Source text - Italian Il futuro dell'Europa nell'Unione bancaria (e fiscale)
Tra luglio 2016 e maggio 2017 ho svolto i miei studi per redarre quella che poi è stata la mia tesi di laurea magistrale in giurisprudenza. Nelle prossime righe cercherò di sintetizzare, in modo quanto più sistematico possibile, le mie conclusioni ed intuizioni, quale risultato della mia ricerca.
Nel tentativo di ricomporre nel corso dello svolgimento di quel lavoro alcune delle vicende più significative che hanno segnato il mutamento dell'approccio alla risoluzione delle crisi bancarie nell'Unione europea ho cercato di condensare l'essenza delle problematiche passate e presenti che hanno determinato un progressivo inabissamento dello strumento degli aiuti di Stato a fronte della ricerca della stabilità sistemica e della riduzione del peso delle risoluzioni bancarie sui taxpayers.
Se, in tempi antecedenti la crisi, la regolamentazione aveva lo scopo precipuo di ridurre la probabilità di fallimento dei singoli intermediari finanziari, la reazione regolamentare alla crisi intesa soprattutto nel suo secondo stadio, ovvero quella dei debiti sovrani, ha aggiunto l'obiettivo ragguardevole di ridurne i costi sociali. Nell'intento di proteggere al contempo i contribuenti ed il mercato, la BRRD (Bank Recovery and Resolution Directive) ha determinato indirettamente una responsabilizzazione del risparmiatore, sempre meno garantito di fronte al baluardo di un mercato quanto più concorrenziale possibile, capace di decidere autonomamente, con chiara impronta liberista, l'uscita dei competitors meno efficienti. La ricostruzione dei meccanismi del bail-in in particolare, denota al di là dei tecnicismi quale la legislazione finanziaria europea ormai ci ha informato, che la nuova regolamentazione delle crisi degli intermediari finanziari è improntata sempre più verso obiettivi macro-prudenziali di gestione del rischio sistemico, a discapito della prospettiva micro-prudenziale di protezione del risparmiatore, in passato prevalente e indiscussa, soprattutto in Italia dove trova espressa tutela nell'art. 47 della Costituzione. Un caso isolato nel panorama europeo, fatta eccezione per il solo Portogallo, il quale però per ragioni storiche, vi giunse molto più tardi.
Per capire appieno la portata del bail-in forse bisognerà aspettare una sua applicazione più vicina e più invasiva (speriamo invero che però questo non accada) rispetto al burden sharing applicato in Italia con la risoluzione delle "quattro banche" in una commistione tra BRRD e la Comunicazione sul settore bancario del 2013. Quel che però è certo è come il periodo di transizione che si sta consumando ha delineato la necessità di una clientela retail sempre più informata. Nella categoria delle passività escluse dal bail-in convivono strumenti di raccolta diversi: alcuni che sono tipici dell'investitore al dettaglio ed altri di carattere prettamente finanziario. Altra criticità che è stata posta in evidenza poi dalle recenti crisi bancarie è stata l'erosione della fiducia tra risparmiatore e banca. Se durante la crisi l'erosione della fiducia ha riguardato maggiormente il mercato interbancario a seguito della crisi di liquidità degli intermediari, oggi questa si è spostata nel rapporto tra cittadino ed istituzione finanziaria: in particolar modo questo è ravvisabile in Italia con il pendente avvio degli arbitrati per il rimborso degli obbligazionisti subordinati delle "quattro banche", traditi dalle stesse istituzioni che dopo aver finanziato i progetti di questi, hanno svenduto loro obbligazioni subordinate per far fronte ad esigenze patrimoniali senza dover ricorrere ad onerosi aumenti di capitale, molti dei quali spesso anche falliti. L'erosione della fiducia tra cittadino ed istituzioni finanziarie non riguarda però solamente il rapporto con le banche, ammesso che le istituzioni europee svolgono (ed hanno svolto) per l'appunto un ruolo centrale nella gestione delle crisi stesse, il rapporto di fiducia con quelle si riflette irrimediabilmente anche su queste. E la crisi dell'Eurozona se da un lato ha proprio creato questa crisi di fiducia verso le istituzioni comunitarie e finanziarie, dall'altra, avendone messo in evidenza le carenze strutturali, propone un'occasione unica per portare avanti una maggiore integrazione europea al fine di attenuare i divari. L'Unione bancaria rappresenta questa grande ed irripetibile occasione. Se la crisi di fiducia nelle istituzioni comunitarie, espressasi nello spread dell'euroscetticismo è stata sostanzialmente dovuta all'inefficienza da parte di queste nel gestire la crisi economica e finanziaria perchè prive degli strumenti per governarla, con l'Unione bancaria non si può mancare l'appuntamento.
