LEASE GENERAL TERMS AND CONDITIONS:
PREAMBLE
(A) The Landlord owns and operates the Centre (as evidenced by such documents provided by the Landlord and attached hereto as Appendix 4) which is located in the Country, and of which the Premises form part; and
(B) The Landlord represents to the Tenant that the Centre has obtained all necessary approvals and permits from relevant Authorities to have the Tenant's Business therein; and
(C) The Tenant is licensed to carry out the Tenant's Business under the Tenant's Trade Name (or such other name as the Tenant may advise from time to time) and the Tenant wishes to lease from the Landlord the Premises for the Lease Term for the purpose of carrying out the Tenant's Business therein; and
(D) The Landlord has now agreed to grant to the Tenant and the Tenant has agreed to accept lease of the Premises for the Lease Term on the terms and subject to the conditions herein contained. | Translation - Arabic
الأحكام والشروط العامّة لعقد الإيجار:
التمهيد
(أ) يمتلك المُؤجّر ويُدير المركز (حسبما يتبيّن من الوثائق التي يقدّمها المُؤجّر ويُرفقها في الملحق 4 بموجب العقد الحالي)، الذي يقع في البلد، والذي يُشكّل العقار جزءاً منه؛ و
(ب) يتعهّد المُؤجّر للمُستأجر أنَّه قد حصل المركز على جميع الموافقات والتصاريح اللازمة من السُلطات المختصّة ليكون عمل المُستأجر فيه؛ و
(ج) يُرخّص للمُستأجر تنفيذ أعمال المُستأجر تحت الاسم التجاري للمُستأجر (أو اسمٍ آخر قد يُشير إليه المُستأجر من جينٍ لآخر) ويرغب المُستأجر أن يستأجر من المُؤجّر العقار لمدّة الإيجار بهدف تنفيذ أعمال المُستأجر فيه؛ و
(د) لقد وافق المُؤجّر حالياً على منح المُستأجر العقار وقد وافق المُستأجر على استئجار العقار لمدّة الإيجار وفقاً للشروط والأحكام المنصوص عليها بموجب العقد الحالي.

نظرة عامة عن الرحلة
تعتبر تركيا احد اهم الوجهات السياحية الهامة فى برنامج السياحة العالمية لما تتمتع به من مزيج فريد من كافة أنواع السياحة التى تستقطب العديد من السياح الراغبين فى المتعة والتعلم والترفيه.
وقد روعى فى تصميم هذا البرنامج ان يحتوي على العديد من البرامج التربوية التثقيفية والتعليمية التى تضيف الى الطلبة العديد من المعارف الحديثة، كما روعى ان يشتمل على برامج تفاعلية تعليمية لينمى لدى الطلبة الالتزام والاعتماد على النفس واكتساب الثقة فى قدراتهم وتعوديهم على الاستقلالية فى اتخاذ قراراتهم فى اطار تربوى منضبط.
وتحتوى الرحلة على العديد والعديد من الرحلات الترفيهية والسياحية التاريخية وسياحة المغامرات والمتعة وتتضمن الرحلة زيارة لمنطقة سوغوت التاريخية والتى تحكى تاريخ حقبة هامة من تاريخ الحكم الاسلامى العثمانى ... وسوف نستعرض لاحقاً بعض المعلومات البسيطة عن تلك المزارات والأماكن .
مركز بورصة للعلوم والتكنولوجيا
هذا المكان مُعد خصيصاً لتدريب الأطفال عملياً من أجل إكساب الأطفال الخبرة الكافية بمجال العلوم والتكنولوجيا، ويتوافر به قرابة 270 من المعروضات، ويضم المركز لـ14 صالة للعرض وعدد من غرف السينما والعديد من المختبرات وعدد من الغرف التعليمية بالإضافة لوجود القبة السماوية.
