Aktuelle Initiativen
Um der angespannten Situation an den EU-Außengrenzen besser Rechnung zu tragen, wurde die ¬EU-Kommission von den Mitgliedstaaten bereits Mitte September 2015 damit beauftragt, in den betroffenen Staaten bis zum Ende des Jahres Aufnahmezentren („Hotspots”) zu errichten, in denen Asylsuchende durch EU-Mitarbeiter und die lokalen Behörden registriert werden sollen. Auf dem Sondergipfel der Staatsund Regierungschefs am 23. September wurde zudem entschieden, die Hotspots in Griechenland und Italien bereits im November in Betrieb zu nehmen. Anfang Januar 2016 waren allerdings von den fünf in Griechenland geplanten Hotspots nur einer (Lesbos), von den sechs in Italien geplanten Hotspots nur zwei (Lampedusa und Trapani) in Betrieb.
Des Weiteren sollen die Grenzschutzagentur Frontex und das Europäische Unterstützungsbüro für Asylfragen, kurz EASO, ausgebaut werden und zusammen mit der Polizeibehörde Europol die Mitgliedstaaten bei der Registrierung unterstützen. Auf dem EU-Gipfel vom 15. Oktober wurde in diesem Kontext eine Erweiterung der Kompetenzen der Grenzschutzagentur Frontex beschlossen. Diese umfassen zum einen eine Ausweitung der Befugnisse der Agentur: So soll Frontex beispielsweise das Mandat erhalten, selbstständig Rückführungen vorzunehmen. Ferner wurde eine finanzielle und personelle Aufstockung um bis zu 1.000 Personen beschlossen. Darüber hinaus könnten Einsatztruppen von Frontex künftig Maßnahmen zur Sicherung der europäischen Außengrenzen – möglicherweise auch ohne Zustimmung des betroffenen Mitgliedstaates – durchführen. Dieser Vorschlag der EU-Kommission von Mitte Dezember 2015 und die damit verbundene Souveränitätsabgabe treffen jedoch auf den Widerstand einiger Mitgliedstaaten.
In den nächsten Monaten wollen die EU-Staaten auch ihre Rückführungspolitik stärken. Bereits in den Aufnahmezentren soll zwischen Flüchtlingen und Migranten unterschieden werden, so dass die Menschen, die keine Chance auf Asyl haben, künftig von hier aus in ihre Heimatländer abgeschoben werden können. Im Jahr 2015 lag nach Angaben der Kommission die Rückführungsquote in der EU – wie auch in den Vorjahren – bei unter 40 Prozent. Die Mitgliedstaaten wollen daher u.a. die Rückführungsabkommen mit Drittstaaten künftig konsequenter umsetzen. Die Menschen, die wiederum einen Asylantrag stellen können, sollen von den Aufnahmezentren aus in die EU verteilt werden.
Aus diesem Grund strebt Kommissionspräsident Juncker auch eine permanente europäische Quotenregelung an: Jeder EU-Mitgliedstaat soll auf der Basis eines Verteilungsschlüssels zu einer bestimmten Zahl von Asylaufnahmen verpflichtet werden. Dieser Schlüssel soll sich an den vier Faktoren Bevölkerungszahl, Bruttoinlandsprodukt, Arbeitslosenquote und Zahl der bisherigen Asylbewerber orientieren. Bundeskanzlerin Merkel und Frankreichs Präsident Hollande unterstützen einen solchen verbindlichen und permanenten Mechanismus. Doch lehnen momentan osteuropäische Staaten eine europäische Quote als unverhältnismäßig und nicht zielführend ab. Sie verweisen zudem auf sehr homogene Gesellschaften in ihren Ländern und auf kaum ausgeprägte Asyltraditionen. Kritiker dieser Regelung merken an, dass eine verbindliche Quote die Präferenzen der Flüchtlinge für bestimmte Zielländer, etwa aufgrund von Sprachkenntnissen oder der individuellen Familiensituation, nicht berücksichtigen würde. Widerstand gegen eine verbindliche Quote kommt auch aus den baltischen Staaten, die auf nationaler Entscheidungshoheit beharren. Großbritannien, Irland und Dänemark ihrerseits müssen sich aufgrund von Ausnahmeregelungen in den Europäischen Verträgen nicht an einer gemeinsamen Quotenregelung beteiligen. In den Schlussfolgerungen der Verhandlungen des Oktobergipfels der Staats- und Regierungschefs konnte nur ein impliziter Verweis auf diese Quotenregelung erzielt werden. Beim EU-Gipfel am 18. und 19. Dezember 2015 wurde das Thema nicht weiter vertieft.
Angesichts des Widerstands gegen eine feste und verbindliche Quote sind die Diskussionen diesbezüglich auf EU-Ebene noch lange nicht abgeschlossen. Vor diesem Hintergrund hat die Kommission einen solidarischen europäischen Finanzierungsmechanismus in Erwägung gezogen, über den Mitgliedstaaten mit überdurchschnittlich vielen Asylgesuchen finanziell entlastet werden könnten, während weniger aufnahmebereite Länder Beiträge einzahlen müssten. Auch wurden in Brüssel und in manchen Hauptstädten Sanktionen für die Länder in Erwägung gezogen, die sich einer europäischen Regelung mit finanziellen Kompensationen strikt widersetzen. Sanktionen könnten die Streichung von Mitteln aus den europäischen Struktur- und Kohäsionsfonds oder die Einstellung der Kofinanzierung länderspezifischer Projekte vorsehen. In einer Pressekonferenz am 15. September 2015 sprach sich Bundeskanzlerin Merkel allerdings klar gegen solche Drohungen aus und appellierte mit Blick nach Osten an den europäischen Geist. Die osteuropäischen Staaten werden auch regelmäßig daran erinnert, dass sie seit Jahren von EU-Hilfen profitieren und dass die Aufnahme von Flüchtlingen ebenfalls eine Frage der europäischen Verantwortung und Solidarität sei. Beim Dezembergipfel der Staats- und Regierungschefs wurde über einen Sanktionsmechanismus nicht diskutiert.
In seiner Rede zur Lage der EU am 9. September 2015 kündigte Juncker außerdem eine gemeinsame EU-Liste sicherer Herkunftsstaaten an. Eine solche EU-Liste soll zunächst Albanien, Bosnien und Herzegowina, den Kosovo, Mazedonien, Montenegro, Serbien und die Türkei umfassen. Außerdem soll in der EU künftig die Regel gelten, dass jeder Staat, dem die EU den Status eines Beitrittskandidaten verliehen hat, automatisch als sicherer Herkunftsstaat zählt. In Deutschland beispielsweise stammten im Zeitraum vom 1. Januar bis 31. August 2015 rund 38 Prozent der Erstanträge auf Asyl von Menschen aus Albanien, dem Kosovo, Serbien und Ma-zedonien, deren Anerkennungsquote aber liegt bei unter einem Prozent. Eine einheitliche Liste sicherer Herkunftsstaaten würde daher europaweit der notwendigen Unterscheidung von Flüchtlingen und Migranten besser Rechnung tragen, die Asylverfahren beschleunigen und die angespannte Situation in den oftmals überfüllten Erstaufnahmeeinrichtungen entspannen. Bis zum jetzigen Zeitpunkt gibt es jedoch noch keine solche Liste.
Um das Problem der unterschiedlichen Asylstandards anzugehen, hat die EU-Kommission im September 2015 40 Vertragsverletzungsverfahren gegen 19 Mitgliedstaaten eingeleitet, die die europäische Asylgesetzgebung – in Bezug auf die Anerkennung von internationalem Schutz und auf Normen bei der Aufnahme von Asylsuchenden – noch nicht ausreichend umgesetzt haben.
Als Sofortmaßnahmen zur Unterstützung der Herkunft- und Transitländer einigten sich die EU-Staatsund Regierungschefs am 23. September 2015 auf finanzielle Hilfen, u.a. zur Aufstockung des UN-Welternährungsprogramms und des Regionalen Treuhandfonds für Syrien (Medad-Fonds). Am 14. Oktober hielt die Kommission in ihrem Fortschrittsbericht fest, dass die EU zusätzliche 1,7 Milliarden für diese Fonds bereitstellen werde. Die meisten Mitgliedstaaten sind jedoch bisher hinter ihren finanziellen Zusagen zurückgeblieben.
Eine verstärkte Zusammenarbeit mit Drittstaaten wurde am 15. Oktober 2015 auf dem Gipfel der Staats- und Regierungschefs beschlossen. Ziel ist es, insbesondere mit der Türkei stärker zu kooperieren. Als erster Schritt sicherte die Türkei Unterstützung bei der Registrierung von Flüchtlingen und der Rückführung abgelehnter Asylbewerber zu. Als Gegenleistung stellte die EU mehr finanzielle Unterstützung, Visa-Erleichterungen sowie neuen Schwung für die EU-Beitrittsverhandlungen in Aussicht. In diesem Zusammenhang hob Kommissionspräsident Juncker allerdings hervor, dass die Türkei nach wie vor alle formalen Kriterien im Verhandlungsprozess erfüllen müsse. Die 28 EU-Staats- und Regierungschefs konnten sich am 29. November auf einem Gipfeltreffen mit der Türkei auf einen gemeinsamen Aktionsplan verständigen, der die unkontrollierte Weiterreise von Flüchtlingen aus der Türkei nach Europa bremsen soll (aktuell befinden sich allein 2,2 Millionen Flüchtlinge aus Syrien in türkischen Aufnahmelagern). Die EU hat sich in diesem Zusammenhang u.a. dazu verpflichtet, drei Mrd. Euro an Hilfsgeldern zur Verfügung zu stellen.
Am 25. Oktober tagte ein EU-Sondergipfel, auf dem acht EU-Länder sowie die Balkanstaaten Serbien, Mazedonien und Albanien sich auf einen 17-PunktePlan einigten. Unter anderem wurden 100.000 Aufnahmeplätze entlang der Balkanroute und 400 Grenzschützer für Slowenien beschlossen.