A completamento dell'Unione bancaria manca ancora un pilastro, forse il più difficile perchè richiede di mettere in comune fondi ingenti a tutela dei risparmiatori. Procedere all'istituzione dell'EDIS, lo European Deposit Insurance Scheme, quindi, oltre ad un grande passo verso il completamento dell'Unione bancaria, potrebbe rappresentare anche un importante segnale politico di coesione.
Inoltre, sempre la recente crisi bancarie italiane, dimostrano che le decisioni relative alla politica finanziaria europea sono condannate a restare questione controversa nel corso dei prossimi mesi e, probabilmente, anni. Un esempio è proprio il conflitto tra governo italiano e istituzioni europee nella gestione dei problemi finanziari del Monte dei Paschi di Siena, terza banca italiana per dimensioni. L'esecutivo italiano, si sta scontrando con la rigidità dei nuovi schemi della Banca centrale europea, accusata di eccessiva inflessibilità nella valutazione del buco patrimoniale della banca senese, per cui il Governo italiano vuole il salvataggio. Salvataggio che potrebbe avvenire sulla scorta dell’art. 32 della BRRD che esclude l’avvio della procedura di risoluzione (quindi anche l’applicabilità del bail-in) nell’eventualità in cui gli enti bancari solventi ricorrano a predeterminate forme di sostegno pubblico straordinario. Solvibilità riconosciuta a metà di aprile 2017 proprio dal responsabile della supervisione bancaria della Bce Danièle Nouy. Coerentemente alle prescrizioni disciplinari dettate dalla BRRD, il Monte Paschi di Siena, in data 23 dicembre 2016, a seguito del fallimento della complessa operazione di debt conversion volontaria in azioni delle obbligazioni subordinate, aveva deciso di presentare istanza per accedere alla misura della ricapitalizzazione precauzionale (espressamente contemplata nel decreto cd. “salva risparmio”). La ricapitalizzazione precauzionale avverrà attraverso un fondo di 20 miliardi di euro destinato alle ricapitalizzazioni cautelative e secondo le ultime indiscrezioni dovrebbe cominciare a maggio 2017. L'ultima parola spetta comunque, ancora una volta, alla Commissione europea.
Ciò che è certo è che la volontà dell'Italia di procedere all'erogazione di aiuti pubblici per salvare Monte dei Paschi, denota ancora una volta le contraddizioni strutturali del sistema finanziario europeo, tra cui il persistere del doom loop, cioè del rapporto simbiotico tra Stato e banca , evidenziando come l'Unione europea sia ancora lontana dall'aver dato una risposta definitiva, attraverso la nuova architettura normativa, alla risoluzione delle crisi bancarie. Il vero problema, infatti, è che il tenore del rischio finanziario differisce notevolmente tra gli Stati membri dell’UEM. E proprio la diversa gradazione del rischio nell'Eurozona rappresenta il maggiore ostacolo al completamento dell'Unione bancaria. Non a caso in questi ultimi mesi si è ripreso a parlare sempre più anche di Unione fiscale. Ecco allora che costruire una macchina fiscale ispirata a quella dei moderni stati federali potrebbe essere l'altra mossa vincente, la mossa che metterebbe definitivamente a tacere le derive "sovraniste", rappresentando la massima espressione dell'art. 222 del Trattato di Lisbona che sancisce come l'Unione debba essere informata ad uno spirito di solidarietà.
Ciò nonostante tanto la realizzazione dell'Unione fiscale quanto il completamento dell'Unione bancaria, che sono intrinsecamente collegate ed essenziali per la futura sopravvivenza dell'UEM, sono in bilico, poichè i negoziati sono momentaneamente bloccati su entrambi i fronti.