حديقة مينى تورك
ميني تورك هي حديقة مصغرة تقع علي الشاطئ الشمالي الشرقي من القرن الذهبي في اسطنبول أفتتحت عام 2003, وتقع علي مساحة 60,000م2 وتعتبر واحدة من اكبر الحدائق المصغرة في العالم، وتحتوي علي مساحات شاسعة من البرك والممرات المائية و500 موقف سيارات وتحتوي الحديقة علي حوالي 105 نموذج مصغر لمعالم في اسطنبول و 45 لمنطقة الاناضول و 15 اخري للاراضي العثمانية التي حاليا تقع خارج تركيا وذلك بالأضافة إلى مطعم ومنطقة ترفيهية ومحل بيع التحف وتستغرق الجولة 2-3 ساعات. | Translation - English
An overview of the trip
Turkey is one of the most significant destinations in the World Tourism Organization program as it has all kinds of tourism that attract many tourists who want to enjoy, learn and entertain.
The program includes many education courses that help student to get a lot of the latest knowledge. In addition, it includes interactive educational courses so that students can develop their liability, self-reliance and confidence in their capabilities and to make independent decisions under educational framework.
The journey includes many leisure, historical, adventure trips. Furthermore, it includes a visit to Söğüt that depicts he history of an important period of Ottoman Islamic Rule… We will then review some information about these sites.
Bursa Science and Technology Center
This place is specially designed to train children so that they get sufficient expertise in the field of science and technology. The center has about 270 exhibits, 14 galleries, a number of cinemas, several laboratories, a number of classrooms and a planetarium.
Miniturk Park
Miniturk is a miniature park located on the north-eastern coast of the Golden Horn in Istanbul. It was opened in 2003, and is located on an area of 60,000 m2, and it considered to be one of the largest miniature gardens in the world. Miniturk has vast areas of pools, waterways and 500 parking lots, and includes about 105 miniature monuments of Istanbul, 45 of Anatolia and 15 of the Ottoman lands which are currently outside Turkey. In addition, it includes a restaurant, a recreational area and an antique shop. The tour takes from 2 to 3 hours. |

وحيث أن المدَّعى عليه الأول قد استعمل حقه في التقاضي وكان الاستعمال مشروعاً فلا يضمن ما ينشأ عن ذلك من ضرر.
ومن ثمَّ أمكن القول بأن دعوى المدَّعية بشأن التعويض منعدمة الأساس جملةً وتفصيلاً.
وفيما يتصل بالمصروفات التي تكبَّدتها المدَّعية في الدفاع عن نفسها في تلك الدعوى والتي رفعها المدَّعى عليه الأول، فذلك شأنها هي ولا علاقة للمدَّعى عليه الأول بهذا الأمر لا من قريب أو بعيد، إذ أن لكل شخص أن يدافع عن نفسه بالطريقة التي يراها وأن يستعين بالمحامين والمترجمين إن شاء وأن يستدعي ما يرى من شهود إذا لزم أمره.
فالمدَّعى عليه الأول لم يطلب إليها أو يجبرها على تعيين محاميين أو ترجمة مستندات أو دفع مصروفات لإحضار شهودها، إلى غير ذلك مما أوردته وفصَّلته من مصروفات تكبَّدتها بسبب الدعوى.
ويكفيها ما قُضي لها به من مصروفات وأتعاب حدَّدتها المحكمة في تلك الدعوى ووفقاً لأحكام القانون. | Translation - English
Whereas the first Defendant using of its right of litigation in a lawful manner shall not guarantee the resulting damage.
Therefore, it is possible to say the Plaintiff’s statement of claim regarding compensation has no basis at all.
Regarding the expenses incurred by the Plaintiff in defending herself regarding the case filed by the first Defendant, the first Defendant shall not be accountable for that at all, as any person shall have the right to defend itself in the manner it chooses, to assign lawyers and translators if it so wishes and to call for witnesses, if necessary.
The first Defendant did not request or force her to assign lawyers, translate documents or pay expenses to bring witnesses as well as other expenses incurred by her due to the case.
The expenses and fees determined by the Court regarding that case and in accordance with the provisions of the Law shall be sufficient. |