Για να αντιμετωπιστεί καλύτερα η τεταμένη κατάσταση στα εξωτερικά σύνορα της Ε.Ε., η Ευρωπαϊκή Επιτροπή έλαβε εντολή από τα κράτη μέλη ήδη από τα μέσα του Σεπτεμβρίου 2015 για ανέγερση κέντρων υποδοχής («Hotspot») στα εν λόγω κράτη μέχρι το τέλος του έτους, στα οποία οι αιτούντες άσυλο θα πρέπει να καταγραφούν μέσω των εργαζομένων της Ε.Ε. και των τοπικών υπηρεσιών. Κατά την έκτακτη σύνοδο κορυφής των αρχηγών των κρατών και των κυβερνήσεων στις 23 Σεπτεμβρίου αποφασίστηκε επιπλέον να τεθούν σε λειτουργία τα κέντρα υποδοχής στην Ελλάδα και την Ιταλία ήδη από τον Νοέμβριο. Στις αρχές του Ιανουαρίου 2016 λειτούργησαν, ωστόσο, από τα πέντε σχεδιασμένα κέντρα υποδοχής στην Ελλάδα μόνο ένα (Λέσβος), κι από τα έξι σχεδιασμένα κέντρα υποδοχής στην Ιταλία μόνο δύο (Λαμπεντούζα και Τράπανι).
Επιπλέον, πρέπει ο Οργανισμός Ευρωπαϊκής Συνοριοφυλακής και Ακτοφυλάκης Frontex και η Ευρωπαϊκή Υπηρεσία Υποστήριξης για το Άσυλο, με τη συντομογραφία EASO να αναβαθμιστούν πλήρως και μαζί με την Αστυνομική Υπηρεσία Ευρωπόλ να υποστηρίξουν τα κράτη μέλη κατά την καταγραφή. Κατά την σύνοδο κορυφής της Ε.Ε. αποφασίστηκε σε αυτό το πλαίσιο από τις 15 Οκτωβρίου η διεύρυνση των αρμοδιοτήτων του Οργανισμού της Ευρωπαϊκής Συνοριοφυλακής και Ακτοφυλάκης Frontex. Αυτά περιλαμβάνουν αφενός τη διεύρυνση των αρμοδιοτήτων του οργανισμού: Έτσι η Frontex οφείλει για παράδειγμα να αναλαμβάνει το καθήκον του προγραμματισμού επαναπροώθησης μεταναστών ανεξάρτητα. Επιπλέον, αποφασίστηκε η ενίσχυση των χρηματοδοτικών μέσων και του ανθρώπινου δυναμικού κατά περίπου 1000 άτομα. Επιπλέον, θα μπορούσαν οι ομάδες δράσης της Frontex να λάβουν στο μέλλον μέτρα για την ασφάλεια των ευρωπαϊκών εξωτερικών συνόρων, πιθανότατα ακόμα και χωρίς τη συγκατάθεση των εν λόγω κρατών μελών. Αυτή η πρόταση της Ευρωπαϊκής Επιτροπής από τα μέσα Δεκεμβρίου 2015 και η σχετική παράδοση κυριαρχίας αντιμετωπίζουν, ωστόσο, την αντίσταση ορισμένων κρατών μελών.
Τους επόμενους μήνες επιθυμούν να τονώσουν τα κράτη της Ε.Ε. την πολιτική επαναπροώθησης. Ήδη στα κέντρα υποδοχής πρέπει να γίνει διάκριση μεταξύ των προσφύγων και των μεταναστών, έτσι ώστε οι άνθρωποι, οι οποίοι δεν έχουν ελπίδες να τους χορηγηθεί άσυλο, να μπορούν να απομακρυνθούν μελλοντικά από εδώ προς τις πατρίδες τους. Το έτος 2015 σύμφωνα με πληροφορίες της Επιτροπής το ποσοστό επιστροφής στην Ε.Ε., όπως επίσης και τα προηγούμενα χρόνια, είναι μικρότερο του 40 τοις εκατό. Για αυτό το λόγο, τα κράτη μέλη επιθυμούν μεταξύ άλλων να αντικαταστήσουν στο μέλλον με συνέπεια τις συμφωνίες επαναπατρισμού με τα τρίτα κράτη. Οι άνθρωποι, οι οποίοι μπορούν να υποβάλλουν εκ νέου αίτηση παροχής ασύλου χρειάζεται να διαμοιραστούν από τα κέντρα υποδοχής στην Ε.Ε.
Για αυτό το λόγο, επιδιώκει ο Γιούνκερ, ο πρόεδρος της Επιτροπής, επίσης ένα μόνιμο ευρωπαϊκό καθεστώς ποσοστώσεων: Κάθε κράτος μέλος της Ε.Ε. θα έπρεπε να είναι υποχρεωμένο στη βάση μίας κλείδας κατανομής να δέχεται έναν συγκεκριμένο αριθμό αιτήσεων ασύλου. Αυτή η κλείδα πρέπει να προσανατολιστεί στους τέσσερις παράγοντες του αριθμού του πληθυσμού, του ακαθάριστου εγχώριου προϊόντος, του ποσοστού ανεργίας και του αριθμού των ως τώρα αιτούντων παροχής ασύλου. Η Καγκελάριος Μέρκελ κι ο Πρόεδρος της Γαλλίας Ολλάντ υποστηρίζουν έναν τέτοιο δεσμευτικό και μόνιμο μηχανισμό. Ωστόσο, προς στιγμήν απορρίπτουν τα ανατολικοευρωπαϊκά κράτη την ευρωπαϊκή ποσόστωση ως υπερβολική και άσκοπη. Επίσης, αναφέρονται στις πολύ ομογενοποιημένες κοινωνίες στις χώρες τους και στην καθόλου έντονη παράδοση παροχής ασύλου. Οι κριτικοί αυτής της ρύθμισης παρατηρούν ότι ένα δεσμευτικό ποσοστό δεν θα λάμβανε υπόψη τις προτιμήσεις των προσφύγων για συγκεκριμένες χώρες προορισμού, για παράδειγμα λόγω των γλωσσικών γνώσεων ή της ατομικής οικογενειακής κατάστασης. Η αντίσταση κατά των δεσμευτικών ποσοστώσεων προέρχεται, επίσης από τα βαλτικά κράτη, τα οποία επιμένουν στην εθνική κυριαρχική εξουσία. Η Μεγάλη Βρετανία, η Ιρλανδία και η Δανία από την πλευρά τους δεν πρέπει να συμμετέχουν στο κοινό καθεστώς ποσοστώσεων λόγω των παρεκκλίσεων στις ευρωπαϊκές συνθήκες. Στα συμπεράσματα των διαπραγματεύσεων της συνόδου κορυφής του Οκτωβρίου των αρχηγών των κρατών και των κυβερνήσεων μπόρεσε να επιτευχθεί μόνο μια έμμεση αναφορά στο καθεστώς των ποσοστώσεων. Κατά την ευρωπαϊκή σύνοδο κορυφής στις 18 και 19 Δεκεμβρίου 2015 δεν έγινε εμβάθυνση στο θέμα.
Ενόψει της αντίστασης στη σταθερή και δεσμευτική ρύθμιση οι σχετικές συζητήσεις σε ευρωπαϊκό επίπεδο δεν ολοκληρώθηκαν για πολύ καιρό. Σε αυτό το πλαίσιο η Επιτροπή έλαβε υπόψη έναν αλληλέγγυο ευρωπαϊκό μηχανισμό χρηματοδότησης, με τον οποίο θα μπορούσαν να ανακουφιστούν οικονομικά τα κράτη μέλη με πολλούς αιτούντες παροχής ασύλου, που ξεπερνούν τον μέσο όρο, καθώς οι χώρες, που επιθυμούν να τους δεχτούν, θα έπρεπε να καταβάλουν λιγότερες εισφορές. Επίσης, στις Βρυξέλλες και σε κάποιες πρωτεύουσες λήφθηκαν υπόψη κυρώσεις με οικονομικές αντισταθμίσεις για τις χώρες, οι οποίες αντιτάχθηκαν στην ευρωπαϊκή ρύθμιση. Οι κυρώσεις μπορούσαν να προβλέπουν την διαγραφή από πόρους των ευρωπαϊκών διαρθρωτικών ταμείων και του Ταμείου Συνοχής ή την αναστολή της συγχρηματοδότησης έργων ανά χώρα. Σε μια συνέντευξη Τύπου στις 15 Σεπτεμβρίου 2015 η Καγκελάριος Μέρκελ τοποθετήθηκε, ωστόσο, ξεκάθαρα κατά τέτοιου είδους απειλών κι έκανε έκκληση προς την Ανατολή για ευρωπαϊκό πνεύμα. Έγινε τακτική υπενθύμιση στα ανατολικοευρωπαϊκά κράτη, ότι επωφελούνται εδώ και χρόνια από την ευρωπαϊκή ενίσχυση και ότι η υποδοχή των προσφύγων είναι επιπλέον ζήτημα ευρωπαϊκής ευθύνης και αλληλεγγύης. Κατά τη σύνοδο κορυφής των αρχηγών των κρατών και των κυβερνήσεων τον Δεκέμβριο δεν έγινε συζήτηση για τον μηχανισμό κυρώσεων.
Στην ομιλία του για την κατάσταση της Ε.Ε. στις 9 Σεπτεμβρίου 2015 ο Γιούνκερ προανήγγειλε επιπλέον έναν κοινό ευρωπαϊκό κατάλογο ασφαλών κρατών καταγωγής. Ένας τέτοιος ευρωπαϊκός κατάλογος πρέπει να περιλαμβάνει αρχικά την Αλβανία, τη Βοσνία-Ερζεγοβίνη, το Κόσσοβο, τη Βόρεια Μακεδονία, το Μαυροβούνιο, τη Σερβία και την Τουρκία. Επιπλέον, πρέπει να ισχύσουν μελλοντικά στην Ε.Ε. οι κανονισμοί, τους οποίους κάθε κράτος, που παρέχει στην Ε.Ε. το καθεστώς υποψήφιας προς ένταξη χώρα, θεωρείται αυτόματα ασφαλές κράτος καταγωγής. Στη Γερμανία, για παράδειγμα, στο διάστημα από 1 Ιανουαρίου μέχρι 31 Αυγούστου 2015 γύρω στο 38 τοις εκατό των αρχικών αιτήσεων για άσυλο προέρχονταν από ανθρώπους από την Αλβανία, το Κόσσοβο, τη Σερβία και την Μακεδονία, των οποίων όμως η ποσόστωση αναγνώρισης βρίσκεται κάτω από το ένα τοις εκατό. Επομένως, ένας ενιαίος κατάλογος ασφαλών κρατών καταγωγής για την απαραίτητη διάκριση των προσφύγων και των μεταναστών θα λαμβανόταν καλύτερα υπόψη σε ευρωπαϊκό επίπεδο, θα επιταχύνει τη διαδικασία ασύλου και θα βελτίωνε την τεταμένη κατάσταση στα συχνά συνωστισμένα κέντρα πρώτης υποδοχής. Εν τούτοις, μέχρι σήμερα δεν υπάρχει ακόμα τέτοιος κατάλογος.
Για να αντιμετωπιστεί το πρόβλημα των διαφορετικών προϋποθέσεων παραχώρησης ασύλου η Ευρωπαϊκή Επιτροπή εισήγαγε το Σεπτέμβριο 2015 40 διαδικασίες παράβασης κατά 19 κρατών μελών, τα οποία δεν είχαν εφαρμόσει ακόμη επαρκώς την ευρωπαϊκή νομοθεσία ασύλου αναφορικά με την αναγνώριση της διεθνούς προστασίας και τα πρότυπα υποδοχής των αιτούντων άσυλο.
Ως μέτρα έκτακτης ανάγκης για την υποστήριξη των χωρών καταγωγής και διέλευσης ενέκριναν οι αρχηγοί των κρατών και των κυβερνήσεων της Ε.Ε. στις 23 Σεπτεμβρίου 2015 την οικονομική στήριξη, μεταξύ άλλων για τη διεύρυνση του Παγκόσμιου Επισιτιστικού Προγράμματος των Ηνωμένων Εθνών και του Περιφερειακού Καταπιστευματικού Ταμείου για τη Συρία (Καταπιστευματικό Ταμείο Madad). Στις 14 Οκτωβρίου, η Επιτροπή επέμεινε στην έκθεση προόδου της, ότι η Ε.Ε. θα διαθέσει επιπλέον1,7 δισεκατομμύρια για αυτά τα ταμεία. Ωστόσο, τα περισσότερα κράτη μέλη έχουν καθυστερήσει ως τώρα στις οικονομικές τους συμφωνίες.
Στις 15 Οκτωβρίου 2015 αποφασίστηκε να ενταθεί η συνεργασία με τα τρίτα κράτη κατά τη σύνοδο κορυφής των αρχηγών των κρατών και των κυβερνήσεων. Ο στόχος είναι η ισχυρότερη συνεργασία ιδιαίτερα με την Τουρκία. Σε πρώτη φάση η Τουρκία διαβεβαίωσε ότι θα υποστηρίξει με την εγγραφή των προσφύγων και τον επαναπατρισμό των αιτούντων άσυλο, των οποίων η αίτηση απορρίφθηκε. Introduction: Analysing Change
in European Gender Equality Policy
On 16 February 1966, 3000 female workers from the Belgian national weapons manufacturer, Fabrique Nationale d’Armes de Guerre de Herstal, began a strike that would last for 12 weeks. Their slogan was ‘Equal work for equal pay!’ Their main demand was the application of Article 119 of the Treaty of Rome at the national level. This Article establishes the prin- ciple of equal pay between men and women in the six founding member states of the European Community (EC).
On 15 September 2010, a European coalition of non-governmental organisations (NGOs) promoting women’s rights launched a campaign on the question of women asylum seekers, under the slogan ‘persecution is not neutral’. Its goal was to have ‘gender persecution’ (genital mutila- tion, rape as a weapon of war, forced marriage, honour crimes, etc.) recog- nised as legitimate grounds for demanding refugee status in the member states of the European Union (EU) in order to ensure greater protection for victims.
More than forty years apart, both these mobilisations show the per- sistent links between women and Europe and the ability of women in Europe to call on these institutions in defence of their rights. The EC, and then the EU, emerged as a space that is open to possibilities and able to accommodate demands to fight against gender inequalities. Mobilisations by women’s groups and feminist groups are also a reflec- tion of the evolution of the very definition of the principle of equal- ity. In each of these two periods, ‘gender equality’ covers very different understandings of what might constitute a category of legitimate pub- lic action at the European level. In the first instance, the slogan ‘Equal work for equal pay!’ is a direct demand for equality of rights between men and women: they must be treated the same. To achieve this, exist- ing inequalities must be corrected by transposing European dispositions