Innanzitutto, relativamente all'Unione bancaria, possiamo affermare che l'accentramento dei poteri di indirizzo e di decisione, attuato in materia di vigilanza e di risoluzione (primo e secondo pilastro), non ha determinato l'abolizione delle strutture nazionali, le quali invece sono state integrate nel nuovo sistema di risoluzione delle crisi bancarie. Infatti, come visto, nelle legislazioni nazionali persistono elementi non armonizzati come nel caso del fallimento e della tutela del diritto di proprietà delle parti coinvolte nelle risoluzioni. Inoltre il principio del no creditor worse off è condizionato dall'applicazione del bail-in il cui pecking order dei crediti interessati dalla condivisione degli oneri per la risoluzione rimane in parte diverso a secondo dello Stato membro. Queste problematiche non permettono all'Unione, ancora una volta, di garantire un sostanziale level playing field ed aumentano l'incertezza relativa all'applicazione del bail-in stesso. Proprio la mancanza di una mutualizzazione completa del costo delle risoluzioni determina in capo alle autorità preposte alla risoluzione difficili decisioni di carattere tecnico che devono bilanciare al contempo tutela dei risparmiatiori, degli intermediari e della stabilità finanziaria. Ciò pone due ulteriori problematiche. La prima riguarda la mancanza di un'idonea rete pubblica last resort che possa fronteggiare schock finanziari di carattere sistemico. Su questo punto si sta procedendo con il "pacchetto Dombrovksi" . Tra le varie modifiche alla nuova disciplina dettata dallo schema CRR/CRD/BRRD/SRMR, è previsto l'incremento della capacità di resilienza da parte delle banche in caso di gravi scenari di stress. Questo attraverso l'integrazione del requisito del TLAC nel MREL. Inoltre, l'altra misura, doveva essere quella di un back-stop fiscale che potesse in casi estremi salvare e liquidare le banche colpite dalla crisi ed eventualmente procedere ad una loro ricapitalizzazione . Questo strumento è poi diventato, dopo il cambio di rotta della Germania prima fortemente contraria, il Single Resolution Fund (SRF), con un fondo di risorse mutuabili che ammonta a 55 miliardi di euro e ancora non operativo in quanto si attende il termine delle tornate elettorali del 2017 e comunque, come detto a suo tempo, dovrebbe essere definitivamente ultimato nel 2023 . Il SRF che rappresenta il secondo pilastro dell'Unione bancaria dovrebbe dare una decisiva svolta nella risoluzione delle crisi future, in quanto renderà gli aiuti di Stato very very last resort (usando una formula già richiamata in precedenza). Sull'EDIS, invece, i progressi si sono arenati. Il quadro normativo attuale si limita all'accordo tra i sistemi di garanzia dei depositi nazionali i GDS, assicurando che tutti i depositi siano protetti fino a 100.000 euro. Ma nel caso di crisi sistemiche non sarebbero in grado di assolvere alla funzione pay box per tutti. La Germania in particolare continua ad essere contraria all'EDIS finchè non verrano portate a termine le operazioni di risanamento dei settori finanziari di quei Paesi, tra cui l'Italia, ancora alla prese con il problema della ristrutturazione delle proprie banche a causa dell'alta presenza di NPL. Secondo la Germania, infatti, il principale rischio è quello che l'EDIS potrebbe rendere vani gli impegni di ristrutturazione delle banche ancora sotto forte stress, diventando il mezzo per l'accesso a fonti sicure che potrebbero portare al tanto agognato moral hazard che la BRRD ha cercato di debellare. E' inoltre necessario prima il superamento dei rapporti tra banche centrali nazionali ed istituti di credito rappresentato da un massiccio acquisto di titoli di stato da parte di banche dello stesso Paese, è evidente che tale obiettivo non potrà essere raggiunto finché i governi nazionali fungeranno da fiscal backstop per il sistema di garanzia dei depositi. Pertanto è chiaro che al fine di concretizzare l'EDIS sarà necessario rispettivamente: ripristinare la stabilità finanziaria con gli attuali mezzi, completare la costituzione del SRF e, probabilmente, la creazione degli c.d. eurobond al fine di rendere sicuri e liquidi i titoli del debito dei vari Stati membri. Questo ovviamente non è possibile senza l'Unione fiscale.
