Source text - Arabic تسعى تونس إلى توسيع دائرة العقوبات البديلة للحد من اكتظاظ السجون وتمكين المحكومين بعقوبات سالبة للحرية من الحصول على
"عقوبات بديلة" تضمن إمكانية اندماجهم في المجتمع، من خلال استبدال أحكام السجن بالعمل للصالح العام، في انتظار تصديق
البرلمان على قانون جزائي جديد يعتبره المتخصصون في الشؤون القانونية نقلة نوعية في المنظومة الجزائية في البلاد .
وأخيراً، أعلنت وزارة العدل عن فتح مكاتب مصاحبة جديدة لتسهيل تعويض الأحكام السجنية بتوجيه المحكومين بالسجن نحو العمل
للصالح العام، في إطار مراقبة هذه المكاتب التي تعمل في ست محافظات، في انتظار استكمال خطة لتعميمها على كل الولايات.
وتقوم المكاتب المصاحبة التي تعم ل وزارة العدل على نشرها بالتنسيق بين قاضي العقوبات والمؤسسات السجنية والمحكومين، الذين
تنطبق عليهم شروط العمل للصالح العام، تحديد أماكن العمل ونوعية المهام الموكولة للمحكومين بدل السجن، فضلا عن مراقبة مدى
التزامهم بإتمام الأعمال المسندة إليهم .
ويعمل في المكاتب المصاحبة موظفون تابعون لإدارة السجون والإصلاح، ومتخصصون في العمل الاجتماعي والنفسي والإداري.
هؤلاء يعملون تحت إشراف قاضي تنفيذ العقوبات، ويتابعون تنفيذ الإجراءات القضائية المتخذة ضد المحكوم عليهم، وإعلام السلطات
القضائية بسيرها، والسهر على احترام الالتزامات التي فرضت عليهم . ويقول ن. ب، الذي تم تعويض عقوبته السجنية بالعمل لمدة ستة أشهر في أعمال زراعية في محافظة سوسة، إنه لا يجد أية صعوبات
في القيام بمهامه بعدما اتفق مع مكتب المصاحبة على أن تكون ساعات العمل نهاية الأسبوع وبمعدل أربع ساعات يوميا )السبت
والأحد(. ويقول ل "العربي الجديد" إنّ العقوبة البديلة ساعدته في الحفاظ على عمله بقية أيام الأسبوع، كما مكنته من الحفاظ على
استقرار أسرته. يضيف أنّ العقوبات البديلة حل جيد للمحكومين في حال ارتكبوا جنحا ليست خطيرة، مشيراً إلى استفادته من خلال
الانفتاح على تجربة اجتماعية جديدة سترافقه نتائجها في مراحل حياته المقبلة. ومنذ سنوات، انخرطت تونس في برنامج استبدال
العقوبات السالبة للحرية بعقوبات العمل للصالح العام أو السوار الإلكتروني، في إطار برامج تعاون مع منظمات دولية تعمل على
مساعدة تونس على تطوير التشريعات الجزائية وتحسين ظروف المساجين . ويفترض أن ينظر برلمان تونس الجديد في قانون جزائي جديد )مجلة جزائية( تحظى فيها البدائل السجنية بأهمية كبرى في كافة
المراحل . وبحسب مشروع القانون، هناك 18 بديلاً كالإقامة الجبرية وغيرها. كما تضمن نظام السجون المفتوحة في بعض الجرائم غير
الخطرة إذا ما تعهد المحكوم عليه بجملة من الشروط، ما يسمح له بممارسة عمله ومقابلة أسرته. كما تمّ اقتراح نظام النصف حرية
الذي يمكّن قاضي تنفيذ العقوبات من أن يحجر على المحكوم عليه الاتصال بالمتضرر أو مقابلة بعض الأشخاص أو ارتياد بعض
الأماكن، ويترتب عن الإخلال بها الرجوع في تلك الوسيلة العقابية . إضافة إلى نظام السوار الإلكتروني، يسمح المشروع الجديد باستبدال العقوبة السجنية بغرامة مالية يومية. ويمكن لقاضي تنفيذ
العقوبات بعد موافقة المعني بالأمر على تعديل عقوبة السجن المحكوم بها، والتي لا تتجاوز عاما سجنيا،ً استبدالها بغرامة مالية لا
تقل عن 500 دينار )نحو 175 دولاراً(، يراعى عند تقديرها الإمكانيات المادية للمحكوم عليه، وطبيعة الجريمة المرتكبة .