into national legislation. In the second case, the reference to ‘gender’ calls for inequalities between men and women to be made visible; for an awareness of the differentiation that exists between the social and cultural classifications of male and female and the recognition that this hierarchy is the basis for the power relations and domination that women are victims of. It is thus a matter of integrating an understand- ing of this differentiation into asylum policy so that it contributes to the requirements in terms of equality.
The 1966 strike and the lobby campaign of 2010 testify as to the – in many ways unpredictable – progress of the European integration pro- cess: the construction of a political system with multiple actors and lev- els, the extension of its jurisdiction to areas of sovereignty (not limited to the functioning of the common market) and the enlargement of its borders. But these two examples demonstrate above all the evolution of the frame of relations between women and Europe; in other words, the appearance of a specific public policy dedicated to gender equality. When the female workers of Herstal demanded the concrete transposi- tion of Article 119 of the Treaty of Rome (which makes equal pay an objective of the Treaty), this article was the only element – material or symbolic – that could support European intervention into the area of gender equality. The demand for its application implicitly revealed the absence of any kind of policy and limited its possible jurisdiction to equal pay. Lobbying by NGOs for gender to be taken more into account in the area of asylum was also part of a broader context. Indeed, more than fifty years after the Herstal strike, the principle of gender equality is now recognised as a fundamental right and constitutes one of the EU’s missions for action. This action is based on a range of instruments, on the functioning of specific structures within the different institutions of the EU and on the consultation and the participation of various actors, including NGOs. Moreover, the desire of women’s rights organisations to influence the criteria according to which asylum is granted is coherent with a gender equality policy with extremely diverse areas of interven- tion and in which equal pay is now simply one objective among others. The trajectory of European intervention in the fight against gender inequalities is the object of this book. Article 119 of the Treaty of Rome in 1957 contained the seed of this intervention and it was brought to life by the Belgian workers in 1966. Today it is widely developed and multifarious. The question that is at the heart of this research concerns the transformations of European gender equality policy; the goal is to explore its emergence, its institutionalisation and its evolution at the European level, in an environment that is in constant flux.
What is gender equality policy?
Gender equality policies are public policies whose principal objective is the fight against gender inequalities and the promotion of equal- ity between women and men. It is also frequently described as gen- der policy or feminist policy (Kantola, 2010c; Mazur, 2002). Gender equality policies can be distinguished from policies of rights or for the promotion of rights (Baudot and Revillard, 2014), as well as from anti- discrimination policies (Geddes and Guiraudon, 2004). In addition to the question of the different boundaries which characterise these types of public policies,1 the essential difference between them is that gen- der equality policies are not solely focused on the application of rights and on the fight against differential treatment between categories of inequalities. Unlike gender equality policy, one of the characteristics of anti-discrimination policies is to focus on an individual approach to discrimination and on modes of public action which favour a judicial treatment of inequalities (Krizsan et al., 2012).
Gender equality policies take many different forms and are deployed in numerous sectors (in terms of rights, political representation, equal- ity at work, work and family life balance, violence, etc.).2 By definition, gender runs through all aspects of the political process (from elaboration to implementation) and all public policy areas (budget, health, peace- keeping, asylum, retirement, etc.). Gender equality policies intrinsically challenge the sectorisation of public action and question the traditional modes of dealing with public issues (Jacquot and Mazur, 2010). As a result, these policies have particular heuristic value for our understanding of the contemporary transformations of public action.
The different conceptualisations of the principle of gender equality
In order to explore European gender equality policy we must first under- stand the range of possible meanings covered by the notion of gender equality. Different understandings of this principle have led to differ- ent political strategies (Squires, 2007). The three major manifestations of this principle are: equal treatment, which is based on the concept of equal rights and implemented through the law; equal opportunities, which is based on the concept of difference and incarnated politically through positive action or positive discrimination measures; and equal impact, which is based on the concept of gender and primarily oper- ates through instruments such as gender mainstreaming. Most feminist analyses agree that like a ‘three-legged stool’ (Booth and Bennett, 2002)

gender equality policy can only pursue its objectives if it is stable and achieves a balance between these three main incarnations of the prin- ciple of gender equality (see Table 1.1).
The principle of equal treatment is based on the modification of tra- ditional systems of discriminatory norms towards women and on the development of new anti-discrimination norms to promote gender equality. It is thus a matter of acting through the law and on the law in

order to correct the inequalities in the judicial and regulatory systems, which reflect values that are no longer predominantly shared by society. As a result, this strategy is to a large extent based on legislators, as well as on the evolutions of jurisprudence. But it is also based on the degree of application of the new norms and is thus dependent on the prior goodwill of the state and its institutions for the implementation of judi- cial norms, and then later on the goodwill of the Courts of Justice and the mobilisation of women’s interest groups. This mechanism indeed awards an important place to the mobilisation and collective action of plaintiffs to move jurisprudence forward, yet national structures of collective mobilisation linked to this kind of activity possess different characteristics (organisational structures, links to the state and state feminism, repertories of legal collective action, etc.), and as a result they have an unpredictable impact (Caporaso and Jupille, 2001; Jacquot and Vitale, 2014). Equality by law, which is necessary for the correction of the most flagrant direct inequalities, therefore does not address the gap between equality in rights and equality in fact, and may leave a gap between the application and the formal respect of the law.
It was specifically this inability to address the gap between norms and reality that led to the principle of equal opportunities based on the con- cept of difference. The political strategy here consists in fighting de facto discrimination with de jure discrimination by creating legal inequalities that combat concrete inequalities. This strategy is designed to redress differences between groups, to compensate for the effects of history, and is manifested through positive action or positive discrimination mea- sures. Positive action measures correspond to temporary derogations from the fundamental law of non-discrimination, in order to compen- sate for existing inequalities which limit women’s possibilities in certain areas. They are incarnated in funding programmes (subsidies, tax cred- its, etc.), training specifically for women and generally in areas dealing with access to employment, education and entrepreneurship. Positive discrimination measures are a more ambitious form of positive action and ensure that women have equal access (if necessary via quotas) par- ticularly in terms of jobs and careers. Generally these are mechanisms designed to increase the participation of disadvantaged groups. The management of these measures, from the 1960s to the 1980s, was attrib- uted by member states to structures in specific sectors, and responsibility was given to either non-specialised actors within the bureaucracy or to external specialists in the area (Mazur and McBride Stetson, 1995, 2010). However, the principle of equal opportunities remains marginalised within the political process and is too limited in terms of the political domains concerned. It is therefore not able to respond to the multiple dimensions of inequality.

The development of the concept of gender has attracted the atten- tion of social sciences to the social construction of inequalities and the power relations involved in this process. A whole movement for redefining and interrogating traditional approaches and concepts has developed. Whereas the classic diptych equality/difference only allows us to analyse the consequences of the differences between sexes (should women be treated differently or the same as men?), the gender approach questions the reasons that this difference came to acquire such impor- tance as a structural factor in social relations of subordination. Equality and difference only allow us to deal with the problem of inequalities after the fact. Moreover, these analytical perspectives focus only on women, considered as an ‘other’ category compared to the male norm; they do not interrogate the relations between men and women as a social rela- tionship of power. Nor do they question it as a conceptual relationship which implies that this vision makes women alone responsible for the resolution of inequalities – both as individuals and as a group.
The notion of gender provides an alternative approach by attempt- ing to understand and deconstruct the reasons for male domination. Considering that the power to discriminate is structural and stems from the institutionalisation of hierarchical relations between men and women has two main implications. Firstly it implies that gender differ- ences can no longer be exclusively considered a women’s problem. It is the history of social relations that has resulted in institutions and actors reproducing inequalities. Furthermore, considering discrimination from a structural perspective means considering policies as both a cause and a solution. The former because policies participate in the construction and especially the perpetuation of structural barriers and disadvantages, and the latter because they also act on the structures themselves and can negotiate between the impossibly tangled threads of equality and dif- ference. The use of gender enabled a final objective to be conceived and defined in the form of equality between women and men, preserving the complementarity between difference and equal rights whilst also surpass- ing them. Relations of domination, and thus also gender inequalities, are constructed and inscribed in social structures for the most part. Because sex-based domination is systemic, it is indeed the system in its entirety that must be taken into account in the treatment of these inequalities.
It is on these bases that gender mainstreaming emerged as the third type of political strategy, derived from the principle of equal impact. It aimed to enlarge the range of possible actions by systematically incor- porating questions linked to gender into all institutions and political domains. From this perspective, ‘tackling inequality is no longer about

finding the right policy but about ensuring that all policies are right’ (Beveridge et al., 2000, p. 278). In focusing the action on the politi- cal process, the main characteristic of this strategy is its horizontal intervention which identifies the possible effects of these policies and political choices on gender. Transversality is thus the main quality of gender mainstreaming. Paying attention to all policies enables the pri- vate sphere to also be included in the public action design (recognition of unequal distribution of family responsibilities, or sexual harassment in employment policy, for example). From transversal action stems the other specificities of gender mainstreaming compared to the two other political strategies. The fact that attention to gender is systematically integrated into each political area, with all sectors of public action con- tributing, implies that the actors of gender mainstreaming are the usual actors in charge of each of these sectors. Equality specialists intervene more for the coordination of the process or for specific support missions. Furthermore, horizontal also means sequential. Gender mainstreaming is supposed to intervene during each sequence of the political process. It is this aspect, intervention from the very definition and conception of policies, that enables this policy to avoid simply having an a posteriori impact. Instead, it is able to modify a proposal seen as having negative effects on gender relations. Transversality in the political process is thus a necessary condition for anticipative action able to address the roots of inequalities. However, transversality is also the source of the prin- ciple limitation associated with the gender mainstreaming strategy: the dilution of resources. Perfectly integrated action, by definition, does not require the allocation of specific means, structures and staff.
These three conceptualisations of the principle of gender equality can be historically situated in the articulation between feminist thought and action on the one hand and the evolution of political strategies on the other. The first type of political strategy, that of equality in the law, is based on a liberal conception of the principle of equality and is consub- stantial to the demands of the first-wave feminists. It was veritably intro- duced in western democracies from the beginning of the 1960s. Equal opportunities and positive actions are linked to second-wave feminists’ use of the concept of difference in theorising the specific exploitation of women and the assertion of this difference. For example, although capitalism oppresses both men and women, it does not oppress them in the same way; women are exploited in work relations and in the private sphere. This second strategy began to be mobilised from the end of the 1970s. The third strategy, gender mainstreaming, appeared a decade or so later and corresponds to the spread of the concept of gender.

Although it is possible to identify ‘generations’ of approaches to gen- der equality, they cannot be considered successive stages because they can coexist as political strategies. Within a single political system, gen- der equality policy could be composed of the superposition or parallel development of these three types of action. We will only speak of succes- sion to the extent that each new manifestation of the principle of gender equality is the result, on a theoretical and practical level, of dissatisfac- tion with the previous form, the progress of research and lessons learned from experience. However, each new generation is not a replacement or a substitute. Each conceptualisation of the gender equality principle is seen as complementary, and in continuity with its predecessors. In spite of this continuity, gender mainstreaming is often presented as ‘another’ approach, a new approach, a source of change (Mazey, 2001; Schmidt, 2005; Woodward, 2003). But rather than becoming a topic for research, the question of how novel gender mainstreaming is has become a ques- tion of political marketing, designed to ‘sell’ change through the means of action by emphasising a break with the past. It is this mythology of novelty linked to gender mainstreaming that has gone through a rheto- ric of modernism, seen as representing an image of effectiveness and efficiency. The rhetoric of innovation and differentiation from existing political strategies seeks to produce a symbolic effect, that of a change in the image of gender equality policy, and as a result to attract a new polit- ical gaze. We can see this at the time of its emergence at the European level in the 1990s.
The principle of gender equality, and European economic and political integration
At the level of the EC, and then the EU, a political strategy for the pro- motion of gender equality based on equal treatment was established from the mid-1970s, and then complemented from the 1980s by the recognition of equal opportunities. This alliance was in turn comple- mented by the use of gender mainstreaming (Rees, 1998).
The principle of equal treatment at the European level was contained in Article 119 of the Treaty of Rome, adopted in 1957, on equal pay. This was then extended by the action of the Court of Justice of the EU (CJEU) in access to employment and social security. Equal treatment, as recognised and protected by the EU, was the object of ten directives and covered equal pay, access to employment, training and profes- sional advancement, working conditions, questions of social security, including professional regimes, for salaried and independent workers. However, the field of action for equal treatment was extended with the

