدات تستخدمها سفن الصيد المرخص لها بالصيد في منطقة اختصاص هيئة مصايد أسماك التونة في المحيط الهندي يتم تمييزها بشكل مناسب، وعلى سبيل المثال، نهايات الشباك والخطوط والمحرك، يجب تزويدها بعلم ورادار بعوامات منعكسة أو العوامات النهارية والعوامات الخفيفة ليلًا بما يكفي لبيان موقعها ومداها؛
ب- يجب وضع حرف S مع حروف السفينة بنحو واضح في جميع الأوقات على عوامات العلامات والأشياء المماثلة التي تطفو على السطح، ويشير الحرف الجهة التي تنتمي إليها السفينة،
ج- يجب وضع علامة واضحة على أجهزة تجميع الأسماك في جميع الأوقات بحرف (ٍS) / أو رقم (أرقام) مع رقم السفينة.
16. يجب على كل طرف متعاقد وطرف غير متعاقد متعاون مع هيئة مصايد أسماك التونة في المحيط الهندي التأكد من أن جميع سفن الصيد الخاصة بها والتي يبلغ طولها 24 متراً أو أكثر والسفن التي يقل طولها عن 24 متراً إذا كانت تقوم بالصيد خارج المنطقة الاقتصادية الخالصة مسجلة في سجل هيئة مصايد أسماك التونة في المحيط الهندي لسفن الصيد المرخص لها بالصيد في مجال اختصاص هيئة مصايد أسماك التونة في المحيط الهندي، والاحتفاظ بسجل وطني للصيد مُلزم مع صفحات مرقمة على التوالي. تحفظ السجلات الأصلية الواردة في سجلات الصيد على متن سفينة الصيد لمدة لا تقل عن 12 شهرًا.
17. يحل هذا القرار محل القرار 14/04 المتعلق بإنشاء سجل هيئة مصايد أسماك التونة في المحيط الهندي للسفن
المرخص لها بالعمل في منطقة هيئة مصايد أسماك التونة في المحيط الهندي.