L'Eurozona ha per troppi anni procrastinato l'appuntamento con la questione dell'un'unione fiscale, ma la crisi ha riaperto il dibattito. In particolare, come raccomandato in un autorevole studio del febbraio 2016 del think thank Bruegel sarebbero tre le direttrici che dovrebbero essere seguite per guidare l'Eurozona al di fuori della crisi. In primis l'Eurozona dovrebbe evitare di imporre aggiustamenti fiscali controproducenti sui Paesi in crisi. Per raggiugnere tale obiettivo la ristrutturzione del debito sovrano dovrebbe essere resa possbile attraverso l'ulteriore rafforzamento del settore bancario e all'estensione del mandato del Meccanismo di stabilità e di crescita (MSC). In secondo luogo la politica fiscale, in periodi sia positivi che negativi, dovrebbe essere gestita da un indipendente European fiscal board, mentre il Patto di stabilità e crescita, dovrebbe essere rigorasamente applicato in periodi di normalità economica. Naturlamente la cordinazione fiscale sarebbe proprio necessaria in quei periodi eccezionali in cui la BCE non sarebbe da sola in grado di provvedere alla stabilizzazione dell'eurozona. In terzo luogo, il Patto di stabilità e crescita dovrebbe essere applicato in modo maggiormente flessibile al ciclo economico, permettendo gli investimenti di spesa pubblica e di sostegno alla disoccupazione necessari, piuttosto che provvedere discrezionalmente come avvenuto negli ultimi anni.
Queste tre raccomandazioni lasciano presagire l'importanza della creazione di una struttura accentrata in grado di gestire la politica fiscale in modo coordinato, ma sopratutto proporzionato, al contempo flessibile, nei momenti di crisi, e rigoroso, nei momenti di stabilità finanziaria.
Tuttavia questo non potrà avvenire senza ulteriori concessioni di sovranità da parte degli Stati membri. La crisi ha dimostrato che una moneta comune senza una politica fiscale comune non è valida e accentua le disuguaglianze. Spostare l'area dell'euro in una federazione pienamente sviluppata richiederà moltissimi anni e potrebbe anche essere che questo non si si verifichi affatto. In ogni caso in questo momento storico coesistono una parziale Unione bancaria ed un'embrionale Unione fiscale. Completare l'Unione bancaria permetterà di consolidare il settore finanziario europeo, impedendo la ciclicità delle crisi e quindi attenuare il compito di resilienza e re-distributore della fiscalità, dando così slancio propulsivo all'Unione fiscale. Il completamento dell'Unione bancaria ed il progresso delle politiche fiscali secondo le direttrici precedentemente menzionate rappresentano, simbioticamente, il futuro dell'Eurozona.
Translation - English THE FUTURE OF THE EUROPEAN BANKING AND FISCAL UNION
Between July 2016 and May 2017 I carried out my studies in order to prepare what later became the thesis for my Masters Degree in Law. In the course of this essay I will try to summarise my conclusions and insights regarding the results of my research.
In an effort to conduct an analysis of some of the more significant events that marked the transformation in approaching solutions of the banking crisis in the EU, I have tried to abridge present and past problems that determined a progressive decrease of government aid while continuing the search of stability in view of reducing the burden of banking on the taxpayers.
Before the crisis, the primary intent of regulation was to reduce the probability of failure in financial intermediaries. The reaction to the crisis in its second stage, regarding sovereign debt, furthered the noteworthy objective of reducing social costs.
With the expressed aim of protecting both the public purse and the market, the BRRD (Bank recovery and Resolution Directive) indirectly conditioned the accountability of the investor, presently less assured in overcoming the obstacles of an increasingly competitive market. This was done via an implementation of a more independent capacity of decision, a clearly liberal approach that would determine the exclusion of less able competitors.
The renewal of bail-in methods in particular, demonstrate that the new technicalities in European financial legislation concerning new guidelines in aiding financial crisis have shifted towards a macro-prudential intent in managing the systematic risk at the expense of the micro-prudential prospect of financial protection of the investor. The latter in the past was more prevalent, particularly in Italy (its expressed tutelage is covered by art. 47 of the Italian Constitution). An isolated case in Europe, save for Portugal; a nation that arrived in that position later in time for historical reasons.
To fully comprehend the importance of the bail-in one must wait for a more aggressive usage of the process (indeed, with the hope that this does not happen) in respect to the burden sharing implemented in Italy which saw a resolution between the “four banks” and a merging between the BRRD and the Commission relative to Communication of the banking industry of 2013.
What is certain is how the transitional period in effect has highlighted the necessity of a more informed retail clientele. Whereas in the category of exempted liabilities there are a number of instruments of debt collection. Some are typical of the retail investor, others are of a purely financial nature. Another criticism highlighted by the recent banking crisis has been a breaking down of trust between the investor and the banking sector. If, during the crisis, this erosion of confidence mostly concerned the inter-bank market following the predicament of the liquidity of intermediaries, today this has shifted in the rapport between citizen and financial institution.