signing of the Amsterdam Treaty and its Article 13 on anti-discrimination more generally. It was on the basis of this article that a new directive on equal treatment was voted in 2004, which extended this principle to the access and provision of goods and services. In addition to the lim- its to the economic domain, the impact of European directives was restricted by the resistance of member states in terms of the application of European legislative norms. The main limit lay in the risks of accumu- lated loss of content through the processes of transposing these norms.
At the European level, the 1976 directive on equal treatment was the first international text (even before the UN Convention on the Elimination of All Forms of Discrimination against Women [CEDAW] in 1979) to evoke the possibility of equal opportunities through positive actions. The development of equal opportunities as a complement to equal treatment only really emerged at the beginning of the 1980s how- ever. Programmes based on co-funding instruments for projects aiming to remove the obstacles to the participation of women in the labour market were established from 1982. As part of the European Social Fund (ESF) these action programmes allowed the EC to intervene in the pro- motion of equal opportunities in the supply and demand of employ- ment (training, professional retraining and the fight against professional segregation). Their presence also meant that the European Commission could enlarge this public policy area to questions such as home-based work, childcare, political representation, women’s health and sexual harassment, which are all beyond the legal scope of Article 119. The regulatory frame in terms of equal opportunities remained extremely restricted, however, in the 1980s and was limited to a Council recom- mendation from December 1984, ‘on the promotion of positive actions for women’. This text was limited to the labour market and remained cautious in its wording: the adoption of legislative instruments for the compensation of disadvantages faced by women was proposed to the member states but no precise model of implementation or example of a system of promotion was proposed, or even raised to the level of ‘good practice’. The Community Charter for Fundamental Social Rights of Workers adopted in 1989 (with the opt-out of the United Kingdom) was the first text to mention that equal opportunities for men and women had to be developed alongside equal treatment. Moreover, in the work programme related to the implementation of this Charter, the Commission explained that it ‘sees its task as ensuring that formal equality can become genuine equality.’3
Following the development of positive action measures over the course of the 1980s, 1992 marked a turning point in the formalisation of the

principle of equal opportunities at the European level. This was the year the Maastricht Treaty was signed, and the year of the vote on the health and safety of pregnant workers directive. The latter was the first legis- lative instrument that recognised the need to treat women differently from men in certain situations, in order to promote a more egalitarian result in terms of access to employment. It was thus a part of the logic of equal opportunities, considering women as a group benefiting from differential treatment in order to compensate for existing disadvantages. In parallel with this, the Maastricht Treaty included in Protocol no. 14 on social policy an ‘agreement on social policy’ which limited the action of the EC in the area of gender equality to equal treatment in work (and no longer simply equal pay, the only guarantee the Treaty had provided up until then), and above all equal opportunities in the labour market.4 This disposition, finally accepted by the UK, was integrated into the body of the Treaty and developed in Amsterdam in 1997. Article 141 (formerly Article 119) recognises in its fourth paragraph the possibil- ity for member states to set up positive action measures in the labour market in favour of what it calls the ‘underrepresented sex’. This step (the first part of which was accomplished at Maastricht) was important because it ran contrary to the liberal definition of gender equality as sim- ply equal treatment and affirmed the legitimacy of the principle of equal opportunities. Overall, positive actions, as they were implemented by the EC and then the EU (rather than as they were authorised or recom- mended), were generally seen as being less than satisfactory and having limited impact – or even as being counterproductive for some. Positive actions and the adoption of specific measures in favour of women have nonetheless benefited from renewed interest at the European level, with the proposed directive presented in 2012 by the European Commission on the presence of women on the boards of listed companies and public enterprises, which has an objective of having 40 per cent women.
As for the desire to promote equal impact in gender policy and gender
mainstreaming, these appeared for the first time in a European text in 1991,5 but were only really endorsed as a political strategy for the EU after the Beijing Conference in 1995. They were finally integrated into primary law in Amsterdam in 1997. The pivotal moment for the emer- gence of gender mainstreaming at the EU level was in the mid-1990s. Article 3.2 of the Amsterdam Treaty proposed a description of gender mainstreaming (although it did not use the expression) and validated the generalisation of this principle to all European policies. Although this disposition did not have direct effect, it can be seen as constitut- ing a ‘political cover’ for gender mainstreaming (Hafner-Burton and

Pollack, 2000). This approach is generally presented as an alternative to equal treatment and equal opportunities. Indeed, it provided a means of getting around the legislative and budgetary reticence of the member states. The end of the 1980s was a crisis period for the EC overall and for social policy in particular. All social policy suffered due to the lack of political will in national governments, the general drop in social spend- ing and the resistance of employers’ unions to any kind of social regula- tion. The 1989 adoption of the Community Charter on Fundamental Social Rights (which the UK did not participate in) in the form of a simple solemn declaration is symptomatic of this climate. This had a direct impact on gender equality policy and particularly affected the directives. The legislative initiative of the EC was weakened overall in this period. Following the UK’s veto, the Commission was obliged to withdraw its proposals on part-time work, the inversion of the burden of proof in matters of discrimination and parental leave. The legislative instrument particularly suffered and gender mainstreaming was part of the first soft law measures that were able to get around the legislative restrictions imposed by the member states. Compared to the reticence of the member states and the budgetary restrictions they imposed, gender mainstreaming had the advantage of being a measure which, a priori, did not require the allocation of a specific budget. This was in direct opposition to the consequences of directives and the functioning of positive actions. Thus gender mainstreaming corresponded (for the gen- der equality policy) to the broadly analysed development of European soft law, deregulation and new modes of governance (Beveridge, 2012; Boussaguet et al., 2011).
In order to further specify the different conceptualisations of the prin- ciple of gender equality (equal treatment, equal opportunities, gender mainstreaming) particular to the EU, it is interesting to make the connec- tion between these conceptualisations and the dynamics that drive the process of European integration. If we follow Fritz Scharpf (1999), the pro- cess of European economic integration is primarily driven by two com- plementary dynamics: market-making and market-correcting. The first is reflected in measures of negative integration and the second in measures of both negative and positive integration.
As far as gender equality is concerned, the dynamic of market- making is consistent with equal treatment. The establishment of mar- kets leads to the possibility of building rules to improve market flows. The insertion of Article 119 in the Treaty of Rome corresponds in part to this logic: it aims to harmonise pay systems for men and women and therefore the social costs for employers, in order to establish fairer

competition between member states. The liberal model of equal treat- ment is also behind the principle of direct effect developed by the Court of Justice and recognised as valid in the area of equal pay between men and women. The EC granted rights directly to the individual, without mediation by states being necessary. Economic actors are therefore free to benefit from these rights, regardless of national or sexual identities. Equal treatment and market-making are deeply, even ideologically, linked, based on the liberal theory that is founded on the unfettered freedom of agents. This guarantee of individual freedom is enforced by the law and by formal equality. Moreover, it was the predominance of this model which long blocked the recognition of equal opportunities at the European level. This model is indeed based on the free action of individual subjects, whereas equal opportunity is based on the recogni- tion of women as a group. The latter sees women as being collectively victims of discrimination, and seeks to implement temporary measures contravening equal treatment in favour of all women as a social group. With the market-correcting measures, we shift from the guarantee of rights to the application of rights, through direction or redirection of market forces. This dynamic corresponds to the equal opportunities strategy. Market-correcting carries the desire to have the political system intervene in order to correct the functioning of the market. The prin- ciple of equal opportunities can be considered as the result of interven- tionist measures aiming to improve the position of women in the labour market. We can consider the EC initiatives in maternity, childcare and sexual harassment as among the measures regulating working condi-
tions by accounting for indirect barriers to women’s employment.
Finally we can consider gender mainstreaming as a part of a third dynamic of social engineering. Gender mainstreaming is based on a sys- temic vision of society and public action. The objective is particularly broad; it aims to modify the social construction of masculine and femi- nine identities and the tasks, roles and functions that are attributed to each sex in public and private spheres, linked to constructed gender identities and the values that feed them. Social engineering aims to act on the internal borders of society, to redefine the limits between social groups, to restructure relations between the sexes and thus to eliminate hierarchical barriers that separate them in many areas (Hirdman, 1994; King, 2007). This is the same logic of social transformation – remodelling what feminist theory calls gender contracts – specific to each social system. More broadly, once the economic integration stage is passed, the focus turns to polity, to intervention on society itself through the political process.

There is a form of parallel between the stages of economic and then political integration in the EU and the types of public action instru- ments that have been successively implemented in the area of gender equality. The common feature is that they are all included within mar- ket logic.
What is European gender equality policy?
What does it mean to analyse gender equality policy at the European level? What are the thematic and analytical implications of the study of a public policy made up of interventions by European institutions in favour of equality between men and women?
The EU’s gender regime: between equality and the market
From a thematic point of view, intervention for the promotion of gen- der equality such as it developed at the European level is unique. For more than fifty years, gender equality policy was a part of the European social policy space – whether through the initial position of its reference article (Article 119, which became Article 141 and then Article 157 in the Treaty on the Functioning of the European Union [TFEU]), through its objectives or through its institutional creations. This means that it belongs to the area of social regulation, characteristic of the EC as a ‘regulatory state’ according to the definition of Giandomenico Majone (1996), although gender equality policy is remarkable for its relatively rapid implementation of redistribution from the beginning of the 1980s. It also means that it belongs to a specific type of social policy that only partially overlaps with national policies, to the extent that European social policy had to develop on the margins of national interventions in the social sphere, because of significant constraints, both budgetary and institutional. Finally, this means that in its very objectives, European social policy sets itself apart from national policies. If we follow Leibfried and Pierson (1995, p. 287), and take up the definition of the objectives of social policy provided by T. H. Marschall, then European social policy exists but it possesses a specific relationship with the market. Similarly, European gender equality policy does not contradict the characteristic of being very closely connected to the market building process, which is common to European social policy more generally.
In this context, it means that the gender regime of the EC, and then the EU, was itself characterised by a specific relationship with the market.6 The relationship with the market was a constituent of European gen- der equality policy, which developed within a political system founded

on economic liberalism with the initial objective of developing the free circulation of capital, goods, services and workers. Most of the feminist critiques emphasise the irresolvable dilemma of a policy to fight against inequalities in which the official discourse sets this priority below that of the search for competitiveness and economic growth. They also pinpoint the fact that the tools of this policy are based on the primacy of the market and are part of a neoliberal project that participates in increasing gender inequalities (Elman, 2007; Kantola, 2010b; Kantola and Squires, 2012). Yet it is this policy, enforced by the market, which has produced non-negligible (although often unexpected) results, including a relatively ambitious space for regulation as an alternative to that of the member states. From the mid-1990s, gender equality policy thus appeared to be an exception which contrasted with the meagre accomplishments of Social Europe (Leibfried and Pierson, 1996; Pierson, 1996). Certain studies, particularly those of Anna van der Vleuten (2005; 2007), have provided an analysis of the reasons for which the policy of promoting gender equality and often costly anti-discrimination legisla- tion in favour of women were able to develop in such an environment. However, rather than creating a binary opposition between the norm of the market on the one hand and the norm of gender equality on the other, it is more useful to think in terms of the articulations between the market and gender equality. Public policies in general, and those destined for the promotion of gender equality in particular, are charac- terised by their ‘contradictory injunctions’ regarding women (emanci- pation, institution, protection) (Commaille, 2001). However, one of the specificities of EU action in this area is its ability to avoid reasoning in terms of contradiction and opposition between these two norms of gen- der equality and the market. It is able to construct an atypical alliance between these two poles. The EU gender regime associates the norm of the market and the norm of gender equality more than it opposes them, bringing them together in a particular combination. This specific- ity corresponds to what Simon Hix noted in another area concerning the political orientation of the European political system. Its accom- plishments cannot be totally attributed to either the neoliberal camp or to that of social democracy: ‘neoliberalism meets the social market [. . .] and this has produced a particular regulatory regime’ (Hix, 2005,
p. 269). The idea of syncretism between economic liberalism and cul-
tural liberalism7 illustrates these ambiguities in gender equality policy. The EU is a system that awards a large place to economic liberalism but which in parallel recognises the values of cultural liberalism as key constituents and defends and promotes them. European public action

in terms of the promotion of gender equality is thus characterised by an original combination using the fight against sex-based discrimination for macroeconomic objectives on the one hand, along with an authen- tic concern for the protection of fundamental rights of those at risk of discrimination on the other.
It is therefore more fruitful to overcome what is ultimately only a super- ficial paradox between the norms of gender equality and the market. It is the evolution of the articulation between these two poles, and their relative equilibrium over time, that this book uses to shed light on the meaning of the transformations of European gender equality policy.
European public policy: between specificity and comparison
Working on European policy also has analytic implications. Following what has been called the ‘policy turn’ in European studies, a debate developed between European studies specialists and public policy spe- cialists on the question of the extent to which European policies are just like other policies, and therefore comparable with other types of public policies (Dehousse, 2014). Given the specificities mentioned above, can European gender equality policy be analysed like other social or gender equality policies, particularly at the national level?
European public policies, including interventions in social policy, undoubtedly have specific finalities but they also have specific modes of elaboration, decision and implementation. However, specific or atypi- cal does not mean incomparable. Rather than considering that a total contrariety exists between European and national public policies, we can instead see ‘European public policy as an area of experimentation for the transformations concerning a whole range of public policies’ (Hassenteufel and Surel, 2000). Indeed, the undeniable specificities in European policy (level of decision-making and multiple implementa- tions; dominance of regulation policies and juridification: lack of a central state actor; lack of a direct link between public policy and pub- lic representation; high level of technicality) can be seen as a trend which also exists in public policy at the national level. Seen in this way, European public policy does not appear to be irreducible to the theo- retical constructions of political science. Using the same methodologi- cal and analytical tools allows us to preserve the possibility of dialogue and compatibility between studies on European public action and those at other levels of political decision-making. European policies can also be seen as a laboratory, or even as a magnifying glass, through which to analyse gender transformations of public action in western societies. This is the path that this book will take.