ويقول الناطق الرسمي باسم الإدارة العامة للسجون سفيان مزغيش، إن ما لا يقل عن 2500 محكوم حصلوا على عقوبات بديلة
بالعمل للصالح العام، مشيراً إلى أن وزارة العدل بصدد التحضير لتوسعة شبكة المكاتب المصاحبة لتشمل ما لا يقل عن 6 محافظات
جديدة العام المقبل، ليرتفع عددها إلى 12 مكتبا.ً ويقول مزغيش ل "العربي الجديد" إن تجربة مكاتب المصاحبة لمتابعة تنفيذ
العقوبات السجنية بالعمل للصالح العام انطلقت عام 2013 في محافظة سوسة، وتمكن المكتب من مصاحبة ألفي محكومة استبدلت
عقوباتهن بالصالح العام، وتم توجيههن للعمل في جمعيات خيرية أو مؤسسات عامة أو أعمال التنظيف والطلاء وغيرها . يضيف مزغيش أن الهدف الأساسي من توسعة العمل للصالح العام هو أنسنة العقوبات، مؤكداً أن التمتع بهذا الحق يكون وفق شروط
يقدرها قاضي تنفيذ العقوبات، وهي ألا تتجاوز العقوبة السجن مدة عام، وألّا تكون خطرة على المجتمع، وأن يكون ملف السجين
خاليا من عقوبات سابقة. ويوضح أن مصادقة البرلمان على مشروع القانون الجزائي ستفتح مجالات جديدة للقضاء لاستبدال
العقوبات السالبة للحرية بعقوبات جديدة تخدم الصالح العام، وتحد من نسبة العودة إلى الجريمة، مؤكداً أن هذه العقوبات تحقق أهدافها
الإصلاحية أكثر من عقوبة السجن
Translation - English Tunisia is currently seeking the elaboration of the alternative sanctions’ concept so as to reduce prisons’ overcrowding, by providing those convicted with custodial sentences with an alternative sanction, allowing them to be reintegrated in the society. This is done by replacing imprisonment with working for the public interest. These endeavors were made in anticipation of the ratification of a new penal law by the parliament. Specialists see that this would be a paradigm shift in the country’s penal system.
The Ministry of Justice has recently announced the establishment of new probation offices to facilitate the conversion of prison sentences into public services within the framework of the supervision of these offices that are currently operating in 6 districts. In the meanwhile, a plan is being updated on establishing more operating offices in the rest of the governorates.
These probation offices define the places of works and the nature of tasks given to the convicts instead of prison, along with surveilling their commitment. They are established in coordination with the Ministry of Justice, the judge, prisons, and convicts who are eligible to benefit from the alternative sanctions.
Its officers shall be part of the General Division of Prisons and Correctional Facilities and be specialized in social works, psychiatry, and administration, under the supervision of the judge. They shall monitor the legal proceedings of the sentences, ensure that a follow-up is handed to the legal authorities and to commit to their obligations.
N.B, a convict whose sentence has been replaced by an alternative sanction of agricultural works in Sousse Governorate for six months, stated to Al-Araby Al-Jadeed that he has no issues with working as long as the work duration is 4 hours Saturdays and Sundays only. He affirms that the alternative sanction helped him preserve his work for the rest of the weekdays. It also helped him maintain his familial stability. The alternative sanction, in his point of view, is a better solution for those who have committed misdemeanors. He has benefited from this new social experience, whose impacts would be fruitful to upcoming stages in his life.
Within the framework of cooperation with other NGOs that work on improving Tunisia’s penal legislatures and prisoners’ conditions, Tunisia has taken part in the program of replacing the deprivation of liberty sanctions by social service work and ankle bracelets.
The new parliament would study the possibility of a new penal code embracing the prominence of the alternative sanctions in all its steps.
According to the draft law, there exist 18 alternative sanctions such as the restricted residence. It also includes the Open Prison System for misdemeanors, applicable to convicts who abide by a set of conditions, which allows them to exercise their profession and meet their families.
The Half Freedom System is also included in this draft, whereby the judge forbids contacting the affected, meeting certain people, or visiting certain places. Any breach shall result in the retraction of this sanction.
In addition to the electronic ankle bracelet, the new draft law would allow replacing imprisonment with a daily fine. The judge could adjust the sentence that shall not exceed one year of prison, after consent of the defendant and taking into account his financial situation and the nature of his crime. The sentence is replaced with a fine of $ 175 (500 TD) minimum.
Sofiane Mezghich, the spokesperson of the General Division of Prisons, says that at least 2500 prisoners have benefited from the social-work alternative sanction. The Ministry of Justice is working on the expansion of the probation offices to double to 12 office in 6 different governorates by the new year, he says.
Mezghich states to Al-Araby Al-Jadeed that this experience has been launched since 2013 in Sousse Governorate. The officers managed to accompany 2000 female prisoners whose sanctions were replaced with social service. Works ranged from charity to public institution tasks in addition to cleaning and painting.
Mezghich adds that the fundamental goal from this expansion is the humanization of sanctions. He affirms that in order to benefit from this right, a set of requirements shall be met: the sentence should not exceed one year of imprisonment, neither shall it be a serious crime. The convicted shall have a clear record, as well. He clarifies that the ratification of this draft law will open doors for Justice to replace the deprivation-of-liberty sanctions with newer ones that serve the common interest and reduce recidivism.
These alternative sanctions shall fulfill their correctional goals more than imprisonment.
