Source text - English Things are looking up for animals. Let’s face it, for years they have been treated as though they were, well, sub-human; but nowadays they can even get their own passports. Pets who fancy a weekend in Paris no longer have to spend six months in quarantine when they get back.
A dog securing a passport may not sound like a big advance, but imagine how it makes Mohamed al-Fayed feel. And last week it was suggested that animals will get their own Bill of Rights. Now, a “Bill of Rights for Budgies” is easy to ridicule –what next, parrots granted the right to silence?- but there is much to be said for extending the protection of the Human Rights Act to our furry and feathered friends.
Turning the European Convention on Human Rights into the European Convention on Animal Rights may at first seem contentious but it could at a stroke deal with some tricky problems. The Government has so far been unable to ban fox-hunting in England and Wales, however many times parliament has voted on it. But article two of the European convention enshrines a right to life. Any decent lawyer acting on behalf of a quick brown fox should be able to get an injunction against a master of fox hounds. Fox-hunting banned by the judges without the Government having to fall at a political fence, or even get off it.
Battery chickens, locked up all their lives in sheds to produce eggs for our breakfast, could rely on article five, which deals with liberty, or even article four which outlaws slavery. Article 12 protects the right to marry, which might not interest all animals but should call into question the practice of castrating, neutering, gelding and other indignities heaped on the animal kingdom.
Most animal breeding practices look like forced marriages which judges have shown an increasing tendency, with or without the Human Rights Act, to declare null and void. And I am not sure there would not be a perfectly good group action brought by weird-looking dog breeds. Imagine what it must be like to have turned in a few generations under human control from a fine grey wolf, the size of a large Alsatian, into a squashed-faced Pekinese lapdog.
More widely in Europe, Spanish bulls might be able to rely on article three of the convention, which prohibits torture. It never looks as though they get a fair trial (article six) in the bullring before they are executed (contrary to protocol four) simply for being bulls (discrimination is forbidden by article 14).
Once the legal rights of animals are established we can look forward to the beagles, who always seem to be used to test tobacco products, being able to sue the tobacco companies for damage to their health. (What is it with beagles? What makes them Dot Cottons of the do world?)
In line with the recent practice of nations apologizing to other nations for acts of destruction and cruelty in previous centuries, the human race might consider offering an apology to the dodo, the passenger pigeon and other species deliberately or by gross negligence forced into extinction by human activity. Obviously, there are no descendants of these unfortunate animals to apologise to, but we could work out a suitable form of words to be used in a speech to their closest living relatives. And if they are as clever as everyone says they are, whales will be able to use the new international criminal court to prosecute Japanese and Norwegian fishermen for genocide and harpooning with intent to cause grievous bodily harm in international waters.
Of course, there are limits. A new breed of half-rat, half-robot is being developed to venture into dangerous situations on our behalf. Of that leads to injury, obviously only the rat half would be able to sue. Giving a machine these sort of rights would be silly.

Ας το παραδεχτούμε, για χρόνια αντιμετωπίζονταν σαν να ήταν, σαφώς, υποδεέστερα του ανθρώπου· αλλά σήμερα μπορούν ακόμα και να έχουν δικό τους διαβατήριο. Κατοικίδια που επιθυμούν να περάσουν ένα σαββατοκύριακο στο Παρίσι, πλέον δεν χρειάζεται να περάσουν έξη μήνες σε καραντίνα όταν γυρίσουν.
Ένας σκύλος που έχει την ασφάλεια ενός διαβατηρίου ίσως να μην ακούγεται σαν μεγάλη πρόοδος, αλλά φανταστείτε πως αισθάνεται γι αυτό ο Μοχάμεντ Αλ Φαγέντ, στον οποίο η Βρετανική Κυβέρνηση αρνείται να εκδώσει διαβατήριο. Και την περασμένη εβδομάδα προτάθηκε να έχουν και τα ζώα τον δικό τους Χάρτη Δικαιωμάτων. Είναι εύκολο να χλευάσει ένας Χάρτης Δικαιωμάτων, τι άλλο, τα δικαιώματα των παπαγάλων στη σιωπή; - αλλά υπάρχουν πολλά που πρέπει να ειπωθούν για την επέκταση του νόμου περί προστασίας ανθρωπίνων δικαιωμάτων στους χνουδωτούς και φτερωτούς μας φίλους.