Tracing the transformations of European gender equality policy
Whether from an analytical or methodological perspective, one of the objectives of this book consists in participating in what has been called the ‘sociological shift’ in European studies. It is part of a recent move in this research literature seeking to recognise the sociologi- cal approaches to the analysis of the European integration process (Favell and Guiraudon, 2010; Mérand and Saurugger, 2010). This complements the dominant institutional approach of the literature on European policy which has led to understating the role, the weight and the creativity of actors, but also their preferences and strategies (Woll and Jacquot, 2010).
Methodological remarks
The research for this book was conducted using a qualitative approach. It is based on a field study carried out in two phases, firstly between 2000 and 2006, and then in 2012 and 2013. This approach aimed to collect three types of source material: written, oral and budgetary.
The written sources were made up of primary and secondary docu- mentation. This empirical material represents a tremendous source of data that is essential in terms of analysis and also of considerable vol- ume. At the European level, the difficulty is not so much having access to documents but rather being able to exploit the massive amount of information available. Moreover, in a Community of Law, it is essen- tial to take legal norms (including jurisprudence) into account, as much because of what they prescribe as for the usages they generate (Dehousse, 1998). More precisely, as far as primary sources are concerned, the grey literature (brochures, guides, internal and external evaluations, binding and non-binding acts of institutions, verbatim of parliamentary hear- ings, etc.) of the European institutions was collected and analysed. This notably included administrative, parliamentary and expert reports and the specialised press (newsletters from NGOs active in the area of gender equality and from the European Parliament’s FEMM Committee in par- ticular, press releases from the European Commission and the Council). Two types of archives were also consulted: the archives of the docu- mentation centre of the Service des Droits des Femmes (Women’s Rights Service) in France, which brings together many documents relating to the preparation and implementation of the Beijing Conference. The per- sonal archives of a former member of the Equal Opportunities Unit at the European Commission were also consulted.

The oral sources were composed of a series of semi-directive inter- views with actors involved in the political process relating to gender equality at the European level since the mid-1970s. These interviews were conducted for informative and comprehensive purposes, in order to complement the data obtained from documentary sources, but also in order to be able to grasp the meaning these actors gave to their usages of Europe, their strategies, their preferences and their representations. Overall, 82 interviews were conducted. The list of participants can be found in the appendixes and reveals a strong initial finding: public action in favour of gender inequalities is considered a women’s question and the vast majority of those involved in its management are women. Budgetary data makes up the third type of source collected. This aspect of European public policy is rarely studied in a literature that focuses more on institutional aspects. If the conception of the EU as a ‘regulatory state’ (Majone, 1996) allows us to shed light on its func- tioning, the role of the allocation of resources is not entirely absent, including in terms of social regulation. The empirical work conducted in this area, that is in sorting through the annual budgets of the EC and then the EU, appearing in the Official Journal between 1974 and 2012, revealed numerous obstacles to the use of this budgetary data (lack of data desegregated by sex, co-funding, spreading of payments, changes in denomination of budgetary lines, need to correct raw data,8 etc.). Yet a systematic longitudinal and qualitative analysis of European funding in terms of gender equality is particularly powerful for revealing the changes that have occurred, and provides new perspective on the evolu-
tion of power relations and configurations of institutions and actors.
Finally, the data collected was analysed using the process tracing method and causal temporal sequences in order to best comprehend the transformations to the political process in terms of gender equality at the European level (Mahoney, 2012).
Structure of the book
The analysis of public action in favour of gender equality at the European level is divided into three major sequences. Each of these temporal sequences corresponds to a period of European gender equality policy and to a particular definition of the gender regime of the EC, then the EU. Chapter 2 thus presents the period between the signing of the Treaty of Rome (1957) and that of the Maastricht Treaty (1992). This first period is characterised by the exception model. In this model, women were seen as a separate category and the public treatment of inequalities took on specific legitimacy; the action of the EC was primarily regulatory and

limited to the sphere of employment and the labour market. In this period, the gender equality policy community was small and very mili- tant, and the institutional structures were few and strongly intercon- nected. Chapter 4 is centred on the next period, between the treaties of Maastricht and Lisbon (2007), which is characterised by the anti- discrimination model. In the context of this new model, women no longer had a special status compared to other minority social groups. Public action was generally incentivising and transversal in all areas of the EU’s action, and the actors and structures involved were multiple and diversified. Chapter 5 analyses the most recent period, since the Lisbon Treaty and the rights model that is currently under construction. This model corresponds to a reorientation of gender equality policy towards a policy more focused on the question of the protection of rights, in which women are above all envisaged as subjects of law suffering from discrimination. During this period public action was primarily focused on the legislative function, and the gender equality policy community pursued its process of professionalisation and normalisation, leading to a marginalisation of militant involvement. The institutional structures of gender equality were also subjected to a managerist movement into the justice sector.
For each of these three periods we have analysed the evolutions at work in terms of institutions responsible for the fight against gender inequalities, the individual and collective actors involved, and the ideas and the cognitive frame in terms of gender equality. To this we have added an awareness of the public action instruments in each period. Using the same structure in each chapter allows us to systematically compare the different variables at work in changes to European gender equality policy.
Alongside these chapters, studied from a diachronic perspective, Chapter 3 is specifically dedicated to gender mainstreaming, its emer- gence and its institutionalisation at the European level. Although this chapter is formally situated in the first half of the 1990s, its primary objective is to propose a detailed analysis of this new instrument for the integration of the gender dimension, and its role in accelerating and revealing the transformations that have occurred in European gen- der equality policy since then. In the area of public policy analysis, many studies have shown that change can occur as much, if not more, through public action instruments as it can through grand structures of meaning or exogenous institutional shocks (Hall, 1993; Streeck and Thelen, 2005).

Στις 16 Φεβρουαρίου 1966, 3000 εργαζόμενες στη βέλγικη εθνική κατασκευάστρια εταιρεία όπλων, Εθνικό Εργοστάσιο Πολεμικών Όπλων του Ομίλου Χέρσταλ, ξεκίνησαν απεργία, που διήρκησε 12 εβδομάδες. Το σύνθημά τους ήταν «ίσες αποδοχές για ίση εργασία!». Το κύριο αίτημα τους ήταν η εφαρμογή του άρθρου 119 της συνθήκης της Ρώμης σε εθνικό επίπεδο. Αυτό το άρθρο καθιερώνει την αρχή της ισότητας αποδοχών μεταξύ ανδρών και γυναικών στα έξι ιδρυτικά κράτη μέλη της Ευρωπαϊκής Κοινότητας (η ΕΚ).

I. Τι είναι η πολιτική για την ισότητα των φύλων
Οι πολιτικές για την ισότητα των φύλων είναι δημόσιες πολιτικές, των οποίων o πρωταρχικός στόχος είναι η μάχη κατά της ανισότητας των φύλων και η προώθηση της ισότητας μεταξύ γυναικών και ανδρών. Επίσης, συχνά περιγράφεται πολιτική των φύλων ή φεμινιστική πολιτική (Kantola, 2010c; Mazur, 2002). Οι πολιτικές για την ισότητα των φύλων μπορούν να διακριθούν από τις πολιτικές των δικαιωμάτων ή για την προαγωγή των δικαιωμάτων (Baudot and Revillard, 2014), όπως και από τις πολιτικές καταπολέμησης των διακρίσεων (Geddes and Guiraudon, 2004). Οι πολιτικές για την ισότητα των φύλων παρουσιάζουν πολλές διαφορετικές μορφές και αξιοποιούνται σε πολυάριθμους τομείς (σχετικά με τα δικαιώματα, την πολιτική εκπροσώπηση, την ισότητα στο χώρο εργασίας, την ισορροπία ανάμεσα στην επαγγελματική και οικογενειακή ζωή, τη βία, κλπ). Εξ ορισμού, το φύλο επισκοπεί όλες τις πλευρές της πολιτικής διαδικασίας (από την επεξεργασία μέχρι την εφαρμογή) και όλους τους τομείς των κρατικών πολιτικών (τον προϋπολογισμό, την υγεία, τη διατήρηση της ειρήνης, το άσυλο, τη συνταξιοδότηση, κλπ). Οι πολιτικές για την ισότητα των φύλων αποτελούν έμφυτη πρόκληση για την κατάτμηση των δημόσιων δράσεων και αμφισβητούν τους παραδοσιακούς τρόπους αντιμετώπισης των δημόσιων προβλημάτων (Jacquot and Mazur, 2010). Με αποτέλεσμα, αυτές οι πολιτικές να έχουν συγκεκριμένη ερευνητική αξία για την κατανόηση των σύγχρονων αλλαγών στη δημόσια δράση.
Α. Οι διαφορετικές αντιλήψεις για την αρχή της ισότητας των φύλων
Προκειμένου να εξετάσουμε την ευρωπαϊκή πολιτική για την ισότητα των φύλων πρέπει πρώτα να κατανοήσουμε το εύρος των πιθανών εννοιών, οι οποίες προβλέπονται στη θεωρία για την ισότητα των φύλων. Η διαφορετικές ερμηνείες αυτής της αρχής έχει οδηγήσει σε διαφορετικές πολιτικές στρατηγικές (Squires, 2007). Οι τρεις κύριες εκδηλώσεις αυτής της αρχής είναι: ίση αντιμετώπιση, η οποία βασίζεται στην αρχή των ίσων δικαιωμάτων και υλοποιείται μέσω της νομοθεσίας. Ίσες ευκαιρίες, οι οποίες βασίζονται στην ιδέα της διαφοροποίησης και ενσαρκώνονται πολιτικά μέσα από τα μέτρα θετικής δράσης ή θετικής διάκρισης. Οι περισσότερες φεμινιστικές αναλύσεις συμφωνούν, ότι όπως ένα «σκαμνί με τρία πόδια» (Booth and Bennett, 2002)η πολιτική για την ισότητα των φύλων μπορεί να καταπιάνεται με τους στόχους της, αν είναι σταθερή και επιτυγχάνει την ισορροπία ανάμεσα σε αυτές τις τρεις ενσαρκώσεις της αρχής της ισότητας των φύλων (βλέπε Πίνακα 1.1).