This is particularly noticeable in Italy with the pending start of the arbitration for the reimbursement of subordinate bondholders of the aforementioned “four banks”. These investors who have been misled by these same institutions, and who, after having financed the establishments’ financial projects ( many of these ventures having failed ), had to sell their shares to deal with asset requirements without resorting to burdensome capital increase.
The wearing down of trust between the ordinary citizen and financial organizations does not only concern the relationship with the banking system, with an acknowledgement that European institutions play a vital part in the management of these crises, the rapport of trust is irredeemably reflected on these institutions.
Though the crisis of the Eurozone actually created this distrust in both communitarian and economic institutions, at the same time, it highlighted the structural misgivings and has anticipated a unique option to conduct a greater European inclusion with objective of reducing the gaps.
The Banking Union represents this unrepeatable opportunity. If the disbelief regarding the communitarian establishment, conveyed by an increase in euro-scepticism was due to the inefficiency in managing the economic crisis, (also due to a lack of executive powers of administration) The Banking Union cannot miss this occasion.
To complete the Banking Union one more vital mainstay is needed though. This may prove difficult however as it requires a pooling of protected investor funds. The creation of the EDIS (European Deposit Insurance Scheme), apart from being a major step towards completion of an effective Banking Union, could also represent an important indication of political cohesion.
Moreover, the recent Italian banking crisis shows that the decisions regarding European financial policies are destined to remain a controversial issue for the next months if not years. An example of this is the animosity between the Italian government and European institutions in the management of the financial difficulties of the Monte Paschi di Siena, the third largest Italian bank. The Italian executive is going up against the rigidity of the new patterns advocated by the European Central Bank, which at various times has been accused of excessive inflexibility in its evaluation of the budget hole of the Tuscan bank, which the Italian government wants to rescue from bankruptcy.
This rescue operation could happen in accordance with art. 32of the BRRD that excludes the initiation of the procedure of resolution (therefore excluding the application of a bail-in) in the contingency in which solvent banks resort to a predetermined form of extraordinary public support.
These cases of solvency were recognised in mid-April 2017 by the president of the Supervisory board of the ECB Danièle Nouy. In accordance with the disciplinary requirements dictated by the BRRD, Monte Paschi di Siena on the 23rd of December 2016, following the failure of the complex and voluntary debt conversion of banking shares into subordinate bonds to undertake precautionary recapitalisation (covered by the “rescue saving” decree).
The precautionary recapitalisation would come about as a 20 billion Euro financial guarantee destined to prudential recapitalisation and, according to the latest indiscretions, should start taking place in May 2017. The final word on the matter is still, as usual, a prerogative of the European Commission.
What is certain is that the will of the Italian government to proceed to providing public aid to save the Monte dei Paschi bank, once again confirms the structural contradictions of the European financial system. For example, the continuation of the so called doom loop, the symbiotic relationship between State and bank, which emphasises how the EU is still far from agreeing on a definitive response, through the new means of regulatory architecture, on how to effectively solve the banking crises.
The real setback is that the level of financial risk varies significantly between member States of the EMU ( Economic and Monetary Union ). And it is this divergence of risk in the Eurozone that represents the main obstacle to completion of a unified banking system. It is no coincidence that in the previous months there has been more and more talk of a fiscal union.
In this respect, instituting a fiscal mechanism inspired by modern federal states could be an appealing feat, a feat that would put a lid on “sovereign” and thus, dividing currents. This move also best exemplifies art. 222 of the treaty of Lisbon, which states how the European Union must attain to a spirit of solidarity.
Nevertheless a realization of a fiscal Union or the completion of a banking Union, which are intrinsically linked and essential for the survival of the EMU, both are on the line, since negotiations are blocked on both fronts. First of all, regarding the banking Union, we can stipulate that the centralisation of powers of decision, implemented in matters of supervision and resolution ( the first and second pillar ), has not determined the abolition of state structures, which instead have been integrated in the new system of banking crises resolutions. In fact, as we have seen, elements with the distinction of being not properly integrated persist in many segments of national legislation, such as the failure of tutelage in discerning rights of property in the parties affected by the resolutions.
Furthermore the “no creditor worse off” principle is conditioned by the application of the bail-in whose “pecking order” is interested by onerous division of credit which again, varies between the different EU member states. These issues prevent the Union, once again, from guaranteeing a substantial level playing field and increase uncertainty comparative to the application of the bail-in itself.
