If the Contractor is of the opinion that any instruction received from the Company or any other development affecting the Works constitutes a Variation, the Contractor shall notify the Company in writing within fourteen (14) Days of: (a) receipt of such instruction; or (b) the date that it became aware or ought to have become aware of the development, as applicable, and in any event prior to commencing any Works, with a statement including the information set out in Article 5.2 (a) (i) to (iii) (“Contractor Variation Request”), and such statement shall constitute a binding offer capable of acceptance by the Company of the terms on which the Variation will be performed by the Contractor. Within fourteen (14) Days of receiving the Contractor Variation Request, the Company shall confirm in writing whether the contractor variation Request has been approved by the Company. | Translation - Arabic
يجب على المقاول، إذا ما رأى أن أي تعليمات مستلمة من الشركة أو أي تطورات أخرى تؤثر على الأعمال تُمثل تعديلاً في العقد، إخطار الشركة بذلك كتابياً في غضون أربعة عشر (14) يومًا إبتداءاً من: (أ) استلام مثل هذه التعليمات أو (ب) التاريخ الذي علم فيه أو كان عليه أن يعلم فيه بهذه التطورات، وذلك حسب مقتضى الحال وقبل البدء في أي أعمال، ويرفق به بيان يتضمن المعلومات الواردة في المادة 2.5 (أ) (i) إلى (iii) والمتمثلة في ("طلب المقاول إجراء تغيير ")، على أن يُعتبر هذا البيان عرضًا ملزمًا بإمكان الشركة قبوله حيث يتضمن شروط المقاول لإجراء هذا التغيير. وبناءاً عليه يجب على الشركة التأكيد على ما إذا كان طلب المقاول بإجراء تغيير تمت الموافقة عليه وذلك في غضون أربعة عشر (14) يومًا من استلام هذا الطلب. |

1. بيان كافة عمليات السحب والإيداع والتحويلات المصرفية الداخلية والخارجية التي تمت على حساب سالف الذكر بالبنك الخاصة بالقضية محل التحقيقات وبيان الشخص القائم بها وصفته في ذلك وقيمة الأموال الناجمة عن تلك العمليات ومعدل دوران الحساب سالف الذكر وعما إذا كان يتناسب مع دخله.
2. بيان مصدر تلك الأموال وما إذا كانت متحصلة من ثمة جريمة أو نشاط غير مشروع من عدمه وفي الحالة الأولى بيان مدى علم المتهم بذلك وكذا الشركات والمصارف والأشخاص الذين تم التعامل معهم بذلك المصدر وما إذا كان لهم ثمة نشاط يتعلق بجرائم غسل الأموال من عدمه وبيان القصد من إجراء تلك العمليات التي تمت بشأن تلك الأموال.
3. بيان كيفية التصرف في الأموال محل تلك العمليات وما آلت إليه والإجراءات المتخذة من قبل المصرف المركزي حيال ذلك الأمر واتخاذ كافة الوسائل اللازمة للمحافظة على الأدلة التي تم التوصل إليها.

1. A statement of all withdrawals, deposits and internal and external bank transfers made into the above mentioned bank account for the case under investigation. Identify the persons and his role, the value of funds resulting from such transactions, the turnover rate of that account and whether it is commensurate with his income.
2. Indicate the source of such funds and whether or not any crime or any illegal activity. In the first case, indicate the extent to which the accused is aware of this, as well as the companies, banks and persons who have been dealt with in that source, whether they have any activity related to money-laundering offenses or not, and indicate the intention to conduct such transactions.
3. Indicate the manner of commitment of funds in the place of such transactions, their consequences, proceedings undertaken by the Central Bank regarding this matter and take all necessary means to preserve the evidence obtained in this case.

La nature des opérations du présent contrat de sous-traitance se limite à celles décrites dans l'autorisation d'exploitation de la Carrière, en plus du transport, stockage et commercialisation des matériaux extraits et/ou élaborés par la société XXXXXXX, comme précisé à l’article 1 ci-dessus.
La société XXXXXXX se conformera aux prescriptions législatives, réglementaires et administratives applicables en matière d’exploitation de carrières.

على شركة ---------- الإمتثال للمتطلبات القانونية و التنظيمية و الإدارية المطبقة في مجال إستخراج المعادن و الأحجار.
ومن الجدير بالذكر , بشكل رسمي, أنه تحت أي ظرف, لا يمكن للعقد الحالي منح شركة --------- حق الملكية التجارية في إطار تنفيذ هذا الأخير.