ώστε να διορθωθούν οι ανισότητες στα δικαστικά και ρυθμιστικά συστήματα, τα οποία αντανακλούν αξίες, που ως επί το πλείστον δεν είναι πλέον αποδεκτές από την κοινωνία. Με αποτέλεσμα αυτή η στρατηγική να βασίζεται σε μεγάλο βαθμό στους νομοθέτες και στις εξελίξεις της νομολογίας. Αλλά βασίζεται, επίσης στο βαθμό εφαρμογής των νέων κανόνων και άρα εξαρτάται από την εκ των προτέρων καλή θέληση του κράτους και των θεσμικών οργάνων του να εφαρμόσουν τους δικαστικούς κανόνες κι εν συνεχεία στην καλή θέληση των Δικαστηρίων και της κινητοποίησης των οργανώσεων για τα συμφέροντα των γυναικών. Αυτός ο μηχανισμός, πράγματι, αποδίδει μια σημαντική θέση στην κινητοποίηση και στη συλλογική δράση των εναγόντων, ώστε να εξελίξουν την νομολογία περαιτέρω, ωστόσο οι εθνικές δομές της συλλογικής κινητοποίησης, που συνδέονται με αυτού του είδους τη δραστηριότητα κατέχουν διαφορετικά χαρακτηριστικά (οργανωτικές δομές, δεσμοί με το κράτος και το κράτος φεμινισμού, εύρος νομικών συλλογικών δράσεων, κλπ) και ως αποτέλεσμα έχουν έναν απρόβλεπτο αντίκτυπο (Caporaso and Jupille, 2001; Jacquot and Vitale, 2014). Η ισότητα νομικά, η οποία είναι απαραίτητη για τη διόρθωση των πιο κατάφορων άμεσων ανισοτήτων δεν αντιμετωπίζει, επομένως, το κενό μεταξύ των ίσων δικαιωμάτων και της ισότητας στην πραγματικότητα και μπορεί να αφήσει ένα κενό ανάμεσα στην εφαρμογή και την επίσημη πλευρά του νόμου.
Αυτή η συγκεκριμένη αδυναμία αντιμετώπισης του κενού ανάμεσα στους κανόνες και την πραγματικότητα οδήγησε στην αρχή των ίσων ευκαιριών βασισμένη στην ιδέα της διαφορετικότητας. Η πολιτική στρατηγική εδώ αποτελείται από την καταπολέμηση των πραγματικών διακρίσεων μέσω των νόμιμων διακρίσεων, δημιουργώντας νόμιμες ανισότητες, που αντιμάχονται πραγματικές ανισότητες. Αυτή η στρατηγική σχεδιάστηκε για να αποκαταστήσει τις διαφορές ανάμεσα στις ομάδες, για να αποζημιώσει για τις συνέπειες της ιστορίας και εκφράζεται μέσα από τα μέτρα θετικής δράσης ή τα μέτρα θετικών διακρίσεων. Τα μέτρα θετικής δράσης συμβαδίζουν με τις προσωρινές παρεκκλίσεις από τον θεμελιώδη νόμο καταπολέμησης των διακρίσεων, ώστε να αποζημιώσουν για τις υπάρχουσες ανισότητες, οι οποίες περιορίζουν τις δυνατότητες των γυναικών σε συγκεκριμένους τομείς. Είναι ενσωματωμένα σε χρηματοδοτικά προγράμματα (επιδοτήσεις, επιστροφή φόρου, κλπ), εκπαίδευση κυρίως για γυναίκες και γενικά σε τομείς, που ασχολούνται με την πρόσβαση στην εργασία, τη μόρφωση και την επιχειρηματικότητα. Τα μέτρα θετικής διάκρισης αποτελούν μια πιο φιλόδοξη μορφή θετικής δράσης και εξασφαλίζουν την ισότιμη πρόσβαση των γυναικών (αν είναι αναγκαίο μέσω ποσοστώσεων), ιδίως όσον αφορά την εργασία και την καριέρα. Γενικά, αυτοί είναι μηχανισμοί σχεδιασμένοι να αυξήσουν τη συμμετοχή μειονεκτουσών ομάδων. Η διαχείριση αυτών των μέτρων, από την δεκαετία του 1960 μέχρι τη δεκαετία του 1980, αποδόθηκε από κράτη μέλη σε δομές σε συγκεκριμένους τομείς κι η ευθύνη δόθηκε, είτε σε μη ειδικευμένους φορείς στο πλαίσιο της γραφειοκρατίας, ή σε εξωτερικούς εμπειρογνώμονες του τομέα (Mazur and McBride Stetson, 1995, 2010). Ωστόσο, η αρχή των ίσων ευκαιριών παραμένει στο περιθώριο στα πλαίσια της πολιτικής διαδικασίας και είναι πολύ περιορισμένη όσον αφορά τους σχετικούς πολιτικούς τομείς. Ως εκ τούτου, δεν είναι σε θέση να ανταποκριθεί στις πολλαπλές διαστάσεις της ανισότητας.
Η ανάπτυξη της έννοιας του φύλου έχει ελκύσει την προσοχή των κοινωνικών επιστημών στην κοινωνική δομή των ανισοτήτων και στις σχέσεις ισχύος, που εμπλέκονται σε αυτή τη διαδικασία. Έχει αναπτυχθεί ένα ολόκληρο κίνημα επαναπροσδιορισμού και εξέτασης των παραδοσιακών προσεγγίσεων και εννοιών. Ενώ το κλασσικό δίπτυχο ισότητας/ διαφορετικότητας μας επιτρέπει να αναλύουμε μόνο τις συνέπειες των διαφορών ανάμεσα στα φύλα (πρέπει οι γυναίκες να αντιμετωπίζονται διαφορετικά ή το ίδιο με τους άντρες;), η προσέγγιση του φύλου αμφισβητεί τους λόγους, για τους οποίους αυτή η διαφορά έφτασε να αποκτήσει τέτοια σπουδαιότητα ως δομικός παράγοντας στις κοινωνικές σχέσεις υποταγής. Η ισότητα και η διαφορετικότητα μας επιτρέπουν να αντιμετωπίζουμε το πρόβλημα των ανισοτήτων μόνο εκ των υστέρων. Επιπλέον, οι εν λόγω προοπτικές ανάλυσης επικεντρώνονται μόνο στις γυναίκες, αφού θεωρούνται «άλλη» κατηγορία σε σχέση με το αντρικό πρότυπο. Δεν εξετάζουν τις σχέσεις μεταξύ ανδρών και γυναικών ως κοινωνική σχέση ισχύος. Ούτε τις αμφισβητούν ως εννοιολογική σχέση, το οποίο σημαίνει ότι μόνο οι γυναίκες είναι υπεύθυνες για την επίλυση των ανισοτήτων, τόσο ατομικά όσο κι ως ομάδα.
Η έννοια του φύλου παρέχει μια εναλλακτική προσέγγιση, επιχειρώντας να κατανοήσει και να αποδομήσει τους λόγους της αντρικής κυριαρχίας. Θεωρώντας ότι η δύναμη των διακρίσεων είναι δομική κι ότι απορρέει από την θεσμοποίηση των ιεραρχικών σχέσεων μεταξύ ανδρών και γυναικών έχει δύο κύριες επιπτώσεις. Πρώτον, σημαίνει ότι οι διαφορές λόγω φύλου δεν μπορούν να θεωρούνται πλέον αποκλειστικά γυναικείο πρόβλημα. Η ιστορία των κοινωνικών σχέσεων έχει οδηγήσει σε θεσμούς και φορείς, οι οποίοι αναπαράγουν ανισότητες. Επίσης, λαμβάνοντας υπόψη τις ανισότητες από μια δομική προοπτική σημαίνει ότι λαμβάνονται υπόψη τόσο η αιτία όσο και η λύση. Το πρώτο, διότι οι πολιτικές συμμετέχουν στην κατασκευή και ειδικά στη διαιώνιση των δομικών εμποδίων και μειονεκτημάτων και το δεύτερο, διότι οι πολιτικές δρουν επίσης στις ίδιες δομές και μπορούν να διαπραγματευτούν ανάμεσα στα τόσο μπερδεμένα κουβάρια της ισότητας και της διαφορετικότητας. Το θέμα του φύλου έκανε ικανή τη σύλληψη και τον ορισμό ενός τελικού στόχου με τη μορφή της ισότητας μεταξύ γυναικών και ανδρών, διατηρώντας την συμπληρωματικότητα μεταξύ της διαφορετικότητας και της ισότητας των δικαιωμάτων, ενώ παράλληλα τις υπερβαίνει. Οι σχέσεις κυριαρχίας, συνεπώς και οι ανισότητες μεταξύ των φύλων, είναι δομημένες και ενταγμένες σε κοινωνικές δομές κατά κύριο λόγο. Καθώς η κυριαρχία βασισμένη στο φύλο είναι συστημική, πράγματι είναι ολόκληρο το σύστημα, το οποίο πρέπει να ληφθεί υπόψη κατά την αντιμετώπιση αυτών των ανισοτήτων. Στη βάση αυτή εμφανίστηκε η ενσωμάτωση των φύλων ως το τρίτο είδος πολιτικής στρατηγικής, η οποία προκύπτει από την αρχή της ίσης αντιμετώπισης. Σκοπός ήταν να διευρυνθεί το εύρος των πιθανών δράσεων, ενσωματώνοντας συστηματικά ζητήματα συνδεδεμένα με το φύλο σε όλους τους φορείς και πολιτικούς τομείς. Από αυτή την άποψη, «η αντιμετώπιση των ανισοτήτων δεν έχει να κάνει πλέον με την ανακάλυψη της σωστής πολιτικής, αλλά με την διασφάλιση ότι όλες οι πολιτικές είναι σωστές» (Beveridge et al., 2000, p. 278). Επικεντρώνοντας την δράση στην πολιτική διαδικασία το κύριο χαρακτηριστικό αυτής της στρατηγικής είναι η οριζόντια παρέμβασή της, η οποία εντοπίζει τις πιθανές συνέπειες αυτών των πολιτικών και των πολιτικών επιλογών για το φύλο. Η οριζόντια υλοποίηση, επομένως, είναι η κύρια ιδιότητα της ενσωμάτωσης των φύλων. Δίνοντας προσοχή σε όλες τις πολιτικές καθίσταται δυνατή η συμπερίληψη της ιδιωτικής σφαίρας στο σχέδιο δημόσιας δράσης (η αναγνώριση της άνισης κατανομής των οικογενειακών υποχρεώσεων ή η σεξουαλική παρενόχληση στην πολιτική απασχόλησης, για παράδειγμα). Από την οριζόντια δράση απορρέουν οι άλλες ιδιαιτερότητες της ενσωμάτωσης των φύλων σε σύγκριση με τις άλλες δύο πολιτικές στρατηγικές. Το γεγονός ότι δίνεται συστηματικά προσοχή στο φύλο σε κάθε πολιτικό τομέα, με όλους τους τομείς της δημόσιας δράσης να συμμετέχουν, σημαίνει ότι οι φορείς της ενσωμάτωσης των φύλων είναι συνήθεις φορείς, οι οποίοι είναι υπεύθυνοι για αυτούς τους τομείς. Οι ειδικοί για την ισότητα των φύλων παρεμβαίνουν περισσότερο για τον συντονισμό της διαδικασίας ή για συγκεκριμένες αποστολές υποστήριξης. Επιπλέον, οριζόντιος σημαίνει, επίσης, διαδοχικός. Η ενσωμάτωση των φύλων οφείλει να παρεμβαίνει κατά τη διάρκεια της πολιτικής διαδικασίας. Από αυτή την πλευρά, η παρέμβαση ήδη από τον ορισμό και την σύλληψη των πολιτικών, επιτρέπει στην πολιτική αυτή να αποφεύγει απλώς την εκ των υστέρων επίδρασή της. Αντιθέτως, είναι σε θέση να τροποποιήσει μια πρόταση, που θεωρείται ότι έχει αρνητικές επιπτώσεις στις σχέσεις μεταξύ των δύο φύλων. Η οριζόντια υλοποίηση στην πολιτική διαδικασία είναι, επομένως, απαραίτητη προϋπόθεση για την προληπτική δράση, η οποία είναι ικανή να αντιμετωπίσει τις ρίζες των ανισοτήτων. Ωστόσο, η οριζόντια υλοποίηση είναι, επίσης, η πηγή του κύριου περιορισμού, η οποία σχετίζεται με την στρατηγική της ενσωμάτωσης των φύλων: η μείωση των πόρων. Η απόλυτα ενσωματωμένη δράση δεν απαιτεί, εξ ορισμού, τον καταμερισμό συγκεκριμένων πόρων, δομών και προσωπικού.