Η μετατροπή της Ευρωπαϊκής Σύμβασης για τα Ανθρώπινα Δικαιώματα σε Ευρωπαϊκή Σύμβαση για τα δικαιώματα των ζώων μπορεί αρχικά να φαίνεται αμφισβητήσιμη, αλλά θα μπορούσε με μια κίνηση να αντιμετωπίσει ορισμένα πολύπλοκα προβλήματα. Μέχρι στιγμής, η Βρετανική κυβέρνηση δεν μπόρεσε να απαγορεύσει το κυνήγι αλεπούς στην Αγγλία και στην Ουαλία, όσες φορές κι αν το ψήφισε το κοινοβούλιο. Κοτόπουλα στοιβαγμένα σε κλωβούς, κλειδωμένα όλη τους τη ζωή σε υπόστεγα για να παράγουν αυγά για το πρωινό μας, θα μπορούσαν να βασιστούν στο άρθρο πέντε, το οποίο ασχολείται με/χειρίζεται/αντιμετωπίζει την ελευθερία, ή ακόμα και με το άρθρο τέσσερα που απαγορεύει την δουλεία. Το άρθρο 12 προστατεύει το δικαίωμα στο γάμο, που ίσως δεν ενδιαφέρει όλα τα ζώα, αλλά θα πρέπει να θέσει υπό αμφισβήτηση την τακτική του ευνουχισμού, της στείρωσης, της εκτομίας (στείρωσης υποειδών) και άλλες προσβολές που κατακλύζουν το ζωικό βασίλειο.
Οι περισσότερες πρακτικές αναπαραγωγής ζώων μοιάζουν με καταναγκαστικούς γάμους τους οποίους οι δικαστές έχουν δείξει μια αυξανόμενη τάση να κηρύσσουν άκυρους, με ή χωρίς τον χάρτη ανθρωπίνων δικαιωμάτων. Και δεν είμαι βέβαιος ότι δεν θα υπάρξει μια απόλυτα δικαιολογημένη ομαδική δράση υποκινούμενη από ράτσες σκυλιών με περίεργη εμφάνιση. Φανταστείτε πως θα είναι να έχετε μετατραπεί, μέσα σε λίγες γενιές υπό τον έλεγχο των ανθρώπων, από έναν επιβλητικό γκρίζο λύκο, στο μέγεθος ενός τεράστιου Γερμανικού Ποιμενικού, σε ένα Πεκινουά σκυλάκι σαλονιού με πλακουτσωτή μουσούδα.
Σε άλλες χώρες της Ευρώπης, οι ταύροι της Ισπανίας θα μπορούσαν να βασιστούν στο άρθρο τρία της σύμβασης, το οποίο απαγορεύει τα βασανιστήρια. Και αυτό γιατί δεν φαίνεται να έχουν μια δίκαιη δίκη (άρθρο έξι) στην αρένα ταυρομαχίας πριν εκτελεστούν (αντίθετα με το πρωτόκολλο 4) απλά επειδή είναι ταύροι (η διάκριση απαγορεύεται σύμφωνα με το άρθρο 14).
Μόλις κατοχυρωθούν τα νόμιμα δικαιώματα των ζώων, μπορούμε να προσμένουμε στα Μπίγκλ, που φαίνεται να χρησιμοποιούνται πάντα για τη δοκιμή προϊόντων καπνού, να μπορούν να κάνουν μήνυση στις καπνοβιομηχανίες για βλάβη στην υγεία τους (Τι είναι με τα Μπίγκλ; Τι τα κάνει να είναι τα φουγάρα του κόσμου των σκύλων;)
Ακολουθώντας την πρόσφατη πρακτική των εθνών που ζητούν συγγνώμη σε άλλα έθνη για ολέθριες και σκληρές πράξεις των περασμένων αιώνων, το ανθρώπινο είδος ίσως θα πρέπει να σκεφτεί να ζητήσει συγνώμη από το Ντόντο, το μεταναστευτικό περιστέρι και άλλα είδη, που χάρης την ανθρώπινη δραστηριότητα οδηγήθηκαν στον αφανισμό είτε σκόπιμα είτε από πλήρη αδιαφορία. Προφανώς, δεν υπάρχουν απόγονοι αυτών των άτυχων ζώων για να ζητήσουμε συγγνώμη, αλλά θα μπορούσαμε να βρούμε τα κατάλληλα λόγια που θα μπορούσαμε να χρησιμοποιήσουμε σε ένα λογίδιο προς τους πλησιέστερους εν ζωή συγγενείς τους. Και αν οι φάλαινες είναι τόσο έξυπνες όσο λένε, θα πρέπει να μπορούν να χρησιμοποιήσουν το νέο διεθνές ποινικό δικαστήριο για τη δίωξη των Ιαπώνων και Νορβηγών ψαράδων για γενοκτονία και αφανισμό λόγο της αλιείας με καμάκι με σκοπό να προκαλέσουν βαριά σωματική βλάβη σε διεθνή ύδατα.
Φυσικά, υπάρχουν όρια. Μια νέα ράτσα ζώου το οποίο είναι μισό-αρουραίος, μισό-ρομπότ αναπτύσσεται για να αντιμετωπίσει επικίνδυνες καταστάσεις για λογαριασμό μας.