The lack of mutual funds complete with decree costs could resolve, according to bodies of authority, the resolutions of difficult technical decisions that have to balance the tutelage of investors, intermediaries and financial stability.
This poses two more problems. The first regards the lack of a suitable public network of last resort which can challenge financial shocks of a systemic nature. Enter the Dombrovski package of reforms. Of the many modifications of the new regulation outlined by the CRR/CRD/BRRD/SRMR scheme, an increase in resilience of the banks in case of grave scenarios of stress has been envisaged. This will be done through the integration of the TLAC and MREL requisites. The second measure was supposed to entail a fiscal back-stop that could (in extreme cases) save banks hit by the crisis and eventually proceed to an eventual recapitalisation.
This instrument, after Germany’s abrupt change of course (as its government had been initially opposed), became the Single Resolution Fund (SRF), including a fund of reimbursable resources amounting to 55 billion Euros. This motion is still not active, at least not until the conclusion of the 2017 elections, and in any case would be only present in full effect (according to the latest estimates) in 2023. The SRF, in being the second most important pillar of the banking Union, represents a decisive breakthrough in resolving future crises.
However, progress in implementing the aforementioned EDIS has stagnated. The regulatory framework limits the agreements between systems of assurance relating to domestic deposits (GDS), assuring that all sums up to 100.000 Euros are protected. But, in the case of crises of past magnitude that would mean an unavailability of functioning pay-boxes for everyone. Germany in particular continues to oppose the EDIS motion until operations of financial reorganisation and consolidation are not thoroughly carried out in countries that like Italy are still in dealing with problems in restructuring their national banks also caused by an elevated NPL (Non Performing Loan) presence.
According to the German government the main risk is that an implementation of the EDIS would undo restructuring commitments of banks that are still under stress, becoming the medium of access to secure sources that could bring about much needed moral hazard that the BRRD had tried so hard to abolish.
In this case what is most needed is a large scale buyout of government bonds by national banks in order to overcome the breaking down in rapport between centralised national banks and other credit institutions. This objective will be very difficult to reach until national governments star acting as a fiscal backstop needed for the implementation of a deposit guarantee scheme. Consequently it is clear, in order to apply the EDIS it will be necessary to execute both a restoration of financial stability with the instruments at the EU’s disposal and to complete the constitution of the SRF as well as the creation of c.d. Eurobond with the expressed aim of securing and liquidating the debt security of member states. This is obviously impossible without a fiscal Union.
For too many years the Eurozone has procrastinated in its approach to fiscal Union, but the latest crises has reopened this debate. Particularly, as advocated by a study of the Think Thank Bruegel, dated February 2016, three directives should have been followed to guide the Eurozone out of the crisis.
Firstly the Eurozone should avoid imposing counterproductive fiscal adjustment on countries hit hardest by the crisis. To reach this goal the restructuring of sovereign debt should be achieved through additional strengthening of the banking sector and an extension of the mandate of the Stability and Growth Pact (SGP). Furthermore fiscal policies, in periods of both growth and decline, should be governed by an independent European Fiscal Board, while the SGP should be rigorously applied only in times of economic normality.
Naturally fiscal coordination should only be necessary in those exceptional time periods in which the ECB would not be able to provide economic stability of the Eurozone by itself. Lastly, the SGP should be applied in a more flexible manner regarding the economic cycle, permitting investments in public expenditure and sustaining necessary unemployment costs, instead of acting too discreetly and ineffectively as has been the case in the last years.
These three directives forecast the importance of creating a centralised structure capable of handling fiscal policies in a coordinated, proportional and flexible manner in times of crisis and in a thorough approach in moments of stability.
However this cannot happen without supplementary concessions of sovereignty of member states. The crisis has demonstrated how a common currency without a common fiscal policy is invalid, counterproductive and accentuates inequality. To transform the Eurozone into a fully developed federation will require many years if this happens at all. In any case in this historic moment both a partial banking Union and a fiscal Union at embryonic stage coexist. To complete an effective banking Union would bring about a consolidation of the European financial sector, impeding the cyclicality of crisis and mitigating the task of fiscal re-distribution providing impetus for the consolidation of the fiscal Union. While the completion of a banking Union and the progress of fiscal policies according these safeguarding directives symbiotically represent the future of the Eurozone.