Αυτές οι τρεις συλλήψεις εννοιών της αρχής της ισότητας των φύλων μπορούν να τοποθετηθούν ιστορικά στη συσχέτιση ανάμεσα στη φεμινιστική σκέψη και δράση από τη μια μεριά και στην εξέλιξη των πολιτικών στρατηγικών από την άλλη. Το πρώτο είδος πολιτικής στρατηγικής, αυτός της ισότητας ενώπιον του νόμου, βασίζεται στη φιλελεύθερη αντίληψη της αρχής της ισότητας και είναι συνυφασμένη με τις απαιτήσεις των φεμινιστών του πρώτου κύματος. Παρουσιάστηκε πραγματικά στις δυτικές δημοκρατίες από τις αρχές της δεκαετίας του 1960. Οι ίσες ευκαιρίες και οι θετικές δράσεις συνδέονται με την χρήση της έννοιας της διαφοράς από τους φεμινιστές του δεύτερου κύματος, κατά τη διατύπωση της θεωρία για την συγκεκριμένη εκμετάλλευση των γυναικών και την επιβεβαίωση αυτής της διαφοράς από τους φεμινιστές του δεύτερου κύματος. Για παράδειγμα, παρόλο που ο καπιταλισμός καταπιέζει και τους άντρες και τις γυναίκες, δεν τους καταπιέζει με το ίδιο τρόπο. Οι γυναίκες γίνονται θύματα εκμετάλλευσης στις επαγγελματικές σχέσεις και στην ιδιωτική ζωή. Αυτή η δεύτερη στρατηγική ξεκίνησε να αναπτύσσεται στο τέλος της δεκαετίας του 1970. Αυτή η τρίτη στρατηγική, η ενσωμάτωση των φύλων, εμφανίστηκε περίπου μια δεκαετία αργότερα και αντανακλά την διάδοση της έννοιας του φύλου.
Παρόλο που είναι δυνατό να αναγνωριστούν «γενιές» από προσεγγίσεις της ισότητας των φύλων, δεν μπορούν να θεωρηθούν διαδοχικά στάδια, αφού μπορούν να συνυπάρξουν ως πολιτικές στρατηγικές. Μέσα σε ένα ενιαίο πολιτικό σύστημα, η πολιτική της ισότητας των φύλων θα μπορούσε να αποτελείται από την υπέρθεση ή την παράλληλη ανάπτυξη των τριών ειδών δράσης. Αναφερόμαστε στη διαδοχή στο βαθμό, κατά τον οποίο κάθε νέα ένδειξη της αρχής της ισότητας των φύλων είναι το αποτέλεσμα, σε θεωρητικό και πρακτικό επίπεδο, δυσαρέσκειας με το προηγούμενο είδος, την εξέλιξη της έρευνας και τα διδάγματα, που αντλούνται από την πείρα. Ωστόσο, κάθε νέα γενιά δεν αποτελεί αντικατάσταση ή υποκατάστατο. Κάθε σύλληψη έννοιας της αρχής της ισότητας των φύλων θεωρείται συμπληρωματική και συνέχιση των προηγούμενων. Παρά την εννοιολογική συνέχεια, η ενσωμάτωση των φύλων παρουσιάζεται συχνά ως «άλλη» προσέγγιση, μια νέα προσέγγιση, πηγή αλλαγής (Mazey, 2001; Schmidt, 2005; Woodward, 2003). Όμως, αντί να γίνει θέμα έρευνας, το ερώτημα του πως είναι η νέα ενσωμάτωση των φύλων, έχει γίνει ένα ζήτημα πολιτικού μάρκετιγκ, σχεδιασμένη να «πουλάει» αλλαγή μέσω της δράσης, δίνοντας έμφαση σε μια αποκοπή από το παρελθόν. Η μυθολογία της καινοτομίας έχει συνδεθεί με την ενσωμάτωση των φύλων, υφίσταται την ρητορική του μοντερνισμού και θεωρείται αντιπροσωπευτική εικόνα της αποτελεσματικότητας και της αποδοτικότητας. Η ρητορική της καινοτομίας και της διαφοροποίησης από τις υπάρχουσες πολιτικές στρατηγικές αναζητά τη δημιουργία ενός συμβολικού αποτελέσματος, αυτό της αλλαγής στην εικόνα για την πολιτική της ισότητας των φύλων, κι ως εκ τούτου να προσελκύσει μια νέα πολιτική ματιά. Αυτό μπορούμε να το παρατηρήσουμε τη στιγμή της δημιουργίας του σε ευρωπαϊκό επίπεδο τη δεκαετία του 1990.
Β. Η αρχή της ισότητας των φύλων και η ευρωπαϊκή οικονομική και πολιτική ενσωμάτωση
Στο επίπεδο της Ε.Κ. και εν συνεχεία της Ε.Ε. μια πολιτική στρατηγική για την προώθηση της ισότητας των φύλων βασισμένη στην ίση αντιμετώπιση καθιερώθηκε από τα μέσα της δεκαετίας του 1970 και έπειτα συμπληρώθηκε από τη δεκαετία του 1980 από την αναγνώριση των ίσων ευκαιριών. Αυτή η συνεργασία με τη σειρά της συμπληρώθηκε από τον παράγοντα της ισότητας των φύλων (Rees, 1998).
Η αρχή της ισότητας των φύλων σε ευρωπαϊκό επίπεδο έχει συμπεριληφθεί στο άρθρο 119 της συνθήκης της Ρώμης, η οποία θεσπίστηκε το 1957 σχετικά με την ισότητα αποδοχών. Αυτή μετά προεκτάθηκε με την πράξη του Ευρωπαϊκού Δικαστηρίου για την πρόσβαση στην απασχόληση και την κοινωνική ασφάλιση. Η ίση αντιμετώπιση, όπως αναγνωρίστηκε και προασπίστηκε από την Ε.Ε., ήταν το αντικείμενο δέκα οδηγιών και κάλυπταν την ισότητα αποδοχών, την πρόσβαση στην απασχόληση, την κατάρτιση και την επαγγελματική ανέλιξη, τις συνθήκες εργασίας, ζητήματα κοινωνικής ασφάλισης, συμπεριλαμβανομένου του επαγγελματικού καθεστώτος για μισθωτούς και ανεξάρτητους εργαζόμενους. Ωστόσο, οι τομείς δράσης για την ίση μεταχείριση διευρύνθηκαν με την υπογραφή της συνθήκης του Άμστερνταμ και συγκεκριμένα του άρθρου 13 της συνθήκης για την καταπολέμηση των διακρίσεων γενικότερα. Με βάση αυτό το άρθρο ψηφίστηκε το 2004 νέα οδηγία για την ίση αντιμετώπιση, η οποία διεύρυνε την εν λόγω αρχή με την πρόσβαση και την παροχή αγαθών και υπηρεσιών. Επιπρόσθετα στους περιορισμούς στον οικονομικό τομέα, ο αντίκτυπος των ευρωπαϊκών οδηγιών περιορίστηκε με την αντίσταση των κρατών μελών αναφορικά με την εφαρμογή των ευρωπαϊκών νομοθετικών πρότυπων. Ο κύριος περιορισμός έγκειται στην πιθανότητα συσσωρευμένης απώλειας περιεχομένου μέσω των διαδικασιών μεταφοράς των εν λόγω πρότυπων.
Σε ευρωπαϊκό επίπεδο, η οδηγία του 1976 για την ίση αντιμετώπιση ήταν το πρώτο διεθνές κείμενο (ακόμα και πριν την σύμβασης των Ηνωμένων Εθνών για την εξάλειψη όλων των μορφών διακρίσεων κατά των γυναικών το 1979), το οποίο προτείνει τη δυνατότητα ίσων ευκαιριών μέσα από θετικές δράσεις. Η δημιουργία ίσων ευκαιριών συμπληρωματικά με την ίση μεταχείριση, παρόλο αυτά δεν εμφανίστηκε ουσιαστικά παρά μόνο στις αρχές της δεκαετίας του 1980. Προγράμματα βασισμένα σε όργανα συγχρηματοδότησης για έργα, τα οποία στοχεύουν στην άρση των εμποδίων για την συμμετοχή των γυναικών στην αγορά εργασίας θεσπίστηκαν από το 1982. Ως μέρος του Ευρωπαϊκού Κοινοτικού Ταμείου (ΕΚΤ) αυτά τα προγράμματα δράσης επέτρεψαν στην Ε.Κ. να επέμβει στην προώθηση των ίσων ευκαιριών κατά την προσφορά και την ζήτηση εργασίας (κατάρτιση, επαγγελματική επανακατάρτιση και την καταπολέμηση της επαγγελματικής απομόνωσης). Η παρουσία των προγραμμάτων σήμαινε, επίσης ότι η Ευρωπαϊκή Επιτροπή μπορούσε να διευρύνει τον τομέα των δημόσιων πολιτικών σε ζητήματα, όπως η εργασία κατ’ οίκον, υπηρεσίες παιδικής μέριμνας, πολιτική εκπροσώπηση, η υγεία των γυναικών και η σεξουαλική παρενόχληση, τα οποία βρίσκονται πέρα από την νομική ισχύ του άρθρου 119. Το κανονιστικό πλαίσιο αναφορικά με τις ίσες ευκαιρίες παρέμεινε ιδιαίτερα περιοριστικό, ωστόσο τη δεκαετία του 1980 περιορίστηκε με μια σύσταση του Συμβουλίου από τον Δεκέμβριο 1984, «για την προώθηση των θετικών δράσεων για τις γυναίκες». Αυτό το κείμενο περιορίστηκε στην αγορά εργασίας και παρέμεινε επιφυλακτικό στη διατύπωσή του: προτάθηκε στα κράτη μέλη η θέσπιση νομοθετικών πράξεων για την αντιστάθμιση των αδικιών, τις οποίες αντιμετώπισαν οι γυναίκες, αλλά δεν προτάθηκε συγκεκριμένος τρόπος εφαρμογής ή παράδειγμα ενός συστήματος προώθησης, και δεν τέθηκε καν υπό την μορφή «ορθής πρακτικής». Ο Κοινοτικός Χάρτης των Κοινωνικών Θεμελιωδών Δικαιωμάτων των Εργαζομένων θεσπίστηκε το 1989 (με εξαίρεση το Ηνωμένο Βασίλειο)ήταν η πρώτη νομοθετική πράξη, η οποία ανέφερε ότι οι ίσες ευκαιρίες για τους άντρες και τις γυναίκες έπρεπε να δημιουργηθούν παράλληλα με την ίση αντιμετώπιση. Επιπλέον, στα προγράμματα εργασίας, τα οποία σχετίζονται με την εφαρμογή αυτού του Χάρτη, η Επιτροπή εξήγησε ότι «βλέπει την αποστολή της ως εξασφάλιση για το γεγονός ότι η επίσημη ισότητα μπορεί να γίνει ουσιαστική ισότητα».
Μετά από την λήψη των μέτρων θετικών δράσεων κατά τη διάρκεια της δεκαετίας του 1980, το 1992 αποτέλεσε σημείο καμπής στην επισημοποίηση της αρχής της ισότητας των φύλων σε ευρωπαϊκό επίπεδο. Αυτή ήταν η χρονιά, κατά την οποία υπογράφηκε η συνθήκη του Μάαστριχτ κι η χρονιά της ψήφισης της οδηγίας για την υγεία και την ασφάλεια των εγκύων εργαζόμενων. Αυτή ήταν η πρώτη νομοθετική πράξη, η οποία αναγνώρισε την ανάγκη να αντιμετωπίζονται οι γυναίκες διαφορετικά από τους άντρες σε συγκεκριμένες περιπτώσεις, ώστε να προαχθεί ένα πιο ισότιμο αποτέλεσμα αναφορικά με την πρόσβαση στην απασχόληση. Επομένως, ήταν μέρος της λογικής για τις ίσες ευκαιρίες, λαμβάνοντας υπόψη ότι οι γυναίκες ως ομάδα επωφελούνται από την διαφορετική αντιμετώπιση, ώστε να αποζημιωθούν για τις υπάρχουσες αδικίες. Παράλληλα με αυτό, η συνθήκη του Μάαστριχτ περιείχε το πρωτόκολλο με αριθμό 14 για την κοινωνική πολιτική, μια «απόφαση για την κοινωνική πολιτική», η οποία περιόριζε την δράση της Ε.Κ. για τον τομέα της ισότητας των φύλων στην ίση αντιμετώπιση στον χώρο εργασίας (και πλέον όχι απλά ισότητα αποδοχών, η οποία ήταν η μόνη εγγύηση, που παρείχε η συνθήκη ως τότε) και προπαντός ίσες ευκαιρίες στην αγορά εργασίας. Αυτή η διάταξη, η οποία τελικά έγινε αποδεχτή από το Ηνωμένο Βασίλειο, ενσωματώθηκε στο σώμα της συνθήκης και διαμορφώθηκε στο Άμστερνταμ το 1997. Το άρθρο 141 (πρώην άρθρο 119) αναγνωρίζει στην τέταρτη παράγραφο τη δυνατότητα των κρατών μελών να σχεδιάσουν μέτρα θετικής δράσης στην αγορά εργασίας υπέρ αυτού, που αποκαλείται το «λιγότερο εκπροσωπούμενου φύλου». Αυτό το βήμα (το πρώτο μέρος, του οποίου ολοκληρώθηκε στο Μάαστριχτ) ήταν σημαντικό, καθώς ήταν αντίθετο στον ελεύθερο ορισμό της ισότητας των φύλων ως απλά ίσης αντιμετώπισης και επιβεβαίωνε τη νομιμότητα της αρχής των ίσων ευκαιριών. Συνολικά, οι θετικές δράσεις, όπως εφαρμόστηκαν από την ΕΚ και μετέπειτα από την Ε.Ε. (κι όχι όπως είχαν εγκριθεί ή προταθεί) δεν θεωρήθηκαν ικανοποιητικές κι είχαν περιορισμένο αντίκτυπο, σε κάποιες περιπτώσεις ήταν ακόμα και αντιπαραγωγικές. Οι θετικές δράσεις και η θέσπιση συγκεκριμένων μέτρων υπέρ των γυναικών έχουν ωστόσο, επωφεληθεί από το ανανεωμένο ενδιαφέρον σε ευρωπαϊκό επίπεδο με την προτεινόμενη οδηγία, η οποία παρουσιάστηκε το 2012 από την Ευρωπαϊκή Επιτροπή σχετικά με την παρουσία των γυναικών στα διοικητικά συμβούλια των εισηγμένων εταιρειών και των δημοσίων επιχειρήσεων, η οποία έχει στόχο οι γυναίκες να αποτελούν το 40 τοις εκατό.
