PRELIMINARY
1. Short title and commencement. (1) These regulations may be called the Central Electricity Regulatory Commission (Terms and Conditions of Tariff) Regulations, 2019.
(2) These regulations shall come into force on 1.4.2019, and unless reviewed earlier or extended by the Commission, shall remain in force for a period of five years from 1.4.2019 to 31.3.2024:
Provided that where a generating station or unit thereof and transmission system or an element thereof, has been declared under commercial operation before the date of commencement of these regulations and whose tariff has not been finally determined by the Commission till that date, tariff in respect of such generating station or unit thereof and transmission system or an element thereof for the period ending 31.3.2019 shall be determined in accordance with the Central Electricity Regulatory Commission (Terms and Conditions of Tariff) Regulations, 2014 as amended from time to time.
2. Scope and extent of application. (1) These regulations shall apply in all cases where tariff for a generating station or a unit thereof and a transmission system or an element thereof is required to be determined by the Commission under section 62 of the Act read with section 79 thereof:
Provided that any generating station for which agreement(s) have been executed for supply of electricity to the beneficiaries on or before 5.1.2011 and the financial closure for the said generating station has not been achieved by 31.3.2019, such projects shall not be eligible for determination of tariff under these regulations unless fresh consent of the beneficiaries is obtained and furnished.
(2) These regulations shall not apply to the following cases:-
(a) Generating stations or transmission systems whose tariff has been discovered through tariff based competitive bidding in accordance with the guidelines issued by the Central Government and adopted by the Commission under section 63 of the Act;
(b) Generating stations based on renewable sources of energy whose tariff is determined in accordance with the Central Electricity Regulatory Commission (Terms and Conditions for Tariff determination from Renewable Energy Sources) Regulations, 2017.

प्रारंभिक
1. संक्षिप्त नाम और प्रारंभ: (1) इन विनियमों का संक्षिप्त नाम केन्द्रीय विद्युत विनियामक आयोग (टैरिफ के निबंधन और शर्तें) विनियम, 2019 है।
(2) ये विनियम 1.4.2019 से प्रवृत्त होंगे और जब तक इनका आयोग द्वारा पहले पुनर्विलोकन नहीं किया जाता या विस्तारित नहीं किए जाते, ये दिनांक 1.4.2019 से 31.3.2024 तक की 5 वर्ष की अवधि के लिए प्रवृत्त होंगे:
परंतु यह कि जहां कोई उत्पादन केंद्र या उसकी यूनिट और पारेषण प्रणाली या उसके अल्पघटक, इन विनियमों के प्रारंभ की तारीख से वाणिज्यिक प्रचालन के अधीन घोषित किया जाता है और जिसका टैरिफ उस तारीख तक आयोग द्वारा अंतिम रुप से अवधारित नहीं किया गया है वहां, ऐसे उत्पादन केंद्र या उसकी यूनिट और पारेषण प्रणाली या उसके अल्पघटक के संबंध में, टैरिफ 31.3.2019 को समाप्त होने वाली अवधि के लिए समय- समय पर संशोधित केन्द्रीय विद्युत विनियामक आयोग (टैरिफ के निबंधन और शर्तें) विनियम, 2014 के अनुसार अवधारित किया जाएगा।
2. विस्तार तथा लागू होना:-(1) ये विनियम उन सभी मामलों में लागू होंगे जहां उत्पादन केन्द्र या उसके यूनिट या अंतर-राज्यिक विद्युत पारेषण के लिए प्रयुक्त संचार प्रणाली सहित पारेषण प्रणाली या उसके किसी अल्पघटक के लिए टैरिफ, अधिनियम की धारा 79 के साथ पठित धारा 62 के अधीन आयोग द्वारा अवधारित किया जाना है।
परंतु यह कि कोई उत्पादन केंद्र जिसके लिए 5.1.2011 या उससे पहले फ़ायदाग्राहियों को विद्युत् की आपूर्ति के लिए समझौते (ओं) को निष्पादित किया जा चुका है और ऐसे उत्पादन केंद्र के लिए वित्तीय समापन 31.3.2019 तक प्राप्त नहीं हुआ है, इस तरह की परियोजनाएं इन विनियमों के तहत टैरिफ के अवधारण के लिए योग्य नहीं होंगी, जब तक कि फ़ायदाग्राहियों की नई सहमति प्राप्त और प्रस्तुत नहीं की जाती है।
(2) यह विनियम निम्नलिखित मामलों में टैरिफ निर्धारण के लिए लागू नहीं होंगे:-
(क) उत्पादन केन्द्र या अंतर-राज्यिक पारेषण प्रणाली जिनका टैरिफ अधिनियम की धारा 63 के अंतर्गत केन्द्रीय सरकार द्वारा जारी दिशानिर्देशों के अनुरुप टैरिफ आधारित प्रतिस्पर्धात्मक बोली के द्वारा निर्धारित किया गया है;
(ख) नवीकरणीय ऊर्जा स्रोतों पर आधारित उत्पादन केन्द्र, जिनका टैरिफ समय-समय पर यथासंशोधित केन्द्रीय विद्युत विनियामक आयोग (नवीकरणीय ऊर्जा स्रोतों से टैरिफ के अवधारण के लिए निबंधन और शर्ते) विनियम, 2017 अथवा उसके किसी उत्तरवर्ती अधिनियमन के अनुसार निर्धारित किया गया।