Αναφορικά με την επιθυμία προώθησης της ίσης επίδρασης στην πολιτική των φύλων και στην ενσωμάτωση των φύλων, εμφανίστηκε πρώτη φορά σε ευρωπαϊκό κείμενο το 1991, αλλά εγκρίθηκε ως πολιτική στρατηγική για την Ε.Ε. μετά τη Διάσκεψη του Πεκίνου το 1995. Τελικά ενσωματώθηκαν στο πρωτογενές δίκαιο στο Άμστερνταμ το 1997. Η κομβική στιγμή για τη εμφάνιση της ενσωμάτωσης των φύλων σε ευρωπαϊκό επίπεδο ήταν στα μέσα της δεκαετίας του 1990. Το άρθρο 3.2 της συνθήκης του Άμστερνταμ πρότεινε την περιγραφή της ενσωμάτωσης των φύλων (παρόλο που δεν χρησιμοποίησε την έκφραση) και επικύρωσε τη γενίκευση αυτής της αρχής σε όλες τις ευρωπαϊκές πολιτικές. Παρόλο που αυτή η διάταξη δεν είχε άμεση επίδραση, μπορεί να θεωρηθεί ότι αποτέλεσε «πολιτική κάλυψη για την ενσωμάτωση των φύλων (Hafner-Burton and Pollack, 2000). Αυτή η προσέγγιση παρουσιάστηκε γενικά ως μια εναλλακτική λύση για την ίση μεταχείριση και τις ίσες ευκαιρίες. Πράγματι, παρείχε έναν τρόπο, ώστε να παρακάμπτεται η νομοθετική και δημοσιονομική διστακτικότητα των κρατών μελών. Στο τέλος της δεκαετίας του 1980 υπήρξε μια περίοδος κρίσης για την Ε.Κ. συνολικά και για την κοινωνική πολιτική συγκεκριμένα. Ολόκληρη η κοινωνική πολιτική επλήγη λόγω της έλλειψης πολιτικής βούλησης των εθνικών κυβερνήσεων, της γενικής μείωσης στις κοινωνικές δαπάνες κι της αντίδρασης των συνδικαλιστικών φορέων των εργαζομένων σε κάθε είδους κοινωνική ρύθμιση. Η θέσπιση του Κοινοτικού Χάρτη των Θεμελιωδών Κοινωνικών Δικαιωμάτων το 1989 (στην οποία το Ηνωμένο Βασίλειο δεν συμμετείχε) υπό τη μορφή απλής υπεύθυνης δήλωσης είναι χαρακτηριστικό αυτής της συγκυρίας. Αυτό είχε άμεσο αντίκτυπο στην πολιτική για την ισότητα των φύλων και συγκεκριμένα επηρέασε τις οδηγίες. Η νομοθετική πρωτοβουλία της Ε.Κ. αποδυναμώθηκε συνολικά σε αυτή την περίοδο. Μετά το βέτο του Ηνωμένου Βασιλείου, η Επιτροπή ήταν υποχρεωμένη να αποσύρει τις προτάσεις της για την εργασία μερικής απασχόλησης , την αντιστροφή του βάρους της απόδειξης σε θέματα διακρίσεων και γονικής άδειας. Συγκεκριμένα, η νομοθετική πράξη επλήγη και η ενσωμάτωση των φύλων ήταν μέρος των πρώτων μη δεσμευτικών μέτρων, τα οποία ήταν ικανά να παρακάμψουν τους νομοθετικούς περιορισμούς, οι οποίοι επιβλήθηκαν από τα κράτη μέλη. Συγκριτικά με την διστακτικότητα των κρατών μελών και των οικονομικών περιορισμών, τους οποίους αυτά επέβαλαν, η ενσωμάτωση των φύλων είχε το πλεονέκτημα να είναι ένα μέτρο, το οποίο εκ των προτέρων δεν απαιτούσε την κατανομή συγκεκριμένου προϋπολογισμού. Αυτό ήταν άμεση εναντίωση στα αποτελέσματα των οδηγιών και στη λειτουργία των θετικών δράσεων. Επομένως, η ενσωμάτωση των φύλων ανταποκρίθηκε (για την πολιτική ισότητας των φύλων) στην ευρέως αναλυμένη εξέλιξη των ευρωπαϊκών μη δεσμευτικών κανόνων δικαίου, στην κατάργηση των νομοθετικών ρυθμίσεων και στους νέους τρόπους διακυβέρνησης (Beveridge, 2012; Boussaguet et al., 2011).
Προκειμένου να προσδιοριστούν οι διαφορετικές αντιλήψεις της αρχής της ισότητας των φύλων (ίση αντιμετώπιση, ίσες ευκαιρίες, ενσωμάτωση των φύλων) ιδιαίτερα στην Ε.Ε., είναι ενδιαφέρον να γίνει η σύνδεση ανάμεσα σε αυτές τις αντιλήψεις και τις δυναμικές, οι οποίες οδηγούν τη διαδικασία της ευρωπαϊκής ενσωμάτωσης. Σύμφωνα με τον Φριτς Σαρπφ (1999), η διαδικασία της ευρωπαϊκής οικονομικής ενσωμάτωσης οδηγείται κυριως από δύο συμπληρωματικές δυναμικές: την ειδική διαπραγμάτευση και την βελτίωση της αγοράς. Η πρώτη αντανακλάται στα μέτρα της αρνητικής ενσωμάτωσης και η δεύτερη στα μέτρα τόσο της αρνητικής, όσο και της θετικής ενσωμάτωσης.
Όσον αφορά την ισότητα των φύλων, η δυναμική της ειδικής διαπραγμάτευσης είναι συνεπής με την ίση αντιμετώπιση. Η καθιέρωση των αγορών οδηγεί στην δυνατότητα δημιουργίας κανόνων για την βελτίωση της ροής των αγορών. Η ενσωμάτωση του άρθρου 119 στη συνθήκη της Ρώμης συμβαδίζει σε ένα μέρος με αυτή τη λογική: στοχεύει στην εναρμόνιση των συστημάτων αμοιβών για τους άντρες και τις γυναίκες, κι επομένως των κοινωνικών δαπανών για τους εργοδότες, ώστε να καθιερωθεί πιο θεμιτός ανταγωνισμός ανάμεσα στα κράτη μέλη. Το φιλελεύθερο μοντέλο της ίσης μεταχείρισης βρίσκεται, επίσης, πίσω από την αρχή του άμεσου αποτελέσματος, το οποίο δημιουργήθηκε από το Δικαστήριο και του οποίου η εγκυρότητα αναγνωρίστηκε στον τομέα των ίσων αποδοχών ανάμεσα στους άντρες και τις γυναίκες. Η Ε.Κ. παραχώρησε άμεσα τα δικαιώματα στα φυσικά πρόσωπα χωρίς να είναι απαραίτητη η μεσολάβηση των κρατών. Οι οικονομικοί φορείς μπορούν, συνεπώς, να επωφεληθούν από αυτά τα δικαιώματα ανεξαρτήτως εθνικής ή σεξουαλικής ταυτότητας.
Η ίση αντιμετώπιση και η ειδική διαπραγμάτευση είναι βαθιά, ακόμα και ιδεολογικά, συνδεδεμένες βάση της φιλελεύθερης θεωρίας, η οποία στηρίζεται στην απεριόριστη ελευθερία των φορέων. Αυτή η εγγύηση της ατομικής ελευθερίας επιβλήθηκε από τον νόμο κι από την τυπική ισότητα. Επιπλέον, η επικράτηση αυτού του μοντέλου εμπόδιζε για μεγάλο χρονικό διάστημα την αναγνώριση των ίσων ευκαιριών σε ευρωπαϊκό επίπεδο. Πράγματι, αυτό το μοντέλο βασίζεται στην ελεύθερη δράση μεμονωμένων ατόμων, ενώ οι ίσες ευκαιρίες βασίζονται στην αναγνώριση των γυναικών ως σύνολο. Αντιμετωπίζει τις γυναίκες συνολικά ως θύματα διακρίσεων και επιδιώκει την εφαρμογή προσωρινών μέτρων, τα οποία παραβιάζουν την ίση αντιμετώπιση υπέρ όλων των γυναικών ως κοινωνικής ομάδας.
Με τα μέτρα για την βελτίωση της αγοράς, μετακινούμαστε από την εγγύηση των δικαιωμάτων στην εφαρμογή των δικαιωμάτων μέσα από την κατεύθυνση ή την ανακατεύθυνση των δυνάμεων της αγοράς. Αυτή η δυναμική συμβαδίζει με την στρατηγική ίσων ευκαιριών. Η βελτίωση της αγοράς εκπληρώνει την επιθυμία της επέμβασης του πολιτικού συστήματος , ώστε να βελτιωθεί η λειτουργία της αγοράς. Η αρχή των ίσων ευκαιριών μπορεί να θεωρηθεί αποτέλεσμα των παρεμβατικών μέτρων, τα οποία στοχεύουν στην βελτίωση της θέσης των γυναικών στην αγορά εργασίας. Θεωρούμε τις πρωτοβουλίες της Ε.Κ. για τη μητρότητα, τις υπηρεσίες παιδικής μέριμνας και την σεξουαλική παρενόχληση- που θεωρούνται έμμεσα εμπόδια για την γυναικεία απασχόληση-κάποια από τα μέτρα, τα οποία ρυθμίζουν τις συνθήκες εργασίας.
Τέλος, μπορούμε να θεωρήσουμε την ενσωμάτωση των φύλων ως ένα μέρος μιας τρίτης δυναμικής κοινωνικής μηχανικής. Η ενσωμάτωση των φύλων βασίζεται σε ένα συστημικό όραμα της κοινωνίας και της δημόσιας δράσης. Ο στόχος είναι ιδιαίτερα ευρύς. Στοχεύει στην τροποποίηση της κοινωνικής δομής των αρσενικών και θηλυκών ταυτοτήτων και εργασιών, ρόλων και λειτουργιών, που αποδίδονται σε κάθε φύλο στην δημόσια και ιδιωτική σφαίρα και συνδέονται με δομημένες ταυτότητες φύλων και στις αξίες, που τις τροφοδοτούν. Η κοινωνική μηχανική στοχεύει στο να δράσει στα εσωτερικά σύνορα της κοινωνίας, να επαναπροσδιορίσει τα όρια ανάμεσα στις κοινωνικές ομάδες, να αναδομήσει τις σχέσεις ανάμεσα στα φύλα και επομένως να καταργήσει τα ιεραρχικά εμπόδια, τα οποία διαχωρίζουν τα φύλα σε πολλούς τομείς (Hirdman, 1994; King, 2007). Είναι η ίδια λογική της κοινωνικής αλλαγής, η αναδιαμόρφωση αυτού, που η φεμινιστική θεωρία ονομάζει συμβάσεις των φύλων, συγκεκριμένη σε κάθε κοινωνικό σύστημα. Γενικότερα, προχωρώντας από το στάδιο της οικονομικής ενσωμάτωσης, το επίκεντρο στρέφεται στην πολιτεία, στην επέμβαση στην ίδια την κοινωνία μέσω της πολιτικής διαδικασίας.
Υπάρχει ένα είδος παραλληλισμού ανάμεσα στα στάδια της οικονομικής και στη συνέχεια της πολιτικής ενσωμάτωσης στην Ε.Ε. και στα είδη των οργάνων της δημόσιας δράσης, τα οποία εφαρμόστηκαν επιτυχώς στον τομέα της ισότητας των φύλων. Το κοινό χαρακτηριστικό είναι ότι εντάσσονται όλα στην λογική της αγοράς.
